On motion of Councilman Graves, seconded by Councilwoman McNeil, the minutes of February 15, 1965, were ordered held over. Motion carried. On motion of Councilman Miller, seconded: by Councilman Whelchel, the claims against the City for the month of March 1965, were approved subject to the approval of the Administrative Officer. Motion carried. 1. On motion of Councilman Graves, seconded by Councilwoman McNeil, the following salary step increases were approved, effective April 1, 1965: ANDERSON, William D., Police Officer, from Step 2 at $480 to Step 3 at $508 per month. DUNAHEE, Kelly, Legal and Administrative Secretary, from Step 4 at $455 to Step 5 at $480 per month. LITHERLAND, Doris M., Stenographer, from Step 2 at $365 to Step 3 at $385 per month. ROTH, Curtis A., Police Officer, from Step 2 at $480 to Step 3 at $508 per month. SILVA, John G., Fire Captain, from Step 4 at $635 to Step 5 at $670 per month. TREJO, Albert L., Fireman, from Step 3 at $508 to Step 4 at $535 per month. 2. Fitzpatrick, City Clerk, reported on bids received for street widening on Johnson Avenue at the Health Center. City Engineer Romero stated that he believed the bids to be excellent ones and recommended that the low bid of J. A. O'Kelley & Son be accepted. At this time the City Clerk, J. H. Fitzpatrick, reported on bids re- ceived for widening on Foothill Boulevard, La Entiada to South Tassajara. The following bids were received: K. Beecham Burke Construction Company Ted Watkins Construction Howie & Shelton Rainey Construction Company Madonna Construction Company $6,545.28 $7,538.15 $8,486.21 $7,954.45 $5,614.15 $7,510.60 D. F. Romero, City Engineer, recommended that the low bid of Rainey Construction Company be accepted. On motion of Councilman Whelchel, seconded by Councilman Graves, the low bid of Rainey Construction Company was accepted. Motion carried. 5. City Clerk Fitzpatrick reported on bids received for furnishing one V -notch Chlorinator machine to the City of San Luis Obispo. Bid received as follows: Wallace & Tiernan $1;660.00 Administrative Officer Miller recommended that the bid be accepted. On motion of Councilman Graves, seconded by Councilman Miller, the bid of Wallace and Tiernan was accepted. Motion carried. 6. City Clerk Fitzpatrick reported on bids received for furnishing trees for downtown streets. Bid received was as follows: Keeline - Wilcox Nurseries $7,087.70 Parks & Recreation Superintendent Flory explained that this was a good bid and recommended that it be accepted. On motion of Councilman Miller, seconded by Councilman Graves, the bid of Keeline - Wilcox Nurseries was accepted. Motion carried. 7. At this time the City Council considered the final passage of ORDINANCE NO. 302, an ordinance amending Section 6100.8 of the San Luis Obispo Municipal Code, covering application for business licenses. City Attorney Houser briefed the ordinance for the Council's information. At this time the City Council considered final passage of ORDINANCE NO. 303, an ordinance requiring right -of -way dedication and improvement on major streets that will require widening. Mayor Davidson declared the public hearing open. City Attorney Houser briefed the conditions of the ordinance for the Council's information. Mr. Carl Lownes appeared before the Council questioning the -right of the City to take private property for street widening without paying for the land, and was this question not settled in the plan line case. Mr. Freeman asked where did these new proposals differ from the old plan line that was kicked out by the City due to the public protest. Mr. Houser explained that the new ordinance required property zoned R -3 or less restrictive to dedicate that portion of their property needed for the widening and to install curb, gutter and sidewalk improvements at-the property owner's expense if said improvements did not exist at the time the building permit was issued. Mayor Davidson declared the public hearing closed. ORDINANCE NO. 303 finally passed on the following roll call vote: AYES: Clay P. Davidson, R. L. Graves, Jr.; Miss Margaret McNeil, Donald Q. Miller, C1ell W. Whelchel NOES: None ABSENT: None 11. At this time the City Council held a public hearing on the recommendation of the Planning Commission to rezone from R -4 to C -1 -S property located at 1321 through 1341 Taft Street. Mayor Davidson declared the public heating open. Planning Director Chapman presented the recommendations of the Planning Commission: "Resolution No. 21 -65 of the Planning Comm fission-recommends approval of the rezoning of 1321, 1325, 1337, and 1341 Taft Street from R -1 to C -1 -S for G. L. MacDonald. This rezoning is requested to enable a high -class service station to be built on the property, and the C -1 -S designation is proposed as an indi- cation of good faith. There were no public objections to this request; and in view of the location in relation to the freeway and California