action on Proposition 801, but was just asking that the Council take an
official stand against discrimination in order to off -set the damage
done by the realty group in furthering discrimination in housing.
Councilman
Miller stated that he had read Bill .801 and
that he supported
it and that
his experience in renting property proved
that discrimination
does exist
in the City of San Luis Obispo against certain
people, and
urged that
the City Council consider endorsing this bill
and further,that

read the bill and take action on the bill
at the study session
Wednesday,
May 3, 1961.
Mayor Davidson
urged the Council Committee of Shipsey
and Miller to study
the bill and make recommendation to the City Council.
24. J. Chshman, instructor at the Senior High School, appeared before the
City Council and tlanked the Council and Department Heads for the work
and time they have contributed to the students taking part in-the
Youth in Government Day activities: He stated that he was sure the
Council and Department Heads did not realize the great impression that
was being made on the students during their day in government. He again
thanked the City Council for their courtesy.
On motion of Donald Q. Miller, seconded by R..L. Graves, Jr., the meeting
adjourned to 7:30 P.M., Wednesday, May 3, 1961.

ADJOURNED CITY COUNCIL MEETING
May 3, 1961 - -- 7:30 P. M.
CITY HALL
The City Council met in Adjourned Session with Mayor Clay P. Davidson presiding.
ROLL CALL: Present - Clay P. Davidson, R. L. Graves, Jr., Miss Margaret M.
McNeil, Donald Q. Miller, Gerald W. Shipsey.
Absent - None
CITY STAFF PRESENT: Planning & Building Director.Abraham, City Clerk
Fitzpatrick, City Attorney Houser, Administrative
Officer Miller, City Engineer Romero.
1. The City Council discussed the matter of adoption of rules of order for
procedure of the Council meetings. The Council discussed various procedural
steps that should be :reduced to writing for a guide to the City Council '
for the Council meetings.
City Attorney Houser explained to the City Council what he had in mind
relative to rules of order so that all the Councilmen would be aware
of the procedural steps necessary to make motions,.etc.
After discussion, tor. Houser offered to contact the League of California
Cities, who have made several studies of this matter and do have copies
of rules of order, and then he could present these.to the Council for
their consideration.

Mr'. Houser was authorized to proceed with his suggestion and report to
the City Council at the first meeting in June, 1961.
2. Councilman Graves reported on a meeting of the Council Committee appointed
to study the Freeway Addition. He stated that only a short study had
been made of this subject, and that he did not believe that it would be
wise to stop the annexation at this point due..to the steps already taken.
City-Attorney Houser explained to the City Council the reason the
annexation was shaped the way it was, as the fact that the citizens
working on the annexation had attempted to get all the property owners
to annex but also had to keep in mind the 50% protest provision.
The City Council then discussed the various aspects of the proposed
annexation.
Mr. Houser then explained the steps necessary to proceed with the
annexation. He explained the provision of the Ordinance necessary
to call the election, etc.
ORDINANCE NO. 189 (1961 Series), "An Ordinance of the City of San Luis
Obispo Calling A Special Election to be Held on the 29th Day of June,
1961, Pertaining to the Annexation of 'Freeway Addition' to the City
of San Luis Obispo," was passed and adopted on motion of Donald.Q.
Miller, seconded by Gerald W. Shipsey, on the following roll call vote:
AYES: Clay P. Davidson, R. L. Graves, Jr., Miss Margaret M. McNeil,
Donald Q. Miller, Gerald W. Shipsey.
NOES: None
ABSENT: None
3. The following communication from Mayor Davidson on the sewer plant
enlargement was presented:
"At this time I would like to introduce to you one of the critical
decisions which we as a Council must make.
I have been studying the composition of San Luis Obispo as a City. At
this time it is my belief we have a well balanced community economically,
We have three State agencies, a start in Industry along with a good
retail district ... all of these contributing to the balance of the
community. We are now on a plateau of decision and must make the correct
choice of action.
With our present arrangement we are fast becoming a bedroom City. As
the State agencies expand they bring people to our community who are
of high caliber, but the taxes on.homes do not return ehough income
to proportionately support community services required. The-State
construction such as we have, again gives no return taxeise. We are
then fast approaching a time when either our tax rate must be raised
very high or a new source of income acquired. I believe this source
should be Industry. Let's review the facts.
We have a good water supply. We have a deficient sewer plant and are
in the process of planning an enlargement. Under present plans we
will enlarge this plant to accommodate 40,000 people. Should we proceed
with this plan we would have to adquire additional lands for ponding
effluent from the sewage plant, namely 19 acres. We now have approximately
50 acres being used in.this manner. These 19 acres will represent an
investment of approximately $47,500 in prime land which is adjoining
the freeway. Tie would end up with around $800,000 cost of enlargment
and still be able to serve only 40,000 people.
Should we successfully attract industry to San-Luis Obispo, which in my
estimation we must do, we could very well get this enlargement .
accomplished just.before it would again be overloaded.
There is one more item to be considered. As this City grown in the
south - easterly direction it will be necessary to install a trunk line
down Tank Farm Road. This line represents about $250,000 in cost.
We then have this proposal to consider. Should we at this time enlarge
the sewer plant, construct an outfall line to the Coast and install the
trunk line down Tank Farm Road? The estimated cost of such a project is
$1,960,000.
What are the advantages of undertaking such a plan? First the City
would then be in a position to service approximately 60,000 people along
with a reasonable amount of industry. In other words, this action will
put the City in a position -to accommodate industry at once. We would.
be in a position to retire a portion of the cost by utilizing a portion
of the Yoakum Tract assessment. There is also a possibility of developing
an annexation near the Country Club which could contribute towards the '
cost of the trunk line. We would also have nearly 50 acres of prime
land available for sale which should be worth approximately $125,000.
This land, after returned to private use and improvements,.could also
be returned to the tax rolls, returning an income of at least $4,000
per year. With this type of plan the total cost could very well be
$1,800,000.
Should you agree this is a good and necessary plan, the next question
is how can this be paid for?
I would like to digress for a moment. As you all know, last Sunday
we were visited by a. contingent from Oxnard including the Mayor who'
is also named Davidson, and several Councilmen. I had the pleasure of
talking to Mayor Davidson of Oxnard for approximately 30 minutes. In
his conversation he mentioned that Oxnard how has a.population of
approxirm tely 45,000 people and-is growing at the rate of approximately
4,000 per year. In the past seven years he has been on the Council,
the City of Oxnard has doubled in size. They have "growing" problems
too. He also mentioned they voted a sewer redemption bond, I believe
two years ago, and are very satisfied with the results except they
didn't go far enough and are now taking in a subdivision without being
able to serve them with sewer.
This is the type of problem-we are now considering. I believe it would
be extremely beneficial to this Council, the Administrative Officer, '
City Engineer, and the City Attorney, to make a one day trip to Oxnard
to study their development and planning over the past ten years. At
that time we could study their experiences with revenue bonds, their
benefits and disadvantages.
This could lead to financing of our program of sewer.system development
by revenue bonds.
I believe you are all familiar with the report .submitted by Mr. Jenks.
His report suggests three courses of action and recommends the first
proposal. Since this was approved by the former Council, no doubt
there should be some discussion regarding Mr. Jenks' recommendation as
well as action on my proposal. Should the Council desire to make the
trip to Oxnard, it will be necessary to contact Mayor Davidson of Oxnard
to set up a date.
At this time is there any discussion regarding the aforementioned proposal ?"
Councilman Miller congratulated Mayor Davidson on a fine analysis of the
City's sewage situation.
The City Council and staff then discussed the Mayor's proposal..
Administrative Officer Miller briefed the Council on progress to date '
on expansion of the sewer plant:
1. Application for government grant.
2. Retention of Stone and Youngberg.as•financial consultants..
3. Retention of Harry Jenks as design engineer.
Mr. Miller further explained that Mr. Jenks' proposal was to phase in
the various steps of the sewer plant enlargmment with final development
i. at some future date.

