Mr. Gianelli stated that he agreed with Mayor Davidson that the City should apply for a perminant license for water.from Santa Margarita and went on to explain the various steps involved and also the difficulties which might arise. One point which was not clear was whether or not the Army permit would be jeopardized by the acquisition of a permanent license-by the City. Councilman Miller said he thought the City ought to continue on a permit basis and not limit itself to its present use. He said the other side of the hill was not growing too fast and furthermore, Zone II might not be successful in its bond election. Mr. Gianelli said the State might someday refuse to grant an extension of permit and force us to get a license.. .In this case, the City would not be pushing the matter, and he said that if the City had a license, it would perhaps be more difficult for the Army to cut the City back in its use. Mayor Davidson urged the Council to decide whether or not this was the proper time for the City to apply for a permanent license for water and the Salinas Dam and then`.`for the consulting firm to contact. the Water Rights Board and the Army informally for their reaction. Mr. Gianelli indicated that if the City does not apply for-extension of its water permit in December; 1962, he believed that the State Water Rights Board would start proceedings for issuance of a permanent license without any application from the City. Mr. Gianelli then read a proposed letter to the Board-of Supervisors referring to the County request to change the place of use of Salinas Reservoir water within Zone II and stating that the City did not intend to protest, providing that the City's water rights at Salinas Reservoir were not adversely affected. The City Council discussed the proposal to apply for a permanent license at length and also discussed the original.agreements between the City of San Luis ' Obispo and the U. S. Army. At 8:05 P.M. Councilwoman McNeil and Councilman Graves arrived at the meeting. Mr. Gianelli stated that this might be a strategic time to apply for a permanent license while the City was the only one using the water by direct diversion. Mayor Davidson said he felt it was in order to determine whether or not the Council wished to apply for a permanent license.