Boulevard, the Commission feels that the rezoning would be.appropriate and therefore recommends approval." Mr. Holloway, Stnadard Oil Company, lessor of the property, stated he had nothing to add unless the City Council had some question regarding the pro- posal. Mr. Holloway then presented two sketches, one showing layout of station with the landscaping and a sketch showing their proposed station. City Council Minutes March 1, 1965 Page 4 He stated that his company is planning on spending $91,000.00 on this station. Mayor. Davidson declared the public hearing closed. On motion of Councilman_ Miller, seconded by Councilman Whelchel, the following ordinance was introduced. ORDINANCE NO. 307, an ordinance re- zoning property on Taft Street form R -l'to C -1 -S. Introduced and passed to print on the following roll call vote: AYES: Clay P. Davidson, R.. L. Graves, Jr., Miss Margaret McNeil, Donald Q. Miller, Clell W. Whelchel NOES: None ABSENT: None Councilman;.Whelchel suggested that a use permit be conditioned that warning bells be toned down so as not to annoy the adjoining neighbors. 9. At this time the City Council considered the final passage of ORDINANCE NO. 304, an ordinance rezoning property from R -4 to C -2. (Nipomo & Pacific Streets). Mayor Davidson declared the public hearing open. Charles Kamm stated the Purity Stores will proceed with development as soon as the rezoning is completed. Mayor..-Davidson declared the public heating closed. On motion of Councilman Miller, seconded by Councilman Whelchel, ORDINANCE NO. 304 was finally passed on the following roll call vote: AYES: Clay P. Davidson, R. L. Graves, Jr.; Miss Margaret McNeil, Donald Q. Miller, Clell W. Whelchel NOES: None ABSENT: None 10A. On motion of Councilman Graves, seconded by Councilman.Miller, the following resolution was introduced.. RESOLUTION NO. 1388, a resolution providing for the holding of a General Municipal Election, establishing precincts and polling places, and appointing election boards. Passed and adopted on the following roll call vote: AYES: Clay P..Davidson, R. L. Graves, Jr., Miss Margaret McNeil, Donald Q. Miller, Clell Whelchel NOES: Done ABSENT: None 10B. At this time the City Council considered the preparation of argument' supporting the enactment of the Sign Ordinance to be enclosed with sample ballots. On motion of Councilman Miller, seconded by Councilwoman McNeil, that Councilman Miller and Graves be appointed as a Council Committee to work with the Planning Commission on this matter. Communication from property owners of a portion of Lot 14, Block 3 of the Goldtree Vineyard Tract requesting that the City Council acquire sewer easement from the adjacent property owners in order that they may extend Gerda Street to serve their properties. City Engineer Romero explained the problems involved. City Attorney Houser explained that if the sewer line andeasement were privately owned, it would be necessary for the City to acquire the facilities by negotiation or dondemnation and that the particular property owner should pay the pruchase price and cost thereof. On motion of Councilman Graves, seconded by Councilman Miller, that the City acquire land as per the City Attorney's recommendation. Motion carried, Councilman Whelchel voting no. The City is to acquire land in accordance with the City Attorney's recommendation. 12A. At this time the City Council held a public hearing on theadoption of ORDINANCE NO. 301, an ordinance amending certain provisions of the Municipal Code for collection and disposal of garbage,.providing for compulsory ser- vice and amending garbage rates. 12B. Communication from Mrs. Madeliend Hoffman, 3261 Rockview Place, pro- testing the proposed billing of garbage colleciton to people who have never had or needed garbage collection service. 12C. Communication from Mrs. Bernice M. Elmer protesting the compulsory garbage collection service. Mayor Davidson declared the public hearing oepn. City Attorney Houser briefed the provisions of Ordinance No. 301 dealing with compulsory collection service, increased rates and collection by the City. W. H. Lobern, Lunetta Drive, compared water service and garbage pick -up service in the City of San Luis Obispo with the City of Davis, California, which gives more for less cost to the public. Bob Rose, Fernwood Drive, asked under what rules can the City collect money for a private company. City Attorney Houser answered tha t the City not only has the right, but apparently the duty, to provide for the collection and disposal of trash and garbage because of the obvious fire and health problems. That the City can purchase the necessary equipment and do the collection itself and then cover the cost by billing the customers or by property tax. That the City of San Luis Obispo has decided to use the alternative procedure of granting a franchise to the lowest responsible bidder and set the conditions and rates to be charged. Mr. Rose