Councilman Graves, seconded by Councilwoman McNeil, Mr. Miller, Administra-
tive Officer, was instructed to direct the Public Works department to
cover all the No- Stopping signs on Santa Rosa Street and further to instruct
the Police Department not to enforce the original No- Stopping Ordinance.
Motion carried.
4. Mayor Davidson reported to the City Council on his meetings with State
Representatives regarding the interchange at Madonna Road, and stated
that the State Budget Engineer told him.that the Madonna Road over- crossing
' had been placed in the 1962 -63 Budget, and if funds were made available,
prelimianary construction could start in early 1962.
Mayor Davidson further stated that he discussed with the State Budget
Engineer the construction of the service road from Marsh Street to Madonna
Road west of the present freeway, and was told that when the State renovates
the present Marsh Street interchange, the city could attempt to obtain the
frontage road with the State as a condition of the revised freeway agreement.
5. Mayor Davidson reported to the City Council on his discussion with State
Senator Sturgeon regarding the participation of Cal Poly in the expansion
and enlargement of the City's sewer and water plants, and that Senator
Sturgeon agreed that the College should contribute and share in these ex-
penditures; and that as State Senator, he would help the City accomplish
whatever was necessary along this line.
Mayor.Mavidson also reported on a discussion with Mr. Wilson, Sacramento
Representative for Cal Poly, on this same matter and was told that he and the
College would co- operate with the City on its expansion program.
6. City Council then proceeded to continue their studies for the 1961 -62 Budget.

1. City Council met to discuss the matter of the condemnation of Maino Con-
struction property on Broad Street for street widening purposes.
Mayor Clay P. Davidson opened the discussion by stating he believed the
City had made an error in starting the condemnation of the Maino property
for the reason that the City does not have the necessary funds for which
to pay for the condemnation when the value is set by the Courts or by
negotiation.
Councilman Graves stated he believed that the City would ultimately widen
Broad Street, but at this moment the City is in a position of not being
financially able to pay for the necessary widening.
Councilman Shipsey asked what steps had the City taken to date on proceeding
with the condemnation. Mr. Houser, City Attorney, reported that only the
litigation report from the title company had been acquired, and quotations I
for professional services from three appraisers had been received.
Mr. Houser then briefed for the City Council the steps that were necessary
to conclude the condemnation proceedings.
Mayor Davidson stated that the City's financial program does not allow
any funds for the acquisition or condemnation of land for street widening
purposes: and that legally, the City cannot encumber more money than can
be collected in one year without,a vote of the people.
Mr. T. C. Maino stated that he wished to remind the City Council that,
because 6f prior Council action, he was required at additional expense
to redesign his proposed addition to include remodeling of the original
building in order to connect the addition to the existing building and
still make both buildings usable.
Councilman Donald Q. Miller asked could the City settle with Mr. Maino for
acquisition of the land without going to Court.
Mr. Houser, City Attorney, explained that the City must attempt to negotiate
with Mr. Maino before going to Court.
Councilman Miller stated he believed that the City Council owed Mr. Maino
something for his trouble in redesigning his existing office and addition
to fit the new street width. '
The City Council discussed the over =all problem involved in proceeding with
the condemnation or abandoning the suit, and attempted to come up with damages
to date to Mr. Maino.
Councilman Shipsey suggested that the City Council.continue the meeting
Until some actual figures are presented to the City Council for its con -
sideration'for acquisition of this property, and then make a decision based
on these figures.
City Attorney Houser reminded Mr. Maino that legally any work done by him
before award by a court is done at the risk of the property owner and may
not be covered by the court award.
City Council discussed with Mr. Maino the amount of:'money involved in the
acquisition of his property for street widening purposes, and asked that
he get his estimate for land and improvements to the City Council as soon
as possible.

The City Council met in joint study session with the City Planning Commission
to discuss various planning problems of the City.
1. Mr. Larry Wise, Planning Consultant, presented to the City Council and
Planning commission an overview of the City's general plan with particular
emphasis on that portion of the plan not adopted by the City Council lying
along the old and new Highway 101, which was proposed in the general plan
as a high density development, but which was removed from the plan due to
the objection by some of the property owners in the area who thought the
area would develop to heavy commercial or industrial uses.
Mr. Wise stated that this portion of the plan must be settled one of these
days between the County Planning Commission and the City. Mr. Wise re-
emphasized the general plan for orderly growth of the community, but it
must be implemented by various precise sections such as the Master Street
and Highway Plan, Central Business District Plan, Subdivision Ordinance,
etc. These precise sections of the plan will be studied and prepared by
the Planning Commission and then forwarded to the City Council for adoption
and implemenation.
2. The Planning Commission and:the City Council discussed the proposed extension
of Highland Drive easterly to Ferrini Road Through Tract No. 225, College
Highlands No. 4.
3. The Planning Commission reviewed for the City Council the proposed Tract
No. 224, the industrial tract which is being considered in the County area
south of San Luis Obispo - adjacent to old Highway 101.' The tract being
proposed is to be developed under County subdivision standards which are
less restrictive than those required by the City.
4. The Planning Commission suggested to the City Council that after the Master
Street and Highway Plan has been studied and forwarded to the Council for
adoption, the establishment of setback ordinances on the giajor streets in
the City be considered at the earliest possible time.
5. The Planning Commission discussed with the City Council the possibility of
making funds available for retaining the Planning Consultant on a twice -a-
month basis, in order that the Planning Commission may proceed with the
completion of the precise portions of the general plan, and also for advice
on day -to -day planning problems.
The Planning Commission presented the City Council with a list of eight
projects they wished covered in the next fiscal year, which would require
the professional help of the Planning Consultant. The City Council discussed
the priority list with the Planning Commission and made suggestions for
rearrangement of items that are believed to be the most important.
Councilman Graves complimented the Planning Commission on the hard work
and long hours and diligence in pursuing a very difficult job and stated
that he would help them in any way possible while on the City Council. It
was moved by Mr. Graves, seconded by Mr. Miller, that as a Council policy,
any time the City Council decides to over -rule a suggestion or recommendation
