Grace Townsend - 90 ft; of 6 ft. park sidewalk on thenorth side of Upham Street, between Chorro and Garden Streets, Wm. Jones - 45 ft. of 6 ft. park sidewalk on the west side of Chorro Street between Upham and Church Streets. The application of Geo. L. Allen for permit to lay 62 ft. of 6 ft. park sidewalk on the north side of Upham Street between Chorro and Morro Streets was granted on motion of R. P. Howell, seconded by Ralph C. Kennedy, with the provision that work be done under the supervision of the City Engineer. The application of Christiana Lauritson for permit to lay 50 ft. of 6 ft. park sidewalk on the south side of Islay Street between Osos and Santa Rosa Streets was referred to the Commissioner of Public Works, with power to act, on motion of Ralph C. Kennedy, seconded by Joseph Leary. The application of Wm. Jones for permit to recess curb for a distance of 12 ft for driveway on the west side of Chorro Street between Upham and Church Streets granted on motion of R. P. Howell, seconded by '11. H. Brazil. In a communication, Mary Edna Kaufman requested permit to remove two trees in front of her residence at 1052 Islay Street. On motioli of.Ralph C. Kennedy; seconded by W. H. Jones - Chorro Street between Upham Street and Church Street ho som Stapp - Chorro Street between Islay and Leff Streets. The petition.of G. W. Hampton for permit to open trench toconnect with City sewer in the Caudill Tract between Story Street and Lawton Street was granted with the provision that the work be done under the supervision of the City Engineer. The petition of Gertude and George Venema for permit to construct a board fence 5 -1/2 ft. high at their premises on lot 3, bloc- 151, Harford Addition, was presented and on motion of Ralph C. Kennedy, seconded by R. P. Howell, the matter was re- ferred to the Commissioner of Public Health and Safety for investigation and report to the Council. On motion of Ralph C. Kennedy, seconded by Joseph Leary the Merchandising Bond of Holt Bros., by Parker M. Holt, in the amount of $200.00, secured by certified check in the amount of $200.009 was cancelled and the certified check ordered released, the principal having fulfilled obligation under said bond. The application of Jos. Thomas for registration as class "E" Contractor, together with U. S. Fidelity and Guaranty Co. bond in the amount of $500.00 and regis- tration fee of $15.00 received, and on motion of R. P. Howell, seconded by Ralph C. .Kennedy, the surety was accepted, bond approved,and registration granted, rpplication of Neely L. Hill for registration as class "D" Contractor, to- gether with U. S. Fidelity and Guaranty Co. bond in the amount of $1000.00 and regis- tration fee of $25.00 received, and on motion of R. P. Howell, seconded by W. H. Brazil, surety was accepted, bond approved, and registration granted. The 43rd Annual Report and Budget of the San Luis Obispo Free Public Library for the fiscal year ending June 30, -1939, was received and ordered placed on file, on motion of Ralph C. Kennedy, seconded by R. P. Howell. This being the date set for Hearing on the Improvement of Islay Street ( reference Resolution No. 431 (New Series) dated July 5, 1939, fixing August 14th, as date for such hearing) the matter is now taken up by the Council: City Attorney read Investigation Report under "Specill Assessment Investigation, Limitation and Majority Protests Act of 1931 ", filed July 5, 1939 re: Improvement of Islay Street. There were no written nor verbal protests filed by interested property owners Resolution No. 449 (New Series) - A Resolution of Report by Legislative Body on Investigation Report Hearing (Islay Street Imp.),was passed and adopted on motion of Ralph C. Kennedy, seconded by R. P. Howell, by the following vote: Ayes: W. H.!Brazil, R.P. Howell, Ralph C. Kennedy, Fred C. M., in the Council Chamber, City Hall, in the City of San Luis Obispo. Re: Rate of Interest on Bonds covering Islay and Morro Street Improvement:- It was moved by Ralph C. Kennedy, seconded by Joseph Leary that interest rate on Islay Street and Morro Street improvement bonds be set at 4 %.. Motion carried. Resolution Of Intention No. 453 (New Series) - A Resolution of the Council of the City of San Luis Obispo declaring its intention to improve Islay Street and a portion.of Toro Street, in said City; Creating an assessment District to pay the costs and expenses of such work and determining that serial bonds shall be issued to represent unpaid assessments thereon was adopted and passed on motion of R. P. Howell, seconded by Joseph Leary by the following vote: Ayes: W. H. Brazil, R.P.Howell, Ralph C. Kennedy, Fred C. Discussion followed. Re: 'utter of Payment of Assessment against Post Office property by the U.S. Government for the Improvement of a portion of Morro Street: Matter discussed and. it was moved by R. P. Howell, seconded by W. H. Brazil that upon failure of the Postal De- partment of the U. S. Government to pay said assessment, that the assessment be.-paid-.from tie General Fund by the'.City of San Luis Obispo. Motion carried. Resolution No.. 458 (New Series) - A Resolution of the Council of the City of San Luis Obispo declaring its intention to improve a portionof Morro Street, in said City; Creating an Assessment District to pay the costs and expenses of such work and determining that serial bonds shall be issued to represent unpaid assessments thereon, was adopted and passed on motion of R. A tentative map of Tract No. 30, "Escuela Alta Subdivision ", a. part of Sections 25 and 26, T. 30 S., R. 12 E., M. D. M. was presented by Albert Nelson. On motion of Ralph C. Kennedy, seconded by W. H.
