Jonas, Community Development Director BY: Glen Matteson, Associate Planner SUBJECT: Early grading permit authorization - request to stockpile soil on the southern edge of the Village Mobile Home Park site, at Bridge Street west of Beebee Street. CAO RECOMMENDATION: Adopt a resolution authorizing stockpiling based on findings and subject to conditions. BACKGROUND Situation The applicant anticipates needing fill material for this site if the proposed Village Park condominium project is approved (application under review by Planning Commission) , and requests council authorization to stockpile soil. The applicant has already stockpiled soil on part of the site, without approval by the City Council as required by the grading regulations (S.L.O.M.C. 17.78.060) . The Community Development Department has issued a "stop work" order, but has suspended code enforcement action pending council review of the stockpiling request. Data Summary Address: 145 South Street (stockpile is on north side of Bridge Street west of Beebee Street) Applicant: Village Park Associates (William Dermody) Representatives: Engineering Development Associates Studio Design Group Zoning: Manufacturing (Medium-density residential requested) General Plan: Service-commercial/light-industrial Environmental Status: Categorically exempt under Class 4, Minor Alterations to Land, Section 15304. of CEQA Guidelines Evaluation The existing stockpile contains about 500 cubic yards. It is about 30 feet wide, 120 feet long, and three to five feet tall. No additional stockpiling .is_proposed at this time. The soil, which contains pieces of pavement, pipe, and other debris, came from a construction site on McMillan Avenue. The debris will have to be screened out before the soil can be used for fill. Typical concerns in stockpiling are: the effects of haulage; wind borne dust; storm water carrying sediment into streets, storm drains and creeks; damage to existing vegetation; S � � 411811 ��y��� iI,�C4"�iI' II City of San Luis OBI SPO A00sZo COUNCIL AGENDA REPORT appearance; displacement of flood water or obstruction of flood flow; encroachment onto public property or private property not controlled by the stockpiler; interference with easements and utilities; removal if not used within a reasonable time. Some recent stockpiling has also involved issues of toxic contamination. Staff believes these issues can be adequately addressed with the proposed plan, but only with the recommended modifications and conditions. If the conditions are not met within ten days of council action, the stockpile should be removed; staff will proceed with enforcement action if it remains in violation of city code or council action. The stockpile appears to be free of chemical contamination. A staff-recommended condition of the pending planned-development rezoning would require an investigation and clean-up of any soil/groundwater contamination for the whole site, to the approval of the Fire Department, before building permits are issued; the concern is prompted by previous industrial use of the area, including the neighboring site which housed the Pacific Coast Railway shops. OTHER DEPARTMENT COMMENTS The Public Works Department preferred that the stockpile be removed prior to any city reviews or approvals. ALTERNATIVES 1. The council may adopt the resolution denying the request and requiring that the stockpile be removed immediately to an approved location. 2. The Council may continue review with direction to the applicant and staff. RECOMMENDATION Adopt the attached resolution to authorize issuance of the requested stockpiling permit, based on the findings and subject to the conditions contained in the attached resolution. (1990 SERIES) A RESOLUTION OF THE SAN LUIS OBISPO CITY COUNCIL AUTHORIZING STOCKPILING FOR VILLAGE PARK, 145 SOUTH STREET The City Council resolves as- follows: SECTION 1. Findings.. 1. The request, as conditioned, conforms with the city's grading regulations. 2. The request is categorically exempt from environmental review as a minor alteration to land (Section 15304 of the State CEQA Guidelines) ; the city has considered the exceptions to categorical exemptions, based on unusual circumstances, and has determined that conditions of approval will prevent any potentially significant adverse effects (Section 15300. [2] ) . SECTION 2. Conditional approval. The stockpiling request is approved subject to the following conditions: 1. Stockpile shall not encroach into the public right-of-way. C2. Encroachment into the high-pressure gas line right-of-way shall be subject to written approval by Southern California Gas Company. 3. Storm water drainage around or through the stockpile shall be provided to the approval of the city engineer. 4. The stockpile shall be covered with a tarp to prevent erosion by wind or water, to the approval of the Community Development Department. 5. Vertical clearance between the stockpile and overhead wires shall be maintained, as required by California Public Utilities Commission standards, and subject to written approval by Pacific Gas and Electric Company. 6. Stockpile shall be removed to a location approved by the Community Development Department within one year (no later than November 20, 1991) . 7. Applicant shall provide security of at least $1,800.00, in a manner approved by the Community Development Department, to guarantee site restoration. S. This authorization does not relieve the applicant of complying with any provision of the city's grading regulations. (1990 SERIES) A RESOLUTION OF THE SAN LUIS OBISPO CITY COUNCIL DENYING A REQUEST TO STOCKPILE FOR VILLAGE PARK, 145 SOUTH STREET The City Council resolves as follows: SECTION 1. Findings. 1. The stockpile would harm the public health, safety, or general welfare. 2. The request does not conform with the city's grading regulations. SECTION 2. Denial. The stockpiling request is denied. The applicant shall remove the stockpile to a location approved by the Community Development Department and restore the site by November 30, 1990 .
