This program to start October 19, 1961. On motion of Councilman Miller, seconded by Councilman Shipsey request was approved. 28. Communication from Bookman, Edmonston, and Gianelli, Consulting Engineers notifying the City that the State Water Rights Board had rejected all the protests to the City's application for area of expanded use of Santa Margarita Lake water. Communication ordered received and filed. 29. Communication from Tri- County Mortgage Company on behalf of Frank Truchan ' appealing a decision of the City Planning Commission in requiring that he place curb, gutter and sidewalks on property that he does not own, but which was illegally subdivided from the original parcel of"which he per- sonally owns a portion. Mr. Romero, City Engineer presented to the City Council a sketch of the property as divided at the present time, and the problem regarding the improvement of the original parcel still owned by Mr. Stairs: Mr. Abraham, Planning Director, suggested that the City require that a bond be placed with the City requiring that all curb, gutters, and sidewalks be placed on all parcels of this subdivision and allow Mr. Truchan, Mr.. Stairs, and W. Berkemeyer to work out the time and costs of improvements. On motion of Councilman Graves, seconded by Councilman Shipsey, it was moved that the City issue a building permit to Mr..Truchan subject to his filing of bond pledging to place curb, gutters, and sidewalks-in front of the Truchan- Stairs - Berkemeyer parcels to be completed within one year of the issuance of the permit if all other conditions of the Planning Commission have been met. Motion carried. The meeting was adjourned at 12 :40 P. M. to Wednesday 7:30 P. Miller CITY STAFF PRESENT - Administrative Officer Miller, City Attorney Houser, Water Superintendent Thompson, Planning Director Abraham, Police Lieutenant Bishop, Battalion Fire Chief Wainscott, City Clerk Fitzpatrick. CIVIL DEFENSE STAFF - Commander Gullickson, Mrs. Gullickson, D. F. Ulansky. COUNTY CIVIL DEFENSE STAFF - Supervisor Roland Gates, Dr. E. D. Lovett, Elmer Moody. 1. Mayor•Davidson briefly explained the purpose of this meeting was to study and discuss the City's over -all Civil Defense and Disaster planning in view of the request of the Governor of the State of Califoria, that all cities: 1. Review emergency plans in your-jurisdiction to.ascertain that all agencies of your government which have emergency capabilities have been assigned appropriate emergency tasks; 2. Adopt necessary local ordinances to provide for in- service train- ing in the agencies concerned.so that emergency plans can be put 1 into effect; 3. Initiate surveys of all.public buildings to determine the space available that is suitable for public shelter: 4. Take steps to provide for your emergency planning agency and to consider the economies and increased efficiency of accomplish - ing this in concert with neighboring political jurisdictions. The Mayor thanked Supervisor Gates for attending the meeting and stated everyone realized the City and County Governments must cooperate and coordinate their plans to protect all the citizens of the community. Supervisor Gates presented .the following documents for each of the City Council and Staff. 1: Minutes of the first meeting of the San Luis Obispo County Civil Defense and Disaster Council. 2. - Letter from the County Administrative Officer to the Board of Supervisors regarding the County Organization. 3. Outline of the proposed basic plan. 4. Copy of letter from County Administrative Officer to the Press, Radio, and TV, regarding Civil Defense and Disaster Planning. S. The County's Manpower Plan. Mayor Davidson then read the recommendations of Commander Gullickson, City's Assistant Director of Civil Defense, regarding continuity of government as follows: "1. I feel that this is at least partially a legal project and the legal angle can be found in:the State Military and Veterans Code. 2.For Civil Defense points of view, the establishment and publication of lines of succession to public office will greatly improve our capability to operate efficiently during disaster operations. A. Continuous leadership,-authority and responsibility. B. Leadership in the conduct of emergency operations. C. Legal succession to official position and minimizing the possibility of persons assuming public office . without legal authority. : D. Increase organizational effectiveness during periods of extreme emergencies. . E. The re- establishment of.those functions temporarily suspended because of emergency conditions." ' Commander Gullickson explained his recommendations that each City Official be at least two deep so that proper government of the City would continue in case of disaster. The Mayor and Council discussed the problem and a