Claims against the City for the month of July, 1958 were ordered paid subject to the approval of the Administrative Officer on motion of Kenneth W. Jones, seconded by Richard G. Sleight. rr The City Clerk reported on bids received and opened for construction of Santa Rosa Park Development Recreational Area Lighting, City plan Gallagher Electric 39740.00 A. R. Ochs 59000.00 A -1 Electric 49250.00 Mr. Miller, Administrative Officer, recommended the low bid of Gallagher Electric be accepted_(3,740.00).. On motion of Richard Sleight, se- conded by J. Barry Smith, Mr. Miller's recommendation was accepted and the bid was awarded to Gallagher Electric of San Luis Obispo. The City Clerk reported on the following bids received and opened July 7 at 2:00 P. M. for Material for Santa Rosa Park Development Recrea- tional Lighting: Pack Pipe & Supply Company San Luis Obispo, California $ 2,$62.5.4 Channel Wholesale Electric Co. Santa Barbara, California - 20.97 @ item 6 only $419.40 A. R. Ochs' San Luis Obispo, California $ 2,280.00 Mr. Miller, Administrative Officer, recommended that the low bid of A. R. Ochs for supplying the material, in the amount of $2,2$0.00 be accepted. On motion of Kenneth W. Jones, seconded by Richard G. Sleight, the bid of A.R. Ochs was awarded. At this time the City Clerk reported on bids received and opened at .3:00 P. M., July 7, for one carry -all type survey true. Communication from the National Municipal Lea'' e announcing the 64th Annual National oonference onn Uovernment to be held in Colorado Springs, Colorado Septermber 14,to 17 was received and .f iled. 2. Communication from the Disabled American Veterans., Chapter 45 re- questing permission to hold their annual flower sale on August 7'and 8 in the downtown area. Permission granted on motion of ' Kenneth W. Jones, seconded by Richard G. Sleight. 3. Communication from the County Grand Jury thanking the City Council for allowing the Grand Jury to use the Council Chambers was re- ceived and filed. 4. Communication from Ruth Mason, operating a cafe at 1136 Carmel requesting restricted parking in this area was referred to the Traffic Committee on motion of Kenneth W. Jones, seconded by Richard G. Sleight. 5• Communication from Sleep Off the Hi -Way Motel requesting the City . to place motel signs at the corner of Higuera and Marsh Streets for motels on South Higuera Street was referred to the Traffic Committee on motion of.Kenn eth W. Jones, seconded by Richard Sleight. 6. Communication from the Department of Public Works requesting the adoption of a resolution urging legislative bodies to support a program of 'cooperative highway planning with other jurisdic- tions was ordered held over for study by the Council. 70 Communication from the California Mission Trails Association,noti- fying the City of San ui� s Apo of the completion of a special film publicizing the Hearst San Simeon Monument and notifying the .City that their share of the production is now due and pay- able was received and ordered filed. 8. Report by Richard D. Miller, Administrative Officer, on the Chamber of Commerce Highway Committee meeting held in June, 1958 was re- ceived and ordered filed. 90 Minutes of the City Planning Commission of June 2, 1958 were re- ceived and 'filed. 10. Request of Patricia J. Clark, City Librarian,. for permission tD attend the American Library Association meeting in San Francisco June 13 - 19, 1958 and also for members of her staff to attend on a rotating basis was approved on motion of Richard G. Sleight, seconded by Kenneth W. Jones. 11. Request of Mr. D. Romero, City Engineer, for the City Council to schedule a study session for discussion of five new assessment districts he has in their preliminary stages was held over for study. 12. Santa Maria, California Smee's Plumbing San Luis Obispo, California $ 33,536.$9 $ 33,227.0$ $ 33,195.78 McBride's Mechanical Contractors San Luis Obispo, California x.412598.96 Mr. Romero, City Engineer, explained for the impact of the bids received on the development. the Council and the public present l various phases of Unit #2 Mr. C. R. Laster appeared before the City Council and stated that although the bids received were somewhat higher than expected he was pre- pared for the City to go ahead with the improvement of this dis- trict. Mr. Bernard asked the City Council if the assessment on his property would be reduced by removal of the sewer line in front of his property.. Mr. Romero answered that the assessment would be reduced just by the cost of the pipe but that the area assessment would still be placed against his property. Mr. Easter stated he was not too pleased with the high assessment, but that he was not protesting the formation of the district. Mr. Freeman asked if any adjustment had been made in the spread of the over -all assessment of the water line which is being placed along Bullock Lane where one- half -the cost of this water line is being spread to all the property in the district. He still believes that this one -half of the water line should be paid for by the City and the money returned to the City as new customers hook up to the line. Further, he believes that if this was not done it was a grossly un- just assessment on the .property owners not benefited by this