Present: D.M.Carpenter, Paul W.Davis, Fred Lucksinger, Timothy I.0'Reilly, Frank V.Woods Absent: None The Minutes of the meeting of July 16, 1951 were approved. First order of business: This being the time set as per advertised Notice for receiving Bids onthe Murray Street Paving Job. The following Bid was the only bid received: Bid of 1''alter Bros. - $ 9149.00 The bid was referred to the City Eng�neer for study, to be acted upon later in the meeting. Ralph Westfall appeared before the Council and presented a tentative map of the Resub. of Alberts property inthe Phillips Additioh which is tentatively named "Alta Vista ", together wuth supporting data for the Council's approval. Aft$r discussion and on motion of D.M. Carpenter, seconded by Frank V.Woods it waa moved that the Council go on record as " approving the tentative map ". Motion carried. Communications: Communication from the Army Advisory Committee Re: Resolution designating Camp Roberts a permanent installation was read, and on motion of D.M.Carpenter, sedonded by Frank V. Woods, the City Attorney was instructed to draft a Proposed Resolution to be presented at the next meeting of the Council. Communication fromJames Vaught Re: asking for a leave of absence from the Police Dept* for one year; on motion of Frank V.Woods, seconded by Timothy I.O'Reilly, the request was granthd, with the provision, that in the event he returns to work for the city, he will be given the job in the department at that time,and at the rate of pay for that particular job or classification. Motion carried. Communication from Wm. Rooney, Supt. Recreation Commission Re: approval of lease to `reterans General Services Administration. The following Resolution was adopted: ?'esolution No.'1034 (New Series) - A Resolution providing for the Execution by the City of San Luis Obispo of an Agreement to rent space in the City Recreation Building to the United States of America was passed and adopted on motion of•D.M.Carpenter, seconded by Frank V.Woods upon the following roll call vote: Ayes: D.M.Carpenter, Paul W.Davis, Fred Lucksinger, Timothy I.O'Reilly, Frank V; Woods Noes: None Absemt: None Resolution No. 1032 (New Series) - A Resolution of the City Council of the City of San Luis Obispo adopting Budget and approving Memorandum of Agreement for Expenditure of Gas Tax allocation for Major City Streets was passed and adopted on motion-of D.M.Carpent seconded by Frank V. Woods upon the following roll call vote: Ayes: D.M. Carpenter, Paul W. Davis, Fred Lucksinger, Timothy I.O'Reilly, Frank V.Woods Noes: None Absent: None Communication from Santos Leguina, Chairman, Recreation 'C'ommission received, relative to property owned by the Commission known as "South Entrace Park" to be turned back to the City, with the recommendation that the 12th Naval District bd granted rights to the property for the construction of a naval reserve armory. The Mayor recalled the fact that this property was turned over.to the City by the State for park purposes only, and that the matter rests with the State of California, but that the Council go on record as approving the measure , and upon the condition that the Division of Highways relax the restriction ih that certain deed No. 2164, dated March, 1950, recorded, volume 553, page 582, official records, San Luis Obispo County. 9 1 1 1 LI 1 1 1 1 Communication from Santis Leguina, Chairman of' the Recreation Commissicn Re: Salary increases for staff members; on motion of Paul W.Davis, seconded by Fred Lucksinger, it was moved that the increase be granted to thefollowing members: motion carried.- Wm. Rooney, Supt. Recreation Comm. 340.00 per month John Gonzales, gardner 250.00 " " Wm. S.Anderson, Janitor 238.00 " " Judith Rooney, Secty. 1.18 per hr. After the above motion was made, a lengthy discussion followed relative to a general 5010 raise to all city employees as of September 1, 1951, whereupon, Commissioner D.M. Carpenter made a motion to rescind the above motion for the salary increase to the Recreation employees. The motion lost for want of a second. Another motion was made by D.M.Carpenter, that a 5% raise be given to all city employee ( excluding the above named employees of the recreation department) The motion lost for want of a second. On motion of Frank V.Woods, seconded by Paul W.Davis-it was moved that the City Atto draft a Resolution granting a 5% increase in wages to all city employees, effective as of Sept. 1, 1951: Motion carried. D.M. Carpenter declining to vote. Communication received from Lloyd Schultz asking for a leave of absence for two months on account of illness was granted. Mr. Carpenter informed the members of the Council that Mr. Schultz was the only qualified motor grader operator the city had and that the street department repair work would be at a standstill until he could secure a qualified operator and asked permission tohire twoqualified menfor the work, so that a substitute operator would always be available. The Council granted-his request. Communicationfrom Maxine Lei.ster asking for a leave of absence for two months as of August 16, 1951 was granted on motion of D. M. Carpenter, seconded by Frank V. Woods. The following reports were ordered received and filed: City Collector's report 'or the month of July, 1951 Police JudgeAs " # Police Dept. " Building Inspector's report City Tfeasurer's report for•the months of May and June, 1951. Claims against the City for the month of July were ordered paid subject to the approval of the heads of the respective departments and the Mayor. The following claims were presented, and approved by the Council, and payment authorized: Maino Constructiori Co. - Request #8 - Re: Water 'Filtration Plant - 5911.93 Harry N. Jenks, consulting Engineer, Services for July, Re: " 100.00 Ordinance No. 348 (New Series).