City Hall, Monday, July 31, 1939 - 7:30 P. M.
The City Council met in adjourned session - Mayor Fred C. Kimball
presiding:
Present: W. H-.Brazil, R.P. Howell, Ralph C.Kennedy, Fred C.Kimball, Joseph Leary
Absent: None
The following applications for permit to build were granted on motion duly
seconded and carried:
Howard B. Kirtland - Office building, pt of lots 15 & 16, Blk 29'9 Cost $8500.00
Anita Hathway - Res. and garage, lot 10, Blk 7, Hathway Addn., 4800.00
Fred Bonilla - Repair building, lot 150 Blk 5, Imperial Addn., " 500.00
Ben Cerini - Addition to residence, Blk 25, " 25.00
M. G. Salmina - Addn of porch, Blk 609 Cost 100.00
The above application referred to the Commissioner of Public ;'corks with power to act.
The application of Howard B. Kirtland for permit to move a building from
lot 161 Blk 29 to a part of Lot 11 Blk 43, referred on motion of Ralph,C.-Kennedy,
seconded by Joseph Leary to the Commissioner of Public ;°forks with power to act.
The ierchandising Bond of Myrtle W. Lynch with H. J. Dubin as surety, was
presented and an motion of R. P. Howell, seconded by W. H. Brazil it was ordered that the
surety be accepted, bond approved and license issued.
The Merchandising Bond of Ring's Groceteria by W. K. Ring with the Great
American Indemnity Co. of New York as surety, was received and on motion of Joseph Leary,
seconded by S.V. H. Brazil, the surety was accepted, bond approved and license ordered
issued.
The application of A. L. Shelton for license for Lodging House at 546
Hip-uera Street referred to the Commissioner of Public Health and Safety for investigation
and report to the'Council, on motion of R. P. Howell, seconded by 11% H. Brazil.
On motion of R. P. Howell, seconded by Joseph Leary the application of Mrs.
Milton Naaelle for license for Bakery at 723 Higuera Street was referred to the Com-
missioner of Public Health and Safety for investigation and report to the Council.
The application of Dr. F. R. Mugler for permit to repair 16 ft. of concrete
sidewalk on the west side.of Toro Street between Hiauera and Marsh Streets was granted
on motion of R.. P. Howell, seconded by Ralph C. Kennedy.
The petition of Walter Parker for permit torehang a metal sign with wood.
frame at Palm and Morro Streets, The Associated Service Station, was .referred to the
Commissioner of Public Health and Safety for investigation and report to the Council,
on motion duly seconded and carried.
Vernon Floray, Minister of the Seventh Day Adventist Church petitioned the
Council for permit to erect a tent 50 x 70 ft. at the corner of Pacific and Garden Streete
to be used for the purpose of conducting evangelistic meetings. Matter referred, on
motion of R. P. Howell, seconded by Ralph C. Kennedy to the Commissioner of Public Health
and Safety for investigation and report to the Council.
On motion of Joseph Leary, seconded by R. P. Howell, the petition of R.
Leal for permit to grade 18 ft. alley running between the south side of Nigh Street and
north side of Sandercock Street at 237 High Street was referred to the Commissioner of
Public Works for investigation and report to the Council.
Ordinance No. 200 (New Series) - An Ordinance amending Ordinance No. 122
(New Series) by adding a new Section numbered 4.3,-relating to Fifteen Minute Parking

36 places, amending.Section 4 of said Ordinance Mo.' 122 (New Series), was finally passed
on motion of Joseph Leary, seconded by W. H. Brazil, by the follo,.iing vote:

Re: application of Natale Mainini for permit to construct 47 ft. of concrete
culvert in rear of his property, part of lots 1 and 2, Block 94, Murray & Church Addn,
Leff Street between Nipomo and Broad Streets: Commissioner of Public Works, R. P.
Howell, reported favorably on the application, and on his motion, seconded by ':V. H. Brazil
the petition was granted.
The Commissioner of Public Health and Safety, W. H. Brazil, reported favorably
on the application of Neon Sales and Service, by Sam Holland, for permit to hang a neon
sign for Pep Creameries at 785 Higuera Street, and on his motion, seconded by R. P.
Howell, it was ordered that the application be granted with the provision that the work
be done under the supervision of the City Engineer and in accordance with Ordinance.
The application of D. N. Hodgson for registration as Class "E" contractor
together with U. S. Fidelity and Guaranty Bond in the amount of $1000.00 and registration
fee of $15.00 received and on motion of R. P. Howell, seconded by Ralph C. Kennedy it
was ordered that the surety be accepted, bond approved and registration granted.
The petition of H. C. Dalessi for permit to grade surface and put in sewer
on Fixlini Street from Upham Street two blocks southward, also, to grade and surface
Spring Street one block between Johnson and Fixlini Streets was granted on favorable
report and motion of R. P. Howell, seconded by 111. H. Brazil with the provision that work
be done under the supervision of the City Engineer.
The application of Jack H. Spandau for license for Auctioneer at 1044 Chorro
Street granted on motion of Ralph C. Kennedy, seconded by 1.17. H. Brazil with the pro-
vision that the present stock only is auctioned.
The matter of the petition of J. H. Kirk and H. C. Kinsman relative to the
installation of a water main on what is known as "Caudill Street" from its intersection
with Broad Street to its intersection with Lawton Street was again taken up and dis-
cussed, and
Resolution No. 442 (New Series) - A Resolution providing for the execution
of an agreement between the City of San Luis Obispo and J. H. Kirk and H. C. Kinsman
relating to the construction of a water main on Caudill Street was passed and adopted
on motion of Ralph C. Kennedy, seconded by R. P. Howell, and Agreement ordered entered
into by the following vote:

Re: Petition of Elizabeth Law for the extension of a !dater Service Main for
approximately 200 ft. easterly on Hope Street to serve residences in Block 2 of the
Slack Tract. Matter discussed and upon motion of R. P. Howell, seconded by W. H.Brazil,
it was ordered that the petition be g ranted, it being understood and agreed that the
petitioner furnish pipe and work to be done by the City.
It was moved by W. H. Brazil, seconded by Joseph Leary that William Villegas
be regularly appointed as Fireman at $125.00 per month, commencing July 17th, 1939.
Motion carried.
Resolution No. 443 (New Series) - A Resolution declaring a portion of Pismo
z,treet to be and Constitute a Boulevard,was introduced and adopted, on motion of

Resolution No. 444 (New Series) - A Resolution directing the City Engineer
to furnish ;.glans and specifications for the improvement of a portion of Morro Street in
the City of San Luis Obispo was passed and adopted on motion of Ralph C. Kennedy,
seconded by W. H.. Brazil by the following vote:

Resolution No. 445 (New Series) - A Resolution directing the City Engineer
to furnish plans and specifications for the improvement of Islay Street and a portion
1 of Toro Street in the City of San Luis Obispo was passed and adopted on motion of Joseph
Leary, seconded by Ralph C. Kennedy-by the following vote:

Resolution No. 446 (New Series) - A Resolution providing for the execution
of an Agreement between the City of San Luis Obispo and Lowe Sanitary District was passed
and adopted on motion of R. P. Howell, seconded by - W. H. Brazil by the following vote:

Ordinance No. 201 (New Series) - An Ordinance providing for the acquisition
of certain real property by the City of San Luis Obispo, i.e., (lots 18 and 19 in�Block
186 of the Ingleside Homestead Tract) was introduced and passed to print on motion of
Ralph C. Kennedy, seconded by W.H. Brazil by the following vote:
