The Council of the City of San Luis Obispo met inregula r session; inthe Council
Chambers, Recreation Bldg., in said city at 7:30 o'clock•P.'M., on SPpt.4th, 1951.
Mayor Timothy I. O'Reilly presiding.
Roll Call:
On Roll Call, there were present, Councilman -'Carpenter, Davis, Lucksinger, Woods and
MavorO' Reilly. Also present were the City Clerk, City Engineer and Attorney Ernest
A. Wilson.
The Minutes of the meeting of August 20th, 1951 were approved.
A Public Hearing by the City Council of the Proposed 'Amendment of Land Use Plan
( Zoning) Ordinance was read at this time as per advertised Notice. No written or oral
protests were offered.
Ordinance No. 353 (New Series) - An Ordinance reclassifying as M =1 District
that area described as Lots 1 to 7inclusive, Imperial Addn. etc, was passed to print on
motion of D.M.Cnrpenter, seconded by Frank V. Wiids upon the following roll call -votO:
Ayes: D.M.Carpenter, Paul W. Davis,'Fred Lucksinger, Frank V. Woods,Timothir I.O'Reilly
Noes: None
Absent: None
Ali matters pending in connection with the Hearing and award of the bid on the
Foothill Sanitary Imp. District project were continued at this time.. Mr. E...A. Wilson
stated that all individual assessments in the district had been re- computed. The
Council overruled all protests and awarded the contract.
Resolution No. 1038 (New Series) - Resolution ordering changes in Assessments
was read. On motion of Commissioner Fred Lucksinger, seconded by Pau1W. Davis, and
unanimously carried, said Resolution was adopted.
Resolution No. 1039 (New Series) - Overruling Protests on Resolution of In-
tention No.1026 (N.S.) was read...On motion of Councilman Fred Lucksinger, seconded by
Paul W. Davis and unanimously carried, said Resolution was adopted.
Resolution No. 1040 (Neia Series) - an Order Adopting Engineer's Report,
confirming the Assessment and Ordering the work was read. On motion of Councilman
Fred Lucksinger, seconded by Paul 14.Davis, and unanimously carried,said Resolution was
adopted.
Resolution No. 1041 (New Series) - of Award of Contract was read. On motion
by Councilman Fred Lucksinger, seconded. by Paul W.Davis and unanimously carried, said
Resolution was adopted.
Resolution No.1042 (New Series).- Determining that public interest and
necessity require the acquisition of easements and directing the filing of eminent
domain proceedings was read. On motion•of Fred Lucksinger, seconded by Paul W. d)avis
and unanimously carried, said Resolution was adopted.
Resolution No. 1043 (New Series) - Accepting Deed of Easement was read.
On motion of Paul W. Davis, seconded by Fred Lucksinger and unanimously carried, said
Resolution was adopted.
Communications: Card of thanks from Miss Sinsheimer and brother Re: message
of sirmpathy was ordered received and filed on motion of Frank V.Woods, seconded by D.M.
Carpenter.
Communication from Frank Sorenson Re: damage caused by grass burning crew was
referred to the Commissioner of Public Works on motion of Frank V.Woods, seconded by
D. M. Carpenter.
Communication from G. B. Peterson Re: purchase of radio parts was referred to
the Commissioner of Supplies on motion of Paul W. Davis, seconded by Frank Woods.

Communication from Frank Garzoli submitting-his resignation fromthe Police Dept.
and on motion of Frank V.Woods, seconded by D. M. C„rpenter, the resignation was accepted.
Communication from Chas. Strom submitting report on street meter survey was held
pending study of Off Street parking on motion of D.M.Cargenter,'�.seconded by Timothy
I. O'Reilly,
Communication from San Luis Obispo Cit;r Schools Re: standby charcre for fire line wa:
referred to the Commissioner of Public Works on motion of Paul W.Davis, seconded by Fred

Communication from Paul Tritenbach Re: landscaping City Hall grounds was referred
to Commissioner of Public Works, with power to act, on motion of Frank Woods, seconded
,y Paul T" /. Davis.
Ordinance No. 352 (New Series) - An Ordinance levying a tax for the current
fiscal year 1951 -1952 upon all taxable property within the City of San Luis Obispo and
fixinP7 the rate of such tax was finally passed onmotion of D. M.mCarpenter, seconded by
Timothy I. O'Reilly upon the following roll call vote:

Claims against the City for the month of August were ordered paid subject to the
approval. of the heads of the respective departments and the Mayor.
Pavment Request No. 9 by Maino Construction Co. in the amount of $ 12,030:37 on
later Filtration Plant was presented to the Council and on motion of D.M.Carpenter, secondec
y Timothy I. O'Reilly, the work was approved and accepted and payment authori -ed.
The application of Gerry L. Rosendahl for registration as Class "E" Contractor
oaether with St.. Paul Mercury Indemnity Co. bond inthe amount of $500 and registration
ee of 4$15.00 received ar_d on motion of Paul W.Davis, seconded by Timothy I. O'Reilly,
t was ordered that the surety be 'accepted, bond approved and registration granted.
It was ordered that Virgil Negranti beallowed a credit' of $300 on Foothill Sewer
ssessment and further ordered that D. Bressi be allowed a credit of $465.30 pending

,hefiling of affidavit of cost, on motion of Frank" V.W -dods, seconded by Paul W. Davis.
Old Business
On motionof Fred Lucksinger, seconded by Frank 'floods it was-ordered that
=arrett Motors be awarded the bid on a 2 -ton Studebacker Dump Truck in the amount of
A3094.74 plus 3'4) Sales Tax $ 92.82 - total V3187.36'-:and..Standard Motors Imc. be awarded
the bid on 4 -1/2 tom pickup trucks in the amount of 4$5765.28 plus 3% Sales Tax, and the
cashiers'checks be returned to the unsuccessful bidders.

By common consent of the Council, Citir Engineer, G. Homer Hamlin was granted
rrnission to leave the State during his vacation period,
Commissioner D.M. Carpenter was authorized to hire two truck and equipment drivers
n the Public Works Dept.
The City Clerk was instructed to advertise for bids for the paving of Santa Rosa
t. from Marsh St. to Southern Pacific R.R. R /w; Bids to be opened at 7:30 "P.M. on Sept.
7, 1951.
