Re: matter of filing fees.for building permits etc. City Attorney filed opinion
as follows:
(a) Where the permit is refused by City, no fee should be charged, and if the fee has
been paid, it should be returned.
(b) Where the permit is granted, but the work does not progress, no return of the fee
should be made.
On motion of J.B. Berkemeyer seconded by R.P. Howell the meeting adjourned to
Monday, Parch 28th, 1938, at 7:30 P. M.

Merchandise Bond of Sanlo.Meat Company (M.H.Fish) with Frank Witcosky and
Ernest Gramespacher as surety was approved and the sureties accepted on motion of R.P.
Howell seconded by J -B. Berkemeyer.
The following applications for licenses were referred to the Commissioner of
Public Health & Safety for investigation and report:

Petition of John Pfleghaar for transfer of licenses for Cigars Sideline and
Soft Drinks at 1057 Monterey Street to G.E. Adler granted on favorable report and motion
of L.J. Defosset seconded'by R.P. Howell.
Application of Gwen Marshall for permit to lay 70 feet of curbing and gutter on
south side of Center Street between Broad Street and Chorro Street ordered on file
awaiting name of contractor and time of doing work.
Petition of E. S. Hamilton for permit to remove a certain tree from.premises at
Aut- o -tel, Lower Higuera Street, referred to the Commissioner of Public Works for
investigation and report on motion of R.P_.Howel- l-seconded by Joseph Leary, as was also, the
application of W.J. Mingille for permit to break pavement 2 x 25 feet on Chorro Street
between Higuera Street and Marsh Street for purpose of installing sewer for premises at
1117 Chorro Street.
On motion of R.P. Howell seconded by L.J. Defosset the following petitions were
erred to the Commissioner of Public Works for investigation and report to the Council:

On motion of R.P.Howell seconded by J.B.Berkemeyer the petition of San Luis Obippc
hamber of Commerce, by M. Bonetti, for permit to put up a banner in the intersection of
anta Rosa.and Monterey Streets indication the Poly Royal Exhibition, was referred to the
ommissioner of-Public Health and Safety with power to act.
The report of the City Treasurer for the month of February 1938 received and
placed on file.
Communication from M.S. Johnson President Channel Counties Regional League
meeting at Santa Maria March 30th ordered placed on file.

Re: communication from Mission Trails Association requesting contribution of
100.00 from the City of San Luis Obispo for 1938 advertising budget. Discussion. It was
,owed by R.P.Howell, seconded by J.B.Berkemeyer that'the City contribute $100.00 to Mission
rails for advertising purposes. Motion lost. City Attorney to bring written,opinion.
Re: petition of R.S. Shatford for.extension of sewer main, and also a water
ervice line, on the westerly extension of Fixlini Street; matter discussed. On motion
J.B.Berkemeyer seconded by L.J.Defosset same referred to the City Engineer for
vestigation and report to the Council.
The application of W.H. Donelson for permit to build a residence and garage in
lips & Beebee Tract again laid over.
