However; we feel very strongly that some steps should be taken to remedy this problem and it. is recommended that a 55 foot loading zone be established on the south side of Pismo extending westerly from the cor- ner of Osos Street. A Good portion of this zone would consist of driaveway ramp along- side the grocery store storage..area and the 55 feet would take up all but 12 feet of this ramp. It is recommended that this westerly 12 feet be marked red inasmuch as it leads to a driveway of a residence located next to the grocery store. Introduction of Resolution-No. 382 (1958 Series) . A Resolution Establishing a Loading Zone on Pismo Street was passdd on motion of Hie rd G. Sleight; seconded by J. Barry Smith on the following roll call vote: AYES: Kenneth W. Jones, Richard G. Obstructions to visibility have been noticed on the northwest and northeast co mers of Carmel and Islay Street, and if the Council has no objection the Engineer ing Department will take steps to have these situations corrected. No objections by the City Council. The Traffic Committ ee'was requested to submit a report on hotel loading zone behind the Anderson Hotel on Court Street. I 58 -6 -6T. Another obstruction to visibility has been noticed on the southeast corner of Warren and Patricia, and if the Council has no objection the Engineering Departmen will also take steps to have this condition corrected. No objection by the Council. 3. The matter of minimum design specifications for construction of water distribution sys- tems for residential development in the City of San Luis Obispo was ordered held ove for further study. 4. Report of ChitX Schofield recommending changes in the Municipal Code bicycle regulation was ordered held over for further study. 5. Resignation of Mrs. Leona Murphy, clerk in the Police Department, effective June 15, 1958 was accepted. Introduction of Resolution No. 383 (1958 Series). Lucksinger NOES: None `:ABSENT: None 1 G 1 At this time Mayor Lucksinger stated the purpose of the meeting was a public hearing on the formation of the Augusta Street;, et al special .assessment districts, Units 1 through 5. Mayor Lucksinger introduced Mr. Harold Blake, of the firm Kirkbride, Wilson, Harzfeld & Wallace, Special Attorneys for the special assessment district and Mr. George Pearson, Consulting Engineer for design of the district. Mr. Blake explained to the people pre- sent the proceedings to date for the formation of the district and the steps necessary to complete thedistrict, make advance payments or let.the unpaid.balances go to bond. Mayor Lucksinger stated that the hearing would be held by unit so that all the informa- tion for each phase of the district would be together. The Mayor declared the public hearing open on Augusta Street, et al, S -58 -1. The City Clerk read protests from the following: Polly Thomas - Assessment #107. Mrs. Thomas protested the .excessive cost of the project and asked if there was some way .the price could be reduced by reducing the standards of the proposed district. Tom Lee - Assessment #113, requested that his property be removed from the district as the proposed improvements would not benefit his property and further that the cost appeared excessive. Carlos Moerman - Assessment #117, protested the. charge for sewer, fire hydrant and water line on the basis that he already installed sewer and water to his property and doesn't feel that he should be charged a second time. Dr. E. D. Lovett - Assessment #112, protested the charge against his property for sewer as he has already paid for installation of sewer for his property and believes this charge is excessive for the servide he would receive,; but he said he would be willing to pay the difference between the charges already made and the new assessment figure. Mr. Moerman appeared before the .Council on behalf of his written protest and stated that he bebiefred it was unfair to charge him for sewer and water a second time as he al- ready had installed- -sewer and water to his property. Mrs. Treanor..appeared before the Council protesting the excessive charges made for im- provement of this street and also questioned why storm drains were placed at their location at Cecelia Court. Also, if the fact that they had installed their curb and gutter prior to the formation of this district, were they given credit for these improvements. _ Dr. Singleton, Assessment #115, 116, appeared before the City Council protesting the in- clusion of her property in this district for construction of sewer facilities as she had already paid for sewer as an individual and further, when the Johnson Avenue sewer district was formed was again assessed for sewer benefits and she requested that the sewer assessments in the Augusta District be dropped from her assessment. Mr. Romero, City Engineer, informed the City Council and Dr. Singleton that no sewer was being assessed to Dr. Singleton in the proposed Augusta Street Unit #1. Mrs. Treanor asked the City Council why the property owners on the north side of Augusta Street were required to pay for the improvement of the curve at Augusta and Bishop Street when property owners`on'the south side of Augusta were not required to contri- bute to this improvement. Mr. Beckwith appeared before the Council asking how the charge for fire hydrant on Cecelia Court was spread on his property as he. sated none of his property is connected to or adjacent to Cecelia Court. Mr. Howard.Pratt.