On motion of Councilman Blake, seconded by Councilman Spring, the minutes of the meetings of December 3, 69 20 and 28, 1965-and January 3, 1966 were approved. Motion carried. On motion of Councilman Spring, seconded by Councilman Gallagher, claims against the City for the month of January 1966 were approved and ordered paid subject to the approval of the City Administrative Officer. Motion carried. ----------------------------------------------------------------------------- - - - - -- 1. Traffic Committee Report of January-11, 1966: 66 -1 -1T: The Traffic Committee has looked at the parking situation on Chorro between Higuera and Monterey and has a report from the Police Department of some difficulty in enforcing the two hour time limit because of meter feeders who move their cars from one space to another on an all day basis. it is therefore recommended that the two end spaces which are presently 12 minute spaces and the two two -hour spaces be ' changed to four 36 minute spaces. 66 -1 -3C: The Traffic Committee feels that the request of the A & M Cab Company for an additional taxi zone in front of the Anderson Hotel on Monterey should be granted. We recommend that the first parking meter space east of the hotel loading zone be designated as a cab zone and the next space be designated as a 36- minute space. 66 -1 -4T: The Traffic Committee has received reports that the present white loading zone west of the Obispo Theater on the south side of Monterey is not being fully utilized for the purposes intended and recommends that a two -hour metered space be Installed instead of the white zone. 65- 12 -1OT: The Traffic Committee has conducted a further study of the traffic situation on Santa Rosa and feels.that a good interim measure would be the restriction of left hand turns off Santa Rosa at Mill between 7:00 - 9:00 A.M. and 4:00 - 6:00 P.M. We so recommend. (The City Council agreed that actual hours of restriction would be left to the discretion of the staff.) 66 -1 -6T: The Traffic Committee has also studied various other steps which should be taken in this vicinity to facilitate traffic flows. We recommend the following: (a) That a two -hour time limit be installed on the east side of Santa Rosa between Palm and Mill. ' (b) That a two -hour time limit be installed on the west side of Santa Rosa between Palm and Mill. (c) That a two -hour parking time limit be installed on the west side of Santa Rosa alongside the Courthouse where the street h" been widened south of Palm. 66 -1 -7T: The Traffic Committee has studied the parking and traffic situation on Morro Street between-Palm and Mill and feels that the east side of Morro should be all zoned for 12- minute green spaces and the west side be designated for a two -hour time limit. 66 -1 -8T: the Public Works Department has called to our attention a hazardous traffic movement on Broad Street near Mlesion and feels that if the center striping were moved to the east and 80 feet of red zone-installed on the curb on the east side of Broad running in a northerly direction from Mission, there would be a distinct improvement. The City Engineer was instructed to proceed with the rec, adation. 66- 1 -14C: The Traffic Committee has studied the suggestion of the Council that stop signs be placed on Sandercock to slow through traffic. We admit that there is occasional speeding on this street as well as many of our collector streets, but we feel that is would be a mistake to hamper traffic by the installation of stop signs ' and recommend against doing this. No action by-the City Council. 66 -1 -1ST: The Traffic Committee discussed the possibility of installing stop signs on Johnson at Phillips, stopping Johnson traffic, but did not get a chance to look at this and make a final recommendation. It is suggested that this be discussed at the Council Meeting in the interest of expediting the stop signs which at least one member of the Traffic Committee feels are necessary. Re- referred to the City Traffic Committee for further study. 2. Mr, Jerry Brown, representing Marveon Sign Company, appeared before the City Council regarding the installation of the sign for the Arctic Circle Drive Inn to be located on California Boulevard and Monterey Street. Mr. Brown stated that the original sign for the Arctic.Circle Drive Inn for which a permit was issued by the City Building Department had over -all dimensions of 18 feet in width and 35 feet in height and that the overall sign area was 184 square feet. The sign that his Company is presently proposing will be 14 feet wide, 17 feet in height and a total of 81 square feet of area. He stated that this represented a 56% reduction of the overall sign area. After discussion by the City Council, it was moved by Councilman Spring, seconded ' by Councilman Miller, that a sign permit be granted for the sign as presented sub- ject to the filing of the necessary covenant for the temporary erection of improve- ments in the setback area and agreement to relocate in the event the street is widened. Motion carried. 3. The following communication from the Model Linen Supply at 34 South Street stated that the sewer backup in the City sewer system is causing the laundry to have production delays. •It stated tba t,at the present time, the sewer backup problem is averaging 15 minutes per day -which is a loss of production of 15 minutes per day on six machines. Mr. Page, Owner and Operator, stated that the sewage backup problem has been most severe since the past summer and appears to have gotten worse since the installation of the water dr8ins on Higuera and South Streets. He stated that the water usage for this period this year as compared to the same period last year was much less and therefore the sewer problem should not be blamed on the production of the laundry. Mr. Page stated he felt that this matter was the city's responsibility as the lines have been adequate, they have added no additional equipment and the actual amount of water being purchased from the City is less than in prior years. He asked that the City Council make every effort to give them some relief on this matter, as the production delays are costly to the firm as well as dangerous to the employees when the water will not drgin out of the plant and there is so much electrical equipment ' around. Mr. Romero, City Engineer, reviewed his memorandum on the problem and explained that City crews had checked the sewer main on South Street many times and found no ob- struction or defect. He explained that a 10" line on South Street would handle approximately three times the capacity of the present six inch line. Mr. Romero pointed out that Council policy-calls for property owners to maintain their own service, therefore iS a defect is found in the Model Linen Service line repairs to this facility should be at their expense. After discussion of the problem with the City Engineer and various possible reasons for the stoppage, the matter was referred to the City Engineer for•furtber investi- gation and report of recommended solution to the City Council. 