The minutes of the meeting of February 6, 1956, were approved as presented.
Claims against the -City for the month of February, 1956, were ordered paid, subject
to the approval of the Administrative Officer, on motion of Kenneth W. Jones, seconded
by Lowell E. Christie.
Ordinance #18 (1956 Series) An Ordinance Amending Ordinance No. 16 (1955 -56 Series) Re-
lating to Two -Hour Meter Zones, was introduced and passed to print on motion of Kenneth �.

Resolution 443 (1956 Series) A Resolution Increasing the 1955 -56 Budget, Account Nos. 154
Phillips Street District Bond and No. 155 Ramona Street District Bond,.was passed and ,(

COMMUNICATIONS
1 - Comm. from San Luis Obispo County Road Commissioner proposing to widen and reconstruct
the Sewer Farm Road between Old State Highway 101 and the Freeway, as well as construct
a new bridge over San Luis Obispo Creek, was referred to the City Engineer and Mr. Miller
for investigation and report to the Council.
2 - Comm. from Civil Aeronautics Board denying a petition of the Southwest Airways Co.
to reopen Docket No. 6503, having to do with United Airways and Southwest Airways using
Santa Barbara and Monterey airports, was ordered received and filed on motion of Kenneth
W. Jones, seconded by Warren G. Edwards.
3 - Comm. from Department of Finance, from John M. Peirce, Director, expressing support of
the proposed sale of land by the California Polytechnic College to private investors for
construction of housing for students at Cal Poly, was ordered received andf`iled on motion
of Warren G. Edwards, seconded by Lowell E. Christie.
4 - Comm. from the Schooner Club commending the City Council for passim on the drunken- i4 z

The notice from the State of California - Department of Public Works - Division of Water
Resources, regarding the application of Anson Lisk, Santa Margarita, for permit to appropri
ate unappropriated water at the Salinas Reservoir, was ordered held over until the next %>
meeting, so that the Water Superintendent would have an opportunity to investigate the
application. I

State Employees' Retirement System was ordered received and filed. ?

The request of permission for Mr. Miller, Administrative Officer, to attend the City
Manager's spring conference in Anaheim, February 29th to March 2d, 1956, was granted on
motion of Kenneth V.I. Jones, seconded by Warren G. Edwards.
Richard D. Miller, Administrative Officer, announced the appointment'of Joseph Carlon as
part -time Park and Ground maintenance man at $1.32 per hour.
On motion of Kenneth W. Jones, seconded by Lowell E. Christie, applications for contractor's
license for the following contractors, the bonds were approved, sureties accepted and
registration granted:

Mr. Thompson, ?dater Superintendent, reported that after studying the bids received for furns't
ishing two prefabricated buildings for the water department, that he recommended that the
bid of E. C. Livingston Co., Inc., of Five Thousand Seventy -Nine Dollars ($5,079.00) be
accepted. Mr. Miller, City Administrative Officer, reported to the Council that he con-
curred with Mr. Thompson and asked that the bid of E. C. Livingston Co., Inc., of $5,079.00
be accepted. On motion of Kenneth W. Jones, second-ed-7-y Lowell E. Christie, and on:the
recommendation of the Administrative Officer, the bid of E. C. Livingston Co., Inc., was
accepted for .15,079.00.

On the recommendation of Richard D. Miller, Administrative Officer, that William Flory
attend a meeting in Sacramento, April 4th and 5th., Governor's Conference on townhall
meetings for youth, was approved on motion of Warren G. Edwards, seconded by Kenneth W.
Jones.
PUBLIC HEARING
At this time the City Council announced that it would hold a public hearing on the advisa-
bility of inaugurating a special assessment district for sewer development and sewer
improvement in the Johnson Avenue area, east of Bishop Street.
Mayor Lucksinger asked that all people present that were interested, to take part in the
discussion, as the Council was attempting to get the best tiinking on this matter.
Mayor Lucksinger called on Mr. Hamlin, City Engineer, to explain the basic problems in
this project.
Mr. Hamlin explained the entire program regarding the sewer project planned for this area.