stated that he will never pay one cent for garbage service to the City. Mr. Alcott, Gulf Street, questioned the validity of the City requiring com- pulsory collection of garbage in the City. Art Blackwell, Madonna Road, stated that he had a garbage disposal unit and that he took his own cans and trash to the dump, and he felt that this proposal was unfair as he did not need garbage collection. Mrs. Cotton, 45811 Higuera Street, objected to the compulsory provision of the ordinance as she does not use the garbage service and has no need for same. City Council Minutes March 1, 1965 Page 6 Heybert Borrowman, 1654 Crestview Circle, objected to the City taking away his basic freedom of._.r.bA#e.by.:.making him take a service he does.not need. Burt Fugate, Garden Street, asked could the City Council explain the back- ground and reasons for requiring the compulsory garbage service. Mayor Davidson explained the reason for the ordinance as proposed, which was based on studies made by Brown & Caldwell, Consultants to the City on this matter. The Mayor also explained the reasons and background for the rate increase. .Douglas Lewetzow asked why should he have to pay for someone else's gar- bage collection when he does not use the service. Louis Hammitt stated that he was in favor of the compulsory service for the good of the City which would prohibit promiscuous dumping of garbage in the streets and creeks of the City., He felt the rate should be higher. Mrs. Ramey, Hermose Street, objected to compulsory provision of the Code and objected to the collection of charged by the City. Mrs. Stairs, 235 North Broad Street, objected to compulsory provision as she does not use service and would not use it even if she was forced to pay for it. Mrs. Rolland Waite, Ramona Drive, objected-to hiring of out of town con- sultants to make recommendations for her garbage rate. Further, she questioned the billing procedure with the water bill when the landlord and not the tenant pays the water bill. Mayor Davidson explained methods used by the consultant in arriving at the suggested rates. Art Blackwell, Madonna Road, dropped the collection service and hauls his own now due to the problems he had trying to get adequate service from the existing company Mrs._.Alcott stated that she had made a survey of many cities from Long Beach to Fresno and she found that San Luis Obispo has the.highest gar- bage collection rates for the poorest service received by the customer of the cities she contaced. Mr. Brown agreed with the City garbage collec tion, but not compulsory with the City collecting the fees and then giving it to a private con- tractor at the expense of the general tax payers. He also objected to the present company's operation and hoped that the Council would think the matter over before passing the ordinance. 1436 Johnson Avenue, objected to the compulsory pro - fisions of the proposed ordinance, and stated that the City should.consider taking over the collections of garbage and then they can make it compulsory if they do an adequate collection service. He also felt that the proposed rates were too high. Carl Lownes did not agree with the City taking over the operation of a private industry as it would cost more if the government took it over. He also suggested that the City put this franchise up for bid and try to get a service rate more in line.thah the ones proposed by the present operator. City Attorney Houser explained the method that was used by the City in awarding the last franchise to the.present garbage company. He also explained again the duty of.the City to provide some sort of garbage and refuse collection service as this is a governmental duty. City Council Minutes March 1, 1965 Page 7 Crestview Circle, stated she felt that the citizens were the government and why .should. the City Council tall them what and when they should take garbage service. ' Councilman Miller went through the Brown & Caldwell Garbage Service Report for the people present so that they might understand the reason for pre- , senting the proposed ordinance for providing an adequate garbage and refuse collection service for the City.. Art Blackwell suggested that with a City election coming up and the present Council no longer in office, that this matter be held over and placed on the same ballot.for the public to decide. Dave Kingsbury, 276 Hermose Way, stated that he subscribes now and would be willing to pay a higher fee and does not believe that everyone should be forced to take a'service they do not want and they should have a choice to take or not to take it. Leland Shankland objected to the compulsory garbage collection rates. Mr. Easter, Easter Trailer Park, explained the problem he has had with the present garbage company so that he has put in a gas -fired incinerator to take care of his own garbage, which now costs him about 30c per day. Mr. Easter then listed all the.things that has been forced on