Easter, Assessment #209, protested the high cost of legal and engineering services for this district and the high cost of the bids received for construction of these improvements. Mr. Easter would like to proceed with the construction of the sewer and water lines. Art- Keta, Assessment #207, protesting to the spread of the cost of one -half of the water line on Laurel Lane to all the properties on the assessment' - district. He believes tt the people on Bullock Lane. .should pay for their own water and that the City of San Luis Obispo should pick up the cost of the other half of the line and charge it to people as they hook on to the line. Further, Mr. Ketz suggested that rather than bid this job with the other four street districts, he believed better bids could be received from small local contractors to do the sewer and water work at a much lower cost. Mr. McKeen, Assessment #203 protested the inclusion of the property in the proposed dis- trict and particularly the cost of water line in the.bid received by the City. Mr. Easter appeared before the Council on behalf of his written protest and also stated he did not believe it was fair for one -half the cost of the water line on Bullock Lane being spread to- all the properties in. the district. Further, he urged that the Bullock Unit be resubmitted so that sewer and water installation can be separated fr the four other units, requiring expensive street work:. In this way, he believes smaller contractors could bid the job and do a more economical job. Mr. Easter then reviewed for the Council the itemized unit prices of the bid received. Mayor Lucksinger suggested that Mr. Easter get an informal petition from the people in the district giving an expression of their feeling regarding the formation of thi district and what procedure they would like to followin completing it. Mr. Freeman appeared before the _Council. on behalf of his protest as a proposed new sewer does not add to his property as he is adequately sewered at the present time. .Fur- ther, he did not believe it equitable for one -half the water line -on Bullock Lane being spread over the entire district, but that the City Water Department should pay for one -Half of this line and be reimbursed as people connect. Mr. McKeen asked why was..he.assessed for a water system when he is served at the p time by City 'Water. Mr. Romero, City Engineer, answered that Mr. McKeen is. presently served by an inade- quate water main. There being no further written or oral protests the hearing was continued to Tuesday, June 17, 1958 at 8:00 P. M. On motion of Kenneth W. Mr. Houser, City Attorney, presented for the City Council's consideration the draft of the final agreement between.. the City..of . San Luis Obispo and .A. Ferrini for development of a water system for Ferrini Heights, Tract #3.. The agreement calls for Mr. Ferrini to ad- vance the City of San.Luis Obispo the.necessary. moneys to develop the water system for this area and then for._ the. City.to_ repay. the loan on a ten year basis with no interest being paid by the City. Mr. Felton Ferrini appeared before the City Council on behalf of the subdivider of Ferrini Heights requ esting.the City reconsider.its.decision of not allowing interest on the money being advanced.by.A. Ferrini to develop a water system for this area. After some discussion by the City Council it was decided there would be no change in the Council's decision. to make the agreement a maximum of ten years and absolutely no inter- est to be paid by the City. COMMUNICATIONS 1. Communication from Maino Construction Company asking reconsideration by the City Coun- cil of their claim for reimbursement of enlarged water pipe on Flora Street in the McAllen Heights Tract,. previously denied by..the City Council was referred to the City Attorney to prepare a letter regarding the development. 2. Communication from Seth Kinney, Building Inspector, requesting the City Council adopt the 1958 Uniform Buildin g...Code for use. in the City of San Luis Obispo was referred to the Council Committee of .Councilman Sleight., Administrative Officer Miller and City Engineer David Romero. 3. Communication from Stone and Youngberg regarding schedule for parking assessment distri No. 1 was received and filed. 4. Communication from KEYT, Channel 3 Television, referred to the City Council from the Recreation Commission,.thanking t.he...Recreation Department for their help in a tri- county band stand dance contest was received and filed. 5. Petition from the residents of the proposed Bullock Special Assessment District request ing the City Council.to call for new..bids for installation of water and sewer in this district was received and filed. On motion ofRichard G. Sleight, seconded by Kenneth Jones,.the City-Engineer was authorized to readvertise for bids for construe tion of water and.sewer systems in the Bullock District. At this time a petition from some of the residents in the proposed Sierra Way Special Assess- ment District appeared before-the Council requesting that the Council proceed with the improvements based on the contractor's bid. Mr. Sweeney appeared before the. City Council stating that he wished the Council to go ahead as he did not believe construction prices would be any lower a year from now. Mr. Cole also stated he.wished to proceed on the present basis. Mr. Wandling also wished to proceed and Mr. G. Culbertson urged speed by the Council in developing this area before another winter arrived. Mr. Sweeney asked the Council if the district did not proceed at this time would the City Council consider closing the street between the old section and the new section of Sierra Way. Also could the' City. place a.little oil or water on the street, in order to keep the dust down. Councilman Smith reported after some questioning that the Baptist Church on Johnson Avenue did not vote for.or.against the..district as.they believed they would have more time to consid er.the. easements and to study the proposal as it affects their large parcel of land. Furber,..they do not believe that the Council would award the bids with- out further notification ofthe property owners involved. The.matter of Sierra Way Street Improvement District was..referred to the Council adjourned meeting on June 17, 1958. Mr. Bongio, of Sierra Way, appeared before the Council regarding the water pressure which has been getting worse each day. and is very..poor for the residents along the upper, or old portion of Sierra Way. Mr. Bongio wanted to know how this portion of Sierra Way was affedted by the proposed special assessment district below. Also he.wished to know if any plans were being made for increasing the water capacity of the lines in the street so as to get better pressur to the homes in this area. Mr. Thompson, Water Superintendent, explained to Mr. Bongio and the people present the City's plan for bettering the water service in this area, both in the new and the old portions of Sierra Way. 6. Communication from three owners of property in lot 14, block 3 of the old Goldtree Vine yard tract requesting the City Engineers Office make a preliminary survey for a street to serve this area, survey to be made.at no cost to the property owners was ordered held over for further study by the Council. 7. Petition from property owners on Gerda Street in the Hagan Tract requesting the City Council not extend Gerda Street beyond its.present location was held for study by th( Council. 8. Communication from the International.City Managers' Association presenting certificates to five department heads for completion of.-courses taken in the institute for train- ing in municipal administrati.on... Mayor Lucksinger presented the certificates for the course in local planning to Mr. Miller, Administrative Officer; David Romero, City Engineer; William Flory., Park.and Recreation.Department; E. Price Thompson, Water Superintendent and J.-H. Fitzpatrick, City Clerk. 9. Communication from the City Planning Commission recommending to the City Council approve of the final map of Tract 126, College Highlands Unit #4 was ordered received.and filed. The City Engineer, Mr. Romero, presented a report to the City Council on final maps of Tract 126 and recommended.to.the City Council that the final map be accepted. On motion of Richard G. Sleight, seconded by Kenneth W.
