City Hall, Monday, October 2, 1939 - 7:30 P. M.
City Council met in regular session - Mayor Fred C. Kimball presiding.

The application of L. & L. Amusement Company by James Ariaga, for permit to
install Music Vending Machines at the following named locations were referred to the Com-
missioner of Public Health and Safety for investigation and report to the Council:

The following applications for permit to lay sidewalk and curbing were re-
(erred to the Commissioner of Public Works for investigation and power to act, on motion
of Joseph Leary, seconded by W. H. Brazil: -
E. C. Reynolds - 50 ft. of 5 ft0 park sidewalk and curbing on the
east side of Chorro Street between Lincoln St. and
Mt. View Street, Anholm Addn.
Lino Donati - 50 ft. of 5 ft. park sidewalk on the north side of

The following applications for permit to connect with city sewer were re-
ferred,.on motion of Joseph Leary, seconded by R. P. Howell, to the commissioner of
Public Works with power to act:-
Lawrence L. Leitner - Islay Street between Santa Rosa and Toro Streets,
M. A. Cheda - Peach Street between Santa Rosa and Osos Streets.
.The petition of John B. Nelson for permit to hang a metal sign with wood frame
at 1044 Chorro Street was referred to the Commissioner of Public Health and Safety for
investigation and report.
On motion of Joseph Leary, seconded by W. H. Brazil the petition of Edna M.
Russell, 1445 Mill Street, for permit to install a septic tank on lot 8 and part of lot 9,
block 45, was referred to the Commissioner of rublic Works for investigation and report
to the Council.
The petition of Henry C. Dalessi for permit to construct 6" sewer line across
Upham Street on Fixlini Street for a distance of approximately 80 ft::k in order to tie in
with present sewer was before the Council, and on motion of Joseph Leary, seconded by
1ph C. Kennedy the petition was referred to the Commissioner of Public 'Idorks, with power
to act.

On motion of Ralph C. Kennedy, seconded by Joseph Leary the following appli-
cations for contractor's licenses were approved, sureties accepted and registre-tion
granted:
A. 0. Johnson - Class "E" Contractor- U. S. Fidelity and Guaranty
Co. bond, "p500.00; registration fee, $15.00.
Thatcher Cc Loomis Bros. - Class "E" Contractor - U.S. Fidelity and
Guaranty Co. bond, $500.00; registration fee, $15.00.
W. I. Cook - Class "D" Contractor - U. S. Fidelity and Guaranty
Co. bond, $1,000.00; registration fee, $ 25.00.
The reports of the Police-Judge and the City Collector for the month of
September were received and ordered placed on file.
Claims against the City for the month of September were ordered paid on motion
of Ralph C. Kennedy, seconded by R. P. Howell, subject to the approval of the heads of
the respective departments and the Mayor.
Anita M. Hathway petitioned the Council relative to the acceptance of a certain
street to,-be known as "Ellen Way" and that part of Third Street, more particularly des-
cribed in a deed presented: utter discussed and on motion of Ralph C. Kennedy, seconded
by Joseph Leary the matter was referred to the Commissioner of rublic Works and the City
Attorney for investigation and report to the Council.
The following matters were continued:
Petition of 71alter Melin - sewer - Branch St. between Cypress -and Beebee Streets.
Vim. Vetter - sewer - Leff St. between Broad and Garden Streets.
E. C. Schwafel - re: Traffic
}} " Mrs. H. L. Coffin - re: Dead End Street Sign.

George B. Benner - sewer - Fixlini Street
Henry Kast and C. C. Dennis - relative to Fire Alarm Boxes at various
locations.
'T A. L. Shelton - License for Lodging House at 546 Higuera Street.
^ J. C. Naylor - Sewer connection - Lot 3, Blk ? McBride Tract.
The petition of Augustus Castro relative to deeding to the City of San Luis
Obispo a certain private alley in Block 14 was again brought up. Commissioner Howell
reported adversely. It was moved by 1,11. H. Brazil, seconded by R. P. Howell that the offer
to deed said alley be denied. Motion carried.
Re: Bids for Insurance for Public Liability and Property Damage on City's
Motorized Equipment received September 25,T 1939: Commissioner Kennedy reported that the
bid of M. Lewin & Son, Agent, ( St. Paul Fire & Marine Insurance Co.) in the amount of
:479.12 was the lowest bid received. It was moved by Ralph C. Kennedy, seconded by R. P.
Howell that the bid of M. Lewin & Son being the lowest and best bid of all bids received,
that the insurance be awarded to 11. Lewin & Son. Motion carried.'
An Agreement dated September 28, 1939 between Francisca D. Summers and 1. T. D.
Summers et al and the City of San Luis Obispo relative to the installation of 3" water
line on Fixlini Street from Upham Street to the southerly end of Fixlini Street in accord-
ance with the City Engineer's estimated cost of $468.00 was presented by Chandler P. Ward,
Attorney, together with check inthe amount of $468.00, being full payment for the cost
of said water line. Matter discussed, andq
Resolution No. 468 (New Series) - A Resolution providing for the execution
of an Agreement between the City of San Luis Obispo and Francisca D. Summers and W.T.D.
(Summers, as Executors of the Estate of William T. Summers, Deceased, T. Wilson Dibblee
and Archie M. Edwards relating to a water main on Fixlini Street was passed and adopted,

on motion of R. P. Howell, seconded by W. H. Brazil, by the following vote:

Re: Andre Freitas 'Water Account: It was moved by Ralph C. Kennedy, seconded
by R. P. Howell that the City Collector be authorized to set up a credit of $3.20 for
Andre Freitas to apply on .water bill of said Freitas -- said credit covering over - payment
for the month of June ana July, 1938. :lotion carried.
The matter of licensing outside bakeries and laundries doing business within
the City of San Luis Obispo was discussed at length -- Commissioners W. H.Brazil and Joseph
Leary were requested to bring hack recommendations on Ordinance regulating bakeries and
laundries.
Re: Lease and Agreement between F.Dalidio and Katie Dalidio and the City of
San Luis Obispo for taking.water from wells on the Dalidio property: Matter discussed.
It was moved by R. P. Howell, seconded by Joseph Leary that the last ;paragraph of said
Agreement relating to minimum of water flow, be stricken from said agreement. Motion
carried. It was then moved by R. P. Howell, seconded by Joseph Leary that the said lease
and agreement, as corrected, be presented to F. Dalidio and Katie Dalidio for their exe-
cution. Motion carried.
On motion of Ralph C. Kennedy, seconded by R. P. Howell the meeting adjourned
to Monday, October 9, 1939 at 7:30 P. M.
