City Hall The City Council met in regular session with Vice -Mayor Kenneth W. Jones presiding. Pledge Invocation by Rev. Kendall of the Methodist Church of San Luis Obispo. Roll Call: Present: Nels Beck, Lowell E. Christie, Warren G. Edwards, Kenneth W. Jones Absent: Fred H. Lucksinger The minutes of the meeting of October 1, 1956, were approved as presented. The claims against the City for the month of October, 1956, were ordered paid, subject to the approval of the Administrative Officer, on motion of Lowell E. Christie, seconded by Nels Beck. The City Clerk reported on the following bids received and opened October 15, 1956, at 3:00 P.M., for furnishing the City the following motor vehicles: Mr. Richard D. Miller, City Administrative Officer, recommends that the low bid in each case be accepted and that the Item No. 1, One Flat Dump Truck (1 ton) be awarded to Hysen- Johnson Ford for $2,711.00, plus tax; and that Item No. 2, One 2 Ton Dump Truck for $3,768.97 plus tax and Item No. 3, One J Ton Pick -up Truck for $1,098.97 plus tax, be awarded to Arland Chevrolet. On motion of Nels Beck, seconded by Warren G. Edwards, the recommendation of Mr. Miller was accepted and the bids awarded as recommended. Comm. from the San Luis Obispo Chamber of Commerce requesting financial help from the City of San Luis Obispo in placing a power line down the streets in the business district = �: on which to hang Christmas lighting was ordered held over for further study. 2. Comm. from Walter E. Austin regarding painting of pedestrian zone on the west side of Johnson Avenue, between the underpass and the general hospital area was referred'to the Traffic Committee. 3. Comm. from the San Luis Obispo City Schools requesting cancellation of City taxes on parcel of property purchased by the school system was referred to the City Attorney. � 4. Comm. from Charles E. Teach P.T.A. regarding: (1) Dog situation in the Teach School area; (2) Stop sign at Foothill Blvd. and Tassajara Street; (3) Stop signs on Cuesta and.; Felton ??.!ay, was referred to the Traffic Committee on motion of Lowell E. Christie, seconded by Warren G. Edwards; also that the Traffic Committee meet with the Principal of Teach School on these matters before reporting back to the City Council. 5. Comm. from the Salvation Army requesting permission of the City Council for a canteen solicitation of funds on the City Streets in downtown San Luis Obispo, November 12, 13., 14 and 15, 1956; the request was granted on motion of Warren G. Edwards, seconded by Nels Beck. 6.- Comm. from H. Neil Warren, Consulting Structural Engineer, to design and prepare plans and specifications for the future Johnson Street Overpass. Introduction of Resolution No. 135 (1956 Series) A Resolution Authorizing Hiring of H. Neil Warren, Consulting Structural Engineer, to Provide Complete Construction Plans & Specifications for Construction of Future Johnson Avenue Overpass was passed and adopted on motion of 1,1arren G. Edwards, seconded by Lowell E. Christie, by the following roll call vote: AYES: Nets Beck, Lowell E. Christie, Warren G. Edwards, Kenneth W. Jones NOES: None ABSENT: Fred H. Lucksinger - J 7 I _j Proposal of Milton E. iaTilleford, Public Accountant, submitting a proposal for the perfor of auditing services for the fiscal year ending June 30, 1957, was ordered held over for further study and consideration of local accountants for this audit. Decision No. 53850 before the Public Utilities Commission, State of California, regarding (1) Order authorizing the improvement of crossing at separate grade of the Johnson Avenue underpass by the City of San Luis Obispo and the Southern Pacific. Company; (2) Order of the Public Utilities Commission fixing just compensation for said Johnson underpass improvement; (3) Order of the Public Utilities Commission regarding maintenance operation of various crossings within the City of San Luis Obispo at Southern Pacific Railroad grade crossings; was ordered received and filed. At this time, Mr. Phillips asked that the City begin an appeal against the PUC order closing Osos Street and that if the action of the appeal fails, then they will begin a taxpayers' suit to get an injunction against the Southern Pacific Company not to close Osos Street. Mr. Houser, City Attorney, explained for the Council the steps that would have to be taken in order to appeal the decision of the PUC. He further stated that