Present: Nels Beck, Paul W.Davis, ''jarren G.Edwards, Kenneth 'uu.Jnnes, Fred H.Lucksinger Absent: None The Minutes of the meeting of April 4th, adjourned meeting of April 7th and Special Called Meetingcf April 12th, 1955 were approved. Claims against the City for the month of April, 1955 were ordered paid subject to the approval of the heads of the respectivedepartments and the Mayor. Re: Report of the City Clerk on Bids opened for the following projects: (A) PHILLIPS SFNDICATE- TAYLOR TRACT - SLACK TRACT STREET IMP. A.J. Ochs & Son 10,280.70 16,119.50 10,200.00 On motion of Paul ti-i.Davis, seconded by Kenneth 11.Jones, the Bid of O.R.Ochs & Son for Waterline replacement Project W -55 -2 was awarded, for the sum of $10,200.00 Motion carried. At this time the City Council held a PUBLICHEARING on the PHILLIPS SYNDICA`1'E- TAYLOR TRACT- SLACK TR.-'.CL and RAMGNA DRIVE ET AL STREET IMPROV MENT PROJECTS. The Steering Committee consisting of the following residents of the Phillips District are as follows: Mart Rosenthal Herman Schinbine Joe Arsenio Harry Albert Wayne Rudolph Dr. A.L.Houk Sam Coull Tom Baumburger John Pedroni Dr. Campbell Howard Brown E.H.Atkinson This committee recommended that the Council study the following possible corrections or changes to the PHILIPS DISTRICT estimate:- ' 15. IteT; 1 - Six inch of base instead of the eight inch base. Item 2 - Standard widths of streets be paid by the District and any additional widths to be paid for by the City. Item 3 - That all survey boxes and monuments bepaid for by the City. Item 4 -_ That a substitute fog coat be placed on the streets instead of the present plan of seal coat. Item - That all water and sewer lines that are being moved or lowered be paid at the expense of the City. Item 6- That contingencies be reduced from 10% to 5%. Item 7 That the expense of the inspection and staking be paid for out of the City Engineer's funds. The City Council told the committee they will take all their questions under advisement. Mr. I''Iart Rosenthal , Chairman of the Committee then presented an envelope with 120 signed protests for the Council's consideration. Mr. Joe Arsenio , ( Phillips District) stated that in his opinion, the residents of the Proposed Street Improvement Listrict do not protest the establishment of said district but they believe that some of the costs can be reduced and that the City assume more of the share of this improvement, and with the cost lowered, he was sure the district wanted to go ahead as rapidly as possible. Mr. Chas Suck, Attorney at law, appeared before the Council on behalf of Mr. John Pedroni regarding the unlawful and illegal assessment made on his client's property, as a portion of this property is separated by a 10 ft. strip on the north side on which his client is cut off from Graves Street, but that his client is being assessed for the' curb and gutter on Graves Street. Mr. Buck stated that his client receives no benefit from the paving on Graves Street. Mr. Buck referred to the protest filed by his client with the City Clerk. Mr.Allan W.Campbell asked the Council that Lot 22, Block 1 of Monterey Heights be eliminated from the Assessment District as this lot faces on Buena Vista, and any. benefits derived from this district would be applied to lot 23, therefore, he requested that the assessment be placed against Lot 23, Block 1, of Monterey Heights and that no be placed against Lot 22 as this lot is being sold and will derive no benefit from this district. At this time, Mr. Ed Atkinson presented to the Council, a chart or sketch of several crossings in the Proposed District, showing discrepancies in the FRONT FOOT COST, Mrs. Fred Johnson told the Council that she thought the bids that were received by the City were very good and that the project should be awarded and be started immediately. Mrs.Vincent Rombalski asked the Council why McCollum Street was being assessed for street improvement as it was once paved by the County and would like to know if the residents of this street will be required to pay the same proportions the people who live on streets that were never paved. PIr. blm. Dresser stated that he believes that with such a low bid having been received by the Council, that the Council proceed with the establishment of the Special Assessment Digtriot and put the improvements in as every one wants the streets and that the small problems can be ironed out as the job progresses. Air. David Cook appeared before the Council and stated that in view of the low bid received on this project, and that the majority of the people are really in X. of this district, he would like to see the project started immediately. Mr. Anderson asked