Edwards, seconded by Nels Beck, the Mayor appointed Councilman Lowell E.Christie', to be Chairman of the Committee to study the financial statements of the Green Bus Service and if'this raise is justified for the continuance of the bus service; then the City Attorney would be instructed to write a letter to the Public Utilities Com- mission regarding the Council having no objection to the fare increase. Mr. Homer Hamlin, City Engineer, recommended to the Council, after some discussion with Mr. Richard ?Miller, Administrative Officer,., that Mr. VI.C.Long, who is presently too ill to work, to be allowed touse up his accrued sick leave, with pay, and then keep him on the "sick leave" without pay until he decides whether to retire or to return to work. The request was approved on recommendation of Mr. Miller and on motion of Warren G.Edwards seconded by Lowell E.Christie. Mr.: J. Cardoza of 1300 block on Broad St. appeared before the Council asking if there was any possibility of slowing down the speed of cars on South Broad St. as there are rpany children in this area and these cars whiz by at a tremendous speed and further stated that a long time ago the police used to patrol this area, but .claims he has not seen a police car there in many months. The matter was referred to the Traffic Committee for investigation and report. On motion of Nels Beck, seconded by ',warren G.Edwards, it was moved that the Council commence with ;;condemnation proceedings" on the Old rJlission Garage property for the acquisition of said property for " off - street parking ". Communication from George Couper, Chairman of the City Planning Commission regarding action taken by the Planning Commission at their regular meeting of August 18, 1955 was ordered received and filed. For Council's information: Appointment of George Angeloni as vacation relief, City Hall custodian, from August 28th to Sept. 10, 1955 at X100. Comm. from Homer Hamlin, City Engineer, regarding the fact that heunderstands that the Divisiun of Highways will soon vacate their maintenance yard at Emily and Fletcher Streets. Mr. Hamlin believes that this yard would ve adequate for the city's maintenance yard for a long time, and he would like to investigate the possibility of purchasing this property for use by the Public Works Dept., also, he reported that the Southern Pacific MillingCo are interested in purchasing the present city yards on Santa Barbara Ave. and possibly the sale of the present yard could be placed against the cost of the ac- quisition of the new maintenance yard. Communication from Seth Kinney to the Council, was presented by Mr. Richard Miller Administrative Officer, regarding the business license of the Cactizona l:iater Service at 1254 Monterey St. The letter regarded Mr. Kinney's opinion that the service did not do any good and that.it might contaminate the city water system. therefore, made the issuance of the permit contingent upon the installation of a check valve and syphon breaker between the device and the city main on all homes that this device is placed on. The communication from Bob Tway, Com ^ittee Chairmanof the S.L.O.County Bowmen asking permission to use portions of property known as Reservoir Canyon for an archery range was referred to the Citv Clerk, City Engineer and Water Supt. to meet with the rep- resentative of the S.L.O.County Bowmen to go over their request. The communicationfrom the members of the Pvission Gardens Plaza PlanningCommittee was ordered received and filed and the City Clerk was instructed to write a letter to Mrs. Rose McKeen stating that the City Council had already taken steps for condemnation of the former Mission Garage property for acquisition by the City. At this time the Council held a Public Hearing as advertised, for considering an amend- ment to the Zoning Ordinance reclassifying certain portions from C -1 to C -3 and R -2 to R -3 in the vicinity of High, Upham and Broad Streets. Mir. Paul Davis appeared before the Council -on behalf of the people who opposed the re- zoning to C -3. Mr. Davis eloquently challenged the legality of the Notices published by the Planning Commission and the procedure used by said commission. Mr. Paul Davis further stated the majority of the area in question is being used as residential property and not t1 Commercial" and that the people oppose the change to C -3, particularly, as the C -3 zone is just one step above the "M1t zone or Heavy industrial. Mir. Davis stated that most of the area is residential and not commercial. Mr. Davis warned the Council that if they allow this change from residential zone to light indutrial, they are opening the door for future 11 Soot Zoning" changes. I,rs. John Hemstreet appeared before the Council supporting the decision of the Planning Commission in charging the zoning to C -3. Mrs. Hemstreet gave to the Council, a brief history of the growth of this area and of the zoning changes. Mfr. Ed. Rodriguez_ appeared before the Council supporting the decision of the Planning Commission to change the zoning to C -3. The City Clerk read a letter from the City School Board requesting that area NOT be zoned to heavy commercial due to the proximity of the City School and the amount of children going to and from the school each day. Mr. Houser, City Attorney, informed the Council that in accordance with the Municipal Code of the City of San Luis Obispo, that the correct legal steps were used, both by the City PlanningCommission and the Council in the matter of publishing notices and Public Hearings. 'after some discussion by the Council the matter of rezoning washeld over on motion of Nels Beck, seconded by Warren G.Edwards to a Special 1,ieeting to be held at 6 P.M., Sept. 7th, -1955 for the express purpose of deciding the matter of this rezoning. At this time the City Council held a Public Hearing on the matter of amending the Zoning Ordinance by reclassifying as R -1 a Buffer strip, west and south of the Goldtree Homes. Mr. Richard Pimental appeared before the Council on behalf of the residents of the Goldtree Homes, urging the Council to approve this Buffer Strip in order to protect the residential character of the area. He further urged the Council to support the action of the Planning Commission in setting up this Buffer Zone. 1 1 1 n 1 1 C I Ordinance No. 5 ( 1955 Series) - An Ordinance amending Section 9200.5 of the San Luis Obispo Municipal Code by reclassifying as R -1 certain real property in the City of San Luis O,ispo was finally passed on motion of Warren G.Edwards, seconded by Lowell E. Mr. Hamlin presented a letter from the Valley Paving Co. reporting to be their schedule of completion dates of the various phases of the projects. i-ir. Hamlin introduced Mr. Calvin Schlegel, Supt of the Valley Paving Co. to the Council who answered questions of the Council regarding certain details in the completion of the Street Projects. The Mayor thanked Mr. Schlegel for being present and asked Mr. Hamlin to report on the status of these projects at each Council meeting from now onuntil completed. Crdinance No. 16 ( 1955 Series) - An Ordinance adopting a Fire Prevention Code prescribing regulations governing conditions hazardous to life and property fro,m fire or explosion, etc. was passed to print on motion of Kenneth Y '9. Miller reported to the Council on the condition of Mr. W.L.Burns, Police Chief, and asked that he be allowed to give Mr. Burns up to 30 days more sick leave due to the fact that he is a department head and that he spends many hours of extra time for which he receives no compensation and time off; on motion of Nels Beck, seconded by Lowell E.Christie, Mr. Miller's recommendation was approved. 83
