10. Communication from the San Luis County Bowmen's Association, re-
questing permission to use city land adjacent to the freeway be-
tween French Road and.Biaachi Lane. Mr. Proud of the San Luis
County Bowmen appeared before the Council regarding the request
for use of city land. Mr. Proud stated that all safety regula-
tions would be complied with, etc. The matter was referred to
the Park and Recreation Commission for study and recommendation
to the City Council.
11. At this time, Mr. William Houser, City Attorney, reported to the
City Council regarding the appeal before the Civil Aeronautics
Board regarding ..airline service for the City of San Luis Obispo.
Mr. Houser stated.that he believed a consultant should be hired
to aid in making the necessary economic studies of the area
for presentation to the C. A. B.
Introduction of Resolution No. 447.(1958 Series). A Resolution Increas-
ing the'1958 -5 udget was approved on motion of Kenneth W. Jones,
seconded by Richard G..Sleight on the following roll call vote:

On motion of Nels Beck, seconded by Richard G. Sleight, Mr. Houser
was authorized to contact and retain consultants for economic
studies in regard to the airlines case before the C:A:B. On
motion of Nels Beck, seconded-by Richard-Sleight Mr. Houser was
granted a 4500 .retainer and 4130 per day for personal appear-
ances before the C.A.B. on behalf of the request for-the City of
San Luis Obispo to acquire airline service.
12. Public Works Department report for the month of August was ordered
received and filed.
13. Mr. Houser was authorized to meet for general pre -trial conferences
on settlement of the Serafin sewer condemnation case with the
attorneys for Serafin.
On motion of- Kenneth W. Jones, seconded by Richard Sleight; the meeting
was adjourned.

COMMUNICATIONS
Mayor Lucksinger.,welcomed thehigh school students who attended the
Council meeting and urged them to ask any questions that they wished
of the City Council or the department heads.
1. Communication.from the Civil Aeronautics Board regarding request of
the City of San Luis Obispo for information.zelative to scheduled
flight revisions at San Luis Obispo -Paso Robles was received and
filed.
2. Communication from Division of Highways, District V, regarding the
widening of the Grand Avenue Undercrossing was received and filed.
3. Communication from the Department of Water Resources forwarding plans
and specifications for the Council's information on the Whale
Rock Dam Project. Mr. Miller was authorized.to write a etter
stating that the plans and specifications appeared in order and
urging that the call for .bids be made as-rapidly as possible.
Authorization was made on motion of.J. Barry Smith, seconded by
Nels Beck.
4. Communication from the Chamber of Commerce thanking the City for
their. cooperation. on street and highway problems was received .
and filed.
5. Communication from the County of Los Angeles Board of Supervisors,
thanking the City of San Luis Obispo for their cooperation in
sending fire equipment during the Monrovia Fire was received

PUBLIC HEARING - At this time the City Council held a public hearing
on the final adoption of Ordinance No. 91 (1958 Series). An Ordin-
ance-.Rezoning Portions of the Ingleside Homestead Tract and the
Murray and Church addition from R -2 to R -3.
There being no fUrther protests, the hearing was closed and the
ordinance finally passed on motion of Kenneth W. Jones, seconded
by Richard G. Sleight on the following roll call vote:

PUBLIC HEARING - At.this time the City Council-held a public hearing
on Resolution No. 426 (1958 Series), a Resolution Propozing- Rezon-
ing of Property at Foothill Boulevard.an d Carpenter Streets.
Mr. Fraser, City Planning Director reported to the City Council on
the meetings held by the Planning Commission.regarding• the re-
zoning of'this area which was denied by the Commission.
Mr. Peter Andre,'Attorney representing Jack Farris and Lloyd Villa
urged that the City Council change the zoning as per the request
of the petitioners.
Further, Mr. Andre stated that the area requested to be rezoned
to R -3 is directly across the street from R -3 property and he
believed that it.was the policy of the Planning Commission to
face similar zoning on.a street.
Mr. Andre urged the City Council to rezone this property to R -3
so that Mr. Farris could build two duplexes on each lot.
Mr. John.Badgley, Architect,.ststed that he is an Architect and
amity Planner for other cities in the state and that he has studied
this matter of rezoning from the point of a professional planner.
He said that a study will show that there are available many large
parcels of land previously zoned R -3 and that there is no need-to
zone additional R -3 property at this time.
Mr. Badgley stated that there were good planning reasons for keep-
ing Carpenter Street in an R -1 district in order to maintain the
high caliber of single family.dwellings in this area. Further,
Mr. Badgley said that dup3ex -type construction breeds slums as
they are'never properly main.taiiied and.are the least desirable-de-
velopment in an area.
He also said that the present traffic load being carried by
Hathway and Carpenter Streets would be increased by a great number
if multiple dwellings were allowed to be placed as requested.
Also, personally, Mr. Badgley is just against R -3 zoning near his
residence.
Mr. Burt Fellows - 20$ Hathway Street -- urged no change in zoning as
requested by the petioners, primarily because of the tremendous
increase in traffic which will .be generated by multiple dwelling
houses to an already overcrowded street. He believed that for the
protection of the children and residents of the area, additonal.
traffic should be.discouraged,
Mr. Paul Rich, property owner, appeared before the Council urging no
c ange in zoning be made as people depend on the zoning at the time
they purchase a property.
Mr. M. E. Smith, property owner, .urged - -no change in the zoning; primar-
ily because of the additional traffic which will be generated on
Carpenter Street, Foothill and Hathway Avenue.
Mrs..Charles Brown urged the City'Counail not to allow the change in
zoning as the proposed area is adjacent to her home and she did '
not wish to look out her window onto these cheap dwellings.as
this is a very desirable residential neighborhood and should be
kept so for the nice people; not rented to transients who add
nothing to the community.
Dr. McCapes urged that no change be *jade in the zoning due to the
increased traffic which will be generated by multiple dwellings.