the Council to study the varied widths of streets in this area, and would the paving on all streets be the same. lit this time the Council heard Protests on the RAPIONA- KEPTTUCKY- HOWARD STREET IMP. DISTRICT. Mr. P: Maughmer ( Unit "B"- Lot 2, Block 5, Hathway Addn. )- asked the Council why he was assessed for curb and gutter and street paving on Second Street when his residence faces on Howard Street and that Second Street was already paved when the Freeway was put in. Mr. Kirk, representing Mrs. Hecker, believes that the assessment for curb and gutter on Second Street is wrong as she already has a paved street and is in good shape. Mr. Ralph Vorhies ( RAMIOYA DRIVE ET AL PROJECT) asked the Council what percentage of reduction would be granted to Unit "A" District, due to the low bid received below the Engineer's estimate. Mrs. Loretta Blair stated that all the people on Ramona Street want the street improvement in as soon as possible as they have been after the City Council for many years to improve the street. 1 I� �II �J 1 1 7 1 D 1 Fir. Woodland asked regarding the assessment on Kertucky Street and wanted to know if this assessment was only for paving and fdr curbs and gutters where it does not exist at the present time or does this also include water line improvement and fire hydrants. Mir. Rombalski ( Phillips Imp. District) asked the Council when the pavement was placed on McCollum St. if the crown would be lowered from what it is now as cars backing out of driveways or. McCollum St. scrape their bottoms on the crown. 11:r. John Pedroni presented to the Council for their investigation and study, a survey of his property made by Burch and Beck, licensed surveyors. Mayor Lucksinger stated to the people present that the Council will study all questions and problems that were brought up at this meeting, prior to awarding any bids or restablishing the Assessment District. He also thanked the Steering Committee of the Phillips area for their help in tr39ng to arrive at a fair and equitable assessment. The Mayor announced that the City Council will meet Thursday, :'Lpril 21, 1955, for study meeting to investigate all problems and questions brought up at this meeting. On motion of Paul W.Davis, seconded by Nels Beck,, it was moved that the PUBLIC HE:'RING on the establishment of the Special Assessment District for the PHILLIPS AREA and the RAMONA DRIVE ET AL area be continued to Monday, April 25, -IL955 at 7:30 P.M. Notion carried. Mr. Ed Atkinson asked the Council if the Steering Committee could use the Council Chamber so that all people in the district would know what their final assess- ments will be before the City makes their final decision. Communications: Communication from Rose McKeen, General Chairman of the Mission Gardens Plaza was ordered received and filed on motion of Nels Beck, seconded by Kenneth W.Jones. Communication from the Board of Fire Underwriters with reference to resurvey of fire protection was ordered received and filed on motion of Kenneth W.Jones, seconded by Nels Beck. Communication from the Office of Civil Defense was ordered received and filed on motion of Kenneth W,.Jones, seconded by Warren G.Edwards. Communication from California Safety Council Re: Report of the Traffic Safety Crusade was ordered received and referred to the Budget Committee on motion of Paul W.Dakis, seconded by Kenneth W.Jones. Communication and invitation to attend the Elks 12th Annual rodeo in Santa i4aria on June 5, 1955 was ordered received and filed on motion of Warren G.Edwards, seconded by Kenneth W.Jones. At this time Mavor Lucksinger appointed the following committees to investigate and prepare plans for acquisition of property for "Off- Street Parking" purposes and also to investigate the possibility of "Lease Purchase. Plans." Nels Beck was appointed Chainnan to investigate the acquisition of the Old Mission Garage property on Chorro and Monterey Streets. Warren G.Edwards, to investigate the Maggie Brown property on Broad and Marsh Streets. i.enneth W. Jones, to investigate the property on iliarsh Street adjoining the Post Office property. On motion of Kenneth W.Jones, seconded by Warren G.Edwards, the Report of the Police Dept. and the Building Inspector for the month of March, 1955 were ordered received and filed. On motion of hels Beck, seconded by Paul W.Davis, the following Salary Step Increases were granted, effective May 1, 1955 : - Angela Chadwick - Secretary- from Step 3 to Step 4- $ 268.00 per mo. Jerry Frederick - Police Officer - from step 2 to step 3 - 317.00 " " .The request of the Chamber of Commerce was referred to the Budget Committee on motion of warren G.Edwards, seconded by Kenneth W.Jones.