- An Ordinance amending Sections 1,2 and 3 of Ordinan No. 324 (New Series) entitled " An Ordinance of the City of San Luis Obispo imposing an excise tax on the use or other consumption of tangible personal property was finally paused on motion of D.M.Carpenter, seconded by Fred Lucksinger upon the following roll call vote: Ayes: D.M.Carpenter, Fred Lucksinger, TiiAothy I. O'Reilly, Frank,V. Woods Noes: Paul W. Davis Absent: None Ordinance No. 349 (New Series) - An Ordinance amending Sections 1, 2.and 4 of Ordinance No. 300 ( New Series) entitled " An Ordinance of the City of San L „is Obispo imposing a License Tax for the privilege of selling Tangible personal property at.retail on and after July 1, 1948, except as in this ordinance provided, etc., was finally passed on motion of D.M.Carpenter, seconded by Fred Lucksinger upon the following roll call vote: Ayes: D.M.Carpenter, Fred Lucksinger, Timothy I.0'Reilly, Frank V.Woods Noes: Paul W. An Ordinance amending Sections 4 and 5 of Ordinance No. 309 (Bew Series) entitled " An Ordinance of the City of San Luis Obispo , fixing rates to be charged for water furnished by said city to consumers, etc., was passed to print on motion of D.M. O'Reilly upon the following roll call vote: Ayes: D.M.Carpenter, Paul W.,Davis, Fred Lucksinger, Timothy I. O'Reilly, Frank j. Woods Noes: None Absent: None The City Attorney presented a letter received from Kirkbride, Wilson, Harzfeld & Wallace Re: Assessment Proceedings -- Foothill Sanitary Improvement District , and on motion of D.M.Carpenter, seconded by Frank V. Woods it was moved that the Council accept the terms of the Agreement as outlined in their letter. Motion carried. The following Merchandising Bonds were received and on motion of Paul W.navis, seconded by D.M.Carpenter,..the sureties were acceptbd,.bonds approved and licenses ordered issued: U.S.Sewing Center, Inc. ( Mdse. Sewing Machines).- 684 Higuera St. Floyd Williams, dba Floyds Market - ( Mdse. Groceries) - 148 Higuera St: . The application of the Merlin Constructioh Co. for a contractor's License ( Roofing and Siding) of Los Angeles, Calif. was not granted on account of the Form of Bond received and the City Clerk was instructed to write to the Merlin Construction Co.', informing them of the Council's action and for them to furnish the City with`..ariother bond acceptable to the City, as to terms and conditions required in said bond. The application for a Dance to be held at the Veterans Memorial Bldg. on August 16th, was granted on motion of Frank Woods seconded by D. M. Carpenter. The following claims were approved and authorized for payment on motion of D.M.Carpenter, seconded by Fred Lucksinger: W. M. Lvles Co. Re: Santa Rosa St. Water Line Imp. Estimate No. 1- 4550.17 W. M. L-vles Co. Re: Johnson Ave. Water Line Imp. " No. 1 - 5748.65 0. R.Ochs. & Son Re: City Hall - Request No. 9 219199.13 Eugene Jackson Re: Water Filtration Plant Residence - Estimate No. 3 2808.90 WM.'Dec^ker Holdredge Re: City Hall - Progress Payment 7� 9- - 500.00 City Engineer, Homer-Hamlin, presented a claim filed by Alfred Ferrini in the amount of $676.03 Re: Water Line installation on Felton Way, and upon recommendation of the City Engineer and on motion of D.M.Carpenter, seconded by Fred Ducksinger, it was ordered that the claim be paid. Motion carried. 1 1 1 1 1 Claim filed by 011ie Brigson Re: damages to car, which was sprayed with oil while 3 cal city employes were spraying the street, was presented . by the City Engineer for Council action. On motion of'D.14.Carpenter, seconded by Timothy I. O'Reilly same was referred to the City's Insurance Carrier. The City Engineer asked the Council's permission to advertise for Bids for the purchase of four pickup trucks and one dump truck, and on motion of Fred Lucksinger, seconded by D.M.Carpenter, permission was granted; said bids to be received up to 7:30 o!clook P.M., August 20th, 1951 at which time they will be opened and read. Motion carried. The City Engineer presented a proposed form of an Organization Chart for the Public Works Department for the Council's approval. After study of the chart it was the con- sensus of opinion of the Council to be a very good plan, and had their approval of same. At this time the award of the Contract on the Murray Street Job was again taken up. Upon recommendation of the Citv Engineer , reporting that the bid met with the necessary specifications and cost anticipated, it was moved by D1 M.Carpente r, seconded by Timothy I. O'Reilly, that the bid of Walter Bros. in the amount of $ 9149. be accepted. Motion carried. Old Business AoDlication for transfer of Checker Cab Co. from Jess Munoz to Asher B.Shaw,referred to Commissioner Woods, was presented. Commissioner Woods instructed the City Clerk to inform Mr. Shaw this license would not be transferred on account of certain conditions that were not coigplied with in regard to the Taxicab Ordinance. Communication from Barbers Local Re: Police Officer involved inthe barbers trade,- the Commissioner of Public Health and Safety informed the Council this matter was taken care of. Mayor O'Reilly appointed Fred Gist as Chairman of the Planning Commission; the appoint -� ment was approved by the Council, on Motion of D.M..C,arpenter, seconded by Fred Lucksinger. Commissioner Frank Woods made the following appointments in the Police Dept: Ival Harmon appointed as regular Police Officer as of June 1, 1951.