4. .Mr. Romero, City Engineer, reported to the City Council on the sewer problem of R. R. Anderson at 80 Benton Way, Mr. Romero stated that the sewer easement provided in the Mount Pleasanton Square Subdivision was only four feet wide and was installed very shallow with many houses being almost level with the sewer. At this time the City Council discussed the necessity of placing curb and gutter improvements --the s.east. side--of Pe -'Street,.. between Milk,�and phjllip.!�._,4tfeet - Oper so L .01 a sa :"nz 3 r I City Council Minutes January 17, 1966 Page 5 This is the area along the Southern Pacific Railroad right- of-way and there are no barricades or other notices to motorists of this dangerous condition. After some discussion by the City Council, this matter was referred to the City Engineer to see if the railroad will install a barricade. 8. Council discussion of-possible development of the area behind and alongside ' the Recreation Center to accommodate off street parking was ordered received and filed. 9. Mayor Whelchel reported to the City Council on the status of the industry that was planning on building a plant in the industrial area east of the City and for which the City Council was planning on extending water and sewer utilities. The Mayor stated that at this-time the industry was not sure when they would build their plant but would have a decision in this matter within the next three or four months. Therefore, the Mayor stated that he felt the matter of the City extending the utilities could be held up until spring, or could be started at the same time that the industry began building its plant. The City Council discussed the matter reported by the Mayor and wondered what . effect this delay would have on the Young Brothers Market development on Edna Road who were also promised connection to the City water system. Mr. Romero, City Engineer, recommended that the City not commit its funds on a speculative improvement until an industry was definitely planning to come in. He pointed out that this expenditure would siphon funds from other needed improvements and-restrict the City's flexibility should industry wish to develop in another area. On motion of Councilman Gallagher, seconded by Councilman Miller, that the City proceed with the preparation of plans and specifications for water and sewer utilities extension but not call for bids until April 1966 and that funds be put in the 1966 -67 ' budget with first payments to be made in July 1966. Motion carried. 10. The matter of the legality of sidewalk repair costs being spread over a three year period as is done for construction was held over to the next meeting. 11. The matter of the Police Mutual Aid Agreement between the County of San Luis Obispo and all the Cities in the County was ordered held over to the next meeting. 12. communication from the Port San Luis Harbor District regarding the California Marine Park and Harbor Association summary of proposed state legislation dealing with Marine Parks and Harbors was ordered held over for study by the City Attorney and any comments on this legislation from the League of California Cities. 13. On motion of Councilman Miller, seconded by Councilman Blake, the following ordinance was introduced and passed to print. Mr. Romero, City Engineer, presented plans and specifications for the City Council's consideration for the installation of the water line and paving work in connection with the Mill Street Bridge. City Council Minutes January 17, 1966 Page 7 Mr. Edmonston stated that he knew the City. Council was interested in all water development in the County and that until all the details are known, he felt the City Council should neither support or oppose this proposal, but suggested that the Council ask the County to continue the matter until the City has an opportunity to study the entire proposal. ' The City Council then discussed with Mr. Edmonston, the overall water problems of zone two in the north part of San Luis Obispo County including the proposed Jack Creek and Santa Rita Development and the Nacimiento Water. It was the common consent of the Council that the City take no stand one way or the other at the January 18th meeting until the City staff and Council have had an opportunity to study the report. 20. Mr. Houser, City Attorney, introduced the matter of retaining legal counsel specializing in water rights and other water matters in order to advise the City Council in matters such as acquisition of the Salinas Reservoir and the proposal of the Supervisor's to spread the area of use of the Nacimieato Lake water. Mr. Houser stated that he had received a proposal from Mr. Frederick Bold, a specialist in this field, who stated he would be willing to represent the City in this matter. Mr. Houser then introduced Mr. Bold to the City Council and gave a brief resume of his background in water matters. On motion of Councilman Blake, seconded by Councilman Spring, that the City retain Mr. Bold pursuant to his written proposal provided that the total amount should not exceed $2,500 without prior City Council consent. Motion carried. 21. Communication from Mrs. Emmons, 253 South Higuera Street, asking the City Council ' to take whatever action was needed to give the businesses and property owners on South Higuera Street some relief from the work being done by the contractor and placir water mains in South Higuera. She claims that the trenches are open and that access to her property is practically impossible. Mr. Romero, City Engineer, reviewed the construction problems in the area explaining that all properties have had continuous access throughout the project with the exception of short intervals of an hour or two while construction work was taking place directly in front of the business. He explained that if the City were to follow Mrs. Emmons' request regarding special backfill, this cost should be borne by the City since the work is beyond the limits of the initial contract. He explained again that both the contractor and the Public Works Department are making every attempt to pacify the property owners and expedite the project. The City Council asked Mr. Romero to try and expedite this project so as not to hurt the people's business in this area any more than has been done to date. 22. Councilman Miller brought up to the Council's discussion the matter of a claim of James T. Estes and Roy Moret for damages caused to their property on Alrita Street due to alleged excess pressure in the water lines caused by the Alrita Street pressure pump system. Councilman Miller stated he felt that the City and the insurance carrier were derelict in their duties in not arriving at a decision on this matter for the property cwners ' involved and also he felt that the insurance carrier should have the adjustors actually contact the claimant in order to get the injured party's reaction to the accident. Communication was received from the Farmers Insurance Group representing the insurance carrier for the City of San Luis Obispo stating they had decided the claim of Estes and Moret on the basis of the report prepared by the Water Superintendent and on information received from the plumbers who made the repairs to both properties after the alleged incident occurred. On motion of Councilman Miller, seconded by Mayor Whelchel, that the City Attorney be asked to prepare a legal opinion on this matter and whether the City could pay these claims after denial by the insurance company.
