DISCUSSIO N On January 22, 2013, Council Member Andrew Carter announced his intention to resign hi s position as Council Member effective at end of business February 20, 2013 . As a result,a Council Member vacancy will exist on February 20, 2013 . City Authority •The City's Charter and Council Policies and Procedures govern the process for filling Cit y Council vacancies . Charter Section 406 states (Attachment 1): .. the Council by a majority vote of its remaining members shall appoint a qualified person t o fill the vacancy until the person elected to serve the remainder of the unexpired term or new ter m takes office ." "If the Council fails to fill the vacancy within thirty (30) days following its occurrence, it shal l call a special municipal election to fill the vacancy, to be held not sooner than ninety (90) days o r not later than one hundred and fifty (150) days following the occurrence of the vacancy ." Section 3 .3 of Council Policies and Procedures establishes a specific process for conducting a n appointment to the City Council, as follows (Attachment 2): 1.At least ten days before Council meets the first time to select a replacement member for a vacancy, the City shall advertise the vacancy in a local newspaper . 2.The minimum qualifications for appointment are residency in the City at least 30 day s prior to appointment and elector status at the time of appointment . 3.Each applicant shall submit a written statement of 500 words or less affirming the amoun t of time available each week to devote to the Council ; reasons for wanting to b e appointed ; involvement in community affairs and organizations, especially in th e preceding 23-month period ; personal qualifications for the position ; and prior experienc e in government, or areas associated with or doing business with government . 4.Meetings to consider the selection of an applicant shall be open to the public . B1-1 Council Agenda Report—Appointment to Fill Council Vacanc y Page 2 5.Applications shall be given to the Council and be available to the public at least four day s before the opening of the meeting . 6.Members of the public may submit written comments regarding an application up to 2 4 hours before the meeting begins . 7.At the meeting, each applicant is to be given five minutes to make a presentation t o Council and will be asked to verify their willingness to serve . 8.Thereafter, all discussion shall be confined to the Council except for questions directe d by the Council to staff or to members of the public . 9.Upon conclusion of the discussion, the Mayor shall open the floor to nominations by th e remaining Council Members . All nominations, seconding, and voting, shall be don e audibly in public . Details not specifically enumerated in the City Charter or Council Policies and Procedures that the Council may wish to consider : A.The format of an application is not set forth; therefore staff suggests using th e Application for Appointment (Attachment 3), which will provide a basic structure t o be followed by the applicants . B.The application requests that the applicant attach a resume, as was requested in th e 2010 process . C.The City Clerk will review the applications for completeness and eligibility an d prepare copies for each Council Member . There is no direction regarding a type o f coversheet desired by Council to be used in their review and deliberations of th e applications . The City Clerk offers the possibility of a spreadsheet with the names o f applicants running down the left side of the page and empty boxes to be used b y Council Members to write their own notes . D.While it is set forth that members of the public may submit written comments at an y time until 24 hours before the meeting, public comment on the appointment should b e accepted at any time prior to Council making nominations and taking action, i n accordance with the Brown Act . E.Council may prescribe a set amount of time for public comment at the meeting i f there is a large applicant pool and Council wishes to manage the meeting time . F.The Council Policies and Procedures do not specify the manner in which Council is to narrow the applicant pool to arrive at consensus, but staffs review of the records o f past appointments did disclose a procedure that seemed to have been efficient an d effective . In the 2010 process, the Council followed a straw vote process as set ou t below . G.Should the Council successfully nominate and appoint an applicant, the City Cler k could immediately administer the Oath of Office to the newly appointed Counci l Member . This calendar was created to afford potential applicants time to do their due diligence as well a s maximize time the City Council has to consider the applications received . This timeline can be modifie d to shorten some of the timeframes such that the appointment could be made sooner and is at th e discretion of the City Council . Staff will be prepared to assist with mapping out alternative timeline s should the council wish to consider other options . Tuesday, February 5, 2013 6 :00 p .m .Council to adopt a process for making an appointment to fil l the unexpired term. Saturday, February 9, 201 3 Saturday, February 16, 2013 Publish Notice of Vacancy in Newspaper; post o n SLOCITY.ORG and on Kiosk at City Hall . Invite eligible persons to complete and submit an application for appointment . Monday, February 11, 2013 8 :00 a .m . through Tuesday, February 26, 2013 5 :00 p .m . Receive applications for appointment in the City Clerk's Office. Friday, March 1, 2013 5 :00 p .m .City Clerk will verify residency and voter registratio n requirements of applicants and distribute copies of validate d applications