The Council t;et in regular session; Mayor Fred H.Lucksinger presiding. Present: Nels Beck, Paul W.Davis, Richard E.'Gragg, Kenneth W. Jones, Fred H.Lucksinger Absent: None The application for city license for Palmistry filed by Katherine Merino dba "Madam Kaye" was denied on motion of Kenneth Pl.Jones, seconded by Nels Beck upon the following roll call vote: Ayes: Nels Beck, Kenneth W.Jones, Fred H. Lucksinger Noes: Paul W.Da3ris, Richard E. Gragg. Mr. Harry Morris of the Insurance Firm of Bachino & Stockird presented the proposal for Fire Insurance coverage for city property, and on motion of Paul W.Davis, seconded by Kenneth W.Jones the insurance proposal was accepted. On motion of Paul W.Davis, seconded by Nels Beck the City Clerk was authorized to sign application for Average Rate to Pacific Fire Rating Bureau. The minutes of the meeting of July 20th, 1953 were approved. Claims against the city for the month of August, 1953 were ordered paid, subject to the approval of the heads of the respective departments and the Mayor. Ordinance No. 385 (New Series) - An Ordinance levying a tax for the current fiscal year 1953 -54 upon all taxable property within the City of San Luis Obispo, and fixing the rates of such tax was passed to print on motion of Paul W.Davis, seconded by o Richard E. Gragg upon the following roll call vote: Ayes: Nels Beck, Paul W.Davis, Richard E. Gragg, Kenneth W.Jones, Fred H.Lucksinger Noes: None Absent: None Mr. Paul Davis reported to the Council regarding meeting with Mr. Fletcher of the Public Administration Service explaining their medhot of conducting a salary survey. Mr. Davis stated that arrangements have been made to have a salary survey for San Luis Obispo to start by Sept. 1, 1953, Communications: Communication from the Bank of America Re: depositing parking meter money was referred to the Commissioner of Finance with power to act on motion of Paul W.Davis, seconded by Fred H.Lucksinger. Councilman Nels Beck reported on the second meeting held by the County -wide group working on the problem of runaway trucks on the Cuesta Grade. After discussion, the Council, on motion of Kenneth W.Jones, seconded by Richard E.Gragg , authorized Councilman Nels Beck to write a letter to the County Board of Supervisors in support of a reduction of the speed limit on the Cuesta Grade to 45 mph for passenger cars and 30 mph for trucks and a second letter to the California Highway Patrol urging that they 30 place the Santa Margarita scales on a 24 hour-operation to check loads, brakes and to warn truck drivers of the hazardous Cuesta downgrade. On motion of Nels Beck, seconded by Paul W.Davis, the Council confirmed the charge in status of R.E.Heidorn for Police Chief to Police Captain at $'396.00 per month and the appointment of Lawrence Elsea as Acting ChiEf of Police at no increase in pay, effective) August, 1, 1953. Mr Richard Miller and Mr. Homer Hamlin reported to the Council the arrangements have been made for getting the trailer out of the creek at the corner of Monterey and Nipomo Streets. Communication addressed to Headquarters,: Sixth Army Re: Water Application was ordered received and filed on motion of Kenneth W.Jones, seconded by Richard E. Gragg. Communication from Dr. Dennis J. Sullivan Re: sick leave for Wm. Terra, Public Works Dept., on motion of Paul W.Davis, seconded by h els Beck, Mr. Terra was granted sick leave up to the number of days he had coming. Communication from Edward N.Skinner Re: .removal of a pepper tree in front of 219 Cypress St., causing damage to sewer line; on motion of Kenneth W.Jones, seconded by Richard E. Gragg, the matter was referred to the Commissioner of Public Works, with power to act. Communication fron David Hildebran, County Coordinator, Operation Skywatch, Re: for leaflet drop was referred to Mr. Gullickson, Asst. Director of Civil Defense with power to act, on motion of Richard E. Gragg, seconded by Kenneth W.Jones. Communication from David Hildebran Re: for correction of bad road conditions to the approach of the Observation post on top of Terrace Hill. On motion of Richard E.Gragg, seconded by Kenneth W.Jones, it was referred to the Commissioner of Public Works, with power to act. Communication from H.G.Sworthout, Sewer Plant Operator, requesting retirement, effective Sept. 1, 1953,- Mr. Paul Davis recommended that his request be accepted and thank him for his many years of service to the City. Motion carried. Communication from the Mayor of the City of.rresno was ordered received and filed, on motion of Paul W.Davis, seconded by Nels Beck. Communication from Eugene K. Sturgis of the law firm of Sturgis- den -Dulk, Douglass & Henes, explaining the benefit of the 1911 Improvement Bond Act, over the 1913 Bond Act, and urging that any future Improvement Bonds be under the 1911 Act was ordered received and filed on motion of Nels Beck, seconded by Richard E; Gragg. Mr. Theodore Willoughby appeared before the Council and proposed that he place (Refuse Cans on the downtown streets of the city and that he sell advertising to go on the cans. Mr. Willoughby will carry public liability insurance on said refuse cans and will maintain them in good condition. On motion of Kenneth W.Jones, seconded by Richard E. Gragg it was moved that the city accept Mr. Willoughby's offer on a two year basis and the following Resolution was passed and adopted: Resolution No. 1235 (New Series) - A Resolution providing for the Execution of Ian Agreement with Theodore Willoughby was passed and adopted on motion of Kenneth W.Jones, seconded by Richard E. Communication from the Division of Highways Re: apportionment of July, 1953 payments of gas tax allocation was ordered received and filed. Re: Rider to change amount of bond on behalf of J.Earle Boyce, City Treasurer, from $12,000 to ,,25,000 was accepted on motion of Kenneth W.Jones, seconded by Richard E. Gragg. Communication from U.S. housing and Home Finance Agency Re: quitclaim deed - Project Calif. 