The Traffic Committee has had several complaints on the green zone in front of the Don Motel at 1473 Monterey Street.. The chief objection is that the zone is not effective after 6:00 P. M. in the evening when many motel guests are arriving. After study, the Committee recommends that this zone be changed to a white hotel loading zone. This would be for one car space approximately 20 feet in length on the south side of Monterey Street and extending in a westerly direction from the motel driveway ramp; L 1 Approved this day of , 195$. y June 17, 1958 - 7:30..;P.M. CITY HALL The City Council met in adjourned session of the public hearing of June 9,' 1958 with Mayor Fred Lucksinger presiding. Roll Call: Present - Nels Beck, Kenneth W. Jones, Richard G. Sleight, J. Barry Smith, Fred H. Lucksinger ABSENT - None Mayor Lucksinger announded that t his.was a continuation of the hearing on the establishment of Augusta Street, Et al,.Special Assessment.District continued from June 9, 1958. The Mayor explained that the protests would be handled on a unit by unit basis starting with Augusta Street, Unit #1. Augusta Street. .Unit #1 Mr. Tom Lee, who-presented a written.protest at the.June 9 meeting appeared before the City Council requesting a break -down of the assessment on his property. Mr: Lee protested on the high bids received and said he believed the costs on his property were too high and he wondered if there was a possiffiity of lower assessments if the project was rebid. . After some discussion Mr. Lee withdrew his protest to the formation of the assessment district. 1 Carlos Moerman, who presented a written protest at the June 9 meeting appeared before the Council. After study and.co.nsideration by the Council.of Mr..Moerman's protest the following adjustments were ordered made: 1. Protest allowed and assessment on water works cancelled. 2. Protest allowed on sewer connection.and assessment ordered cancelled. 3. Protest on the water hydrant assessment-not allowed and the assessment to remain on this property. Introduction of Resolution No....38.7 (1958 Series), .A Resolution Establishing a white Loading Zone in rant. of the Don Motel was.,passed.and adopted on motion of Kenneth W. Jones, seconded by .Richard G. Sleight on .the following roll call vote: AYES: Nets Beck, Kenneth W. .Jones,. Richard G. Sleight, J. Barry Smith, _ Fred H. Lucksinger NOES: None ABSENT: None 58 -3 -3T. The Traffic Committee.has re- studied the red zone in front of the Watkins Store on Santa Rosa.-Street at..Mill at the Council's suggestion. The Council asked that this zone be .considered on a maximum basis in order to reduce the hardship to the businesses at this location. this location could.be cut.down The Committee feels that the 45 foot red zone at by 20 feet thus-providing one additional parking space to the south of.the first driveway ramp. This would still provide some improv ment in visibility and ease in turning:movem ent over the original condition. Introduction of Resolution No._188.11958 Series l. Lovett sent a' written protest. on June 9, 1958 regarding the sewer assessment on his property. Protest.-was upheld and assessment reduced accordingly. Mr. Treanor appeared before the City Council and .asked the cost per square foot of paving, curb and gutter on the bid received by. the .City. Mr. Treanor questioned the contingent; reserve in the assessment and. asked. for a breakdown of'the contingencies. Mr. Romero, City Engineer, explained what the. contingency reserve consisted of. Mr. Treanor then:asked the. Council why Henry Dalessi does not contribute more to the district than he has been assessed. for-as he is receiving the' greatest benefit. Mr. Treanor suggested that if Mr. Dalessi does not _contribute any more to the district than proposed, then Mr. Dalessi should.not be.allowed..to.use.this property for twenty five years. Mr: Romero, City Engineer,. reported to t-he Council that the Dalessi parcel was included in this district so that proper.design .could be made.of._Augusta Street and its inter- section with Bishop and also to provide for proper radius at this turn. Further, Mr. Dalessi contributed a large. parcel of land to the City for this street widening at no cost to the City or District. Upon questioning by the-,Mayor, Mr. Treanor did not protest the district but wished that the cost could be i-educed. cDonald, Assessment #105, who.had.protested.water and sewer assessment at the June 9 meeting appeared before the .Council. After... consideration and study the protest was allowed and the assessment ordered reduced. Treanor . appeared before the City. Council and.protested..the high cost to them for the sm la�� amount of improvement needed at .their property as they have already installed curb, gutter, sewer and. water. and all that is.needed..is one half of the street paving for Augusta Street and one half, of. the paving on Cecelia Court, Harold Blake, special assessment Attorney, explained.for the people present the purpose: of the 26% incidental cost to the District. The following protests made to the City Council for Unit #1, Augusta Street were withdrawn: Thomas J. Lee J. R. Treanor Carlos Moerman Dr. E. D. Lovett The protest of Mr. Polly Thomas was not withdrawn. On motion of Kenneth W. Jones, seconded By els Beck, the contract was awarded on Unit #1 and the protest not withdrawn was overruled on the following roll