City Hall, Monday, August 28, 1939 - 7:30 P. M.
The City Council met in adjourned session - Mayor Fred C. Kimball presiding.
Present: W.H.Brazil,R.P.Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary
Absent: None
The following application for permit to build was granted, on motion of R.P.
Howell., seconded by Ralph C. Kennedy, subject to the approval of the building inspector;
work to be done under'his supervision:
C. E.Hackett & G.H.Shadinger - 10 Cabins and Office Bldg., Lots 1 -2 & 3,
B1k 153, Harford Addn. Cost 4000.00
The application of Irene J. Carpenter for permit to raze a building in Block
17 was granted on motion of R. P. Howell, seconded by Ralph C. Kennedy, subject to the
approval of the building inspector.
On motion of Ralph C. Kennedy, seconded by W. H. Brazil, the following appli-
cations for permit to lay sidewalk and curbing were granted, with the provision that work
be done under the supervision of the City Engineer:
Christina Jacobsen - 65 ft. of 5 ft.park sidewalk, curbing and gutter
on west side of Hill Street between Mt. View and
Lincoln Streets - Anholm Addn.
0. R.'Ochs - 50 ft. of 4 ft. park sidewalk and curbing on the
east side of Chorro Street between Center Street
and Venable Street - Anholm Addn.
The application of Maurice 'N. Vrnitzel for registration a's Class "F" Con-
tractor, together with U. S. Fidelity and Guaranty Co. bond in the amount of $200.00 and
registration fee of $10.00 received, and on motion of Ralph C. Kennedy, seconded by
R. P. Howell, it was ordered that surety be accepted, bond approved and registration
granted.
Petition received from J. H. Kirk requesting that curb grade be established
on Caudill ; -3treet between Broad Street and Lawton Street'. Matter discussed and on motion
of R. P. Howell, seconded by W. H. Brazil, the City Engineer was instructed to furnish
grade as petitioned for.
Ordinance No. 202 (New Series) - An Ordinance letying a tax for the current
fiscal year (1939 -1940) uppn all taxable property within the City of San Luis Obispo,
and fixing the rate of such tax at $1.38 on each one hundred dollars in.value of said
property, was finally passed on motion of R. P. Howell, seconded by W. H: Brazil by the
following vote:

Absent: None
Ordinance No. 203 (New Series) - An Ordinance Relating to the Care and Ex-
penditures of Monies received from the State of California under the provisions.of
Article 5, Chapter 1, Division I of the Streets and Highways Code was finally passed on
motion of R..P. Howell, seconded by W. H.Brazil by the following, vote:
Ayes: W. H. Brazil, R.P.Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary

The petition of J. C. Naylor for permit to recess curb for a distance of 10 ft.
and lay concrete walk for driveway, ramping same for a distance of 3 ft. on the east side
of Broad Street between High Street, and intersection of Broad and Chorro Streets, McBride
(Tract, was granted on motion of R. P. Howell, seconded by W. H. Brazil, with the pro-

Petition of G. H. Shadinger for transfer of license for Restaurant and Cigars
Sideline at 1129 Monterey Street, The ?,ideawake Cafe, to C. L. Burch, granted on motion
of 71. H. Brazil, seconded by R. P. Howell, with the provision that license for the present
quarter has been paid.
The application of Model Linen Supply, by H. B. Page, for license for laundry
at 338 Higuera Street was granted on favorable report and motion of W. H. Brazil, seconded
by R. F. Howell.
Application of 0. W. Hodgin for license for Restaurant at 968 Monterey Street
granted on motion of W. H. Brazil, seconded by R. P. Howell.
Re: Application of Adele Kucera for permit to hang a board sign at 1024 Morro
Street, The Steak Rector Cafe: It was moved by Ralph C. Kennedy, seconded by W. H.Brazil
that inasmuch as the said sign does not conform to provisions of Ordinance, that the
application be denied. Matter turned over to the Commissioner of Public Health and Safety
The application of Neon Sales and Service by E. bI. 4ndrez for permit to
hang a neon sign at the United Cigar Store, Monterey and Morro Streets, granted, on
favorable report and on motion of W. H. Brazil, seconded by R. P. Howell, with the pro-
vision that wor< be done under the supervision of the City Engineer and in accordance
with provisions of Ordinance.
The petition of the Model Linen Supply by H. B. Page, relative to the in-
stallation of 170 H. P. Steam Boiler, also Fuel Oil Storage Tank at 348 Higuera Street
was taken up, and on;-motion of Ralph C. Kennedy, seconded by R. P. Howell the matter
was referred to the Commissioner of Public Torks, with power to act.
Resolution No. 460 (New Series) - A Resolution_ accenting a new Franchise
Bond from Union Oil Company of California was passed and adopted on motion of Ralph C.
Kennedy, seconded by R. P. Howell by the following vote:
Ayes: W.H.Brazil, R.P.Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary
Noes: None

Re: Petition of Veterans "lelfare Board, State of California, ;:requesting
cancellation of taxes levied against Lot 15 of the Loma Vista Addition, (for year 1939-
1940), title as of March 6, 1939, vested in the name of Alvinza °iebster and Edith F.
';,lebster, Veteran contract holder, Wm. Henry ?fuss, Jr., Contract No. 23440, Deed recorded
April 19, 1939, was before the Council. Matter discussed and on motion of Ralph C.Kennedy,
seconded by W.H.Brazil, it was ordered that the petition be denied, inasmuch as tax against
said property became a lien on same, March 6, 1939.
Resolution No. 461 '(New Series) - A Resolution accepting a Deed from H. C
Kinsman and Ella -Kinsman quitclaiming unto the City of San Luis Obispo for street purposes,
certain portions of lots 20 and 21 of the property of ',V. L. Beebee and C. H. Phillips in
the City of San Luis Obispo as surveyed by R. R. Harris in November, 1874, according to the
map thereof, recorded in Book "A" of maps at page 44, Records of the County of San Luis
Obispo was passed and adopted on motion of'Ralph C. Kennedy, seconded by R. P. Hoije�l by
the following vote:

Ordinance No. 204 (New Series) -An Ordinance Repealing Ordinance No. 162
(New Series) relating to licensing the selling of "Oleomargarine" in the City of San Luis
Obispo was introduced and passed to print on motion of Ralph C. Kennedy, seconded by
