CITY COUNCIL MINUTES

The City Council met in regular session with Mayor Pro Tempore Kenneth W. Jones
presiding.

Minutes for the special called meeting of December 14,1959, regular meeting of
December 21, 1959, special called meeting of January 4, 1960 and regular
meeting of January 4, 1960, were approved as presented.
City Clerk reported on bids received and,opened for furnishing PETROLEUM PRODUCTS
for the City of San Luis Obispo for the calendar year, February 1, 1960, to
January 31, 1961:

Administrative Officer Miller reported that after analyzing the bids and the
estimated quantities, he recommended that the low bids of Seaside Oil Company
for gasoline be accepted and the low bids of J. B. Dewar, Inc. for diesel fuel,
stove oil and motor oil be accepted.
After some discussion by the Council, it was moved by J. Barry Smith, seconded
by Gerald W. Shipsey, that the recommendations of the Administrative Officer
be accepted and the bids awarded accordingly. Motion carried.
COMMUNICATIONS
1. Communication from the Department of Water Resources regarding increase in cost
for theWhale Rock Dam Project was received and filed.
2. The following Board Orders from the County Board of Supervisors were received
and filed:
#22, dated December 7, 1959, in that the County agrees to take
over operation and maintenance of County Road FAS1207, Old Creek
Road.
#23, dated December 7, 1959, regarding the contract with the State
- Department of Water Resources and the County for-additional surfac-
ing for Cottontail Creek Road.
#25, Resolution appointing the County -Road Commissioner as County
Agent'relative to state road resurfacing contract. (Cottontail
Creek Road)

3. Mr. Miller, Administrative Officer, presented a letter from the Department
of Waix Resources suggesting to the City Council that the City apply for
financial assistance for extra costs on the Whale Rock Project, under the
provisions of the Davis- Grunsky Act. Administrative Officer Miller recom-
mended to the Council that they file a preliminary application for determi-
nation of eligibility under this act.
RESOLUTION N0. 625 (1960 Series), "A Resolution Authorizing the Filing of a
Request for Preliminary Determination of Eligibility for Financial Assistance
Under the Davis - Grunsky Act" was passed and adopted on motion of J. Barry
Smith, seconded by Donald Q..Miller on.the following roll call vote:

4. Notice of Public Hearing on Resolution of Intention to Create Zone #4 of the
San Luis Obispo County Flood Control and Water Conservation District was re-
ceived and filed.
5. Communication from the Planning Commission regarding the placement of benches
for bus stops in the downtown San Luis Obispo area and the problems attendant
thereto, was referred to the Traffic Committee for study and report of any
problems to the Council.
6. Communication from the San Luis Obispo City Schools requesting that the City
Council not consider the annexation of any area to the City which may be sub-
divided unless available schools.are already constructed or land can be made
available for school sites was received and filed.
7. Communication from Touy.Perez and Gil Brown to hold a Latin.Jazz Dance at the
Grange Hall on.January 30, 1960 was approved on motion of Donald Q. Miller,
seconded by Gerald W. Shipsey.
8. Communication from Mel Sebastian, Jr.'requesting abandonment by the City of
that portion of Church Street between Nipomo and High Streets, adjacent to Lots
5 and 6, was referred to the Planning Commission on motion of J. Barry Smith,
seconded by Donald Q. Miller for investigation and report.
9. Copy of communication from A. M. Nash, District Engineer to Mr. E. H. Atkinson,
Chairman of the Chamber Highway Committee regarding indefinite postponement
of plans for improvement of route 147 from San Luis Obispo to Arroyo Grande
to expressway standards wasreceived and filed.
10. Notice of Channel Counties Division Meeting, League of California Cities,
Thursday, January 28, 1960, at Lompoc, California, was received and filed.
11. Communication from the Administrative Officer regarding proposal of Harry N.
Jenks, Consulting.Engineer, to prepare a study of future sewage disposal re-
quirements in the City of San Luis Obispo.
Councilman Smith asked the Administrative Officer when the last study was
made for sewer facilities for the City of San Luis Obispo and what data was
offered in said report. The matter was held over for investigation of prior
reports. (referred to special council meeting, February 1, 1960)
12. Communication from Whipple, Adamson, Murphy & Pearson, offering to furnish
Civil Engineering services for the'design -of Higuera Street sanitary sewer
outfall line from French Street southerly for 1800 feet.
The City Council discussed the advisability of having the consulting engineers
prepare a study including plans and specifications for the sewer line from
French Road to the sewer plant at this time, and then call for bids on a unit
basis as funds become available.
On motion of J. Barry Smith, seconded by Gerald W. Shipsey, the proposal was
accepted, from French Road to PortugeseeFlat Road. Motion carried with Coun-
cilman Miller voting no.

