Lucksinger NOES: None ABSENT: None s ik At this time the City Council considered the final passage of Ordinance No. 84 (1958 an Ordinance Rezoning Property on Santa Rosa and Montalban Streets from R4 to Cl. Mr. Keith Fraser, Planning Director, was asked by the Council to present the City Plann- ing Commission's views on the rezoning. Mr. Fraser reported that there were no public objections at the two public hearings of the Planning Commission but that i °ir. Wise, Planning Consultant, and'_-.he as Planning Director objected to the rezoning primarily for the fact that this would comprise strip zoning which is not considered good planning technique. Further, they stated that Santa Rosa Street is a very narrow, heavily tra -_.i . veled street and the addition of another service.station would just increase the hazard in this area. Mr. Fraser listed the types of businesses which could be allowed in a C -1 zone. Further, he believed that.R -4 was the proper development for this area as this type of development was needed in the city. Mr. Harris appeared before the Council and.asked Mr. Houser to list uses in the h -4 zone Mr. Harris stated that he could see no objection to a service station in this area as there are more objectional uses allowed in R -4 zones which would cause more problems tha a service station. Further, Mr. Harris stated that while everyone has hopefully been waiting for this areato develop- into.R -4 uses, except for a small business office there has been no development in this area for this use. Mr. Harris also stated that he be- lieved the main objection to a service station would be traffic on Santa Rosa Street, but that a study showed a negligible amount of accidents in this area. He also said that if service stations were allowed in R -4 zones he was sure there would be no objet:' tion by anyone. Police Chief Schofield presented a.report concerning traffic collisions at the intersec- tions of Santa Rosa and Olive Streets and Santa Rosa and Montalban Streets. Un motion of J. Barry Smith, seconded by Richard G. Sleight, Ordinance #84 was finally passed on the following roll call vote: AYES: Nels Beck, Kenneth W. Jones, Richard G. Sleight, J. Barry Smith, Fred H. Lucksing er NOES: None ABSENT: None COMMUNICATIONS 1. Communication from Charles M. Teague, member of Congress regarding the excise tax on telephone service was received and ordered filed. 2. Communication from the office of the State Attorney General notifying the City of San Luis Obispo that the Whale Rock Agreement has been filed and signed by the Cayucos area water organizations was received and filed. 3. Communication from San Luis Obispo City High School students thanking the City Council for their help and cooperation during Youth Government Day held May 5, 1958 was re- ceived and filed. 4. Communication from the J. C. Penney Company requesting permission to have a parade of . children from the store to th e.Freemont- Theatre on June 17 at 10:30 a.m. was referr to the Police Chief for coordination. 5. Communication from,-the auto car dealers of San Luis Obispo thanking the City Council for allowing the downtown showroom for the night auto show was received and filed. 6. Communication from S. C. Masterson, California Legislature, forwarding an agenda for the meeting of the Assembly Revenue and Taxes Committee to be held in Richmond May 23, 1958 was referred to Mr. Miller with power to act. 7.. Communication ,from the U. S. Civil Aeronautics Board,, Docket #5645 Et al. Pacific Southwest Local Service Case notice of postponement of.prehearing conference was re- ferred to the City Attorney, William Houser. 8. Communication from the Mission Trails Association listing their achievements in the pas year and asking for a donation by the City of.San Luis Obispo to continue their worthwhile program was referred to the budget hearing. 9. Communication from the City Planning Commission regarding the Master Land Use Plan and report of meeting with realtors as requested was held over for Council study. .0. Communication from the City Planning Commission regarding the action taken by the Plan - ning Commission in denying the rezoning request by Felton Ferrini on Cerro Romauldo was received and filed. .1. Communication from the City Planning Commission with. attachments regarding the request of Dominic Bressi for building permits on his property on Bressi Place for construc- tion of additional units without filing subdivision maps or complying with small subdivision regulations. Mr. Houser, City Attorney, reported to the City Council regarding the legal aspects of the request of Mr. Bressi, stating that this division of land consists of five parcels which require that subdivision requirements be met by filing tentative and final maps, including dedication of streets and public utilities. Mr. Andrew Renetzky, Attorney, appeared before the Council on behalf of Mr. Bressi stating that this is not really a subdivision of land but just construction of renta units into a court -type operation. Mr. Renetzky stated further that Mr. Bressi feels that a hardship is being placed on him in requiring him to complete a subdi- vision of his property as he cannot use his land as he so desires. 1 �I L 1 1 i 49� Mr. Bressi further asked that an exception be made in his case so that he be allowed to build four additional rentals and that the City Council can then make the require ments of the larger subdivision not to be accepted until that street known as Bressi Place was completely acceptable to the city. After some discussion it was moved by Kenneth Jones and seconded by Doctor Smith that the request of Dominic Bressi for building ,permits to build additional houses in thi: area be denied until Mr. Bressi complied with all the requirements of,the city ordin- ances, on the following roll call vote: AYES: Nels Beck, Kenneth W. Communication from the City Assessor requesting corrections of clerical errors and omis- sions to the 1957 -58 assessment roll -,was approved on motion of Nels Beck, seconded Richard G. Sleight. 