3. Traffic Committee report of February 1, 1966:

the Council authorize the City Engineer to contact the Division of Highways to see
if they would be agreeable to such an installation.

On motion of Councilman Spring, seconded by Councilman Miller, the request of the
Barber Shop Quartet was approved and the Mayor was authorized to execute a proclam-
ation dealing with the program. Notion tarried.
Mr. Chapman, Planning Director, commented on the reasons for the Commission's
request and the Council's action in prohibiting roof signs in the C -1 and R
Districts.

to amend the ordinance to allow roof signs in the C -1 and R Districts.
Motion lost on the following roll call vote.

On motion of Mayor Whelchel, seconded by Councilman Spring, the following
ordinance was introduced. Ordinance'No. 337, an ordinance amending ordinance 331
regarding temporary restrictions on installation of signs.
Introduced and passed to print on the following roll call vote.

The request of City Neon was held over for amendment to Ordinance -No. 331,
6. Communication from the Chamber of Commerce requesting allocation of funds from
the City Council to purchase "Welcome to San Luis Obispo" brochures and hotel -
motel reservation forms.
Councilman Blake stated that he wished his firm's name withdrawn from the bid list
submitted by the Chamber of Commerce as it was not his understanding when he bid
on these items that City funds would be requested to pay the bill.
Dr. 0. B. Paulsen, Executive Manager of'the Chamber, appeared before the Council
on behalf of the request for funds from the City.
The City Council discussed with Dr. Paulsen the request for additional funds for
the Chamber stating that he felt that if the funds continued to be spent for short
term proposals such as being requested at this time, that none of the so called bed
tax money would be kept and,used to develop a Convention Center.
' Also the Council felt that the hotel -motel members of the Chamber could well afford
the reservation forms being requested by the Chamber.
On motion of Councilman Gallagher, seconded by Councilman Spring, the request for
allocation of funds to the Chamber was-denied. Motion carried.
7. Communication from the Southern Pacific Company forwarding agreements for
execution by the City for installation of automatic crossing gates at Orcutt -Road
in San Luis Obispo was received and discussed by the Council.
The Council discussed the proposal and felt the City should not execute the agree-
ment until the County had agreed to share in the cost of these improvements as the
crossing is partly in the County. -

at this time could assume the responsibility of paying for the improvements or a .
portion of the improvements after all the required hearings and notices had been
sent to the property owners and no protests were made.

The motion was cancelled by the maker and the seconder and the matter was referred
to the City Attorney to see if the City could legally pay for a portion of the
' improvements.
On motion of Councilman Miller, seconded by Councilman Gallagher, the following
resolution was introduced. Resolution No. 1520, a resolution confirming costs of-
sidewalks constructed under the 1911 Act.
Passed and adopted on the following roll call vote.

9. At this time the City Council held a public hearing on Resolution No. 1513,
a resolution of intention-to abandon a portion of Wilson Street and Grove Street.
Mayor Whelchel declared the public hearing open.

resolution was introduced. Resolution No. 1523, a resolution abandoning a portion
of Wilson and Grove Streets.

' 10. Communication from Cuesta College asking the City Council if they could supply
the College with potable water if the College were located on the Reis property at
Santa Margarita.
Mr. Houser, City Attorney, stated that the request is for potable water supply and
since the Reservoir is exposed to recreational uses, the State Health Department
Permit requires full treatment and filtering of the water before the City can use if r
it for domestic use. Therefore, the furnishing of a potable water supply would
require the City to assure such treatment and processing and would also require a•
policy determination of what amount of water the City would be willing to perpet-
ually furnish outside of the City limits.
On motion of Councilman Gallagher, seconded by Councilman Blake, that the City
notify Cuesta College that it can not supply potable water on the Santa Margarita
side of Cuesta Grade. Motion carried.