the only basis for an appeal would be that due process of the law was not followed in the hearings, or that additional pertinent testimony regarding the closing of Osos Street is.to be presented. Mr. Phillips again urged the City Council to proceed rapidly as possible in the appeal on the closing of Osos Street. Vice -Mayor Kenneth W. Jones suggested that Mr. Phillips meet with Mayor Lucksinger and City Attorney, Mr. Houser, to "see if there are any grounds for an appeal and on what basis it would be made. ce Mr. Jack Brown presented a letter and petition, signed by 38 property owners in the vicinity of-Higuera Street and the Southern Pacific Co. crossing, in which he states that the original petition had been forwarded to the PUC at San Francisco. Mr. Brown urged the City Council to do all in their power to see that the Higuera crossing not be closed and further that the City Attorney begin whatever legal steps necessary to appeal the order of the PUCI in the closing of Higuera Street. Vice -Mayor Jones suggested that the City Council should hold a study session and possibly call a special meeting to decide what could be done regarding an appeal from the Order of the PUC regarding the Osos Street and Higuera Street crossings. Mr. Jones further stated that Mr. Phillips and Mr. Brown would be notified if and when the Council held the above meeting. Mr. Phillips asked that the meeting be held in the afternoon after 3:00 P.M, The financial report of the Chamber of Commerce for the month ending September 1956, and minutes of the regular board meeting of the San Luis Obispo Chamber of Commerce of September 10, 1956, was ordered received and filed on motion of Warren G. Edwards, secondec by Lowell E. Christie. On motion of Warren G. Edwards, seconded by Lowell E. Christie, the following contractors registration applications were granted, bonds approved, and sureties accepted: M. D. Hodges - General - Class nCn On motion of Lowell E. Christie, seconded by Nels Beck, the report of the fire drill held September 27, 1956, was ordered received and filed. On motion of Warren G. Edwards, seconded by Lowell E. Christie, the following salary step increases were granted effective November 1,.1956: ;Waldron, Burke V. - Adm. Assistant - From Step 3 396 to Step 4 $419 Bowman, Ruth - Typist Clerk - From Step 2 1,31 hr. to Step 3 $1.39 hr. Garzoli, Frank J. - Police Officer - From Step 3 336 to Step 4 354 Ryan, Wilford L. - Police Officer -.From Ste p 4 354 to Ste 5 5375 On motion of Lowell E. Christie, seconded by warren G. Edwards, the Council granted permission for certain department heads to attend the League of California Cities conference at Los Angeles, October 29, 30, and 31, 1956. On motion of Lowell E. Christie, seconded by Nels Beck, the Council granted permission fort the City Clerk to leave the State of California for one day, October 31st or November 1, 1956. Communication from Cal Poly Homecoming Parade Committee requesting help from the City Council regarding parade routes, traffic control, etc. On motion of Nels Beck, seconded by Warren G. Edwards, the request of the parade committee was granted and the details to be worked out with ift. Schofield, Chief of Police. OLD BUSINESS 1. Comm. from Richard D. Miller, City Administrative Officer, regarding the acquisition of a surplus steam locomotive from the Southern Pacific Railroad was ordered held over for report and recommendation from the Park and Recreation commission. 2. Comm. from Wm. E. Flory regarding the planting of parkways on Grand Avenue and the Monterey Triangle at Dana Avenue. Mr. Miller, City Administrative Officer, recommends that the report of ta'm. E. Flora* be accepted. On motion of Lowell E. Christie, seconded by Warren G. Edwards the recommendation of Mr.. Miller was accepted and the work was ordered to proceed. Mr. Richard D. Miller, City Administrative Officer, reported to the City Council that he appointed William Villegas as acting Fire Chief, effective October 16, 1956, at the 5th step of the Assistant Fire Chief at $495.00 per month. Mr. Miller further reported that he is proceeding with the necessary steps to recruit a Fire Chief for the City of San Luis Obispo and all members of the local department would be allowed to take the examination for Fire Chief. His tentative plans call for the fil date to close Nov. 15th, the written examination December 1st, 1956, and the appointment 1 1 1 1