The City Council requested that R. D. Miller, Administrative Officer, get
a proposal from the consulting engineers for the balance of the route to the
sewer farm.
13. Grant Deed from A. L. Ferrini and Hilda Ferrini for pump house site and tank
site in the Ferrini Ranch Estates was accepted on motion of Gerald W. Shipsey
seconded by J. Barry Smith.
14. Grant Deed from Maioo Properties and agreement regarding alley ajjacent to
Foothill Shopping Center was accepted on motion of Gerald W. Shipsey,
seconded by Donald Q. Miller.
15. Agreement between the City of'San Luis Obispo and the Springfield Baptist
Church for construction of two standard drop inlets at the southerly limits
of Brook Street for drainage was accepted on motion of Gerald W. Shipsey,
seconded by Donald Q. Miller.
Councilman Smith left the meeting at 8:30 PM.
16. City Engineer Romero outlined the program.of improvement as proposed under
the Richard Street Assessment District.
He discussed the various parcels which were assessed and compared them with
the original estimate. He requested a council policy decision regarding
City contributions on existing water services.
It was the consensus of the Council that the City would pay for the normal
residential frontage on all parcels with a legal existing service.
This matter was held over to the meeting of February 1, 1960, for presenta -.
tion of legal documents for formation of the district by special assessment
' attorneys.
17. David F..Romero, City Engineer, briefed for the Council the proposed develop-
ment of Bel -Air Manor, a county subdivision, and•expihined the invitation
of the County Planning Commission for the City Planning Commission to. take
part in the study of the development of this proposed subdivision. Received
and filed.
18. Communic ation:from the Regional Water Pollution Control Board bringing the
Council's attention to public law 660 in the 84th congress regarding sewage
treatment construction grin ts"for projects to be undertaken during 1960 -61.
Received and filed.
19. Bulletin from the League of California Cities, Subject -- League Committee,
annual appointment by new league president. Received and filed.
20. Bulletin #78, Feather River &'Delta Diversion Projects, primary report, was
received and filed.
21. The following salary step increases were approved on motion of Donald Q.
Miller, seconded by Gerald W. Shipsey:
RICHARD AYERS - Disposal Plant'Operator - from, step 1, $312
to step 2, $330 per month effective February 1, 1960.
JOHN GREENE - Police Officer - from step 1, $368 per month to
step 2, $390 per month effective February 1, 1960.
TIMOTHY E. STORTON - Police Officer - from step 1, $368 to
step 2, $390 per month effective January 1, 1960.
CHARLES A. JONES - Assistant Building Inspector - from step 1,
$390 per month to step 2, $412 per month. effective Febru-
ary 1, 1960.

Councilman Smith took his seat at the Council table at 8:50 PM.
22. Claims against the City for the month of January, 1960, were approved on motion
of Donald Q. Miller, seconded by Gerald W. Shipsey, subject to the approval of
the Administrative Officer.
23. The City Council discussed the newspaper articles regarding the sale by the
School Department of Mitchell Park, which is presently leased to the City
of San Luis Obispo. The City Council discussed the matter relative to being
required to read about these matters in the newspaper and not being notified
at a regular meeting.
Mayor.Pro Tempore, Kenneth W. Jones, appointed a council committee of Coun-
cilman Smith and Shipsey to look into the Mitchell Park lease problem with
the City School Board.
24. The City Council discussed the Industrial Annexation and asked the Acting Plan-
ning Director what was the present status of this annexation.
Councilman Miller suggested that progress reports ehould be submitted to the
City Council so that the Council will know what is going on regarding these
matters when members of the gemeral public call for information. Also, which
area is now included in the Industrial Annexation, as he understands that
there have been various amendments.and changes to the annexation as approved
by the Council.
City. Engineer Romero explained the status of the annexation.
OLD BUSINESS
1. Traffic Committee Report:
60 -1 -2T. "For Some time the Traffic Committee has been working with the '
Postmaster in a study of the traffic congestion which exists in connection
with the mail box at the curb in front of the Chamber of Commerce.office.
After study, it is felt that this box should be eliminated and replaced with
a similar installation alongside the Presbyterian Church on the east side
of Morro Street just south of Marsh."
"It is therefore recommended that one car space within the existing 60 -foot
red zone at that location be painted white and the curb -side mail box moved.
to that location. It is likewise recommended that the present zone on Marsh.
be eliminated and that one parking meter space be restored."
"It is felt that this will be a big improvement and that motorists traveling
north on Morro Street will be able to mail letters at this box very easily,.
then turn-right onto Marsh without hindering the main flow of traffic."
Held over for further study.
"60 -1 -3T. A complaint has been received 'on an obstruction to visibility on the
southwest corner of McCollum and Henderson Streets. The Traffic Committee had
confirmed this, and if the Council has no objection, the Engineering Department
will take steps to remedy this situation."
There was no objection. Recommendation approved.
The Traffic Committee was requested by the City Council to check the obstruc-
tions on the southeast corner of Ella and Johnson Avenue. (Councilman Donald
Q. Miller)
2. Report of the City Engineer on the number of residential garages that have
been remodeled into rooms, etc. (referred back to City Engineer on January
4, 1960 to verify dates of conversion and number actually in violation of
code) was held over for completion of study by the City Engineer.
3. Yoakum Annexation progress report. Mr. Houser, City. Attorney, explained that
he had prepared the necessary petitions for securing signatures for annexa-
tion and had forwarded instructions to the proponents and they now have six
months in which to complete the petition:

