HomeMy WebLinkAbout04-21-2005 Minutesr Council Minutes City Hall, 990 Palm Street, San Luis Obispo Tuesday, April 21, 2015 Regular Meeting of the City Council CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on Tuesday, April 21, 2015 at 6:00 p.m. in the Council Chambers, located at 990 Palm Street, San Luis Obispo, California, by Mayor Marx. ROLL CALL Council Members Present: Council Members Dan Carpenter, Carlyn Christianson, Dan Rivoire, Vice Mayor John Ashbaugh, and Mayor Jan Marx. Council Members Absent: None City Staff Present: Katie Lichtig, City Manager, Christine Dietrick, City Attorney, Michael Codron, Assistant City Manager, and Anthony Mejia, City Clerk, were present at Roll Call. Other staff members presented reports or responded to questions as indicated in the minutes. PLEDGE OF ALLEGIANCE Council Member Rivoire led the Pledge of Allegiance. PRESENTATION P1. PROCLAMATION — HOLOCAUST DAY OF REMEMBRANCE Mayor Marx presented a Proclamation to Bob Spector, Board President of the Jewish Community Center - Federation of San Luis Obispo, declaring April 16, 2015 as "Day of Remembrance" in honor of the victims of the Holocaust, the survivors, the rescuers, and the liberators. P2. PROCLAMATION —ARBOR DAY Mayor Marx presented a Proclamation to Ron Combs, Urban Forest Supervisor /City Arborist, declaring April 25, 2015 as "Arbor Day." PROCLAMATION —EARTH DAY Mayor Marx presented a Proclamation to Sandra Marshall, of Information Press, declaring April 22, 2015 as "Earth Day." INTRODUCTION OF NEW HIRES Community Development Director Johnson introduced newly -hired Code Enforcement Officer James Stephens. PUBLIC COMMENT Donald Hedrick, San Luis Obispo, voiced concern that the government has not kept the public informed of environmental issues, such as the Fukushima disaster and chemtrails; encouraged Council to take a leadership role in environmental stewardship. David Brodie, San Luis Obispo, advised that a tourist expressed concern to him regarding chances to the historical character in the downtown, removal of trees, and number of alcohol outlets throughout San Luis Obispo; urged Council to have a vision of preserving the historic resources of the City. Mila Vujovich- LaBarre, San Luis Obispo, voiced concern whether there is sufficient water to allow for proposed development projects in the City; opined that the City's response to a letter from Caltrans regarding the Land Use and Circulation Elements (LUCE) is flawed and that Council should agendize reconsideration of the LUCE for a future meeting. Steve Barasch, San Luis Obispo, spoke on his past suggestion regarding a satellite police station on Cal Poly campus; opined that there should be a greater police presence in the neighborhoods around Cal Poly as well as on campus. CONSENT AGENDA Donald Hedrick, San Luis Obispo, voiced concern regarding the cost of purchasing a light weight robot (Item C6); questioned whether special equipment will be needed to transport the robot and whether more robots will be purchased in the future. Stewart Jenkins, San Luis Obispo, spoke on Items C3 and C8, suggesting that the City should have project labor agreements which require contractors to hire local skilled labors; spoke on the potential benefits to the local economy when labor agreements are utilized. Leslie Halls, Executive Director of San Luis Obispo County Builders Exchanges, San Luis Obispo, voiced opposition to the use project labor agreements for public projects, noting that they substantially increases project costs. In response to public comment, City Attorney Dietrick advised that Items C3 and C8 do not propose to use project labor agreements, nor has Council given direction to implement use of such agreements. C1. WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5 -0, to waive reading of all resolutions and ordinances as appropriate. C2. MINUTES OF THE CITY COUNCIL MEETING OF MARCH 31, 2015 MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5 -0, to approve the Minutes of the City Council meeting of March 31, 2015, as amended. C3. HIGH STREET STORM DRAIN REPLACEMENT. SPECIFICATION NO. 91307 MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5 -0, to: 1. Approve plans and specifications for the "High Street Storm Drain Replacement, Specification No. 91307." 2. Authorize staff to advertise for bids, and authorize the City Manager to award the contract if the lowest responsible bid is within the Engineer's Estimate of $111,300. C4. CITIZENS' REVENUE ENHANCEMENT OVERSIGHT COMMISSION BYLAWS AND COMPENSATION — ORDINANCE INTRODUCTION MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5 -0, to: 1. Adopt the Citizens' Revenue Enhancement Oversight Commission (REOC) bylaws. 