Communication from the City Planning Commission forwarding Resolution No 157 -58 recommending action by the Council on a proposed amend- ment to allow rezoning of part of the Ingleside.Homestead Tract, Lots 1-through 11, Block 123 and Lot 1 Block 23 of the Murray and Church Addition from R -2 to R -3. Introduction of Ordinance No. 91 (1958 Series). An Ordinance Re- zoning Portions of the Ingleside Homestead .Tract and the Murray and Church Addition from R -2 to R -3 was introduced and passed to print on motion of Kenneth W. Progress' -report by the..Department of.Water Resources for the month of August on the-Whale Rock Project was received and filed. 12. City Administrator requests permission to call for bids for the Marsh Street Traffic Signals- -Broad to Marsh - -bids to be opened October 20, 1958.. Mr. Romero presented a plan for traffic move- ments on Marsh Street in connection with the signal program, including red zones and turning pockets. With the Council's con- sent this pattern, as. presented, was approved as a part of the signal installation. Request to call for bids was approved on motion of Kenneth W. Jones,-seconded by Richard G. Sleight. City Engineer was in- structed to prepare studies as to the feasibility of installing signal lights at the intersections of Foothill and Chorro, Marsh and California and Marsh and Johnson. 8:00 P.M. -- PUBLIC HEARING At this time the. City Council held a public hearing on the final pass- age of.Ordinance No. 89 (1958 Series). An Ordinance Rezoning Prop- erty on Swazey Street From R -2 and R -3 to C -3.: Communication from the Planning Commission recommending change in re- zoning. Petition from property owners. in the vicinity protesting zoning change (32 signers). 1 1 U i ID,% a;;Pq . 37 Mr. Hiltunen.- 2045 Swazey Street - appeared before the Council on be- — half -of the - petitioners protesting the zoning change a s contem- plated by Ordinance 89. Mr. Hiltunen stated that in addition to the points brought out.in the.petition, he and his neighbors did not desire another junk -type construction yard like is maintained by Ochs at the present time on Swazey Street. .-Also, he stated he wished the Council to realize the narrowness of Swazey Street which is only'a thirty foot street from property line to property line. and it. is extremely dangerous for the residents ' and children of the area to use this street when cars are parked and heavy trucks.move in and out.. Further, that this has been de- veloped as a: residential. area, except for the junk yard maintained by Allan Ochs. , Mr. Earl Wiseberg appeared before the Council on behalf of his request for rezoning stating that he was only interested in.selling his lots on. Swazey Street and that they could not be, sold. for residen- tial. He was sure that if..the commercial zoning was allowed he could sell them easily. M Mrs. Bruce - 2046 Swazey Street.- protested the rezoning of the lots-.. adjacent to her property which is maintained as a .private residence Q as she would not like a warehouse or construction yard next to her home. Also, she stated that Swazey Street is extremely narrow and is dangerous to pedestrians using .this narrow unimproved street. She has three small.children living in her home and the workers presently using this street drive too fast for the safety-of these c children. Mr.s Ellen Lindsmith appeared before the Council protesting the re- zoning to commercial due to the large number of additional motor vehicles which would:be generated in this area if additional com- mercial properties were allowed. ' Mr.. Louis German - 2064 Rachel Street - appeared before the Council .protesting the rezoning of -this property as.his home would look down into this.area.and he is not interested in looking down into the yeards of industrial property -as he is required to do presently because of the Ochs construction yard: After some discussion-by the .Counci.l, final passage of Ordinance No. 89 was continued to..the next meeting of October 20, 1958 so the City Council will have an opportunity to investigate this request personally. 13. Request`of Patricia Clark, City Librarian, for permission for one staff member from the library to attend the annual con- ference of the California Library Association October 29 to 31 in LongeBeach, California was approved on recommendation of R. D. Miller, Administrative Officer, by motion of Richard G. Sleight, seconded by Kenneth W. Jones. 14. R. D. Miller, Administrative Officer, announced the appointment of Joseph L. Rodrigues, Laborer- Equipment Operator, Step 1 $300 per month effective October 1, 1958. 15. The following salary step.increases were approved on motion of Richard G. Schlobohm for Council approval of sick leave exceeding two weeks for Fire Captain Gill and communication from Dr. E. W. Webel regarding treatment of Captain Gill. Permission was granted on motion of Richard Sleight, .seconded by Kenneth W. Jones. OLD BUSINESS 1.. Purchase order to the 40 and 8 flag fund for purchase of 16 flag sets was received and filed. 2. Traffic Committee Report on matters referred: (copies attached) 58- 10 -1C. On the request of the San Luis Clinic that time limit zones be established in the vicinity of the clinic, the .traffic committee feels that this request is .justif.ied. and recommends that one and one -ha.lf hour time limit zones be established from 9:00 am to 6:00 pm, Sundays and Holidays excepted, on both sides of Pacific from -Morro to Osos and on both sides of Osos from Pacific to Marsh. Introduction of Resolution No. 442 (1958 Series).. A Resolution Establishing bne and e- alf hour Parking Zones on Pacific and Osos:.Streets was passed and adopted on motion of Richard Sleight, seconded by Kenneth W. A Street light has been requested in Monterey Heights at the turn- around'located.at the extreme end of Buena Vista Street. The P.G. & E. Company has studied this and finds there -is no problem in the installation. If the Council has no objection, it is requested that Mr. Romero be authorized to order.the street light installed. There being no objections, Mr. Romero was authorized to order the street light installed. 