City Council met in adjourned session - Mayor F. C. Kimball presiding.
Present: W. H. Brazil, R. P. Howell, Ralph C. Kennedy, F. C. Kimball, Joseph Leary
Absent: None
The following applications for permit to build were granted on motion of
R. P. Howell, seconded by ,. H. Brazil:

The application of Harold C. Madsen for permit to build residence and garage
on Lot 4, Block 28 of the Phillips Syndicate Addition ( outside of the City of San Luis
Obispo) was presented and on motion of R. P.�Howell, seconded by W. H. Brazil, it was
ordered that the application be received with approval and placed on file.
The application of Neon Sales and Service, by E. M. Andrez, for permit to hang
a neon sign at 1313 Broad Street for the Modern Family Laundry was referred to the Com-
missioner of Public Health and Safety for investigation and report to the Council.
The application of Mrs. H. E. Palmer for permit to open trench for sewer con-
nection on Upham Street between Johnson Ave. and Fixlini Street was referred to the Com-
missioner of Public Vlorks, with power to act.
The petition of the Board of Directors of.the Christian Science Church, by
Alberta Price, for permit to erect a sign at the corner of Marsh and Garden Streets on
the property occupied by Long Music Co. designating the location of said church, was
received and on motion of R. P. Howell, seconded by W. H. Brazil the petition was referred
to the Commissioner of Public Health and Safety for investigation and report to the Council
This being the time and place fixed for hearing on the issuance of bonds to
cover unpaid assessments for the improvement of Islay Street and a portion of Toro Street
under Resolution of Intention No. 453•(New Series), the matter was now taken up. No
written or verbal protests were made, and,
Resolution No. 495 (New Series) - A Resolution relating to the issuance of
Improvement Bonds of the City of San Luis Obispo, pursuant to Resolution of Intention
No. 453 (New Series) determining the amount of unpaid assessments, prescribing the de-
nominations of such bonds and providing for their issuance and delivery was introduced
and adopted on motion of Ralph C. Kennedy, seconded by R. P. Howell by the following vote:

Noes: None
Absent: None
This being the time and place fixed for hearing on.the issuance of bonds to

Resolution No. 496 (New Series) - A Resolution relating to the issuance of
Improvement Bonds of the City of San Luis Obispo, pursuant to Resolution of Intention No.
458 (New Series) determining the amount of unpaid assessments:, prescribing denominations
of such bonds, and providing for their issuance and delivery was introduced and adopted,
on motion of Ralph C. Kennedy, seconded by R. P. Howell by the following vote:

Communication from John Christensen, Sr. relative to the keeping of poultry in
the City of San Luis Obispo was received and ordered placed on file.
This being the meeting of the City Council next after the expiration of three
days from and after February 20, 1940, the date upon which the special annexation election
was held in the Caudill Tract and part of the Imperial Addition, the Council now proceeds
to canvass the returns of said election. There being but one polling place and precinct
for the holding of said election, upon examination of the tally sheets and returns, the
Council found that more than a majority of the votes cast at said election were cast in
favor of. annexation.
It was moved by Councilman R. P. Howell, seconded by Councilman Ralph C. Kennedy
that the following record of the result of said canvass be made and entered upon the
minutes of this City Council, to -wit:
That the proposition submitted at said election was as follows:
Shall the Caudill Tract and part of the Imperial Addition to the
City of San Luis Obispo be annexed to the City of San Luis Obispo
and the property within said territory, after such annexation, be
subject to taxation equally with the property within the City of
San Luis Obispo to pay for all of the bonded indebtedness of said
city for the acquisitiCn, construction and completion of various
municipal improvements, incurred and outstanding at the date of
such annexation and all bonded indebtedness heretofore authorized
and to be represented by bonds of said city hereafter to be issued?
That the whole number of votes cast thereon in the territory proposed to be
annexed was 77.
That the number of votes cast therein in favor of annexation was 59.
That the number of votes cast therein against annexation was 18.
Said motion duly carried.
Ordinance No. 212 (New Series) - An Ordinance approving the annexation of the
Caudill Tract and part of the Imperial !addition to the City of San Luis Obispo was in-
troduced and passed to print on motion of R. P. HoiNell, seconded by W. H. Brazil by the
following vote:

The petition of Christine Lee for transfer of license for Lunch Counter, Soft
Drinks and Cigars Sideline at 1088 Higuera Street to George Dawson was granted on motion
of W. H. Brazil, seconded by R. P. Howell.
The petition of Bernard S,. Hawkins for permitto install a septic tank at 1447
Marsh Street supported by a letter from the Department of Public Health, approving said
application, was ordered granted on motion of R. P. Howell, seconded by W. H. Brazil.
The petition of Veterans of Foreign Wars, Harold J. Anderson, Post No. 1766,
by D. Z7. Babcock, Commander, for permit to hold a carnival show within the city was grantee
on motion of W. H. Brazil, seconded by R. P. Howell. Date of such carnival to be decided
later.

The petition of J. A. McKinnon et al for the Improvement of Upham Street
between Johnson Ave, and Fixlini Street was continued for one week.
The petition of George Matts for permit to connect with sewer on Kentucky
Street between Murray Ave. and Stafford Street, and the petition of R. H. Dickson for
permit to connect with sewer on Crandall Tday between Foothill Boulevard and the Polytechnic
school grounds ( both locations outside the city of San Luis Obispo) were granted on
favorable report and on motion of R. P. Howell, seconded by W. H. Brazil.
Ordinance No. 211 (Neva Series) - An Ordinance amending Ordinance No. 122
(New Series) by adding a new section to be known as "Section 42" relating to a limitation
on "Time Parking" was finally passed on motion of W. H. Brazil, seconded by R. P. Howell
by the follcvaing vote:

The petition of Mrs. C. Bianchi relative to bridge over San Luis Obispo Creek
at what is known as "Bianchi Lane" was again continued.
The petition of A. V. Muller et al relative to curbs on Chorro Street between
Palm Street and Murray Ave. was received and placed on file.
On motion of Ralph C. Kennedy, seconded by VI. H. Brazil the following licenses)

There was discussion relative to the matter of an ordinance in connection
with keeping.znimals in the city of San Luis Obispo, truck routes, recreation room and
sewer connections. Matters continued.
On motion of W. H. Brazil, seconded by R. P. Howell, J. R. Woodward was
appointed a regular employee in the fire department as of February 1, 1940 at a salary
of $125.00 per month, said salary to be divided equally between the fire department and
the water department.
On motion of R. P. Howell, seconded by Ralph C. Kennedy, the meeting adjourned)
to Thursday, February 29th, 1940 at 10 o'clock A. M.