to Council Members . Friday,March 1, 201 3 through Tuesday, March 12, 2013 Each council member will individually read and evaluate th e applications and resumes . If a Council Member has a question for one or more candidates, the question(s) should b e addressed to the individual applicant with an understanding that each council member will make a report at the public hearing about the conversations with the applicants . Tuesday, March 5, 2013 Publish City Council Agenda for March 12, 2013 Specia l Meeting and post applications of validated applicants . Applications will be available for review in the Office of th e City Clerk. Monday, March 11,2013 5 :00 p.m.Written public comments regarding applications to be accepted in the City Clerk's Office until 5 :00 p .m. Tuesday, March 12, 2013 6 :00 p.m .Hold a Special Meeting of the City Council to consider th e applications . Tuesday, March 12, 2013 If a candidate is appointed — the City Clerk will administer th e Oath of Office to the new Council Member . Potential additional meeting date s Tuesday,March 19, 2013 or Thursday,March 21, 2013 . If no candidate is appointed March 12, 2013, an additiona l Special Meeting of the Council could be held before Friday , March 22, 2013 • B1-3 Council Agenda Report—Appointment to Fill Council Vacanc y Page 4 Proposed process for the Special Meeting March 12, 2013 .The following steps are suggested i n conducting the Special Meeting on March 12, 2013 . These steps are based upon procedure s followed during the 2010 appointment process . 1 . Hold a Special Meeting of the City Council to consider the applications for the vacanc y of Council Member. No other business will be conducted at this meeting . 2 . Council Members will be asked to disclose any ex parte communications with individua l applicants including a general explanation of the substance of any communications . 3 . Each candidate will make an oral presentation of no more than five minutes . There wil l be no questions from Council Members of applicants, since there will have been ampl e time for council members to have asked in the time between the application deadline an d the meeting . 4 . Hear public comments at the meeting in accordance with the Brown Act. 5 . After public testimony, the matter will be brought back to City Council for deliberation . 6 . In a straw vote, each Council Member will announce, and the City Clerk will record, a lis t of up to three applicants that they can support, in alphabetical order . a.If 3 or more Council Members name the same applicant and only one applican t receives 3 straw votes, the Mayor will call for a motion to appoint that person . b.If more than one applicant receives 3 or more votes, these applicants should b e further discussed until an appointment is made (either via more straw votes of a favored applicant from each Council Member or consensus from deliberations). c.If no candidate gets 3 or more votes, the Council can expand the list by engagin g in additional rounds of listing applicants . Any applicants identified in the firs t round would continue to be considered if there are two or more straw votes in his or her favor. d.At any time during the straw vote process a Council Member could change his o r her mind regarding an acceptable applicant and express support for any applicant . e.A Council Member can propose a motion in favor of any applicant at any time . 7 . If a candidate is appointed, the City Clerk shall administer the Oath of Office to the ne w Council Member who would be seated immediately . If no candidate is appointed by Friday, March 22, 2013,a Special Election would be triggered . A special election will need to be held between 90 and 15 0 days of the vacancy (February 20, 2012). (May 21, 2013 — July 20, 2013 .) An election must be called 88 days before the date of th e election, therefore, the earliest the election could called i f triggered by the Friday March 22, 2013 date, would b e Tuesday, June 18, 2013 and as late as Tuesday, July 16, 2013 . FISCAL IMPAC T If the Council makes an appointment to fill this vacancy, there will be minimal fiscal impacts .A special election, however, will result in an expense to the City as follows : 1.Estimate from election contractor Martin & Chapman to conduct a Vote by Mail Specia l City election is $65,156 ($58,000 for Martin & Chapman services, plus $7,100 .00 for postage . An additional charge for the County to provide voter files is estimated a t $56 .00 . If additional services are required, the County would charge us at $82 .39 per hour .) 2.The County Registrar of Voters Office may not be in a position to conduct an election du e to a conflict they may have with another possible election . They provided the following estimate if they were able to conduct a special election : $129,560 Polling Place Electio n $96,305 Vote by Mail Election ($10,400 additional if the city wants to pay th e postage on the returned vote by mail ballots ) The estimates above do not include City staff time or additional assistance in the City Clerk's office. In addition to contracting with Martin & Chapman during the April 2005 Specia l Election, the City contracted with a retired City Clerk to assist with the internal operations of th e election . That was an additional cost of $21,000 . Vacancies . An elective office becomes vacant when the incumbent thereof dies, resigns, is removed fro m office under recall proceedings, is adjudged insane, convicted of a felony, or of an offens e involving a violation of the Mayor or Council Member's official duties, or ceases to be a residen t of the City, or has been absent from the State without leave granted by the City Council for more than sixty (60) consecutive days, or fails to attend the meetings of the Council for a like perio d without being excused there from by said body . A vacancy in the Council shall be filled for the remainder of the unexpired term, if any, at th e next regular municipal election following not less than seventy-two (72) days upon th e occurrence of the vacancy, but the Council by a majority vote of its remaining members shall appoint a qualified person to fill the vacancy until the person elected to serve the remainder o f the unexpired term or new term takes office . If the term still has two (2) years until expiration a t the time of the next regular municipal election, the election to that seat shall be separated fro m the election for the other Council candidates . If the Council fails to fill the vacancy within thirt y (30) days following its occurrence, it shall call a special municipal election to fill the vacancy, t o be held not sooner than ninety (90) days or not later than one hundred and fifty (150) day s following the occurrence of the vacancy . The election shall be governed by the provisions o f Article III . A person elected to fill a Council vacancy for an unexpired teen shall take office on the firs t Tuesday following his election . I heard extensive testimony urging that you appoint the contestant who had won the next highes t number of votes . I repeatedly heard that this was the "right" and democratic thing to do from Mr . Carpenter and hi s supporters in the community . Although Mr . Carpenter now calls that an "anomaly" I am hopeful you will recall and ac t upon those urgings from Mr . I am also very concerned about the lack of truly competent candidates to replace Andrew . By competent, I mea n someone who has knowledge of City government, experience in related fields, and who has demonstrated seriou s interest in the City by attending City Council meetings . Among all the candidates, only Kevin Rice has regularly attende d these meetings . Paul Brown and Andrea Miller have links to alcohol outlets, which are destroying our downtown, an d Jeff Arranguena and Amy Kardel have no experience whatsoever . The amazing part about Jeff Arranguena is that he ra n for City Council, but has not attended any of the Council meetings ever since . In view of his lack of knowledge on these Oters,it is worrisome that he is not more curious . While council seats are non partisan, the homepage of the San Luis Obispo County Democrati c Party's website urges its members to email you (city council) to urge the appointment of Jeff Aranguen a to fill the vacant seat . And turnout is encouraged to address council Tuesday evening in support of Jeff . Such partisan politicizing of this issue is regrettable and I hope you do not succumb to such pressure , regardless of how many letters you receive or public speakers you may hear from in support of Jeff . I do not know Jeff personally and like most city residents have only read positive comments of hi s teaching ability as a high school government teacher . This does not make Jeff qualified for council no r does it make him the logical choice as a city council appointee . Mayor and Council , I am troubled by remarks from Dan Carpenter yesterday (1/28113) on Dave Congalton's show . Dan Carpenter stated that the city historically has not had any kind of "precedent" when appointing an applican t to a vacant seat . Many remember 2010 extremely well . I am writing in favor of the city moving forward with the appointment process, and not an election . Kathy Smith, Jan Marx, and John Ashbaugh, and Andrew Carter, I highly recommend that you take a close loo k at your remarks from two years ago, when Dan Carpenter and Patti Andreen stated their case for thei r appointment . I remember, as do many, because I was in the room . All of you made it clear that you favored an appointment from a candidate who participated in the previou s election . And in the end, appointed Dan Carpenter . I highly recommend reviewing your remarks from the December 1 St 2010, and December 21 st 2010 meetings . i Dan Carpenter, as a supporter of yours in the previous two elections, I want to remind you of your comments, a s well as your supporters comments, in both those meetings dining public comment . Dan, your supporters and you, stated clearly and you argued persuasively in those public comments, that : 1)the appointed candidate should have been someone who campaigned in the previous electio n 2)the council should honor the voice and votes of the people, and consider the 5000 votes you received in th e election. I highly recommend reviewing your remarks from the December 1 S` 2010, and December 2 1 "2010 meetings, i n order to avoid conflict . I support Dan, and hope to see him run in two years for mayor . I would hate to see the city spend $100,000 o n an election, and blame the council for practicing "what's good for the goose is good for the gander," politics , and cost the tax payers. Dan and other council members, I hope you review your remarks from these meetings in order to avoid conflict , as I am sure the people who campaigned in 2012, will most likely apply for the position . That should not be considered close enough to be a mandate by the voters . As a long-time SLO resident, I would hope that you will consider a number of factors i n appointing a replacement such as the candidate's experience and knowledge of Cit y history in regards to policies, procedures, and goals, their active participation in the Cit y such as sitting on a City Board, Commission, or Advisory Body, frequent attendance o f City Council Meetings, good interpersonal and leadership skills, and a reputation o f integrity beyond reproach .