2. Introduce Ordinance No. 1615 (2015 Series) entitled "An Ordinance of the City Council of the City of San Luis Obispo, California, amending Municipal Code Chapter 2.14.030 to remove compensation of Citizens' Revenue Enhancement Oversight Commission (REOC)." C5. AGREEMENT WITH SONOMA STATE UNIVERSITY'S ANTHROPOLOGICAL STUDIES CENTER FOR WORK ON PALM STREET CHINATOWN ARTIFACTS MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5 -0, to authorize the City Manager to execute an agreement with Sonoma State University's Anthropological Studies Center for $55,000 to continue work on Palm Street Chinatown Artifacts with funding previously approved by the City Council during the 2014 -15 Mid -Year Budget Review. REQUEST FOR PROPOSAL FOR THE PURCHASE OF A LIGHTWEIGHT ROBOT FOR SWAT USE, SPECIFICATION NO. 91353 MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5 -0, to: Authorize staff to advertise a Request for Proposal to purchase a "Lightweight Robot for SWAT Use, Specification No. 91353," using Homeland Security Grant Funds. 2. Approve an amendment to the Law Enforcement Grant Fund to reflect reimbursement revenue in the amount of $64,000, and the appropriation of $64,000 for the purchase of the robot. 3. Authorize the City Manager to award the contract if the selected proposal is within the approved budget of $64,000. C7. Approve the Request for Qualifications (RFQ) to provide: a. Landscape Architecture Services, Specification No. 50410.2015LA b. Construction Management Services, Specification No. 50410.2015CM c. Environmental Services, Specification No. 50410.2015ENV d. Soils and Material Testing Services, Specification No. 50410.2015SMT 2. Authorize the City Manager to execute agreements with selected consulting firms. 3. Authorize the Finance Director to execute and amend Purchase Orders for individual consultant services contracts in an amount not -to- exceed the authorized project budget. C8. CALIFORNIA BOULEVARD AND JOHNSON AVENUE 16 -INCH WATERLINE REPLACEMENT, SPECIFICATION NO. 91354 MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5 -0, to: 1. Approve plans and specifications for the "California Boulevard and Johnson Avenue 16 -inch Waterline Replacement, Specification No. 91354." 2. Authorize staff to advertise for bids, and authorize the City Manager to award the contract if the lowest responsible bid is within the Engineer's Estimate of $1,490,000. DETERMINATION OF HISTORICAL SIGNIFICANCE FOR 3987 ORCUTT ROAD - RESOLUTION MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5 -0, to adopt Resolution No. 10611 (2015 Series) entitled "A Resolution of the City Council of the City of San Luis Obispo, California, determining the property at 3987 Orcutt Road does not qualify for inclusion on the list of Historic Resources, HIST- 0828 - 2015." BUSINESS ITEM B1. STRATEGIC BUDGET DIRECTION AND MAJOR CITY GOAL WORK PROGRAMS FOR THE 2015 -17 FINANCIAL PLAN City Manager Lichtig, Assistant City Manager Codron, and Interim Information Technology and Financial Planning Director Stilwell narrated a PowerPoint presentation entitled "Strategic Budget Direction" and responded to Council inquiries. Warren Ristow, President of the Vista Grande Homeowners' Associations, San Luis Obispo, requested that a slope stabilization project for the Vista Grande property be included in the Capital Improvement Plan. Jonathan Roberts, San Luis Obispo, urged Council to focus on bicycle /pedestrian projects that improve students' safe routes to school, specifically near Bishop Peak Elementary and Pacheco Elementary. Kim Bishoff, San Luis Obispo, thanked Council for installing pedestrian safety improvements on Foothill Boulevard; urged Council to include funding for a bicycle boulevard on Broad Street. Michelle Shoresman, San Luis Obispo, urged Council to prioritize pedestrian and bicycle safety improvements at Ferrini Road as well as Foothill Boulevard. Scott Bishoff, San Luis Obispo, requested that Council prioritize safety improvements for pedestrian corridors, particularly those used by children going to school. Tawny Steries, San Luis Obispo, spoke on the need for pedestrian safety improvements, including a possible roundabout on Chorro Street going towards the Foothill area. Ermina Karim, San Luis Obispo Chamber of Commerce, San Luis Obispo, spoke on the importance of infrastructure financing, workforce housing, and addressing unfunded liabilities; voiced concern regarding the high start-up cost of the proposed Rental Housing Inspection Program. San Luis Obispo City Council Minutes of Apri121, 2015 Pale 6 Lea Brooks, San Luis Obispo County Bicycle Coalition, San Luis Obispo, voiced support for the addition of funding and staff to help expedite the implementation of the Bicycle Transportation Plan. John Smi eg lski, Friends of Laguna Lake, San Luis Obispo, addressed the need to expedite the restoration of Laguna Lake, noting the City -wide support demonstrated at the Community Forum; urged Council to allocate sufficient funding to proceed with dredging of the lake. Rob Davidson, Friends of Laguna Lake, San Luis Obispo, urged Council to affirm their commitment to restoring Laguna Lake and to direct staff to fast -track the design and removal of sediment and shore line stabilization. Don Green, San Luis Obispo, thanked