call vote: AYES: Nels Beck, Kenneth W. Jones, Richard G. Sleight, J. Unit #2 Bullock 'etition received covering over 75% of the area in. the proposed district, asking that the City Council readvertise for bids for construction of the Bullock Unit; bids to be opened June 30, 1958. Mr. Harold Blake, Special Assessment Attorney, explained to the Council and the people present the procedure for readvertising for bids. City Clerk presented for the Council's consideration one additional protest to the Bullock District. gan Flagg, Assessment #203 -B protested his assessment on the basis that the parcel of land being assessed for sewer and water is to be used for road purposes in the proposed residential subdivision to the north of the. Bullock District. Said subdivision is to b in an area previously assessed for sewer. Therefore, he requests that this assessment be removed from this parcel. Charles Freeman, Assessment #205, presented a written protest at the June 9 meeting and again appeared before the Council protesting the spread of the assessment in this unit, particularly the one half assessment on the..water.line on Bullock Lane being spread to all the parcels in the District. He believes that this assessment should be paid for b the City Water Department and then collected from anyone who hooks on in the future. motion of Richard Sleight, seconded by Kenneth W. Jones, authority was granted -to readve tise for bids for sewer and water in the Bullock area. Auausta.Street, Unit #3. Almond..... e following written protests were received by the Council at the June 9 meeting: E. L.. & Eleanor McQuary, requesting the elimination of sewer construction in the alley in block 12 of the nholm Subdivision. After discussion by the Council the protests was upheld and the assessment reduced propor- tionately. Tom D. Harding,. protesting the assessment #323 as the property is too small to use for construction of buildings. After-study by the City Council.the protest of Mr. Hard- ing was upheld and assessment #323 was reduced to 118 assessment. There being no further protests,.on motion of Kenneth Jones, seconded by Nels Beck adjust- ments were ordered made and the hearing on.Augusta Street, Unit #3. was closed on the following roll call vote: AYES: Nels Beck, Kenneth.W..Jones, Richard.G. Sleight, J. Barry Smith, Fred ' H. Lucksinger NOES: None ABSENT: None Augusta - Street, Unit #4.- Felton -Cerro Romauldo- A written protest of the San Luis Obispo City School District was received-on June 9, 1958. Mr. Rhoades appeared before the.Council and asked what provisions had been made to handle rain water from his property. Mr. Romero, City Engineer explained for the .City..Council and Mr. Rhoades the plans for handling the drainage from Mr. Rhoades' property. Mr. Romero stated that the plan calls for sewer concrete drainage structure which will handle the water that is being handled through Mr. Rhoades' structure at the present time. Mr. Rhoades then asked if he could put in his own curb and gutter. Mr. Romero answered that under the present plans he could not put in his own curb and gutter as the bids were based on so many feet of curb and gutter. Mr. Rhoades asked if his property could be deleted from the proposed district at this time or until the water problem to the north and west of him has been solved so that a proper drainage structure can be de- signed and constructed on his property for handling this water. Mr. Romero, City Engineer reported to the City Council that a portion of the street presently constructed in front of the Rhoades' property is in acceptable condition and that the Rhoades' assessment could be reduced for the street surfacing. There being no further protests, the protest of the San Luis Obispo City Schools was over- ruled, work was ordered to proceed and the-hearing on Augusta Street, Unit #4 was..ordere closed on the following roll call vote: AYES: Nels Beck, Kenneth W. Jones, Richard G. Sleight, J. Barry Smith, Fred H. Lucksinger NOES: None ABSENT: None Augusta Street. Unit #5 - Sierra.Way. Mr. Blake, Special Assessment Attorney stated that after restudy of the bids received they showed that the increases were primarily caused by the drainage conditions in this unit and that the City's contribution would be increased by $2,300. Also, the $2,000 which had been set aside for.pro perty acquisition could be used to offset a portion of the in- crease in the bid as it appears that no land must be purchased as the property owners have willingly donated the necessary rights-of-way. It appears that the assessments as mailed to the taxpayers will be just about the same as the actual construction costs. The original contribution by the City and drainage was estimated at $7,697. Under the bids received, the City contribution will be approximately $10,997• There being no further .protests the work was ordered to proceed and the hearing closed on Augusta Street, Unit #5 on the following roll call vote: AYES: Nels Beck, Kenneth W. Jones,Iichard G. Sleight, Fred H. Lucksinger NOES: J. Barry Smith ABSENT: None Mr. Sweeney, a resident of Sierra Way thanked.the City Council for their consideration and help in trying to arrive at an equitable solution of the assessment district for his area. The public hearing on the Augusta Street, etal Project S -58 -1 was ordered closed on motion of Kenneth Jones, seconded by Ri.thard G. Sleight. .
