City Hall, Monday, April 25, 1955- 7:30 P.M.
The City Council met in adjourned session to continue the PUBLIC HEARING
on the PHILLIPS SYNDICATE- TAYLOR TRACT -SLACK TRACT STREET IMP. DISTRICT and on the
RAMONA DRIVE - HOWARD STREL'T- KENTUCKY STREET IMP. DISTRICT.
Present: Nels Beck, Paul W.Davis, Warren G.Edwards, Kenneth W.Jones,Fred H.Lucksinger
Absent: None
Resolution No. 1445 (New Series) - A Resolution establishing the Policy
of the City of San Luis Obispo in regard to the paving of present existing unimproved
dedicated streets was passed and adopted on motion of Kenneth W.Jones, seconded by
Warren G.Edwards upon the following roll call vote:
Ayes: Nels Beck, Paul W.Davis, Warren G.Edwards, Kenneth W.Jones, Fred H.Luck si nger
Noes: None
Absent: None
At this time, the Mayor declared the PUBLIC HEARING opened for the formation
of the above mentioned SPECIAL ASSESSMEVT DISTRICTS:
Mr. Helen Baumberger appeared before the Council on a point of order regarding the illegal
and unlawful use by the self - appointed Steering Committee and abetted by the City
Council in preparing letters withdrawing Oo'tests to the district then on fibs iwith
the city. She further stated that the people of the district have not had an oppor-
tunity to meet with the so called steering committee to find out the results of the meet-
ing with the City Council, so that the people in the district could make a decision as
whether to go ahead or not.
After some discussion between Mrs. Baumberger, Mr. Atkinson and Mr. Arsenio, Mr. Atkinson
requested that the Council give the group an opportunity to discuss the Phillips Imp.
District problem before the Council made a decision.
Mrs. Fred Johnson then stated that she did not sign any protest against the di-trict
and that there were many more in the district who did not sign such protests and all they
wanted was the district to proceed and construction to start.
On motion of Kenneth W.Jones, seconded by Warren G.Edwards, it was moved that the Council
take a recess so that the self appointed committee could meet with the residents of the
PHILLIPS ADDITION IMP. DISTRICT regarding the formation of the Assessment District.
The meeting reconvened at 9:15 P.M. Mr. Mart Rosenthal presented 63 letters from
people iii the district withdrawing protests then on file with the City.
At this time Mr. Harold Blake, Mr. George Pearson, Mrs. Baumberger and Mr. Dresser
and several other interested residents of the Phillips area, left the Council Chamber
at the request of the council to check the number of protests that were withdrawn and
the letters presented by Mr. Rosenthal inorder to determine whether there was a majority
of protests or not.
On motion of Nels Beck, seconded by Kenneth W.Jones, Mrs. Genevieve Vance was appointed
as stenographer in the Police Dept., Step #1 - $215.00 per month, effective April 11,1955•
On motion of Nels Beck, seconded by Kenneth W.Jones, Mr. Richard H.Rayburn was
appointed as Police Officer, Step #1 - -';?'284-00 per month, effective May 1, 1955•
The request of t.l:e Police Dept. for authorization of position of " typist- clerk"
in lieu of replacement of Police Officer for Wm. Kiger, who is retiring, was held over.
The Mayor requested that Mr. Richard Millar and Chief Burns write a letter to the Council
regarding the elimination of one police officer and replacement of position of '" typist -
clerk".
A letter from the Library Board regarditgthe dedication of the new Library to be
on May 15th, 1955 was read to the Council and the City Clerk was instructed to write to Mr.
David Grant, Secretary of the Library Board, that the.City Council had received his letter.
Resolution No. 1446 (New Series) -- A Resolution accepting,Deed of Easement from
Johnny Perez et al was passed and adopted on motion of Kenneth W.Jones, seconded by
Warren G.Edwards upon the following roll call vote:

The Mayor announced that this was the time and place for the hearing on Resolution
o. 1426 (New Series) of Preliminary Determinatiofi and of Intention and the Engineer's
eport. All written protests were read by the Clerk. The Iviayor asked if there was anyone
resent desiring to be heard. All those desiring to speak were given the opportunity.
11 written and oral protests were duly considered by the Council and the hearing ordered
losed.
On motion of Paul W.Davis, seconded by Kenneth W.Jones, it was moved that no work
was to be done on Second Street between Howard and Kentucky St. on this assessment project.
Resolution No. 1447 (New Series) - Resolution Overruling Protests on Resolution
No. 1426 (New Series) of Preliminary Determination and of Intention- RAMONA DRIVE ET AL.
STREET IMPROVaTENT- Project No. S 55 -1 was passed and adopted on mot ior_ of Paul W.Davis,
seconded by Nels Beck upon the following vote:

Resolution No. 1448 (New Series) - Resolution Ordering Reduction of Assessments,
as passed and adopted on motion of Kenneth W.Jones, seconded by Paul W.Devis upon the
ollowing roll call vote:

Resolution No. 1449 (New Series) - Determining convenience and necessity, adopting
