HomeMy WebLinkAbout07/13/1959JUL 13 M3 MINUTES ADJOURNED COUNCIL MEETING July 13, 1959 - 7:30 P.M. The City Council met in adjourned session with Mayor Fred M. Waters presiding. Roll Call: Present - Kenneth W. Jones, Donald Q. Miller, Gerald W. Shipsey J. Barry Smith, Fred M. Waters , 1. Proposed sign ordinance was held over for Council study. 2. Proposed ordinance controlling "out of business sales," fire sales," etc. was held for Council Study. 3. Proposed sidewalk ordinance was held for Council study. 4. UNION OIL COMPANY FRANCHISE Mr. Houser, City Attorney, explained the conditions under which the present franchise was granted and then described the proposals in the new franchise requested by Union Oil Company, and the legal re- quirements regarding granting of a franchise by a municipal corpora- tion. City Attorney Houser and Administrative Officer Miller recommended to the Council that a new franchise be granted to the Union Oil . Company for five years on the basis of $100 per mile per year. On motion of J. Barry Smith, seconded by Kenneth W. Jones, the re- commendation of the Administrative Officer and City Attorney were adopted and the City Attorney was instructed to prepare the neces- sary documents for granting a franchise. 5. RICHARD STREET ASSESSMENT DISTRICT FORMATION ' Mr. Miller, Administrative Officer, recommended.to the Council that before any official.hearings are held regarding the formation of an assessment district, that an informal hearing with the proponents and opponents of the proposed district be had, so that the Council can decide whether a district can be formed if the people are fully informed as to costs, etc. Mr. Levin appeared before the Council and urged that rapid formation of the district be made as he needs water now. Mr. Romero, City Engineer, stated that with the present time schedule and the legal requirements, it could go to contract some time between April and May, 1960. On motion of J. Barry Smith, seconded by Donald Q. Miller, the City was authorized to proceed with the formation of the district and to get proposals for engineering design from outside consultant firm and proposal for a legal consultant for the district. 6. JOHNSON AVENUE PLAN LINE Mr. Romero, City Engineer, briefed the Council on the proposed plan line for Johnson Avenue, and policy decisions made by prior Councils ' regarding the development of the plan line. Administrative Officer, R. D. Miller, read Resolution No. 341 (1958 Series), "A Resolution Establishing Certain Policies of the City in Connection with Plan Lines," f6r the Council's information. It was moved by J. Barry Smith, seconded by Gerald W. Shipsey, that the City Council hold a public hearing on the establishment of a plan line on Johnson Avenue, hearing to be held on August 3. 1959. Motion was carried. JUL 13 tyiD i 7. PROPOSED ENGINEERING MINIMUM DESIGN STANDARDS Mr. Romero explained to the Council the purposes of the minimum design standards for engineering within the City. Mr. Romero stated that after adopting a set of minimum design standards it enables outside engineers and subdividers to know what the minimum requirements of the city are. Mayor Waters suggested that the contractors be allowed to review these standards before adoption by the Council. ' Mayor Waters appointed Councilmen Jones to set a meeting andmeet with the contractors to go over these :standards. City Engineer, Planning Director, and Administrative Officer were also asked to meet with Mr. Jones and the contractors to go over these standards. 8. (a) DEEP LOT ORDINANCE 17 '" Mr. Houser, City Attorney, at the request of R. D. Miller, Administrative Officer, explained to the Council the provisions of the recommended deep lot ordinance. rr After some discussion by the City Council, the following ordinance Q was introduced and passed to print on motion of J. Barry Smith, seconded by Kenneth W. Jones: ORDINANCE NO. 125 (1959 Series), "An Ordinance Adding Section 9200.16 (7) to the San Luis Obispo Municipal Code Provided For the Regulation of Deep Lot Subdivision." AYES: Kenneth W. Jones, Donald Q. Miller, J. Barry Smith, Gerald W. Shipsey, Fred M. Waters NOES: None ABSENT: None (b) BOARD OF ADJUSTMENTS Mr. Houser explained to the City Council the recommendation of the Planning Commission regarding additional duties of the Board of Adjustments. On motion of J. Barry Smith, seconded by Kenneth W. Jones, the following ordinance was passed to print: ORDINANCE NO. 124 (1959 Series), "An Ordinance Amending Section 9200.17 (g) (1) and Section 9200.17 (9)(2). AYES: Kenneth W. Jones, Donald Q. Waters NOES: None ABSENT: None (c) COOPERATIVE APARTMENT DEVELOPMENT Mr. Houser, City Attorney, explained to the City Council the recom- mendations of the Planning Commission regarding the amendment to the Municipal Code, both in the subdivision section and in the zoning section, setting forth provisions for developing cooperative apartments. On motion of Kenneth W. Jones, seconded by Donald Q. Miller, ORDINANCE 110. 