- Assessment #120 - asked why was the Dalessi parcel on thecorner of Augusta and Bishop assessed such a small amount of the costs when the most benefit appeared to be to Mr. Dalessi as he had the most land to develop. Mr. Harold McDonald - Assessment #105 - asked the City Council why he was required to give hi s and to the City for street purposes, construction of Cecelia Court, when no plans that he knew of had been made to pay him for the land taken. Mr. Romero andwered for the Council's information and for Mr. McDonald that the costs if any,-`for easements and,tights -of -way for street:. purposes would have to be paid for by the district and each property owner was being asked,to donate the little land re- quired for street improvements so as to minimize the costs to the district. re being no further protests, verbal or written,. the hearing on Augusta Street, Unit #1 was continued to Tuesday, June 17, 1958 at 8:00 P. M. Mayor Lucksinger declared the hearing . open on Unit #3, Almond Street Improvement andthe Cit Clerk read the following protests: E. L. - Assessment #307 - protesting the prospective installation of sewer. in th alley in lot 12 of the Anholm Subdivision. ox S. Hixon - Assessment 003 - prote sting . the proposed sewer line to be run in the all in block 12, Anholm Subdivision. Tom D. Harding - requesting that lot 11, block 10 of the Anholm Addition have the assess went cancelled as due to the topography and shape of the land, with respect to Old Garden Creek, that only 6' by 18' would be.available for building purposes after all improvements were put in. and he believes that no assessment should be made on this property. r r Mr. L. Somogyi appeared before the Council on behalf of Tom Harding .requesting. can- cellation of assessment #323 as the lot cannot be built on due to its location. (Mr. Dave Romero, City Engineer, stated that after further study he receommended co sideration by the City Council of the protest of Mr. Harding.) Mr. Joseph Greiler - Assessment #310 appeared before the Council protesting the propose paving and improving of the public way in block 12 of the Anholm tract and also pro- tested the` instal3ation of a sewer in this same public way .being assessed to property owners facing Almond Street. Willard S. Fairbanks - Assessment ff332 - requested information from the City Council re- garding the provisions being made for drainage in the Almond Street area. Mr. Romero, City ,Engineer, explained the plans that had been made and the provisions for handling the drainage problems in this area. Mr. D. S. Hixeon - Assessment #303 - appeared before the City Council on behalf of his protest regarding installation of sewer in the proposed public alley as he did not believe this was a fair charge to the people facing Almond Street who would not use this line, and that the people who were developing this property should have to pay for their own sewer. Harold Tar�ta liiaa - Assessment #317 - asked for clarification of the proposed treatment of that portion of Venable Street going from Almond Street to Broad Street. Mr. Romero, City .Engineer, . explained the planned treatment as proposed in the spec assessment district for Venable Street. There being no further protests, verbal or written, on Unit :. #3 Almond .Street, _the hearing was continued to Tuesday, June 17, at 8:00 P. M. * * Ai this time Mayor Lucksinger declared public hearing open for Unit #4,'Felton and Cerro 1. Romauldo. The City Clerk read one written protest from the Board of Education, San Luis Obispo School District, requesting that they be omitted from the proposed special assessment district due to the school district's financial condition which is extremely precarious. Claud Batchelor appeared before the City Council urging them to complete theformation of this unit of the proposed assessment district.as all the residents of this area have been trying for several.years.to get these improvements put in and they would like to have the project started as soon as possible. Robert Bouchard urged the Council to complete the formation of the district so that the improvements would be completed before another winter. Mr. D. Q. Miller, Assessment #403, appeared before the Council on behalf of the formati of Felton Way and urged the Council's completion of this district. He was also very critical of the School Board for not going along with the improvement of Felton Way. Mr. Rhoades, Assessment #401, appeared before the Council regarding plans for handling the drainage through his property on Felton Way, and asked if it were possible to k the curb in he now has if he added the gutter. Mr. Romero, City Engineer,. answered that present plans for the district called for standard street widths and standard curb and gutters and that Mr. Rhoades curb was presently in the right -of -way and would naturally have to be removed for construction of the new curb and gutter. He also stated that the drainage going down through Mr. Rhoades property would be handled by an under - sidewalk drain which would carry the water into the street gutter and then be carried off. Mr. D. Rogers appeared before the Council to urge them to take the necessary steps to complete the improvement of Felton Way as was.made for the safety of the children going to and from Teach School. Mr. Wm. Meeds appeared before the Council on behalf of the Teach P.T.A. urging the for- mat on of the Felton and Cerro Romauld6 improvement districts for construction of streets and sidewalks, primarily for the safety of the school children who must use these streets to go to Teach School. Mr. Meeds stated that the P.T.A. is extremely interested in getting these improvements put in for safety reasons. Further, he stated he was sure that the school board now had the necessary funds to contribute to this district as the final bids which were opened by the school board for constructioi of Quintana School were much lower than