method of appointing alternate Council members. Councilman Graves stated the Council should adopt Commander Gullickson's recommendations and appoint alternate City Councilmen. On motion of Councilman Shipsey, seconded by Councilman Graves, the City adopted the recommendation of Continuity of Govern- ment as presented by the Assistant Director of Civil Defense. Councilman Shipsey then asked-if each Councilman should now take 3 alter- nates for their position and present them at the next meeting. The Council agreed .and -were requested to submit names of at least three can- didates for each position. City Attorney Houser explained for the Council's information the pre- sent organization of the Civil Defense and Disaster Council. City Attorney Houser continued that at the present time'there was no director of Civil Defense according to state law, as it has always been assumed that the Mayor was the Director-of Civil Defense and sug- gested that the Council take steps to fill this position. The City Council discussed the proper succession in case of disaster. The following resolution was adopted on motion of Councilman Graves, seconded by Councilwoman McNeil on the.following roll call vote: RESOLUTION NO. 857 (1961 Series) "A Resolution appointing the Mayor as Director of Civil Defense." AYES: Miss Margaret M. McNeil, R. L. Graves, Jr., Gerald.W. Shipsey, Clay P. Davidson NOES: None ABSENT: Donald Q. Miller The following resolution was passed and adopted on motion of Council- man Graves, seconded by Councilman Shipsey on the following roll call vote: RESOLUTION NO. 858 (1961 Series) "A Resolution appointing the Mayor Pro Tem as Vice Chairman of the Disaster Council." AYES: Miss Margaret M. McNeil, R. L. Graves, Jr., Gerald W. Shipsey, Clay P. Davidson NOES: None ABSENT: Donald Q. Miller. The Mayor nominated the following as successors to his office as Mayor and Chairman of the Civil Defense Council for Council con- sideration and approval: 1. Gerald W. Shipsey 2. Fred L. Lucksinger 3. Fred M. Waters City Attorney Houser read for the Council's information the State letter regarding the qualifications of appointees and method of appointment as successors to public offices, and method of succession. Mayor Davidson suggested that the City Council hold a meeting on.Novem- ber 24, 1961, at 7:30 P. M., at which time the appointees as successors would be presented to the Council for consideration and appointment. Councilman Graves reported that the City's Civil Defense Committee had discussed the matter of whether to report on the disposition.of Disaster Personnel Families and wished to discuss this matter with the Disaster Council. Mayor Davidson stated that before.this matter came up, he though a dis- cussion should be held regarding the possible establishment of a joint control center with the County and.asked if the County had discussed this possibility in their meeting. Dr. Lovett of the County Civil Defense Organization stated that at the first meeting of the County Disaster Council, the matter of establishing a County Control Center was not resolved, but he was sure as additional meetings were held, the Control Center location would be established. Dr. Lovett presented several points of information to the City Council regarding the County Medical Services Division which he heads, and stated this program must be coordinated not only.within the County, but with all Cities in the County. Further, he stated that the Medical Service Pro- gram must be prepared not only for a war type disaster, but also -for a natural type disaster. 1-1 1 1 Supervisor Gates stated that the County Board of Supervisors wanted all areas of the County including Cities to be represented at the County Civil Defense Programs so that all County Civil Defense Programs might be coordinated so that all residents of the County can be represented for the protection of all County Citizens. Mayor Davidson stated that one of the first problems to be solved at this time is the location of the Control Center in the City of San Luis Obispo, as it seemed to him it would be ridiculous for the County to have a Control Center in the Court House, and the City andontrol Center in the City Hall, right across the street, as possibly, one Control Center could be established for use by both agencies. R. D. Miller, Administrative Officer reminded the City Council of the commitments which have.been made for the use of the City Hall Basement for use in a disaster emergency to Federal Agencies. Commander Gullickson stated that the mission of the County Government in case of disaster is different from hat of the City, and Commander Gullickson read, a letter from Regional Civil Defense Headquarters regarding use of the City Hall Basement as a Control Center. Supervisor Gates