The City Council met in regular session; Mayor Timothy I. O'Reilly presiding.
Present: D.M.Carpenter, Wm. O.Hall, Timothy I. O'Reilly, Kline Williams, Frank V.tdoods
Absent: None
The minutes of November 21st, 25th and 28th, 1949 were approved.
Mayor O'Reilly opened the meeting by reviewing the charges made against Chief

Files by former Police Capt. James Courtney, stating we have been plagued with numerous
problems in the operation of our Police Dept. for some time now, and think conditions
in the Police Dept. merit an investigation, asking Commissioner Woods if he would approve;
following an unanimous vote, the Mayor then notified Chief Files of his immediate sus-
pension " as of this hour" pending the investigation.
Mr. Smee, on December 5, 1949, at a regular Council meeting, gave evidence to the
City Council that he had all licenses neceGsary to engage in the contract work for the
PHILLIPS ADDITION SEWER IMPROVEMENT DISTRICT NO. 1 contract, said license bore date of
Oct. 27, 1930 and bearing the seal of Reg. and signed license #2.5817 and bore the
following Class C -36 Plumbing, S -C 42 Sewers, Sewage Disposal and Drains, and Cement
Pipe Lines.
On December 5, 1949, at 4:32 P.M., Mayor. O'Reilly received a telegram from Ernest
A Wilson of San Mateo, Calif., Special Counsel for the City of San Luis Obispo, ( quote)
"Smee may execute Contract if now licensed ", (unquote)
By common consent of the City Council, the contract was officially awarded to
John E. Smee, dba "Smee's Plumbing and Hearing ", 1302 Osos St. in the amount of 27,596.841
Communication from the Military Order of the.Purple Heart asking permission to
display car and accept donations to raise funds for State Convention was granted on motion
of Fran?- V.Woods, seconded by Wm. O. Hall.
Communication from SanLuis Obispo City Schools requesting city taxes be cancelled
on property acquired by San Luis Obispd High School District was referred to Commissioner
of Finance on motion of Frank V. Woods, seconded by D.M.Carpenter.
Communication from Chief Files requesting a Public Hearing onhis accused violation
of Oath of Office as Chief of Police, was orderedreceived and filed on motion of D.M.
Carpenter, seconded by Kline Williams.
Communication from Geo. Couper, asking; permission to suspend wire across Orange
Drive for Christmas display, was referred to Comm. of Public Health and Safety, with
power to act, on motion of Wm. 0. Hall, seconded by Kline Williams.

Communication from John R. Haile, Chairman of Citizens Committee on Housing.
The transfer of License of Delite Bakery at 723 Higuera St. from H. R. Bareuther
to T. S. Buchan was granted on motion of Frank V. Woods, seconded by Kline Williams.
The application of Construction Corp. of America for registration as Class "E"
Contractor, together with Columbia Casualty Co. bond-in the amount of $500, and regis-
tration fee of•6W15.00 received, and on motion of Kline Williams, seconded by Wm.. 0. Hall,

16 it was ordered that the surety be accepted, bond approved and registration granted.
The Citv Clerk was instructed to call for Informal. Bids covering the city's
requirements on gasoline, Oils, Greases, etc. for the year 1950; Bids to be opened at the
meeting of Dec. 19, 1949 at 7:30 P.M.
Claims against the City for the month of November, 1949 were ordered paid,
subject to the approval of the heads of the respective departments and the Mayor.
On motion of Vim. 0. Hall, seconded by D.M.Carpenter, the Mayor was authorized
to sign Contract with the Los Angeles Chemical Co. of Los Angeles, Calif. covering city's
requirements on Liquid Chlorine covering the period of January 1st thru December 31, 1950,
Resolution No. 931 (New Series) - A Resolution of the City Council of the
City of San Luis Obispo for a preliminary Loan from the Public Housing Administration to
conduct a survey to determine whether there exists in the City of San Luis Obispo a need
for low rent Public Housing was passed and adopted on motion of Wm. 0. Hall, seconded by
D. M. Carpenter upon the following roll call vote:

Resolution No. 932 (New series) - A Resolution providing for the
execution of an Agreement with Louis J. Kroeger and Associates was passed and adopted on
motion of Kline Williams, seconded by -D. M. Carpenter, upon the following roll call vote:

Ordinance No. 323 (New Series) - An Ordinance providing for the acquisiti

The following matters were held over awaiting reports:
Communicationfrom Public Housing Administration Re: Transfer of Housing Units.
Petition from V. M. Burdick et al requesting street work, fire protection and street
signs, etc. along Bishop Street and Serra Way awaiting report from Commissioner of Public
Health and Safety and Commissioner of Public Works.
Communication from Division of Highways under date of Oct. 21, 1949, Re:
cancellation of city taxes on property acquired for highway purposes showing name of
grantor and recording data, on motion of Kline Williams, seconded by D.M. Carpenter, the
taxes were ordered cancelled.
On motion of Wm. 0. Hall, seconded by D.M.Carpenter, it was moved that Frank
A Waddell, 1515 Beach St. be refunded in full on building permit, amount $6.00 filed on
Oct. 30, 1949 and that A.Madonna, 581 Higuera St. be refunded 50% on building permit,
amount $9.00, filed on March 1, 1947, as the work was not started on the above permits.