improve- ment. Mr. B. McKeen protested the assessment 'on his property for.the cost of water line as he is presently served by City water and he was-pro- mised by the City Engineer and Council (1948) that if he in.stalled this water extension any future enlargements 'of this system would be paid for by the City as a normal water improvement. He also protested the sewer line assessment on his property as his property is presently severed from the Johnson area. There being no further protests the 'City Clerk, at the request of the Mayor, went through each formal protest for the Councils information. Mr. C. R. Easter requested that his protest be withdrawn. Mr. Romero, City Engineer, reported that he had talked to Mr. Ketz on thetelephone and that he,had requested his formal protest be withdrawn. Morgan Flagg, who had proVc sted sewer and water assessment on assess- ment #203 -B did not withdraw his protest. Mr. Freeman, protesting sewer line on the north side of Orcutt Road and water. line on Bullock Lane did not withdraw his protest. Mr.. Daggitt , protesting water and sewer assessment withdrew his for - mal protest and urged formation of the district. . Sleight that the sewer line on the north side of Orcutt Road be elimi- nated from the district for parcels 203. -B, 204 and 205 from engin- eering station 3 plus 19 to 6 plus 25 and the assessments on these parcels reduced accordingly, 'on the following roll call vote. Mr. D. Romero, City Engineer, reported to the Council the various elements that made up the bid and the differences between the Engineer's esti- mate and the actual bids as ,received. The City Clerk reported.no written protests to the Alrita District. Mr. Blaser asked the reason for the large difference in the water sys- tem installation, particularly the difference in the.bid cost and the Engineer's estimate. Mr. Sandow, representing the Special Assessment Engineer, explained the basis used by the Engineer in estimating.the cost of the lift station and equipment. Mr. Smee asked for a cost breakdown for the electrical panel system in the water lift station and stated that he had bid the job as a sub and that the engineer's estimate was way off. Mr. Blaser requested that the City.readvert_ise the project for bids as the costs seemed entirely out bf line. Further, he asked that the 5% contingency fund be eliminated by the City as the City .had picked up this coat in other projects. Mr. R.' D. Miller, Administrative .Officer, suggested to the Council that possibly the project should be held over until.the early spring of 1959 so as to get a lower bid after the rainy season. Mr. Romero suggested that the project be rebid as follows: Alternate one: The contractor to supply the labor and materials install the complete pump station. Alternate two: The City to supply materials and the contractor to install same and construct the pump station. On motion of Nels Beck, seconded by Kenneth W. Jones, it was moved that the bids received on July 7, 1958 be rejected. Introduction of Resolution No. 406,(195$ Series). A Resolution Calling For Sealed Proposals, Alrita Street, Et Al, Project S -58 -9 was passed and adopted on motion of Richard G. Sleight, seconded by Ken- neth W. Jones on the following roll call vote: AYES: Nels Beck, Kenneth W. Jones, Richard G. Sleight, J. Barry Smith, Fred H. Lucksinger NOES: None ABSENT: None The public hearing,on the Alrita Street Special Assessment District was continued to July 28, 1958 at 7:30 P. M. Mr. Paul Wagner, m'mber of the City Sign Committee offered his resigna- tion from said committee as he is being promoted by the Division of Highways and is moving to Sacramento., TheCity Council accepted his resignation with regret and wishes him well on his new job in Sacra- mento. Mr. Miller, Administrative Officer, announced the appointment of the following: Elvira E. Flossi, Stenographer in the Police Department at $240 per month effective June 20, 1958. Traffic Committee report #5$ -6 -$C regarding hotel loading zone on Court Street .behind the Anderson Hotel was ordered held over for further study by the Council. Request of the Division of Forestryfor a sewer connection outside the City was referred to a Council Committee of Councilmen Jones, City Administrator, Miller and City Engineer, Romero-and held over for study. Councilman Sleight, appointed to investigate -the request of the Junior Rifle Clubs for permission to install a soft drink vending machine in the basement of .City Hall, reported it was his recommendation that vending machine be installed and that the profit, if any, go to the Rifle Clubs for maintenance of the range. On motion of Richard G. Sleight, seconded by Kenneth W. Jones, the request was approved as recommended. Council Committee report of Councilmen Jones and Smith and Planning Director Fraser regarding annexation fees was ordered held over for Council study. Recommendation of Police Chief Schofield for changes in the municipal code regarding bicycle regulations was ordered held over. Request of the Water Superintendent for adoption of _minimum design speci- fications for construction of water distribution systems for resi- dential development was ordered held over for Council study. The matter of enlarging the sewer .transmission mains on Tassajara and Cuesta between Cerro Romauldo and Foothill Boulevard and contribu- tions, if any, from new subdividers using said mains wasp held for further study.by the Council. 