the engineer *s estimate and that money which was set aside could now be placed at the Teach Location in order to complete the im- provements of the school property. Mrs. J. Stur eon, President of the.Teach- Quintana P. T. A. appeared before the City Cour cil on behalf of the P. T. A. urging.the formation of .these districts on the hope the the streets and sidewalks would be in before the next school year for.the safety and health protection of the children. Mrs. McAllister appeared before the Council urging the construction of Felton and Cerro Romauldo Streets for the childrens' sake and she was sure that the school board does have the money to make these improvements. Mr. Howard.Barlow, Assessment #416,_appeared before the Council and asked why a-10% cit contribution was not granted to the construction of Cerro Romauldo as was granted other districts. Mr. Romero, City Engineer, answered Mr. Barlow that the Council policy was that no contribution would be given on nondedicated city streets. Further, the dity is con- tributing substantially to the drainage on Cerro Romauldo. Mr. Barlow stated that he had a letter from a city engineer, dated July, 1957, stat- ing that the City would pay.the engineering costs or some contribution on constructi J 1 1 1 1 lJ I� 1 It this time Mr. Houser, City Attorney, explained for the people present the procedure in the acceptance of streets during annexation proceedings when the streets were maintain by the county. Mrs. Grace urged formation of the Felton -Cerro Romauldo district. Mr. Harold Blake, special assessment attorney, outlined the procedure under the law for overruling the protest of the school board and forcing the school district to pay for their share of the street improvement . Mr. Rhoades, Assessment #401, asked is it possible to put in your own curb and gutter and have the contractor put in the street under. the. special assessment proceedings. Mr. Romero answered that normally the contractor bids the job based on lineal feet of curb, gutter and street and that nothing would be gained by individuals placing their own curbs and gutters. Mr. G. Woods asked if the high crown on Ferrini Road at the intersection of Cerro Romau] . Abd Ferrini Road was to be improved. Mr. Romero, City Engineer, answered that the city plans to improve this high crown as a separate project and at the city's expense. Don questioning by the City Council regarding easements and rights -of -way granted to the city Mr. Romero stated that any easements granted to the city for construction of street improvements in these districts would be returned to the property owners if the districts were not formed., Mr.. Rhoades;.Assessment. #401, questioned the engineering design of the drainage for his property on Felton Way. . Mr. C. R. Bonin urged the council to :form these districts for the children's safety. Mr. Wm. Meeds asked the council if they. were prepared to go ahead with the formation of these districts or must the P. T. A. go to work to urge the council. e being no further protests, oral or written, the hearing on Unit #4, Felton -Cerro Ro- mauldo District was continued to Tuesday, June 17 at 8:00 P. M. At this time Mayor Lucksinger declared public hearing open for Unit 5, Sierra Way. The City Clerk reported no written protests to the formation of this district. Mr. Ed Sweeney, Assessment #509, asked why was the bid on Sierra so much higher than the other districts and would the City Council force the formation of the district by a 4/5s vote if the people decide they could not afford these improvements. Mr. Romero, City Engineer,_ answered Mr. Sweeney with the opinion as to the reasons for thehigh bid by the contractor. Mr. Harold Blake, special assessments attorney, gave the various alternatives for the for- mation of this district. 1. Set special hearing and notify the taxpayers on increasing the estimate of the assessment on each property based on the present bid. 2. Readvertise for bids as a separate project immediately. This would require minor changes in the plans and specifications. 3. Hold for one year and then restart. the proceedings at that time. weeney asked for .clarification of the various items in the design of the drainage plan r the Sierra District, Mr. Romero, City Engineer, answered Mr. Sweeney's request by explaining the actual dp of the drainage plan for this area. Cole, Assessment #507, asked, if the City Council were to readvertise for bids for the Sierra District alone would they possibly .get . a better bid for this construction. • Also'i Mr. Cole asked would it be possible for the people in the proposed district to meet and discuss amongst themselves whether they should go ahead with the project as presently constituted or to readvertise for bids. There being no further written or oral protests the hearing on the Sierra District was con- tinued to June 17, 1958, Tuesday at 8:00 P. M. At this time the Mayor declared the public hearing open for the formation of Unit #2, The City Clerk read the following written protests: Charles E. Freeman, Assessment #205, protested the charge to his property for sewer line as he has ready an adequate sewer serving his property which was paid for through the Johnson Avenue sewer district. Also Mr. Freeman said that the estimated cost in ' the bids was excessive. He doesn't believe the assessments are fairly distributed, particularly with reference to one -half the cost of the water line on Bullock Lane being spread to all the properties in the district. C. L. Daggett, Assessment #208, protested the high charges being made against the prop- erty or sewer and water lines and requested that lower assessments be placed on the property.