stated that the County'Board of'Supervisors are ,planning to include a regular Civil Defense Control Center in the new annex.of the Court House in San Luis Obispo. Councilman Shipsey left the meeting at 8:30-P.' M. Mayor Davidson asked that the Council decide now whether the City should proceed with their own plans for their own Control Center or wait until the County decides what they are going to do as to a Control Center in- ' stallation. Supervisor Gates suggested that the City wait until the next meeting of the County Disaster Council which would be held November 21, 1961., at 1:30 P. M. in the Supervisors Chambers in the Court House, at which time he was sure the matter would be discussed. Councilman Graves stated that he believed the program required both a City and County Control Center as the City and County's mission in case of a disaster are different. R. D. Miller, Administrative Officer stated that the hard core of the Civil Defense Personnel would be City and County employees who would be reporting to their own Control Centers for assignment of duties. Commander Gullickson stated that each chief must be in the Control Center, but their respective departments would be working out of their own head- quarters, such as the Police Station, Fire Department, Hospitals, etc. R. D. Miller, Administrative Officer stated that he believed the situation in an emergency would be chaotic enough without confusion of operating with other Governmental Agencies. Councilman Graves agreed that each Governmental Agency should make their own provisions for a Control Center and operate their own Civil Defense Organization. Commander Gullickson stated that he believed that in the event of a war - caused disaster that each City would be an island and must be able to support itself for the period of disaster. Mayor Davidson stated that if the County were to build a Control Center, then the City must take advantage of this construction so as to set a place for both City and County Civil Defense Staffs, as the same taxpayers would be paying for the Control.Center when built by the County. R. D. Miller, Administrative Officer stated that the City Council should list the personnel who would be required to be in the Control Center so that enough personnel would be available to do the necessary work for a 24 -hour period. Councilman Graves stated that he agreed that the matter of families who who would be with the staff members in the Control Center should be de- cided upon, and also, what work the dependents should be, and would be required to do while in the Center. Commander Gullickson agreed and stated the families should be in the Control Center to help the staff, as a staff member would be a better worker if he knew his family was with him. Mayor Davidson suggested that an Annual Meeting of the Disaster Council be held on the fourth Monday of May, of each year, in order to review plans and familiarize all personnel with the Civil Defense Plans.* , Councilman Graves suggested that rather than the fourth Monday in.May, the annual meeting should be held on the fourth Monday in April, so that an orderly changeover could be achieved during an election year. After discussion by the City Council it was moved by Councilman Graves, seconded by Councilwoman McNeil, that the Disaster Council meet on the fourth Monday in April of each year, and on an election year, all newly elected officers be invited to attend. Motion passed: R. D. Miller, Administrative Officer stated that the City Council Civil Defense Committee had discussed with Mr. Thompson, Water Superintendent to include in all future plans for the Water Plant expansion protection for the operator, so that the operator could work the plant without fear of radiation. Mr.' Thompson, Water Superintendent stated upon questioning that the present Filtration Plant was designed for out -in- the -open operation and that operation must be out in the open to operate the plant, so that probably, some sort of shelter.would be required for the operator. The City Council discussed with Mr. Thompson the means of operating.the Water "Supply System for the City in the event of radiological fal -lout. Mayor Davidson suggested that the City's Civil Defense and Disaster plan be placed in a loose leaf type binder so that as changes are made, they can be brought up to date on a page basis without having to revise a whole section. Also, the binder should be completely-indexed for ease of use.. He further stated that each index should include not only title of division, but also the name of the incumbent in the position. Commander Gullickson stated he would pursue this matter with the State Civil Defense Organization regarding naming of the incumbent officers, as the State Plan did not allow for this at'this