4. Report of the City Engineer on progress of surveyor making accurate survey
of each proposed parcel to be acquired by the Parking District. Mr. Romero
reported that the surveyor is still preparing the survey of the proposed
parking lots.
5. Report of the Planning Director on the relocation of Howie- Shelton corpora-
tion yard on Walnut Street and Santa Rosa and other violations to the code.
Held over for report on all violations of record.
6. Communication from the Lindero Investment Company requesting acceptance by
the City of Tract 138.- On motion of J. Barry Smith, seconded by Donald Q.
Miller, the request was dropped from the agenda as the subdivision has still
not been completed.
7. Communication from R. L. Cline and D. Bressi for acceptance by the City of
dedication of Bressi Place into the City street system.
Communication from the City Planning Commission recommending acceptance of
the Cline subdivision and setting forth the requirements of the acceptance.
Communication from R. L. Cline requesting that his proposal be withdrawn

8. Cdmm nication from Edgar 0. Laird requesting the City Council sell Lot 22 Blk
d-j 45 at public auction.
Report of the City Clerk on the above. On motion of J. Barry Smith, seconded
by Donald Q. Miller, recommendation for public auction was adopted - -City
Clerk and City Attorney to prepare Notice of Public Auction to be held
February 1, 1960. Minimum bid - $29500.
Councilman Smith requested that the City Council be furnished a list of all
City -owned property regardless of - how acquired, for the information of the
Council.
9. Petition from the residents of the 500 block of Kentucky Street requesting
that the Council take action to have curbs and gutters placed in front-of
522 and 526 Kentucky Street.
City Engineer Romero reported that one property owner had contacted the con-
tractor to have curb and gutter placed in front of their property. The
second property owner, Gragg, was waiting for a decision on property acqui-
sition from the City before proceeding with curb and gutter installation.
10. The following is a letter from City Engineer David F. Romero on the transfer-
ring of certain properties in lots 11 and 12, block 8, Arlington Addition to
0. D. Vansandt and J. M. Gram:
"Since it appears that there may be some controversy rggarding the Gragg-
Vansandt street deed on Taft Street, I feel it is worthwhile to place in
writing my recollections of the events leading up to tonight's meeting.
"My first contact with Mrs. Gragg was at the request of the Council, after
receipt of the petition of property owners on Kentucky Street for formation
of an assessment district to force the installation of curb and gutter across
her Kentucky Street frontage. During this conversation she informed me that
she did not want to be the only person on the street holding back progress
but that she did not desire to place curb and gutter across her frontage until
the question was resolved as to whether she was poying taxes on and would be
improving city -owned property.
"With Mr. Fitzpatrick's help, .I investigated this and found that both her
city and county taxes were correct as assessed. I informed her that the
portion on Taft Street, to be deeded by the City, varied in width from approxi-
mately one foot at the Kentucky and to approximately 10 feet at the rear of her
lot. She informed me that it was not worth the curb and gutter improvements
for so small a portion of property. On this understanding, I instructed my .
crew to prepare the property description under one parcel.
"Meanwhile, Mrs. Vansandt, who had received the impression at the Council

