HomeMy WebLinkAbout09/03/1940491 City Hall, Tuesday, September 3rd 1940 - 7:30 P.M. City Council met in regular session - Mayor F.C.Kimball presiding. Present: W.H.Brazil, R.P.Howell, Ralph C.Kennedy, F.C.Kimball, Joseph Leary. Absent : None. The minutes of August 19th.,22nd, and 26th were read and approved as read. The following application for permit to build was granted on motion of W.H.Brazil seconded by Ralph C.Kennedy Minta L.Long - Double garage with Apt. Lot 38.Block 11 Weills Addn 'Cost 19800.00 The application of ;9m.R. and.Bernice.Tardif for permit to enlarge bedroom, part of Lot 6 Block 81 was referred to.the Commissioner of Public Works, with power to act, on motion of W.H.Brazil.seconded.by Ralph C..4ennedy. Application of.Mrs A.M..Fluitt for license for i4ierchandise (Confectionery,Lunch, Soft Drinks.etc) at 1177_Marsh Street was referred to the Commissioner.of Public Health and Safety for investigation and.report, on.motion.of.R.P.Howell seconded by 7J.H.Erazil. Application -of:.Rose Merino for license for Fortune.Telling at 1029 Morro Street, and the application of Marie Todorovich for license for Astrology were received and on motion of R.P.Howell seconded by W.H.Er9zil the applications were referred to the Commissioner of Public Health and Safety for investigation and report to the Council. The oetition of Standard Auto Parts, by A.O.Johnson, for permit to recess curb for a distance of 20 ft and ramp sidewalk 3 ft for driveway, on the south side of Higuera Street between Osos Street and Santa Rosa Street was received and referred to the Com- missioner of Public Works with power to act, on motion of W.H.Brazil seconded by Ralph C.K nnedy. The application of L.B.Cook & Son for permit to place two metal signs 2 ft x 40 ft flush with building at Montgomery Ward & Cc store ( one sign Higuera Street frontage and one sign on Monterey Street frontage) was granted on motioh of W.H.Brazil seconded by Ralph C. Kennedy with the provision that the signs be hung according to provisions of Ordinance end under the supervision of the City Engineer. The petition of Porter & Richards, by 11I.L.Porter, for transfer of licenses for Class "B" Service Station and Soft Drinks at 636 Higuere Street to Ralph Duncan was referred to the Commissioner of Public Health and Safety for investigation and report, on motion duly seconded and carried. .The applications of the Pacific Gas and Electric Company Nos.272 and 273 for per it tc eplace a pole on Morro Street between Pacific Street and Marsh Street, and to set a pole on Montalban Street .between Lincoln Street and Stenner Street respectively, were referred to the Commissioner of Public 71orks with power to act, on motion of Ralph C.Kenne y seconded by W.H.Brazil. Application of John Madruga for registration as Class "D" Contractor, together with Great American Indemnity Co Bond in the amount of $ 1,000.00 and registration fee of ` 25.00 received, and on motion of Ralph C. Kennedy seconded by W.H.Brazil, the surety was accepted, bond approved and registration granted. On motion of W.H.Brazil seconded by Ralph C. Kennedy, the petition of Burr Kirby for permit to remove a tree in perkway of sidewalk at 1662 Hillcrest Place was referred to the Commissioner of Public ',:orks with power to act. The report of the City Collector for the month of August 1940 was received and ordered placed on file. At the recuest of the Rodeo committee, and on motion of W.H.Erazil seconded by R.P.Howell, the Citv.Clerk was directed to write Nathan Abas,960 Bush Street, San Francised, 'A.P:r_.Official, requesting that a series of concerts be given by the W.P.A. Orchestra in the City of San Luis Obispo on Sept 6th, 13th and 20th at the noon hour. 1 1 1 1 1 1 1 1 1 In a communication, Mr. W.T.Shipsey accepted with thanks, his appointment as a 497 mber of the Board of Trustees of the Free Public Library of the City of San Luis Obispo. Claims against the City for the month of August, 1940, were ordered paid subject to the approval of the heads of the respective departments and the Mayor, on motion of loh C. Kennedy seconded by W.H.Brazil. This being the date set for Hearing on the Improvement of portions of Mill, Peach sos and Morro Streets( Peach 3t (?t) Improvement ) reference Resolution No. 523 (New Series) ted Tuly 29th. 1940 fixing September 3rd. 1940, at the hour of 7:30 o'clock P.M. as the ate for such hearing, the matter is now taken up by the Council. The City attorney read nvestigation report on " Special Assessment Investigation, Limitation and Majority Protest Act of 1931" filed 7uly 29th. 1940 re:-the Improvement of the hereinabove named Streets. The City Clerk presented a formal written protest of 1-Irs. N. Albertoni; No verba protests were received. It was moved by R.P.Howell seconded by W.H.Brazil that the formal mritten protest of Pass. N. Albertoni be placed on file. The motion carried. Resolution No. 529 ( New Z)eries ) A Resolution of report of legislative body on Investigation Report Hearing was duly and regularly adopted on motion of Ralph C. 