Mr. Andre again appeared before the City ;Council urging that the
change in zoning be made for multiple dwellings as the community
needs this type of .dwelling. Further, that whether this property
is developed as a single or multiple dwelling the traffic would
not be materially reduced due to the constant growth of the
city.
Mr. Andre believed that having these apartment dwellings built
close to the school might tend to alleviate the traffic as
students living this close to Poly might walk to school.
1 Mr: Bad 1 asked that the City Council study the figures presented
by the ity's Planning.Consultan t, Hahn -Wise regarding the
percentage of R -3 Area in the City and compare that with the
perd.entage:of R -3 area in other cities.
Mr. ,Brown, Cal Poly staff member, stated that he did not believe
that the housing of Poly- students is an important item here as
the most important point in this rezoning was the allowing of
cheap housing to encroach upon high -class residential property
such as he has. tie also said that most people., when they speak
for- housing for Cal Poly students are not sincere as they are
not interested in the student's welfare, but the money they
bring to the community.

PUBLIC HEARING - At this time the City Council held a:--public hearing
on final - passage of Ordinance No. 89.(1958 Series).. An Ordinance
Rezoning Property on Swazey Street From R -2 and R -3 to C -3.
Mr. Fraser, Planning Director, briefed the City Council on the
actions of the Planning Commission regarding the rezoning of
a portion of Swazey Street.
Mr._ Hiltunen appeared before the. City Council urging that they
allow no change in aDning on Swazey Street due to the narrow-
ness of the street, the poor.drainage and the heavy traffic
that will be generated'by additional commercial development
.in this area. He also said that people in this area were
attempting, through maintenance and repair, to make this a nice
residential area
Mr. Joe Warnagieris, Realtor, appeared before the Council urging
that no change to commercial or industrial zoning be made in
this area of the closed Osos Street crossing as these types
..of businesses create a greater fire hazard and access for fire
equipment to this area is very poor. Also, heavy traffic. would
-.be generated by these industries on an already overcrowded.. street.
Mr. Warnagieris believed that this area has already been pocketed
by the.-closing of the Osos street crossing and should be allowed
1 to grow as a residential area.
There being no further comments the hearing was closed.

an assessment district in the Serrano Heights. area was referred
to a Council study session.
14. Communication received from David Romero, City Engineer requesting
reclassification of Tom Gingg from Senior Engineering Aide, 4300
per month to Principal Engineering Aide, first step at $354 per
month
15. Mr. Miller, Administrative Officer recommended approval promotion
to be effective November 1, 1958. Council approved and promotion

Traffic Committee Report 58- 10 -8T. . "For sometime the City has been
working with property owners on the alley running between Garden and
Broad Streets and Marsh and Higuera Streets.
Quit claim deeds have been received from all property owners with
the understandin g that the City would repave the alley. The
Traffic Committee recommends.that the City Attorney be authorized
to prepare an ordinance for the Council's approval restricting
the alley to one-way traffic entering at Garden and exiting, at
Broad and providing that the alley shall be used for loading and
unloading only of passengers, freight, etc. The engineering de-
partment also plans to revise the driveway ramps in and out of
the alley to provide for street type sections rather than driveway
ramps. This should facilitate traffic movements,
It is also recommended that an ordinance be passed designating the.
alley as Garden Alley. This name has been approved by the Planning
and Fire Departments."
Traffic Committee's report was referred to the City Attorney for-pre-
paration of. ordinances to enact.

9. Communication from William E. Schofield, Chief of Police, recom-
mending to the City Council approval of turning over to the
Highway Patrol that portion of the 101 freeway through the City
of San Luis Obispo -for patroling and policing.. Chief Schofield
states the matter has been discussed with the District Commander
and Assistant Commissioner. Plan approved on motion of Nels
Beck, seconded by Kenneth W. Jones.
10. For the Council's information, communication from R. D. Miller,
to J. C. Williams, Foster & Kleiser Company, requesting the in-
stallation of the poster panel at the extreme rear of the Mission
Garden property at Chorro and Monterey, authorization previously
given by Mr. Renetzky, Attorney for the Frederick truct. Approved
by common consent of the Council.
11: City Council requested Mr. Miller to look into the matter of having
the fence repaired, along the sidewalk of the property owned by
the Marre estate on Chorro Street, to b e. expedited if the fence
is found to be in an unsafe condition.
12. Mr. Houser was;.requested to look.into the matter of circus posters
and other advertising being placed on fences and buildings and
not being removed.