meeting that the Council'a action in passing an ordinance to print constituted
a final agreement for her to acquire the entire Taft Street frontage, had pro-
ceeded,•, with the installation:>of curb, gutter and sidewalk across the frontage
of her residence and curb and gutter along the Taft Street frontage of the Gragg
property. Mrs. Vansandt came into.the office and asked whether it would be pro-
per for her to place sidewalk along the Taft Street frontage of the Gragg property.
I informed her that the city had no objection to this or did it normally exercise
any control regarding the limits of improvements placed by a property owner.
"Some time later, Mrs. Gragg informed me that she had all along wished to acquire
the.Taft Street frontage and that she objected to the installation of sidewalk
across this frontage since she intended to construct a driveway ramp her and did
not wish to go to the expense of tearing out curb, gutter and sidewalk in order
to construct the ramp. I immediately called Mrs. Vansandt and asked her to hold
up on the sidewalk installation and informed her that the city would describe
the property on Taft Street in two parcels - -one frontingher residence and one sid-
ing the Gragg property. (this had been agreed upon at the last Council meeting)
She stated that she had already contracted with Mr. Lenger. for the full improve-
ments and wanted to know haw she could be assured that she would not have to pay
for the full cost if she did not acquire all of the property. I informed her that
the Council would probably deed the property to the highest bidder on the condition
that the improvements were in and paid for by the party receiving the property.
I suggested that she hold up payment of her contractor's bill until after the
Council meeting, so that if the Graggs acquire one parcel they could pay the con-
tractor instead.
"I informed both Mrs. Gragg and Mrs. Vansandt that the only way I could see to
settle the problem was for both of them to attend tonight's meeting and bid on the
property if they wished to acquire it:"
Mr. Vansandt appeared before the Council stating that he would give up his claim
on the land adjacent to the Gragg property if Mr. Gragg would pay him for the curb
and gutter installed on this parcel of land.
Mr. Gragg appeared before the Council stating that he would pay for the curb and
gutter installed along the parcel of land adjoining his property if it were deeded
to him.
ORDINANCE NO. 149 (1960 Series), "An Ordinance Granting City -Owned Property
to 0. D. Vansandt and Beatrice Vansandt and James M. and Louise Gragg" was
introduced and passed to print on motion of J. Barry Smith,.seconded by
Donald Q. Miller, subject to the filing of an arrangement by which Mr.
Gragg will either pay the contractor for the improvments on the land he is
acquiring or pay 0. D. Vansandt for the improvements, who in turn will pay
the contractor.

12. Engineer's preliminary report on formation of an improvement District for
street improvements on Sydney Street from Johnson £o Flora and on Flora from
Sydney to its easterly end was referred to a Council committee for study and
recommendation. (Committee= - Councilmen Jones & Shipsey) Matter held over.
Herbert C. Grundell, Attorney, presented the following letter to the City
Council on behalf of his client, Henry.Diel:
"I represent Henry Diel, who owns the property fronting on one
side of Sydney Street, between Johnson and Flora.
"The matter of the formation of an improvement district for street
improvdments on Sydney Street between Johnson and Flora, and on
Flora from Sydney to its end, is now pending before this council.
"Because actual benefits would be very small, and because the
area to be benefited is small, the expense of a street improve-
ment district would be extremely large to each of the abutting

property owners; additionally the expense of going to bond
would entail an extra burden in the way of finance and legal,
when compared with other methods that may be used.
."Eliminating any thought at the present time of subdividing
any of the.. =.abutting•lands'in the area, an alternate plan of
presently improving Sydney Street has been advanced.
"My understanding of this alternative plan is as follows:
1. No improvement district is to be formed;
2. A two lane paved portion would be constructed
from-Johnson on Sydney to where he Maino sub-
division paving stops on Flora. This would be
a street of 24' minimum width, to grade, uti-
lizing a minimum of 6" IBM and 2" plant mix
surfacing.
3. No water, sewer, curbs or sidewalks would be
constructed under this plan.
4. By utilizing the $900 which Maino is obligated
to pay, providing construction is commenced prior
to June 17, 1960,'plus the payment of one dollar
per front foot by Mr. Diel and the other property
owners on S]tdney Street, with the City making up
the difference in cost this two lane street can .
be constructed. To eliminate any question, this
plan calls for Mr. Diel to pay $1.00 per foot of
his frontage on Sydney, and the owners on the
other side to pay $1.00 per front foot for their
property.
5. The two lane road as constructed will be to
grade, so that if any of the abutting property
is latersubdivided, in obeying the requirements
therefor, there will be no additional expense
in regrading or altering the paving so laid
under the plan. In other words, the above will
be the basis for future subdivision requirements
insofar as the central portion of the street is
concerned, and this'-Portion will not have to be
redone at the expense of the property owner.
"Mr. Diel has authorized meto say to you that he is in complete
agreement with the understanding as above stated, provided however,
that action must commence prior to the expiration date on the Maino
agreement with the City dated June 10, 1957."
12. The matter of the plant mix driveway at 129 Chorro Street which was referred
to City Engineer Romero to contact the property owner was received and.filed.
Mr. Romero is to present to the City Council his recommendation for a policy
determination on this type of problem.
13. ORDINANCE N0. 150 (1960 Series), "An Ordinance Adopting the San Luis Obispo
City Electrical Code" as:-amended to January 12, 1960, was introduced and
passed to print on motion of Donald Q. Miller, seconded by J. Barry Smith
on the following roll call vote:

14. Request for abandonment of half or all of Park Street between Wilson and
Highway 101 by the City.
Communication from the Planning Commission recommending that the street be
abandoned.
On motion of J. Barry Smith, seconded by Donald Q. Miller, this request was
held for Council study and the City Attorney was requested to review this