4 -151 F- Water Supply Facilities; on motion of Kenneth W. Jones seconded by Richard E. Gragg, deed was accepted and the followirig.Resolution was adopted: Resolution No. 1236 (New Series) - A Resolution authorizing City Clerk to accept and record quit claim deed from the United States of America was passed and adopted ' on motion of Kenneth ;V. Gragg, Kenneth W.Jones, Fred H.Lucksinger Noes: None Absent: None Communication from the Fidelity and Casualty Co. of New York Re: bond held in name of Dr. Horace Hagen for improving Sydney Street from Johnson to Augusta St. On motio of Paul W.Davis, seconded by Nels Beck, the City Clerk was instructed to notify the Bondin Company that the City no longer holds the Bonding Co. liable and release them from any obligation. The following requests for transfer of licenses were granted rn motion of Paul ' W.Davis, seconded by Richard E,Gragg: Transfer of the E & E Cafe from G. Edmond Rose to John C. Lee Transfer of Laundromat at 675 Higuera St. to L.A.Cook The report of Willeford & Wiltshire , C.P.A. for Fiscal Year ending June 30, 1953 was ordered received and filed on motion of Paul W.Davis , seconded by Kerreth W.Jones. The reports of the City Treasurer for the months of April, May and June, 1953 and the minutes of the Planning Commission for July 16, 1953, were ordered received and filed. Ordinance No. 384 (New Series) - An Ordinance of the City of San Luis Obispo prohibiting the trespassing upon land posted as private property, etc. was finally passed on motion of Paul W.Davis, seconded by Richard E.Gragg upon the following roll call vote: Ayes: Nels Beck, Paul W.Davis, Richard E.Gragg, Kenneth W.Jones, Fred H.Lucksinger Noes: None Absent: None Request from Chas. Lewelling Re: Amendment to Ordinance governing Card Tables to operate after 12 o'clock midnight was referred to the Commissioner of Public Health ' and Safety for investigation and report back to the Co,,:ncil on motion of Kenneth W. Jones, seconded by Richard E. Gragg. At this time, Mr. M.J. Anderson of the Anderson Hotel appeared before the Council: protesting street noises doing harm to the hotel business, specifically, the noises from the adjoining bars and the garbage company pick -up in the early morning hours which dis- turb the patrons of the hotel. Mr. Anderson requested that the City Ordinance in effect, be enforced. Mayor Lucksinger appointed the following committee to investigate and report back to the Council. �1 32 Councilman Nels Beck and Kenneth W.Jones, City Attorney George Andre and Acting Chief of Police, Lawrence Else &. At this time, Mr. Frank Cheda protested the poor construction for drainage in -:the underpass at Chorro Street and the Freeway. No action taken. On motion of Kenneth YV %Jones, seconded by Nels Beck the City Clem was authorized to advertise for bids for one -half ton pick -up truck for the city fire department. On motion of Richard E. Gragg, seconded by Kenneth W.Jones, it was moved that the Agenda for all Council meetings will be closed at 2 P.M. on the Friday preceding the Council meetings. Mr. Nels Beck brought up for discussion, the construction of the new Fire Station 12. On motion of Nels Beck, seconded by Kenneth W.Jones, the contract for construction of the Fire Station #2 was awarded to the Maino Construction Co. in amt. $36,137.00. Resolution No. 1237 (New Series) - A Resolution authorizing Quit claim deed to the State of California was passed and adopted on motion of Kenneth W.Jones, seconded by Richard E.Gragg upon the following roll call vote: Ayes: Nels Beck, Paul W.Davis, Richard E.Gragg, Kenneth W.Jones, Fred H.Lucksinger Noes: None Absent: None Communication from O.H.Haddock, Police Officer, notifying the Council of his resig- nation effective August 3, 1953, and asking for allowance of two weeks vacation due him. The request was granted and resignation accepted on motion of Nels Beck, seconded by Fred H. Lucksinger. Mayor Lucksinger nominated Banning Garrett to the Park & Recreation Commission to fulfill the unexpired term of Wm. T.Smith. Kenneth W.Jones, seconded by Nels Beck. The nomination was accepted on motion of Mayor Lucksinger instructed the City Cleric that in the future he is to take care of the insurance for the city and was approved on motion of Paul W.Davis, seconded by Kenneth W.Jones. The City Attorney was instructed to d^aw up Resolution Re: City Employees who do not pay their bills will be subject to dismissal at the discretion of the Council. Ordinance No. 386 (New Series) - An Ordinance providing for the acquisition of certain real property by the City of San Luis Obispo from J.W. Fisher was passed to print on motion of Kenneth W.Jones, seconded by Nels Beck upon the following roll call vote: Ayes: Nels Beck, Richard E.Gragg, Kenneth W.Jones, Fred H. Lucksinger Noes: None Absent: None Abstain: Paul W.Davis Communication from Wm. Rooney Re: placing of a cyclone fence along Third Street that borders the ball field at Santa Rosa Park was read; the Mayor will investigate and report back to the Council. The City Clerk was authorized to advertise for sale at Public Auction the city's surplus automobile- 1948 Pontiac 4 Door Sedan, to be sold on August 17, 1953 at 8 P.M. The City Clerk was authorized to advertise for the sale of the surplus "Burroughs Accounting Machine ". Resolution No. 1238 (New Series) - A Resolution relating to Boulevard Stops was passed and adopted on motion of Kenneth W.Jones, seconded by Richard E.