16. Salary increases for Robert W. Hilderbrand, police officer, from step 1, $317 to step 2 $336 was granted on motion of Richard G. Sleight, seconded by Nels Beck. 17. Mr. Miller, Administrative Officer,. announces.the appointment of Ada Seimer, typist clef in the library, effective July 1, 1958, step 1-at $240 per month. 1$. Mayor Lucksinger, with .the approval of the City Council appointed the following-commit- tee to meet with the County Contractor's. - Association regarding bui1 ding, regulations building inspection, etc: Councilman Sleight, Chairman; Richard Miller, Administra- tive Officer; Mr. Houser, City Attorney. Sleight, seconded by Nels Beck. 9. On motion of J. Barry Smith, seconded by Richard G. Sleight, it was decided that the loading zone on the west side of Chorro Street between Monterey and Higuera Streets be continued. Report b� Chief Schofield on bicycle carriers. Chief Schofield presented a report and recommendation for additional requirements for the operation of bicycles and access- ories to the City Council. The matter was referred to a council study session for consideration. Mr. Dickey stated that he disagreed with the recommendations of the Police Chief as he did rot go into the study of the adequacy and safety of child carriers of commer. cial make. While the general recommendation as to safety, etc. recommended by the Police Chief appeared proper the matter of the child carrier was not adequately covered. Mrs. Dickey asked the council why extra seats were allowed on motorcycles yet were not allowed on bicycles. This seems inconsistent. 1. Request for the Veterans of.Foreign Wars of the United States and also the American Legion to sell buddy poppies on May 23 a 24 was approved on motion of Richard G. Sleight, seconded by Kenneth W. Jones. 2. TheCity Council requested the Traffic Committee to study the following items and repo to the Council: 1 1. Loading zone on Court Street at the rear entrance to the Anderson Hotel-- - possibility of enlarging this zone so trucks can pull in and unload. 2. Installation of a No Through Street sign on Princeton Street. 3. Application #40057 of the Greyhound Corporation for an increase in intrastate passeng fares before the Public Utilities Commission, State of California, was ordered re- ceived and filed. Introduction of Resolution No. 372. A Resolution Increasing the 1957 -58 Budget For Improve ments At The Sewage Plant, was passed and adopted on motion of Richard G. Sleight, sec- onded by Nels Beck on the following roll call vote: AYES: Nels Beck., Kenneth W. Jones, Richard G. Sleight, J. Barry Smith, Fred H. Luck - singer. NOES: None ABSENT: None 5. Mr. Romero, City Engineer, presented plans for the street program f orthe summer of 19 for reconstruction of various streets within the city. Mr. Romero requested autho zation to advertise for bids for the street program, phase H, as soon as plans and specifications are completed. On motion of Councilman Sleight, seconded by Jones, authority was granted to advertise for Phase H of the street program. Request of William Schofield, Police Chief, to attend the zone meeting, State of Cali - fornia,.for Police Chiefs in Long Beach on June 11, 1958, was approved on motion of Nels Beck, seconded by Richard Sleight. 7. Report of Chief Schlobohm regarding automatic dispensing nozzles in gasoline stations was ordered received and filed. 8. City Attorney, William Houser, reported to the City Council regarding the necessity of closing a portion of the road in Reservoir Canyon in order to safeguard the city's water supply in this area. Mr. Houser reported regarding negotiations which have been going on with the county regarding the closing of this road.. Mr. Houser re- quested authority of the council for the Water: Department to contact property owners who use this road to grant an easement over the portion to be closed. 9. Councilman Smith asked if it were possible for the City Attorney and Planning Director to study and recommend an ordinance setting up rules.for voting on the Planning Commission so as to give them more flexibility in the ^operation of the Planning Com- mission. 0. Mr. Gordon Whitney of West Street appeared before the Council protresting a charge by a private contractor to the property owners for paving of West Street from Chorro Street east to the limits of the Lincoln Terrace Tract. Mr. Whitney stated that originally an estimated price was given to the property owners by the City Engineer' Office but now the contractor quotes a higher figure which would make a hardship on some of the people living in the area. Mr. Romero stated that he had contacted the property owners in November, 1957, in regard to setting up a voluntary paving project on.a cash basis for the property owners fronting on West Street as the subdivider of Lincoln Terrace must replace West Street in the same condition as-driginal, which was an oil surface with an acceptable base. Mr. Romero stated that he thought it would be to the property owners advantage to contribute the final paving on West Street so as to make a complete development. At the time Mr. Romero approached the property owners the contractor had given a figure of 110 a square foot but now that the project is ready to move ahead the price has increased to 13¢ a square foot. Mr. Romero stated that the subdivider of Lincoln Terrace and the Southern Counties Gas Company would also contribute to this paving 1 1