lines from this area to the sewer plant. Mr. Hamlin gave certain estimates of costs for
the property owners and emphasized that they were just estimates. For example, a 50 ft.
lot would pay approximately $350.00 if it were not served by sewer at the present time.
Mr. Don Coats, asked what happens to; people already on the sewer line and also why, was the
o dtree Tract exempted from this district.
Mr. Hamlin answered,- first.the people-already on sewer lines would not be requested to
pay any money for collection system but that they would be requested to pay a certain.
sum for transmission system approximately thirty dollars ($30.00). Secondly, Goldtree
Tract was exempted, as the residents of areas other than Goldtree and Hagen were informed
that they would be requested to pay for an additional or an enlarge transmission system,
except for the area between the Hagen Tract and the railroad right -of -way. Anyone above
this point would be requested to pay for an enlarged transmission system.
Eugene Mead said he believed that everyone should pay the cost of the transmission system
regardless of what they have paid before this, particularly the Goldtree Tract, which
did not contribute to the Hagen transmission line.
Miss Frances Sturgeon wanted--.to be sure that they were included in the purposed district
because they wanted sewer as.soon as possible.
Mrs. Zimmerman 'asked what would happen to the property which lies between Hagen Tract
and Sinsheimer School. Whether the cost would be based on front foot or acre basis.
Ken Smee wanted to know if it was necessary to hook on the sewer when installed on his
property, as his house is on an extreme end of a five acre parcel.
Mrs. Bonnie Beckwith wanted to know how soon they could get on the sewer in addition to
the formation of the district under consideration.
W. C. Hoover asked if corner lots would be assessed any higher than inside lots for
assessment purposes.
Bill Woodward asked if the sewer main would run on Johnson Avenue or Augusta Street.
Mrs. Burtch stated that she understood that the Hagen Tract had been reimbursed for the cost of
the transmission line "install'ed 'by ahem, and further that 'she believed 'that -they had no
right to be exempt because of the fact that they had already paid for the transmission
line did not mean a thing.
Mr. Hamlin stated, that no money had ever been paid to the Hagen subdivision or to the
people who had purchased property in the tract for the installation of the transmission
line from the tract to the nearest sewer main.
William McKeen asked what applied to his property, by that he meant would it be assessed
on a front foot basis or an acre basis.
Mr. Hamlin stated that it would include a portion of both front foot and acre, but it
would depend primarily on Mr. McKeen's plan for development.
Mr. McKeen also asked how long before this project could be completed and for how many
years would the bond be set -up for redemption.
Mr. Hamlin estimated that it would be sometime in the late summer or fall before construction
could start on the project, due to time involved in preparing plans and specifications
and other engineering details. The bonds could be let for a period up to 25 years, but
the normal procedure is to take the bonds for 15 years.
At this time, Mr. B1ake,Kirkbride, Wilson, Harzfeld & Wallace, discussed to the people
present the relative merits of the 1911 and 1913 act procedures as to saleability and
interest rates. Mr. Blake further stated the possibility of using a combination of acts
in order to get the lowest possible rate of interest.
Eugene Mead again asked what would stop the city from coming back later and assessing
the people for additional sewer system as is being done at the present time.
Mr. Hamlin answered that under the assessment procedures this would be practically im-
possible.
Don Coats stated that ha could not understand why at least 100 residents in Goldtree were
left out of the district.
J. R. Trainor believed that the Goldtree Tract should be included in the district as
everyone who uses the sewer system should pay for it.
Robert McGuire stated that he could understand the reason for Hagen Tract being left
out of the new district as they had already paid for transmission line, but he could not
understand why the Goldtree Tract was left out ".
Ira Sims asked if a sewer line would be placed to his lot as he is very interested in
getting sewer to his property. Mr. Sims further added, that at Morro Bay they had just
completed a special assessment district, and for his 50 ft. lot he had been assessed
$314.00, not including interest.
Mr. Schwartz, represented Goldtree Homes, stated he would like to have the Goldtree Tract
represented at future meetings and demanded that a postcard be sent them, notifying them
of said meetings.

At this time, Mr. Harald Nielsen, subdivider for Dr. Hagen in the formation of the Hagen
Tract, stated that each resident of the Hagen Tract paid over and above the individual
connection system of the tract; $190.00 per lot as a pro -rated cost of the transmission
line from the South limits of the tract to the sewer connection.
J. R. Shirmen stated that he wanted sewer and has been waiting for two years. He would li
to get started immediately.
Donald Smee asked if property not readily available.for sewer would be assessed at a lower
rate than property readily accessible to the sewer.
Mr. Hamlin said that the utility to the property would be taken into consideration when
spreading the assessments.
Mr. Blake, of Kirkbride, Wilson, Harzfeld & Wallace, reviewed many of the comments of the
people present, particularly the cost per acre for land that is not readily useqble for
improvement. He further suggested the possibility that the transmission lines be financed
by Special E bonds, to be paid from the ad valorem property tax and not included in the
special assessment district.
William McKeen asked Mr. Blake how the vote would be counted for the formation of this
district on the basis of area, valuation, or registered voters.
Mr. Blake answered, stating that there was no vote taken, that it was up to the Council to
determine it necessary for the formation of the district and then take whatever action
they thought proper at time the protest hearing was held.
D. Raymond asked how many acres would be included in this proJect.
Mr. Hamlin stated 320 acres approximately were involved.
Mr. Mead again stated that it was his belief that everyone on the sewer line should pay
an assessment, particularly the Goldtree tract. Mr. Mead asked the Council to keep this
in mind in making their decision on this matter.
R. E. Collet asked if Richard Street was an accepted street of the City.
Mr. Hamlin said no, that this wqs considered as a paper street and not included in the city,
assessment.
Mr. Lowell E. .Christie. asked, how much would the city be required to spend before the
start of the project and would this cost be lost if the majority of the people were against
the-project.
Mr. Hamlin stated the cost of preliminary engineering plans and specifications would cost
around 15,000. and could not be recoverable if the district did not go ahead.
Mayor Lucksin7er asked if anyone else had anything.else to add regarding the sewer assess-
ment district, if not, he would like to have Mr. E. Price Thompson, Water Superintendent,.
outline his plans for water development in this same area.
Mr. Thompson outlined the plans of the water department for an enlarger in the present
water system in this ar,a and the extention of new assessments which would project with
the growth of the district. He explained the plans for installation of large storage
systems for better pressure in this area and his plans for water main development.
There being no further comments and questions by the persons present the City Council closed
the public hearing and scheduled a Council study session for 7:30 P.M., Monday, February 27!
1956.