8 Jut 7 1958 Communications from three owners.of property in ,lot 14, Block 3'of the Goldtree Vineyard Tract requesting the City Engineer's Office to make a survey for a street to service this area at no cost to the proper- ty owners was ordered held over for.study by the Council. Petition from property owners on Gerda Street in the Hagan Tract request- ing the City Council not to extend Gerda Street beyond its present location was held for further study. Communication from the Building Inspector regarding amendment to the City electrical code requiring the wiring of apartment houses with more than six units was ordered held over for study by the City Council. Communication from the Building Inspector requesting the City Council to adopt the 1958 uniform building code for use by the City.of San Luis Obispo and referred to the Council Committee of Councilman Sleight; Administrative Officer, Miller and City Engineer, David Romero was held over. Communication from the Maino Construction Company requesting reconsidera- tion of their claim for reimbursement of enlarged water pipe on Flora Street in the McAllen Heights Tract previ6uslq denied by the City Council, and referred to the City Attorney for answer explaining Coun- cil's reason for denying Maino's claim, was held over for study. Mr. Miller, Administrative Officer, requested authority to advertise for bids to demolish city -owned buildings on Parking Lot #2 and when the buildings have been removed to pave and install parking meters. Re- quest of Mr. Millerwas approved and authority granted to demolish these buildings. Communication from the Pismo Beach Civic Association requesting permission to sell tickets .on a 14 foot boat in the downtown area of San Luis O- bispo on July 10, 1958, proceeds to go to the Pismo Beach Civic Associa- tion for recreation equipment on the beaeh was approved on motion of Kenneth Jones, seconded by Richard G. Sleight. Request of the Junior Chamber of Commerce to allow a soft drink stand and popcorn stand to be placed on Higuera Street as part of the Dollar Days Celebration was approved on motion of J. Barry Smith, seconded by Kenneth W. Jones and referred to Chief Schofield to arrange for the use of parking meter space for the 10th, 11th and 12th of July. Communicati6n fr6rn the Port San Luis Harbor District thanking the City Council for the use of the Council Chambers for a meeting of. the State Small Craft Harbors Commission was received and filed. *rr. Romero, City Engineer, requested approval of plans and specifications and authority to advertise for bids for reconstruction of Johnson Avenue from Laurel Lane east 947 feet. On motion of Nels Beck, secon- ded by Kenneth W: Jones, request was granted, plans and specifications approved and authority granted to advertise for bids. SOUTH STREET PLAN LINE At this time the Mayor declared the public hearing open .on the final adop- tion of Ordinance No. 85 (1958 Series). An Ordinance establishing Official lan Lines of South Street. Mr. Romero, City Engineer, at the request of the Mayor explained the alignment of the proposed plan line for South Street and showed how each property was affected by the proposed street widening. Mr. T. J. Smithon, 503 Branch Street, asked how his property was affected in the proposed widening. Mr. Rudd asked if other streets were to be opened between South Street and Branch Street. Mr. H. Norton appeared before the City Council protesting the design of the proposed plan line for South Street insofar as property was concerned. Mr. Norton went on at some length as to the unfairness of taking 26 feet from his property and not an equal amount from properties on the North or upper side of South Street. Mr. Norton urged that the City redesign the proposed widening so that property would be taken equitably from both sides of the street. 1 1 JUL .7 1955 4 Mr. Max Matejcek, representing the El Camino Bowling Association ap- peared before the City Council stating that they c'mild not go a- head with their plans for developing their property *on South Street with a $750,000 investment in a bowling alley until the matter of street widening and alignment is settled by the City. Mr. Richard Harris, Attorney representing Mr. Albrecht, Mr-. Silva and r. Norton stated that the plan line as proposed was unfair to his clients as all the land is being taken off one side of South Street and none from the North Side, or upper side, and he does not believe that this is fair to ail concerned as the burden of street, widening should be placed on all owners facing the street and not just the owners on one side. Mr. Harris urged (1) that no plan line be adopted for South Street at t hi s t ime , or J2) , he reque st ed that i f t he Counc it was de- termined to proceed, that the proposed plan line be readjusted so that land for the widening be taken equitably from both sides of the street. iJ 1 City Clerk reported that as of 10 A. M. July 7, 1958, there were no protests filed on the 1958 -59 assessment roll and that the period of equalization was to continue to July 21, 1958 or to a date scheduled by the Council.