Council and staff for communicating with the public regarding the implementation of the Laguna Lake Conservation Plan; stated that neighborhood residents have expressed support for the creation of a special assessment district to help fund restoration of the lake. RECESS Council recessed at 8:11 p.m. and reconvened at 8:23 p.m., with all Council Members present. Geoffrey Land, San Luis Obispo, urged Council to include funding for a bicycle boulevard on Broad Street. Daniel Bohlman, Land Conservancy of San Luis Obispo County, requested that Council include funding in support of the Land Conservancy's Octagon Barn Center, noting that the project will provide parking and restroom facilities for visitors of the trails. Jim Woolf, Chair of the Bicycle Advisory Committee, San Luis Obispo, expressed gratitude for the funding allocation and addition of staff to help implement the Bicycle Transportation Plan; suggested that priority be given to the completion of the Bob Jones bicycle trail and construction of Prado Road bicycle trail. Myron Amerine, San Luis Obispo, expressed support for increasing staff levels to help implement active transportation projects. Scott Cleere, San Luis Obispo, requested that Council accelerate the timeline for installing tennis court lighting at Sinsheimer Park. Donald Hedrick, San Luis Obispo, opined that Laguna Lake needs to be deepened and sediment should be routinely removed after major storms. San Luis Obispo City Council Minutes of April 21. 2015 Page 7 Penny Rapp a, San Luis Obispo, urged Council to support the Octagon Barn Center project, noting that the City has enjoyed a long -term partnership with the Land Conservancy. Christopher Helenius, Land Conservancy of San Luis Obispo County, Avila Beach, noted that the Land Conservancy's Octagon Barn Center will need financial support from the City to help fund construction. Lynne Landwehr, San Luis Obispo, requested Council's support for the Octagon Barn Center, noting the importance of preserving the City's history and potential for increasing tourism revenue. In response to public comment, Natural Resources Manager Hill explained that the Laguna Lake Restoration work plan includes an allocation of $250,000 for dredging of the lake, which could be utilized if permits are granted earlier than expected and conditions are appropriate; advised that the Laguna Lake Natural Reserve Conservation Plan includes provisions to address a funding shortfall if a special assessment district is not approved. By consensus, Council received and filed an updated Five -Year Fiscal Forecast and directed staff to develop a prioritization to contribute one -time funding toward the Land Conservancy's Octagon Barn Center project. By consensus, Council conveyed support for the following: 1. Open Space Preservation work program, with direction that education efforts be directed towards the student age population. (Major City Goal) 2. Multimodal Transportation work program, with direction that staff develop a proposal to prioritize the Broad Street Bicycle Boulevard into the 2015 -17 Capital Improvement Plan for consideration, with information to be presented about trade- offs required to fund the project. (Major City Goal) 3. Housing work program, as presented. (Major City Goal) 4. Neighborhood Wellness work program, as presented. (Other Important Council Objective) 5. Laguna Lake Restoration work program, as presented. (Other Important Council Objective) 6. Fiscal Sustainability and Responsibility work program, as presented. (Other Important Council Objective) 7. (Other Important Council Objective) (Council action continued on next page) San Luis Obispo City Council Minutes of April 21, 2015 Page 8 By consensus, Council expressed support for the recommended allocation of one -time and ongoing budget resources to fund proposed Significant Operating Program Changes (SOPCs), and the Capital Improvement Plan (CIP), Fleet Replacement Fund, Information Technology (IT) Replacement Fund, and Major Facility Replacement Fund. By consensus, Council received and filed an update on key information items regarding future financial issues, and conceptually approved an updated Budget and Fiscal Policy related to unfunded liabilities to be considered for adoption as part of the Fiscal Year 2015 -17 Financial Plan. LIAISON REPORTS Council liaison reports were received from Council Member Christianson and Mayor Marx. COUNCIL COMMUNICATIONS None. ADJOURNMENT The City Council adjourned at 10:27 p.m., to a Special Meeting to be held on Wednesday, April 22, 2015 at 1:30 p.m. in the Council Hearing Room, located at 990 Palm Street, San Luis Obispo, California, for the purpose of conducting a closed session to evaluate appointed officials. A subsequent Special Meeting will be held on Thursday, April 23, 2015 at 3:00 p.m. in the Council Hearing Room, located at 990 Palm Street, San Luis Obispo, California, for the purpose of continuing a closed session to evaluate appointed officials.
