The City Engineer presented an agreement between the City of San Luis Obispo and Americo Alberti and 7.stee L. Alberti, and, Resolution No. 484 INew Series) - A Resolution providing for the Execution of a:: .- 7reement between the City of San Luis Obispo and Americo Alberti and Estee L. Alberti relating to the Leese of Certain property for the Purpose of Taking Field Stones There- from, was passes and adopted on motion of R. 1. Flowell, seconded by W. H. Brazil by the following vote: Ayes: V.H. Brazil, R. P. Howell, Ralph C. Kennedy, F. C. Kimball, Joseph Leary Noes: None Absent: None Re: Sale of Wharf It was moved by R. P. Newell and seconded by 'S. H. Bruzil that the City of San Luis Obispo sell all of its right, title and interest in and to what ra-mains of a certain Vlharf at Laguna Lake, located on the Johe property, to the San Luis Obispo Rod and Gun Club for the sum of $1.00. Pleasanton, " 25.00 The application of Robert 14. Umbertis for permit to change location of resi- dence on part lot 5, Block 21, Central Addition was granted on motion of R. 11. Howell seconded by Joseph Leary with the provision that the building be placed at a location approved by the City Engineer. Merchandising Bond of L. B. Price Mercantile Co. with*U. S. Fidelity and Guaranty Company Bond in the amount of 4200.00 as surety, was approved, surety accepted and license ordered issued, on motion of Ralph C. Kennedy seconded by R. P. Howell. The applications of Dante Chiesa and Charles Joseph Gates for licenses for Soft Drinks and Cigars Sideline at 993 Higuera Street were referred to the Commissioner ofl Public Health and Safety for investigation and report to the Council on motion of R. P. Howell, seconded by 71. H. Brazil: 1 1 1 1 D 1 1 1 The reports of the City Clerk and the City Treasurer for the .month of De'cember,' 1939 were received and ordered placed on file. The following applications for licenses were granted on motion of W. H,. Brazil seconded by R. F. Howell: J. H. Russell - Lunch Counter, Soft Drinks and Cigars Sideline, 562 Higuera Street ''1023 Club" (,Vm. Shepherd) Soft Drinks and Cigars Sideline, 1023 Morro Street Petition of Emerson Electric, by Elmer Emerson, for permit to move a double face Neon Sign from 785 Marsh Street to 447 Higuera Street, also, to install a single face Neon Sign at 447 Higuera Street was granted. Said signs to hang in accordance with the provisions of Ordinance and viork to be done under the supervision of the City Engineer. This being the date and place fixed by the Council, as set out in Resolution of Intention No. 479 (New Series) to call a Special Election to submit to the qualified electors, of the Caudill Tract and a part of the Imperial Y'Lddition the question whether such territory shall be annexed to, incorporated in, and made a part of the City of San Luis Obispo, and designating this date as the time and p ;ace when and where any person owning real property within said territory so proposed to be annexed and having any objections to the proposed annexation, may appear and show cause why said territory should not be annexed, the matter was now taken up by the Council. There were no written protests filed. Mrs. A. R. (Dorothy) Smith and Mrs. Clara B. villa appeared and made verbal protest. Matter discussed with protestants. City Attorney presented Resolution, calling special annexation election,. It.was moved by Ralph C . Kennedy and seconded by W. H. Brazil that the lower floor of the Latter Day Saints Church be desig- nated as a Precinct polling place within said territory for such election. The motion carried. It was moved by Ralph C. Kennedy, and seconded by W. H. Brazil that Mrs. Beatrice I. Barlow be designated as Inspector, and that Mrs. Clara B. villa and Mrs. Cara A. Sinner be named as Judges for such election. The motion carried and it was so ordered. It was moved by W. H. Brazil and seconded by R. F. Howell that the "Atascadero Nens" be designated as the official newspaper in which the notice of such election shall be advertised. The motion carried. Resolution No. 485 (New Series) - A Resolution calling a Special Election and submitting to the qualified electors of the Caudill Tract and part of the Imperial Addition to the City of San Luis Obispo the ?uestion whether such territory shall be annexed'to, incorporated in, and made a part of the City of San Luis Obispo, was passed and adopted on motion of R.