13. City Engineer, D. F. Romero, presented his report to the City Council on the
investigation,..made: by. his department. ;of 'the sewer..main.,and - lateral.serving. the .;..,

cleaning out both the City's main; and `ihe_ Model -I:inea' Supply .ylater_al..,.He,,stated..:
that in all cases the City facility and the laundry facility were found to be in
excellent working condition and that;. there ;were, no obstructions in •the.,line.,and,:no
detrimental affect on the sewer service caused by the recent construction.
Mr. Romero stated that he again suggests; that the. only,.jsolubion to�,rthis problem is
for the installation of a parallel 10" line from the connection at Higuera Street
to the Model Linen Supply lateral. r
Mr. Burch Page, operator of the Model Linen Supply, stated that.since.this;;work had
been done by the Engineer, that no stoppages or work delays had occurred and he
hoped that this would - solve-their.problem,but, hoped ; that the City..would.- continue a
to eonsider:instaling an _adequate size, line.in the street.

Engineer prepare plans and specifications to install a 10" sewer line W South;''��
Street west of Higuera Street.

The motion of Councilman Miller and Councilman Sprligi was amended.to include the

providing assured sewer service to property owners on Benton WayFho have experi-

After discussion by the City Council no action was taken except that the City
Engineer was instructed to provide cleaning of this sewer line on an accelerated
schedule.
44a. Communication from E. W. Rodriguez asking the City Council who was responsible
for repairs to damage of new sidewalk recently placed on his property on High and
' Ward Street.
Mr. Rodriguez claimed that shortly after completion of the curb, gutter and sidewalk
that large cracks and fissures appeared which he was sure would have to be repaired
and was wondering whose responsibility this would be.
The City Council discussed-the matter of damage to the sidewalk at High and Ward
Streets and who would be responsible for such repairs and further who was to blame
for the damages to the existing property.
Mr. Romero, City Engineer, explained that in his opinion two broken places at the
driveway ramp were probably caused by trucks moving on to the site, that the broken
sidewalk near the fire hydrant was probably caused by the contractor, and that the
large crack running diagonal at the intersection was probably not caused by the
contractor's equipment working in that street, since a sidewalk, curb and gutter
would not crack in this fashion due to a heavy load alongside the gutter.
Mr. Rodriguez appeared before the City Council and discussed his problem attempting
TO place responsibility for the damage and also who would pay for the repairs to
the sidewalk.
It was moved by Councilman Miller,,that the city repair the cracks in the sidewalk
adjacent to the City Fire Hydrant.
Motion died for lack of a second.
Councilman Blake stated that he objected to the expenditure of public funds for the
repair of private property unless the City was sure who was responsible for the
damage.
It was moved by Councilman Miller, seconded by Councilman Spring, that the City
Engineer negotiate with the contractor to repair the sidewalk at the contractor's
expense. Motion carried.
15. Communication from the City Engineer reporting on the difficulty being
experienced in the operation of the treadle pad traffic activator units at Foothill
Boulevard and Santa Rosa Street.
Mr. Romero stated that a new type'of traffic unit is presently available on the
market and appears to have a great deal of potential to solve the problems in this
field.
Mr. Romero asked the City Council's permission to install a pair of the new units
on the westerly Foothill Boulevard leg of'the intersection on an experimental basis
as soon as possible. Total cost of the installation would be approximately $600.00
with the cost to be shared on a 50 =50 basis with the Division of Highways.
On motion of Councilman Miller, seconded by Councilman Gallagher, the City Engineer
was authorized to proceed as requested. Motion carried.
' 17. Communication from property owners adjacent to Grove Street east of Higuera
Street requesting abandonment of that portion of Grove Street so that developments
can be made in this area.
The City Planning Commission submitted a report recommending that Grove Street east
of Higuera Street to the creek be abandoned subject to a permanent 16 foot access
being provided to the property owned by Mr. Wilkinson.
Dr. Brown and Dr. McAdams appeared before the City Council on behalf of their
request for abandonment and explained to the City Council just what they were
proposing to do with the adjacent properties if Grove Street were abandoned.
The City Council discussed the request with particular emphasis on guaranteeing
street access to the Wilkinson property. Also consideration to be given for'
placing the Wilkinson water line in the street rather than coming off Higuera