City- Engineer•Romero then presented not only the.three proposals of Mr.
Jenks, but also suggested•.that the Council should keep in-mind the.
following major items of sewer improvement, and explained that these
figures represented a horseback estimate to give some idea of
magnitude:
1. Sewer line Tank Farm Road, estimated $350,.000 plus.
2. Extension of Yoakum sewer, $40,000.
3. The final stage of the main City sewer line south on Higuera
Street from Portuguese Flat Road to the sewer plant, $75,000.
15% should be added to all_of the above for overhead costs.
Mr. Romero also urged that a consultant be retained to begin a study of
sewage development in the southeast area of the City for future
expansion.
Administrative Officer Miller discussed with the City Council the use
of-consultants in general, and also explained work done in the past
by Mr. Adamson on the sewer and water master plan, who is the engineer
Mr. Romero would like to see make the southeasterly study of the sewer
development.
The City Council then discussed various aspects of Mayor Davidson's
proposal regarding complete improvement and expansion of the sewer
plant.
Administrative Officer Miller suggested that the City Council authorize
I1r. Jenks and Stone and Youngberg to get together to study the Mayor's
proposal and then appear before the Council with the results of their
study. Mr. Miller also explained the cost to the City of the contract
with Stone and Youngberg and Harry Jenks.
Administrative Officer Miller was instructed to proceed with his
suggestion to contact the consultants to study the proposal and to appear
before the City Council with their recommendations.
4. Mayor Davidson presented each member of the City Council with a study
prepared by the One- Hundred Percenters Club of the City of Fresno, a
merchant group for the revitalization of the downtown business district
of the City of Fresno, which had been allowed to deteriorate by the
expansion of shopping centers to outlying districts.
5. On motion of Gerald W. Shipsey, seconded by R. L. Graves, Jr., City
Clerk Fitzpatrick was authorized to•call•for bids for demolition of
buildings in Lot D of the Parking District(Monterey- Higuera- Court -Osos
Streets), bids to be opened at 3:00 P.M., June 5, 1961.
6. Planning Director Abraham, at the request of Councilman Miller, explained
to the City Council the problem incurred in inspection of buildings •
within the City when the City does not have an adequate housing code.
He also explained how this problem is aggravated by the overabundance
of property zoned R -3 in the City.
7. Councilman Shipsey asked the City Council whether they should proceed
with a farewell party for the retiring Mayor and Council as has been
done in the past.
The Council agreed that this was a; nice gesture and Administrative
Officer Miller and City Clerk Fitzpatrick were appointed as a committee
to make the necessary arrangements._
8. City Attorney Houser reported to the City Council regarding negotiations
to date for exchange of property between the City of San Luis Obispo
and the Division of Highways at the sewer farm. Mr. Houser explained
the agreement section by section to the Council as to what would be
acquired by the City and what would be acquired by the State. Mr.
Houser said the.Council Committee and Staff.were agreed that with the
safeguards set up in the agreement the City would be protected against
any excessive costs. Mr. Houser then presented a Resolution to.the
City Council authorizing the Mayor to sign the agreement on behalf of
the City.