him by the City, such as increased taxes, sewer charges, water bills, water connection charges, and other fees.levied by the City Council. He also objected to the necessity of being required to pay for garbage service that he doesn't need or require. Mrs..Alcott again stated that she feels that the majority of the citiznes in the. City do not understand what the results of this proposition.will be. She urged that the City Council not pass this ordinance and put it on the ballot and let the people decide... Mrs. Gilbraith objected to the present operation of the existing garbage collection serivice. Mr. Cook, 297 Beebee Street, stated that the City only governs through the governed and .that the cross section present is opposed to this proposal. Bob Jung, Rachael Street, objected to compulsory provision and did not be- lieve that anyone should be forced to pay when the service is not needed or desired. Bob Leitcher asked for clarification of the provision of the ordinance; for example a rental is empty for part of a month - -is a credit given to the per- son who is vacating, and also, he asked for clarification of rates charged to motels and courts. City�:Attorney Houser explaiend that as long as the water is on, then the sewer and garbage rates would continue. Also, he continued that on apart- ments and courts, the rates are based on the number of containers. Mr. Rainier asked if it were true that the present garbage company offered to pick up all the trash, garbage and rubbish for $2.50 per month. Mayor Davidson answered that his recommendation was for a.$2..50 per month feelto pick up all the trash and garbage on the property. Lloyd Dietrich suggested that the Counci. turn down the proposed ordinance and come up.with a proposal that was fair to everyone. City Council Minutes March 1, 1965' Page 8 Mr. Alcott presented the following petition: "We the undersigned are against the compulsory garbage law under study by the City Council. We the undersigned are residents of San Luis Obispo." (The petition was signed by 302 signatures) Mrs. Rainier asked if the City Attorney was sure that the City could re- quire the compulsory collection of refuse and garbage. Mr. Stairs, North Chorro Street, asked if it were true that the County Supervisors required this new.cut and fill operation now, will they also stop dumping in the County and along the County roads. Howard Franklin stated that it was a disgrace the way the public dumped garbage and trash along the County roads and along the creeks. Mrs. Jung, 206 Rachel Street, stated that even if you find people dumping on your property, the City police will do nothing about arresting the violators. Mr. Burns urged that if the City Council was trying to clean up the City, then let the City require that the garbage company pick up all the garbage trash and rubbish in town at a reasonable rate. He felt that all the people present would go along with this proposal if it were to clean up the community. Mayor Davidson stated he appreciated the people com ing out at this was one way that the public could get their views across. He stated that this was the reason he voted to pass the ordinance to print so that the public could have their say. Howard Brown, Johnson Avenue, asked how can you stop people from dumping bee cans along the road, which he felt was worse than any garbage dumped along the road. On motion of Councilman Graves, seconded by Councilman Miller, that the ordinance be referred back to the Council Committee for additonal study based on comments presented by the public at this meeting and report back to the Council at their meeting of March 15, 1965. Motion carried. Mayor Davidson Declared the public hearing closed. On motion of Councilman Graves, seconded by Councilwoman McNeil, that the committee be increased by two (2) members of the public to sit on the committee. Motion carried. The- citilensocommittee will consist of Mrs. Alcott and Mr. Rose. 14. At this time the Council Committee (Miller and Whelchel) appointed to investigate the feasibility of a tax decrease, was requested to give a report. Mayor Davidson stated that prior to the adoption of the Bed Tax Ordinance in December, that he recommended to the Council that consideration be given_ to a reduction in the property tax as over $400,000.of ,excess revenue from additional service charges were being levied on the public and urged a' compensatory reduction in the City's general tax rate to help the property owner. Councilman Whelchel stated that the Committee met and are making prelim- inary studies relative to a tax reduction, but that preliminary studies show that a reduction of taxes are possible, but it will take a policy - decision by the Council of whether a reduction of taxes is approprite or whether the City should proceed with the capital improvements of the City. 1 1 City Council Minutes March 1, 1965 Page 9 Councilman-Miller agreed with Councilman Whelchel