City Engineer reported on matter of Change of Curb Grades on Upham Street between Johnson Street and Fixlini Street: After discussion it was moved by J. B. Berkemeyer, seconded by R. P. Howell that the City Attorney be directed to d raw the necessa papers in conjunction with the City Engineer looking toward Change of Grade at the herein - above named location. The City Engineer filed report on the matter of a proposed widening of Hathway Ave. between Toro Street and Bond Street. Matter laid over for further study. The Cite Engineer presented profile of Curb Grades on South side of Pismo Street between Beach Street and Carmel Street and the City Attorney presented draft of Resolution giving tentative figures on Curb Grade for the southerly side of Pismo Street between Beach Street and Carmel Street. Discussion followed: Resolution of Intention No. 409 - (New Series) - A Resolution Declaring the Intention of the City Council to order a change in the Official Curb Grade of a portion of Pismo Street was introduced end adopted, on motion of R. P. Howell, seconded by J. B.Berkemeyer by the following vote: Ayes: J. B. Berkemeyer, R. P. Howell, Joseph Leary, L. F. Sinsheimer oes: None bsent: L. J. Defosset On motion of J. B. (The latter permit granted subject to the approval of the Building Inspector ) The IVierchandising Bond of Andrew B. Hedrick, Jr.., with the Sun Indemnity Co. of New York as surety, was approved and the surety accepted on motion of R. P. Howell, seconded by J. B. Berkemeyer. 13 3114 The petition of Tess L. Whitaker for street grade on Grove Street between Higuera Street and the San Luis Creek was received and on motion of J. B. Berkemeyer, seconded by R. P. Howell, the City Engineer was instructed to establish Official Grade fat the said location and report to the Council. The petition of G. B. Richina for permit to remove a .tree from sidewalk area on Branch Street at Harris Street referred to the Commissioner of Public Works for investigation and report. The petition of Peon Sales and Service by E. M. lx drez for permit to hang a neon sign at Tasty Bakery, 895 Higuere. Street, and the petition of George Dawson for the transfer of license for Lunch Counter, Soft Drinks and Cigars Sideline at 1088 iauero Street to C. A. Markel were referred to the Commissioner of Public Health and Safety for investigation and report to the Council. The application of the ;pan Joaquin Power Division, Pacific Gas and Electric Co. No. 253 for permit to replace a 20 ft. pole with a 45 ft. pole on Beebee Street between igh Street and Branch Street referred to the Commissioner of Public Works for report. The application of the Pacific Telephone and Telegraph Co. for permit to do certain pole work on Lizzie Street and Upham Street between Johnson and Fixlini Streets, more Particularly described in application on file, dated March 23, 1939, was referred on motion of R. P. Howell, seconded by Joseph Leary to the Commissioner of Public IVorks for investigation and report. The following applications for registration as Contractors were received: Lovell A. Gragg - Class "E'' Contractor, U. S. Fidelity & Guaranty Co. Bond : "1,000. Registration fee. $15.00 . S. Fockett - Class "F" Contractor., U. 3. Fidelity &. Guaranty Co. Bond, 500. Registration fee, X15.00. motion of R. P. Howell, seconded by 7. B. Berkemeyer;, it was ordered that the sureties eccepter7, bond apnroved and registration granted. Communication received from the gamewell Co. re: Fire Alarm System ,- ered received and placed on file. Communication lmas received from H. M. Harrv:erth of the California Mission Trails ^_ssociation Ltd. requesting the Council to contribute to the Association „100.00 or advertising purposes. The matter was discussed and it was moved by R. F. Howell, econded by J. B. Berkemeyer that the City contribute $100.00. Matter further discussed and the .motion : ^:es amended, substituting $50.00 in lieu of $100.00. Motion put and cerried, Joserh Leary voting "'o- on the around that the contribution was illegal. Applications for the quarterly licenses were granted on motion duly seconded and n-- rried. The petition of Rundle's Inc. for permit to m:.ve a neon sign from Clarence prof ^.,n, Jeweler, at 1037 Chorro Street to new location at 862 Higuera Street granted on motion of L. J. Defosset, seconded by R. P. Howell with the provision that sign be hung in accordance with Ordinance and under the surer.vision of the City Engineer. The following applications for permit to connect with sewer were granted on motion of J. B. Berkemeyer, seconded by R. P. Howell with the provision that work be done under the supervision of the City Engineer: Ernest Vollmer - Santa Rosa Street between Pacific Street and Pismo Street Mrs. A. Ferrini - Essex Street between Mill Street and Palm Street. On f-:jvorable report and on motion of J. B. Berkemeyer, seconded by R. P. Howell, the application of James C. Gillis for permit to open trench to renew sewer on Br .-nch Street between Harris Street and Price Street granted with the provision that the work be done under the supervision of the City Engineer and that the pavement be restored to its original condition. The petition of the Union Oil Co. for permit to break about 30 sq. ft. of pavement for the purpose of repairing leak in oil line on Higuera Street between South Street and Short Street granted - work to be done under the supervision of the City Engineer. The netition of the Santa Maria Gas Co. for permit to brea'r. hole in pavement on Higuera Street between Essex Street and Johnson Street granted. 'Rork to be done under the supervision of the City Engineer.. The application of the Santa Maria Gas Co. for permit to install approxi- mately 200 ft. of 3" gas main on Essex Street between Palm Street and Mill Street to serve A. 11. Ferrini residence granted. Work to be done under the supervision of the City Engineer. The petition of Robert M. Leslie requesting that water service be furnished lot 20, Blk 4, of the'Fixlini Addition, referred to the Vater Department, on motion duly seconded and carried. Re: Petition of Robert M. Leslie for grading and gravelling Fixlini Street from Upham Street to its southeasterly termination: Matter discussed and it was moved by J. B. Berkemeyer, seconded by R. P. Howell that the City Engineer be instructed and directed to prepare the necessary grade, that Official grade may be established. The applications of Foster & Kleiser for sign - boards at various locations in the City again brought up. It was moved by L. J. Defosset, seconded by R. P. Howell, that the application of Foster 3c Kleiser Co. to erect an advertising sign -board on the E. 1,7. Brown property on Higuera Street near the junction of T.Zarsh Street be granted. Motion was lost. The matter was further discussed and on motion of R. P. Nowell, seconded by L. J. Defosset all of the said applications were laid over for one week.
