Graves, Jr., Miss Margaret McNeil, Donald Q. Miller, Ciell 1•7. Wheic::el City Staff Present: P. Chapman, Director of Planning & Building; J. H. Fitzpatrick, City Clerk; W. M. Houser, City Attorney; R. D. Miller, Administrative Officer; D. F. Romero, City Engineer; Barney Duveneck, Lew Litzie, Morgan Flagg, Charles Wiswell. 1. Mayor Davidson introduced the subject and the purpose of the special called meeting which was to consider the providing of an adequate access from Santa Rosa Street to the two (2) proposed student housing developments off of Santa Rosa Street north of Foothill Boulevard. The two (2) student housing develop- ments proposed are the Flagg development and the Litzie development. (Duveneck, Taylor, and Xinney property) D. F. Romero, City Engineer, presented copies of letters from the Division of Highways addressed to Bernard Duveneck, dated March, 1960 regarding street and road access from his property to the No. I Highway. N¢. Romero also presented a letter from the Division of Highways to himself dated November 15, 1963, regarding proposed access from the Litzie development through the Duveneck opening on Santa Rosa Street. Mavor Davidson again stated that the purpose of the meeting was to attempt to find a way for both Na. Litzie and Mr. Flagg to develop their proposed student housing and still allow safe and proper access to and from Santa Rosa Street. Mr. Flag stated that several years ago studies had been made by his firm for development of a bowling alley on his property, and studies at that time showed that access to and from his property would be adequate. Mr. Litzie stated he had no comment to make at this time about the subject as as he was not made aware of what was being proposed at this meeting. Mr. Romero then presented a sketch of the general area under discussion and also showed sketches of the proposed development. He explained traffic patterns that would be developed by these proposals. Mayor Davidson atated that the matter before the Council at this time was to attempt to procure street access through the Steiner property for access to the Litzie housing development. Mr. Flagg stated that his company had paid in ti:e vicinity of $26,000 in lease payments and taxes on the property he controls and further, he believed a road through his property for use by Mr. Litzie would not be an asset to his property but would only benefit others. Further, he believed that the placement of the road as presented would do damage to his property and that the cost would be increased due to the severance damage to the Steiner property and the overall value of the property to be acquired. D. P. Romero. City Engineer, stated that from an engineering standpoint, the best access to Santa Rosa Street would be opposite Boysen Avenue to serve both properties. He also mentioned that possibly a frontage road could be installed without too much damage to the Steiner property. City Council Minutes April 9, 1964 Page -2- Mr. Plasm stated that at one time he had studied this overall area for development and that he believed that the best access to the Litzie develop- ment was through the Spooner property to Foothill Boulevard. Mr. Duveneck stated that in addition to the development of the Kinney and Taylor parcel, there was also the possibility of developing the five acres west of the creek owned by him, because regardless of the Flagg and Litzie developments, his four (4) acres of property will someday be developed and some access to Santa Rosa must be maintained. Favor Davidson stated that this area must be developed, and in order to be developed to its highest potential, an adequate access must be provided for safe traffic flow. Mr. Flagg explained prior negotiations in granting access to the Duveneck property, and an additional access route or street would have to be paid for, either in granting additional parking rights on the adjoining property or by condemnation by the City which would be expensive due to the severance involved and further, he honestly did not feel that his property would gain anything from the proposal of the Mayor. Mr. Litzie stated that the City's proposal to run an access road through the Flagg housing development and parking lot would be more dangerous than the two (2) proposed entrances for Flagg and Duveneck. W. Houser, City Attorney, suggested that with the possible relation of Highway No. 1, Santa Rosa Street would then become a City street, and an access of four hundred (400) feet apart would not be much of a problem. The group present discussed various possible routes for roads through the Steiner property, particularly trying to find a solution that would do the least damage to the Flagg development. --------------- Councilman Whelchel left the meeting at 9:05 P. M. Councilman Miller stated that he believed this subject had been brought before the Council at the wrong time, as this should have been discussed at the time the planned development for Mr. Litzie was approved. Further, he did not believe it was fair for the Council to delay these developments at this time as there was a need for student housing and that these two (2) developers wished to proceed in order to meet a September, 1964 deadline. Further, that both parties involved had met in good faith on the recommendation of adequate access and that they could not come up with an adequate development fair to both parties. He therefore recommended that the developers be allowed to proceed with the access as presently approved. Councilman Miller moved that the meeting adjourn. Motion lost for the lack of a second. Councilman Graves suggested that possibly a Council committee should be appointed to meet with the principals involved and that they try and arrive at a solution to all parties in this matter as he believed all parties were acting in good faith. Mr. Duveneck urged the Council not to delay these two (2) projects any longer than necessary as both the Litzie and Flagg developments are moving ahead so that the housing developments will be available to students by September, 1964. Councilman Miller moved that the meeting adjourn and that the City not delay these developments any longer. Motion lost. On motion of Councilman Graves, seconded by Mayor Davidson, that a Council committee be appointed consisting of two (2) Council members, Mr. Duveneck, W. Flagg, Mr. Litzie, City Attorney Houser and City Engineer Romero, to continue discussion on this matter and try to arrive at a decision. Motion carried.