and explained some of the deficiencies faced by the City, such as the poor conditions of. the streets. He also listed other capital improvements that are needed and planned by the Council. Mayor Davidson again stated that the to increase in State gas.tax brought in an extra $100,000 in revenue for street improvement. Therefore, he feels that a reduction in tax rate is long overdue to compensate the property tax payer for the excessive water and sewer charges levied on the citizens and further, that the Council promised the people a reduction when the water rates were increased and sewer rates initiated. Administrative Officer-Miller explained the ramifications of certain capital programs being undertaken by the Council. If taxes are to be decreased, it would probably be necessary to cut back on some of these programs. When all budget figures are gathered, we will know more about the situation. Councilman Miller stated that he never felt that he had promised a tax reduction when the sewer service charges were added and water rates were increased, as he felt that he was responsible for keeping up the City's physical plant and take care of the growth of the City plus any needed capital projects. The Council Committee stated they would have an additional report at the next meeting. 25. Communication from the City Planning Commission regarding the extension of Augusta Street.' The communication was as follows: "Resolution No. 19 -65 adopted by a majority of the Planning.Commission recommends that Augusta Street be extended to join with Richard Street and that the name of Richard Street be changed to Augusta. Resolution No. 20 -65 adopted by a majority of.the Planning Commission recommends that this project receive a high priority in the street im- provement section of the Capital Improvement Program. The Planning Commission has met with the School Board in study session and their recommendations are based on the need for: a. Improved access for children going to Sinsheimer School from Southwood area. b. Improved fire protection for the Sydney Street area. c. Improved water circulation in the area." City Engineer D. F. Romero stated that a preliminary estimate of cost for the improvement would be approximately $26,000 of which roughly $10,000 would be chargeable to the school. He explained that construction could be completed during summer vacation if the Council decides to proceed with the improvement. Lewis McCall, representing the City School Superintendent, stated that he wished to restate the school board's position to expedite this project and they would cooperate financially. Councilman Whelchel stated he felt that the City should go along with this plan as soon as possible, and as soon as finances are available, and get it done this summer before the school starts in the fall. Councilman Miller agreed, as he felt that this should have been done originally and he felt that if this project goes .ahead that the.full street improvement should be put in on the south part of Augusta from the school, including sidewalks. City Council.Minutes March 1. 1965 Page 10 Jim Baird urged the Council to proceed with this improvement in order to guarantee the safety of children attending this school, and is needed due to increased development east of Laurel Lane that use this school. City Engineer Romero stated that the public works department had recommen- ded a number of years ago that the street be opened and continues to so recommend.. On motion of Mayor Davidson, seconded by Councilman Graves, that the City Engineer proceed with design of creek corssing and also to improve Augusta Street from Greta Place to Richard Street. Motion carried. 16. At this time the City Council reconsidered the Underground Utilities Ordinance as presented by the City Planning Director. Ordinance No. 306, an ordinance adding Chapter 4 of Article VIII of the San Luis Obispo Municipal Code, providing for underground utilities, was presented at this time. Peter Chapman, Director of Planning and Building, reported as follows regarding the Underground Utility Ordinance. He stated that the present proposal differs significantly from that prepared by the Council Committee. The portion adopting Underground District A has been omitted-and Under- ground Area One has been considerably reduced in size. The language is repetitive, cumbersome and difficult to understand; which will aggravate the problem of explaining the ordinance to those affected. City Attorney Houser explained the reason for presenting the ordinance as proposed. That the wording was modified for two primary reasons. First, that it was necessary to enact an enabling ordinance to.subse- quently create any district which would force the property owners to make electrical alterations on theri property at the owner's expense. Second, that in creating a new type of utility district, it is my recommendation to follow the ordinances that other cities have