Sinsheimer, John Chapek, W, M. Stover. Absent, None. Communication from Aug. Vollmer in re "hater Rates" referred to Commissioner of Public Works on motion of..H. B. Kirtland seconded by John Chapek. The application of Pulliam Pfeiffer for permit__ to build. a Residence on Lot 4 Block 121, the same to cost $1200.00, was granted on motion of John Chapek seconded by H. B. Kirtland. Application of Dr. L. T. Wade for Taxicab license received and referred to Commissioner Gowman on motion of H. B. Kirtland seconded by John Chapek. The petition of M. J. Castro requesting a transfer of the Livery Stable license of C. L. Evens to himself was referred to the Commissioner of Public Health and Safety on motion of H. B. Kirtland seconded by John Chapek. On motion of L. F. Sinsheimer seconded by H. B. Kirtland the application of A. Yager for sewer connection on Broad St. between South St. and Fulton Ave. was granted. The City Attorney filed his opinion regarding the legal and moral liability of the individual members of the Council in the matter of the shortage in the accounts of.the late police Judge Thos. Rhodes. The opinion follows: " October 8th, 1917. To the Mayor and Members of the Council of the City of San Luis Obispo: - Gentlemen:- In response to your motion requesting an opinion as to the individ- ual liability.both legal and moral of each of. you on account of the shortage of Mr. Rhodes while Police Judge of. this City, I beg to submit the following: I find no legal obligation imposed upon the Mayor or any member of the Council which. imposes on any of you any legally enforceable liability for the shortage. A discussion of your moral liability is outside the province of your attorney, but I shall endeavor to comply with your request. No member is in any way morally responsible for the default save as ih the exercise of a high degree of attention and care it might have been detected at an earlier stage or the absence of a bond-subsequent to June first discovered.. Probably each member of the Council during the time the late -police -judge reported to the Council was somewhat remiss in not having checked up these reports so as to detect that the totals given in the reports were incorrect, and probably each member of the present Council is somewhat remiss in not having not#d that no bond for the term commencing June lst,1917 was submitted for approval. I know of no difference in the position of the respective members as to their .liability in this regard save that a greater degree of attention may fairly be said to have been imposed upon the Mayor by reason of the fact that he is also an executive officer charged with the enforcement of the laws and ordinances of the city and upon the Commissioner of Public Health and Safety because the default occurred in the Department of which he is the responsible head. Burch, presented a report in regard to work which is necessary to be done by the City previous to permanent street work being started , on Marsh St. The report did not include work necessary to done by Public Service Corporations. On motion of H. B. Kirtland seconded by John Chapek the report was ordered filed. The application of Commercial Bank for sewer connection on Santa Rosa St. between Montalban and Stenner -St. was granted upon motion of L. F. Sinsheimer seconded by John Chapek. The applications of Cornelius Van Proyen and Antonio.Petrini for Taxicab licenses, which had been referred for investigation were granted upon motion of H. A. Gowmar seconded by H. B. Kirtland. On motion of L. F. Sinsheimer seconded by H. A. Gowman the City Clerk was directed to call the attention of the heads of the various departments to communications, etc. which affect those departments, that action may be taken on such when presented to the Council, thereby making it unnecessary to lose time by referring same. Resolution No. 41 (New Series), .concerning the bonding of the City of San _ Luis Obispo, for the acquisition and improvement of certain real property known as the "City Farm" was introduced, and on motion of H. A. Cowman seconded by H. B. Kirtland was adopted by the following vote: ROLL. CALL: AYES: H. B. Kirtland, H. A. Gowman, L. F. Sinsheimer, John Chapek and W. M. Stover. NOES: None, Absent, None. The committee recently appointed by the individual members of the Board for ' the purpose of selecting a suitable standard for street lights, submitted a re- port with the following recommendations: That the lighting standards installed trroughout the City be uniform and of the "George Cutter Coss Park View Design, of cast iron material,,adapted to receive the Welsbaeh Street Lighting Co. two mantle type "D" lamp. That the height and dimensions be as shown in blue print attached and in accordance with specifications attached. It was moved by H. A. Gowman and seconded by H. B. Kirtland that the report of the committee be accepted. Commissioner Sinsheimer moved to amend the motion to read - "that the Council of the City of San Luis Obispo, adopt such types of standards as best suits the location at which they are to be erected ". The amendment was lost for the lack of a second. On Roll Call the vote on the original motion stood as follows: AYES: H. B. Kirtland, H. A. Gowman:, John Chapek, Vd. M. Stover. H OES: L. F. Sinsheimer, ABSENT: None. This was the date set for receiving bids for street- lighting. The bid of U the Santa Laria Gas & Power Co. was the only one received. It was moved by H. A. Gowman and seconded by H. B. Kirtland that the bid of the Santa Maria Gas & Power Co. be accepted and that the Mayor be empowered to
