City Hall, Monday, September 16, 1940 - 7:30 P. M.
City Council met in regular session - Mayor F. C. Kimball presiding.

Absent: None
The minutes of September 3rd were read and approved as read.
On motion of R. P. Howell, seconded by W. H. Brazil the following applications
for permit to build were granted:
Donald Moses - Residence and Garage - Lot 13, Blk 8, Anholm Addn. Cost 4000.00

The Merchandising Bond of Victor E. Schoch in the amount of $200.00, with U.• S.
Fidelity and Guaranty Co. as surety, was received and on motion of Ralph C. Kennedy,
seconded by R. P. Howell the surety was accepted, bond approved and license ordered issued
The applications of Steve Mendoza for licenses for Cigars Sideline and Billiard
and Pool at 887 Palm Street were referred to the Commissioner of Public Health -and Safety
for investigation and report to the Council, on motion of R. P. Howell, seconded by Ralph
C. Kennedy.
The following applications for permit to lay and repair sidewalk were referred,
on motion of IN. H. Brazil, seconded by Ralph C. Kennedy, to the Commissioner of Public
Works, with power to act:
Mrs. Jennie Hill-- To repair:l2.it of full width sidewalk and ramp, on the
North..pide of Buchon.Street between Broad St. and Nipomo St.
Fitzgerald Estate and Jas. Quaglino -
o repair 25 ST.- Ft. of sidevialk on the North side of
Higuera St. between Court St. and Morro Street.
Christine Hoerntlein - To lay 75 ft. of 4 ft sidewalk adjoining property line
on the Southside of Spring St. between Fixlini St. and
Johnson Ave;
Also, 50 ft. of 4 ft. sidewalk adjoining property line on
the West side of Fixlini St. at Spring Street.
The following applications for permit to open street to connect with sewer were
referred to the Commissioner of Public Works, with power to act, on motion of W.H.Brazil,
seconded by Ralph C. Kennedy:
Dohald Moses - To open trench for sewer connection on Center St. between
Chorro St. and Lincoln Street.
George W. Kilbern- To cut pavement for sewer connection on Buchon St. between
Broad St. and Nipomo Street.
W. Fetters - To open trench for sewer connection on Lincoln St. between
Iviontalbon St. and Mission Btreet.
Minta Long - To open street for sewer connection on Branch St. between
Broad St. and Beebee Street
Walter Peterson - To open trench for sewer connection on Longview St. between
Bond St. and California Blvd. ( outside the city)
Communication was received from C. A. Maino relative to sewer connection on
Johnson Ave. between Mill Street and Palm Street, also, requesting that something be done
relative to the surfacing of Johnson Ave. between Palm.Street and Mill Street. The
matter was discussed and on motion of Ralph C. Kennedy, seconded by W. H. Brazil, same
G was referred to the Commissioner of Public Works for investigation and report to the
Council.'
The application of the Pacific Telephone and Telegraph Co. No. 4 for permit to
replace poles at carious locations on South Broad Street, more particularly described
in application on file, was refezed to the Commissioner of Public 'Noiics, with power to act,
on motion of I. H. Brazil, seconded by Ralph C: Kennedy.
The application of the Pacific Telephone and Telegraph Co. for pergiit to place
underground cable conduit on Morro Street between Monterey and Peach Streets, a distance
of approximately 700 ft., to provide additional telephone facilities to the National
Guard Camp etc, was granted, on motion of R. P. Howell,'-seconded by W. H. Brazil; work

to be done under'the supervision of the City Engineer.
The,application of the Union Oil Co. of California for permit to change the
location of a telephone pole from the Northwesterly corner of Pismo Street and Garden
Street to the Northeasterly corner of Pismo Street and Garden Street was granted on motion
of R. P. Howell, seconded by-W. H. Brazil.
The application of the San Joaquin Power Division, Pacific Gas and Electric Co.
No. 274, for permit to-set a 35 ft, pole on the West side of Chorro Street at Monterey
Street to facilitate installation of street lights, was granted on motion of W. H.Brazil,
seconded by R. P. Howell, providing that a decorative steel pole be put up and painted;
work to be done under the supervision of the City Engieer. Motion carried. Joseph Leary
voted "No ".
On motion of R. P. Howell, seconded by Ralph C. Kennedy, the following applications
for permit to hang signs were referred to the Commissioner of Public Health and Safety for
investigation and-report to the-Council:
Neon Sales & Service - Neon sign for Blue Bell Coffee Shop - 987 Monterey St.
Rudolph's Electric - Neon sign for Steak Rector Cafe - 1024 Morro St.
Rudolph's Electricl Neon sign for Bob Olgiati - 1019 Court St.
The reports of the City Clerk, the City Treasurer, the 'Police Judge and the

ound Master for the month of August, 1.940 were received and ordered placed on file on
motion duly seconded and carried.
In a letter W. W. Cotnam Adj., Harold J. Anderson Post No. 1766, Veterans of
Foreign Wars, thanked the Council for.contribution enabling that organization to send the
V.F.t^!. Band to the National Convention at Los Angeles. Communication ordered filed.
Notification from the State Board of Equalization under date of Sept. 6,1940
relative to the transfer of license for "On Sale Beer" from Alice A. Rogers to Gorge VJ.
Taylor, 850 Marsh Street was received and on motion of 49. H. Brazil, seconded by R. P.
Howell the same was ordered filed.
A petition was received from Laura C. Ruda et al requesting that Walker Street
from Higuera Street to High Street; Archer Street, from Marsh Street and Higuera Street
to Buchon Street; and Pismo Street from Higuera Street to Archer Street be improved by
road mix methods; s6id petitioners agreeing to pay the cost of proposed work with the
understanding that the cost not exceed 25¢ per lineal foot. Matter discussed and on
motion of W. H. Brazil, seconded by R. P. Howell the petition was referred to the Com-
missioner of rublic Works for investigation and report to the Council. Motion carried.
Petition was received from Nelson H. Russell et al requesting the Council to
improve Ella Street by oiling same. After discussion-the matter was referred to the Com-
missioner of Public Works for investigation and report to the Council.
R. M. Bradbury appeared before the Council, offering certain property owned by
the Presbyterian Church at the corner of Osos and Marsh Street as a possible site for a

The application of Mrs. A. M. Fluitt for license for Mdse. (Confectionery,
Lunch, Soft Drinks, etc.) at 1177 Marsh Street was granted on motion of W. H. Brazil,
seconded by R. P. Howell.
On motion of W, H. Brazil, seconded by R. P. Howell the petition of Porter
& Richards by W. L. Porter, for transfer of license for Class "B" Service station and
Soft Drinks at 636.Higuera Street to Ralph Duncan was granted.
The application of Marie Todorovich for license for Astrology, and the appli-
cation of Rose Marino for license for Fortune Telling, Card Rg.ading etc. at,1029 Morro
Street were,and each of.them was denied, on motion of W. H. Brazil, seconded by R. P.Howell
Commissioner R. P. Howell reported favorable on the following applications,
and on his motion, seconded by W. H. Brazil, the same were granted:

Resolution No. 533 (New Series) - A Resolution approving diagram of assessmen

Resolution of Intention No. 534 (New Series)--- A Resolution of the Council
f the City of San Luis Obispo declaring its intention to improve portions of Mill, Peach,
sos and Morro Streets in said city ( Peach St. Joint Improvement); creating an assessment
istrict to pay the costs and expenses of such work and determining that serial bonds shall
e issued to represent unpaid assessments thereon was introduced and adopted, on motion of