used and applied with success in their jurisdictions. Bud Hoffman, representing P.G. & E. Company, stated he felt that the new boundaries of the underground service area were much more realistic and was something that could be worked with. Lee Ballatti, representing Pacific Telephone & Telegraph Company, stated he felt that this ordinance is much better and can be worked out by both utilities and property owners. On motion of.'Ceuncilman Whelchel, seconded by Councilman Miller, that this matter be referred to a Council Committee to meet with the utility companies for recommendation. Report to be presented to the City Council at.the meeting.of March 15, 1965. Motion carried: 26. Communication from the Planning Commission regarding the sign at the High School. The communication read as follows: "The School Board wishes to erect a 5' x 12' free standing, illuminated sign at the High School to advertise events. This is not permitted by the Zoning Ordinance. However, the Sign Ordin- ance Section 8700.9 Exemption.says -- (6) 'traffic or.other municipal signs, legal notices, or railroad crossing signs' as may be approved by the City Council. This.item is therefore referred.airectly to the Council and a drawing will be presented at the meeting." On motion of Mayor Davidson, seconded by Councilman Miller, that the sign be approved. Motion carried, Councilman Graves voting no. 1 1 City Council Minutes March 1, 1965 Page 11 17. Legislative Bulletin from the League of California Cities regarding SCA -17, Telephone Franchise Tax. City Attorney Houser briefed this bulletin for the Council's information. Lee Ballatti, Pacific Telephone and Telegraph Company, appeared before the Council urging that the City Council not endorse the adoption of SCA -17 or take any action at this time. On motion of Councilman Miller, seconded by Councilman Graves, that this matter be held over to the meeting of March 15, 1965. Motion carried. 18. Application from Charles R. Lewelling to operate a card room at 676 Higuera Street. A. Communication from William Schofield, Chief of Police, requesting that the City Council conduct a study in the best interest of the total community's benefit from card rooms. On motion of Councilman Graves, seconded by Councilman Miller, that the license applied for by Charles R. Lewelling be granted. Motion carried. On motion of Mayor Davidson, seconded by Councilman Miller, that the matter of a study regarding the above subject be referred to the Police Advisory Board for initiation of a study of overall card room problem in the City of San Luis Obispo. .Motion carried. 28. The following communication was received from the.Planning Commission recommending adoption of the amendments to the General Plan: "Resolution No. 26 -65 of the Planning Commission recommends that the City Council amend the General Plan which was adopted on March 14, 1961. ' These amendments were discussed with the Council at a study session some- time ago and have been approved in principle by the County Planning Commission. The Commission has held a public hearing on the amendments and met with the School Board, also representatives of the Park Commission, and the Economic Development Committee. There were no objections to the proposed amendments. On motion of Mayor Davidson, seconded by Councilman Miller, a public hearing was set for March 15, 1965. Motion carried. 29. The following communication was received from the City Planning Commission recommending changes to the Zoning Ordinance: "Resolution No. 31 -65 of the Planning Commission recommends the adoption of amendments to the Zoning Ordinance previously sent to the Council, revised ' according to the attached document. These revisions have been made in the light of the public hearings and are based on recommendations made by the Building Contractors' Association, local realtors, and others. The following communication was received from the Planning Commission regarding amendments to the Fire Zone Ordinance: "When discussing amendments to the Zoning Ordinance, the Planning.Commission received a suggestion from the Fire Chief that the Fire Zone Map be auto- matically changed when zoning changes take place. The Commission agreed with this suggestion and recommends that the City Council amend the "Fire Zone" Ordinance as follows: ARTICLE III =- FIRE PROTECTION AND PREVENTION CHAPTER 1 -- FIRE REGULATIONS Part 4 -- FIRE ZONES SECTION 3140.1 DELETE Any land annexed to the City... SECTION 3. That Section 3140.2... ADD SECTION 3140.2 Annexations Land annexed to the City shall be in Fire Zone No. II if zoned to any C or M District and Fire Zone No. III if zoned to any R or U District. SECTION 3140.3 Zone Changes a. Land rezoned to any C District which is contiguous to Fire I shall be in Fire Zone I. b. Land rezoned to any C or M District other than the above shall be in Fire Zone II. c. Any land rezoned to any R or U District shall be in Fire Zoen III."
