McNeil CITY STAFF PRESENT Park & Recreation Director Flory, City Attorney Houser, Administrative Officer Miller, City Engineer Romero, City Clerk Fitzpatrick - ------ ----- ----- 1. The City Council discussed pending negotiations with the Division of Highways for acquisition of two parcels of city -owned land for inclusion in the Madonna Road Interchange. The Council discussed the present offers of the State.for both parcels of land and authorized the staff to contact the State and renegotiate for the property lying east of the Freeway. The meeting adjourned to the City Hall Council Room at 1:10 P. M. 2. The City Council discussedc'.amending or cancelling the present farm lease with Ernest Dalidior.for the city -owned property at Laguna Lake. Mr. Houser, City Attorney briefed for the Council the conditions of the present lease with Mr. Dalidio regarding cancellations, etc. The Council also discussed the claim of Ernest Dalidio for loss of use of grazing and farming land because of land taken by the City for construction work in widening and deepening the lake. Mr. Houser explained that this alleged claim was taken care of by Mr. Skinner, allowing Mr. Dalidio to put his cattle on the Johe land for grazing purposes. Mr. Miller, Administrative Officer suggested that Mr. Houser, and Mr. "Romero, contact Mr. Dalidio regarding the amount of land the City will need for park development, and then adjust the annual rent on the remainder of the land on the lease. Mr. Flory, Park Superintendent explained the Park Department's requirements in requesting that some of this land be returned to City control so that the Park department might begin planting trees, etc. Mr. Flory then pre - wnted two letters from the Park & Recreation Commission recommending that the City Council cancel the lease on the Laguna Lake property so that the Park Department can begin the necessary tree planting and development of recreational facilities at the lake. On motion of Mayor Davidson, seconded by Councilman Miller, that the City negotiate with Ernest Dalidio along the line that he agree to exclude from this use the portions outlined in red and green on the City Engineer's Maps, and also, install the necessary fence to keep the cattle out of the red and green area; the City Council would cancel any payment due for duration of the lease by the City until November 15, 1962, with the stipulation that all claims for loss of use be waived. Motion carried. Miss Margaret M. McNeil absent. 3. Communication from Mr. David F. Romero, City Engineer requesting guidance from the City Council on a request of Dr. Mullin of 720 Foothill Blvd., for installation of curb, gutter and sidewalk on this setback street. Mr. Romero wished to know, as this is an R -3 zone, but is a commercial enterprise, which policy would apply to this property? The City Council discussed the request of Mr. Romero and the Council agreed that this property use was professional, and Section "E ", property zoned or used other than for residential, of Resolution No. 868, would be effective.