'ennedy, seconded by 17.F.Brazil by the following vote: s `-- 7.H.Brazil, R.P.Howell, Ralph C. Kennedy, F.C.Kimball, Joseph Leary. oes : None. bsent: None. On motion of Ralph C.,Kennedy, seconded by R.P.Howell, it was ordered that the onds to be issued in connection with the costs and expenses of the proposed improvement of ort.ions of Mill, Peach, OsoS and Morro Streets in the City of San Luis Obispo, shall mature ine years from the second day of July next succeeding ten months from their date( rather ✓ han four years as stated in said report ) and that the proposed number of installments of he principal of such bonds shall be ten ( rather than five as stated in said report). The otion carried. Resolution No. 530 (New Series )- A Resolution determining that limitation of ndebtedness may be exceeded ( after hearing before legislative body) was duly and regularl dopted, on motion of R.P.Howell seconded by W.H.Brazil by the following vote : yes : W.H.Brazil, R.P.Howell, Ralph C. Kennedy, F.C.Kimball, Joseph Leary. oes : None. bsent: None. Resolution No. 531 ( New Series ) - A Resolution directing the City Engineer to urnish plans and specifications for the improvement of portions of Mill, Peach,Osos and rro Streets in the City of San Luis Obispo was passed and adopted on motion of R.P.Howell econded by W.H.Brazil by the following vote: yes : 'I;i.H.Brazil,R.P.Howell, Ralph C. Kennedy, F.C.Kimball, Joseph Leary. oes : None. lbsent: None. Ray Hearne appeared relative to the parking of cars at or near the intersection of Toro and Walnut Streets; Commissioner of Public Health and Safety to take note. Ordinance No. 218 ( New Series ) - 'A Ordinance levying a tax for the current fiscal year ( 1940 -1941 ) upon all taxable property within the City of San Luis Obispo and fixing the rate of such te.x at $ 1.36 on each $ 100.00 in value of said property was finally passed on motion of R.P.Howell, seconded by W.H.Brazil by the following vote: Ayes : W.H.Brazil, R.P.Howell, Ralph C. Kennedy, F.C.-Kimball, Joseph Leary. Noes : None. Absent: ?None. 498 The Commissioner of Public Health and Safety reported favorably on the applicati of Theo. Vega for license for lodging house at 1716 Osos Street, stating that the law had been complied with relative to fire escape signs, and on his motion, seconded by R.P.uowell the application was granted. The following applications for permit to hang Neon signs were granted on motion of W.H.F.razil, seconded by R.F.Howell with the provision that said signs be erected in accordance with the provisions of existing ordinance and that the work be done under the supervision of the City Engineer: R.udolph's Electric - neon Sign at Golden ;Jest Restaurant - 676 Higuera Street. Rudolph's Electric - Neon Sign at Lehnhoff & Laux Service Station -406 Higuera ,t. 1 Commissioner R.F.Fowell reported favorable action upon the application of Tony Machado for sewer connection on Murray Avenue between Motley Avenue and Kentucky Street, and on the application of Alfred F. Selvage for sewer connection on Fixlini Street between Spring Street and the end of said Fixlini Street, and on his motion seconded by W.H.Brazil the applications were granted. The matter of the complaint of C.A.Younglove regarding noise from a certain motor at Bay's Market was held over for further report from the City Engineer. The petition of «ugustus Castro and Fred. L. Gist for cancellation of certain tax sales under provision of Section 3716.2 of the political code of the Stat'e,of California was ordered filed for future reference, on motion of Ralph C. Ir.ennedy seconded by W.H.Rrazil. The Commissioner of Supplies was directed to obtain a number of ''" No Shooting_Signs " and post on City's property in Reservoir Canyon. Re: Application of Mary J. Anderson dba as " Mary's Cafe ", 406 Higuera Street for " On Sale Beer " license from the State Board of Equalization dated 8,/15/40 - the Commissioner of Public Health and Safety reported " No objection ". Mr Bernal L. Reasoner representing the Gamelaell Company addressed the Council relative to the diarhone horn fire siren, suggesting but not recommending certain methods of slightly modifying the intensity of sound of said siren.