time. Commander Gullickson continued that one of the biggest problems for the Civil Defense Organization was the matter of publicity for the Civil Defense Program, and he has no one that would.work on this, and asked that the Council suggest how he go about getting publicity for the program. He requested that the Council appointea publicity director to clear all news releases. R. D. Miller, Administrative Officer suggested that all news releases should go out over the Mayor's signature, as he is the Director of Civil Defense, and the public would look to him for leadership during a disaster and this would be a good way to acquaint the citizens with.the Disaster Council. Councilman Graves suggested that the Telegram- Tribune be encouraged to write a Civil Defense Column each week to inform the Citizens of present and future plans of Civil Defense in the State. Mayor Davidson agreed to work with Commander Gullickson and try- and get the Telegram-Tribune-to publish a Civil Defense Column. Supervisor Gates requested that some official from the City be appointed to the County's Disaster Council to represent the City of'San Luis Obispo, and take part in the formation of the County Organization. The reports from the County Disaster Organization were ordered received and filed. 2. Following communication from James A. Quaglino requesting that the City Council consider the inclusion of music stores as an allowed use in the C -1 Zone. "Due to the fact that the Planning Commission's next meeting is on November 4th, 1961, I am taking this means to get an early ruling on the following: I own the "building located at'the corner of'Broad•& Sandercock Streets which has been occupied by Jack ,& Merry's "Auto "Supplies for -the past four years. They have now moved to larger quarters. Naomi.M. Casselman who owns Music Store'locdted at 979 Johnson-Avenue, desires.to rent the building.. Being located in C -1 District which designates types of business for occupancy such as food, hardware, book, liquor stores, etc., but no Music Store. Thereby, I present to the City Council and the Planning Commission for - their consideration of including Music'Store occupancy at.this location." J. W. Abraham, Planning Director stated that this use would not be supported by a neighborhood, but would require support from the entire City. He be- lieved that this type of business would be'retail in nature, and they would do some repair work and it should be in the C -2 or Central Business District, as the C -1 Zone was established for neighborhood service centers. Mayor Davidson stated one of the main reasons for zoning was control and an ordinance cannot list each type of business allowed in a specific zone and believed further that this particular business would be an asset to this building and of good use in the area: Also, the building is available, and a rentor is available; and he thinks that the property owner should be allowed to use the building andthe Planning Commission was unfair to this ' property owner in not allowing him to use this property. Mr. Abraham,. Planning Director again reiterated his objections of allowing C -2 use in a C -1 area. Councilman Graves . stated that the present ordinance does not implement the general plan and does not control the growth of com- mercial areas.by placing central type uses in neighborhood areas. City.Counci'l discussed the request of Mr. Quaglino for determination in allowing a music store in a C -1 Zone. Mr. Houser, City'Attorney explained the background of the Planning Commission determination in the C -1 and C -2 Classification: Mayor Davidson moved that Mr. Quaglino be granted his appeal and that a music store be allowed in the C -1 Zone. Motion died for lack of a second. 3. Administrative Officer Miller urged that the City Council authorize notification by the City Engineer to all contractors that'no permits would be granted for street excavation in the downtown area from December .l, through December 25, 1961; except in case.of emergency.And approved by the City Engineer. On motion of Councilman Graves, seconded by Councilwoman McNeil, authority was granted for the City Engineer to notify all contractors and.public utility companies that no street excavations would be permitted in the downtown area from December 1, through December 25, 1961. 4. R. D. Miller, Administrative Officer brought up the matter to the City Council of receiving proposals from C.P.A.. firms to do the independent audit of the City's records for the "fiscal year 1961 -62. After some discussion by the City Council, it was moved by Mayor Davidson, seconded by•Councilman Graves, that the accounting firm of Hutchinson & Horn, Johnson & Hey, of Oxnard, California, be asked to submit a proposal to the City for audit purposes.
