ROLL CALL: Present - Clay P. Davidson, R. L. Graves, Jr., Miss Margaret M. McNeil, Donald Q. Miller, Gerald W. Shipsey. Absent - None CITY STAFF PRESENT: City Clerk Fitzpatrick, City Attorney Houser, Administrative Officer Miller, City Engineer Romero. Also Present: Planning Consultant Larry Wise, Special Legal Counsel Wickson.Woolpert. 1. The City Council held a confidential discussion on pending litigation before the City. 2. 10:50 P.M. Councilman Shipsey left the meeting. 3. It was moved by Councilman R. L. Graves, Jr., seconded by Donald Q. Miller, that the City Council deny the building permit of Maino Construction Company for addition to their plant at 2238 S. Broad Street, and initiate condemnation proceedings if necessary to ac- quire land for future street widening, on the following roll call vote: AYES: Clay P. Davidson, R. L. Graves, Jr., Miss Margaret M. McNeil, Donald Q. Miller NOES: None ABSENT: Gerald W. Shipsey On motion of Donald Q. Miller, seconded by R. L. Graves, Jr., the meeting adjourned at 11:10 P.M. FITZPKMCK, City Clerk 1 1 1 Planning Director Abraham stated that he agreed with the City Engineer with re- gard to the proposed 60 foot minimum street width but that the City Planning Commission to date had not established a plan line nor recommended sidewalk widths as the area is presently zoned "M" on the east side of Broad Street; however, the General Plan envisions a professional- administrative type of use which might or might not require less sidewalk area. Mr. Abraham said he felt that off - street parking requirements and intensity of the use of the land had a good deal.to do with any decision as to width of sidewalks. Because these things had not been decided-as yet, the decision as to width of sidewalk would have to be made by the Council. Councilman Miller stated that he believed that the sidewalk area should be ten'feet wide and that the street should not be made any narrower. Councilman Graves agreed, saying that the City will eventually need 10 -foot sidewalks in this area and that the width should be taken at this time instead of 5 -10 years from now. Mr. Maino stated that the City Council should -make up their minds now, before he begins construction, because once the building is built, the severance cost to the City would be prohibitive. The City Council then discussed various alternatives for use of the property with the present building and proposed addition. Mr. Maino asked that the matter be settled by the Council at this time so he could plan his building once and for all, and not have to worry about removing a portion of it at a later date. Councilman Shipsey arrived and took his seat at 4:20 P. M. City Attorney Houser, upon request of the City Council, stated that they had the following choices of action: - 1. Condemn 10' in front of the-new addition only. 2. Condemn 10' of entire frontage of the property. 3. Let Maino build as is. 4. Let Maino build to reduced set -back line. After discussion, it was-moved by R. L.• Graves, Jr., seconded by Donald Q. Miller, that the City proceed with condemnation along•Broad Street in front of the existing office building and the proposed building for an area of 10' in width. Councilman Miller asked if the motion of condemning 10' would allow Mr. Maino to salvage the majority of his present office building. Administrative Officer Miller recommended that the City Council only condemn frontage in front of the buildings and not condemn the frontage of the storage yard. Councilman Shipsey stated he would rather wait before condemning property =for street widening purposes until the City Council had made a decision on the over- all plan line program. 'Councilman Miller called for the question on the motion. Motion carried on the following roll call vote: AYES: Clay P. Davidson, R. L. Graves, Jr., Miss Margaret M. McNeil, Donald Q.