126•(1959 Series), "An Ordinance Amending Section ' 9100.4 and 9200.16 of the San Luis Obispo Municipal Code" was intro- duced and passed to print.. AYES: Kenneth W. Report by Councilman Jones and Miller regarding traffic signs, etc. was held over. 10. Communication from City Engineer David F. Romero, regarding the removal eucalyptus trees on Monterey and Kentucky street to alleviate sewer problems in this area. Mr. Romero recommended that these trees be removed. On motion of Donald Q. Miller, seconded by Gerald W. Shipsey, the eucalyptus trees on the south side of Bond are to be removed. Motion carried unanimously by the Council. 11. Communication from David F. Romero, City Engineer, regarding the complaint of drainage run off from buildings in the old city corporation yard on Santa Barbara Street. Mr. Romero reported that he investigated the matter of the alleged. run off of rain fronf..buildings in the corporation yard and that gutters have been placed around the shop building and water drains.to Santa Barbara Avenue. Also, a drain had been constructed from.the low point in the yard to Chorro Street. Mr. Romero believed these provisions were satisfactory. Councilman Donald Q. Miller suggested that possibly the City could rod out the drain from the yard to Chorro Street and also place a gutter on the rear portion of the buildings, so as to protect the new duplex on Chorro Street. 12. Announcement that the next quarterly meeting of the Leanue�; of California Cities, Channel Counties Division, will meet in Pismo Beach on Thursday, July 16, Arroyo Grande and Pismo Beach to be the hosts. 13. Mayor Waters nominated the following citizens to serve on a committee to study traffic problems in the downtown business district, including one -way streets and other related traffic problems: John Ross, Chairman J. A. Bardin Margaret McNeil J. Rex Bowlby Jr. Walter Pfleghaar Bernard Duveneck Randol A. Ward E. J. Fabbri June Zegar Paul Jones Councilmen Shipsey & Smith On motion of Gerald W. Shipsey, seconded by J. Barry Smith, the citizens appointed by Mayor Waters.were approved. 14. Mayor Waters announced that the City Council and Planning Commission will hold a joint meeting at 5:30 P.M., August 4, 1959, at the Motel Inn, and any items to be suggested for an agenda please be turned into the City Clerk. 15. Richard D. Miller, Administrative Officer, announced the appointment of Raymond M. Mattos, Janitor, effective July 13, 1959, at $280 per mo. 16. Communication from the City Planning Commission regarding the request of the Industrial Development Committee of the Chamber of Commerce regarding proposed annexation southerly from the south city limits. The Planning Commission submitted a map showing the results of their meeting and the area proposed to be annexed. The Planning Commission so recommends to the City Council. Mr. Kjaerbye, Chairman of the Chamber's Industrial Development Committee urged the Council to approve the annexation so;that,7steps can be made to annex this property to the city, so that some industrial property be made available for development. 1 1 1 JUL 13 1959 Mr. Houser, City Attorney, stated that informal petitions requesting annexation to the city by interested property owners is the first step in starting the annexation proceedings. Mr.-Miller, Administrative Officer, mentioned the city's uniform policy of requiring those annexing to agree to the assumption of all prior bonded-_ indebtedness-of the city. He added, however, that at the present time, this only amounted to a lur (one cent) differential in the tax rate. There was no objection on the part of the Industrial Development Committee to following the usual practice. Mr. Rjaerbye stated that the Industrial Development Committee will also help the Yoakum area in their attempts to annex to the City. After some discussion, Councilman Smith stated that the first step was for the Council to receive a.petition from the property owners asking for annexation. On motion of J.