58-10-3T. Some time ago the.Traffic Committee recommended a stop sign on Kentucky.at Hathway, but the Council held this matter over pending a more complete study of the Traffic situation on the other side of.the street. Now that Cal Poly has installed a stop sign at the intersection of their access road and Hath- way, it is-recommended that the Council authorize the stop sign on Kentucky at Hathway stopping Kentucky traffic. Introduction of Resolution No. 443 (195$ Series). A Resolution Establishing Boulevard Stops on Kentucky Street at its Inter- section with Hathway Street was passed.and adopted on motion M of Kenneth Jones, seconded by Richard G. Some time ago the Litho Art Shop at.1$04 Osos Street' requested a,.time -limit zone in front of the print shop. At that time, the Traffic Committee recommended against such a ,zone because the congestion did not seem to justify the re- quest.. However, with the opening of Cal Poly, additional parking has been noted, and it is recommended that.one ten- ' minute green zone be established on the east side of Osos run- ning 22 ,feet in a southerly direction from the southeast corner of Church and Osos. Barry 'Smith 58-10-5T. - With the street - improvement on Cerro Romauldo, it is felt that stop signs should be installed on Cerro Romauldo . stopping traffic in both directions at Cuesta and protecting Cuesta Street traffic. These stop signs are recommended by the Traffic committee. Introduction.of Resolution No.. 445 (195$ Series). A Resolution Establishing Stop Signs on Cerro Romauldo at its intersec- tion kth Cuesta Street, was passed and adopted on motion of Kenneth Jones, seconded by Richard Sleight on the follow - ing roll callvote: 58- 10� -6T. For some time, the Committee has been studying the dip at the corner of Pacific.-and Morro Streets near the old Telegram- Tribune Building. A study has 'shown that it would cost many hundreds of dollars to correct this dip which repre- sents a traffic hazard.. However, after further study the Com- mitt'ee feels that this expense could be avoided and the traffic problem would not be hindered if the stop signs were reversed stopping traffic in both directions on Morro at Pacific and eliminating the present signs on Pacific at Morro. The dip would not be at all dangerous for cars coming to a stop at the signs. 40 ®CT 6 1958 Introduction of Resolution No. 446 (195$ Series). On the request that the visibility conditions'at Palm and Santa Rosa be studied, the Traffic Committee feels that this street would be quite difficult to widen in the foreseeable future because of the large number of permanent improvements. In lieu of widening, we feel that sooner or later parking will have to be eliminated on both sides of Santa Rosa from Monterey to Mill Street. In fact, we would be willing to make such a recommendation at this time in the interest of traffic safety and easing of congestion. However, we realize that this would be a rather important policy de- cision, and the parking needs of the community might have to be con- sidered in addition to the problem of traffic movement. It is sug- gested that the Council.might wish to hold a public hearing on this question of eliminating parking along Santa Rosa, or as another al- ternative might pick a committee to study this matter further with U60 This matter was ordered held over for further.study Oy theCity Council. 30 Second reading of the application for boardin house license from (1) Colista Morris, 99 Foothill Boulevard 2T-Ra--611danks, 1233 Monte Vista Place. Request of James Danaher for abandonment of Park Street by the City adjacent to Lot lock 13$, Phillips Addition, referred to the City Clerk for investigation was then referred to the-Planning 1 Commission for study and recommendation to the City Council. 5. Request of Elizabeth Hannah to purchase city -owned property adja- cent to 1420' Street, referred to the Planning Uommission for investigation and recommendation to the City Council. 6. The .following salary step increase was approved by the -Council on motion of Nels Beck, seconded by Richard G. Sleight. Jack S. Bomar - Police Officer - from step 1 or $354 per month to step 2 or 4375 per month., effective.November 1, 1958. 7. Announcement of a one -day traffic court and enforcement conference in Santa Barbara. Mr. Miller-, Administrative.Officer, requested that Police Chief Schofield and Lieutenant Elsea and Sergeant Malmen be allowed to attend this session. Request approved on motion of Richard Sleight, seconded by 'gels Beck. $. Communication from William Flory, Superintendent of Recreation Depart- ment to Police Chief Schofield, requesting assistance of the Police Department in the recreation program for the children of the community-on Halloween. At the request of theCouncil the Police Recrea- Department will cooperate and coordinate-with the tion Department. ' 9. For the Council's information, a complaint was filed * in -Superior Court by the narmon Valley Creamery Association vs. W. M. Lyles Company and the City of San uiL s Obispo for alleged damages on Dana Street. Mr. Houser, City Attorney, reported that the city's insurance carrier had been notified and also the W. M. Lyles Company was notified to defend and save the city harmless from any costs in defending this suit.