establishing a 10 foot setback line on the street side of Monterey Street across
from the Mission.
After some discussion by the City Council, it was moved by Mayor Whelchel, seconded
by Councilman Gallagher, that the City Attorney open negotiations to acquire the
remaining parcels of property on Monterey Street for the realignment of Mcuterey
' Street from Chorro to Broad Street. Motion carried.
On motion of Mayor Whelchel, seconded by Councilman Gallagher, the City Attorney
and City Clerk were instructed to get proposals from appraisers to make evaluation
studies of the property value and also procure a preliminary title policy on
properties to be acquired. Motion carried.
30. At this time the City Council discussed the provisions of the recently adopted
requirements for home occupations in the Municipal Code and felt that some conditions
should be made for stricter control over home occupations.
This matter was referred to a Council Committee consisting of Councilman Blake
and Councilman Spring to discuss this matter with a Planning Commission Committee
and make recommendations to the City Council.
31. E. P. Thompson, Water Superintendent, reported to the City Council that the
bypass and pressure relief valve already installed on the Alrita pump station had
been completed. Communication received and filed.
32. City Engineer, D. F. Romero, presented plans and specifications for traffic
signal installations at the following intersections: Higuera and Nipomo Streets,
Nipomo and Marsh Streets, Higuera, High, and Pismo Streets, and Higuera and South
Streets. He explained the proposed method of operation and explained that a consid-
erable amount of parking restriction would be needed on Higuera at High in order
to make the signal work properly. Mayor Whelchel questioned the need of traffic
' activated signals at South and Higuera and suggested that fixed time signals would
function adequately. Mr. Romero recommended against fixed time installation on the
basis that unnecessary delay would be caused for the motorist. Councilman Gallagher
recommended that the City Engineer take additional traffic counts at the inter-
section. Mr. Romero stated that additional counts are not needed but if the
Council so decided, they would be taken. He also explained that he would review
possibilities of fixed time operation with Division of Highways personnel and would
report back at the next Council meeting.
Decision on this matter was held over until additional studies had been prepared
by the City Engineer.
33. Request from the Fire Chief, L. Schlobohm, for permission for the City Fire
Department personnel to attend the special State sponsored Oil Fire Control School
at Turlock, California and requesting augmentation of the budget for this purpose.
Mr. Miller, Administrative Officer, recommended that the request be approved and
that $175.00 for expenses be taken from Contractual Services Account 210.2.
On motion of Councilman Miller, seconded by Councilman Gallagher, the request was
approved as recommended by the Administrative Officer. Motion carried.
35. The following bids were received to supply petroleum products to the City of
San Luis Obispo. (See attached sheet)

each category was accepted by the Council. Motion carried.
36. A proposal from the Tri- Counties Communications Company to install a complete
new public address system in the Council Chambers was ordered held over for
additional information and brochures on the type of equipment being recommended.

to exchange City owned property at Laguna Lake for privately owned property in
Block for development as_a- ,Municipal Parking Lot.
The Council Committee recommended exchange of City owned property on Madonna
Road as shown on the'map, consisting of approximately ten acres, for the property
fronting on Monterey Street and to the rear of the I6izio • Graham buildings, to be
used for public parking purposes. The buildings fronting on Monterey Street were
' subject to month to month tenancies except the bar, which had approximately five
years to run, and a small structure extending from the Graham building which was
included in the Graham lease which would expire sometime in 1967. The City would
not receive any rental on this small structure because of the inability to prorate
the existing lease on the Graham building.
No real estate commission would be paid by the City, taxes and rent would be
prorated as of close of escrow, with the City paying one -half of the escrow cost
and each party paying for their title insurance policy.
If the Council wished to follow the Council Committee's recommendation, it
would be necessary to pass an ordinance to print to exchange the property.
On motion of Councilman Blake, seconded by Councilman Gallagher, the following
ordinance was introduced and passed to print. Ordinance No. 338, an ordinance
authorizing exchange of real property.
Passed and adopted on the following roll call vote.
