Spring, Clell W. Whelchel Present: R. Young, Planning Director; J. H. Fitzpatrick, City Clerk; H. Johnson, City Attorney; R. D. Miller, City Administrative Officer; E. L. Rodgers:, Police Chief; D. M. Musgrave, Police Sergeant. 1. The City Council discussed the problem of two automobiles purchased by the City on a bid basis from Stanley Motors which were to be delivered to the Police Depart- ment but prior to delivery it was discovered that the wheel base was less than the minimum length specified in the bid specifications. Police Chief, E. L. Rodgers, explained that if this lesser wheel base was accepted, then other bidders who could not bid the 117 inch wheel base should be included if the Council wishes to accept this length. Mr. Stanley Cole, Stanley Motors, appeared before the City Council and explained at when the bid notices came from the City, he submitted the specifications to the manufacturer's representative who prepared the bid proposal for the City. Mr. Cole stated that the manufacturer's representative did not show a deviation from the specifications that he was bidding 116 inch wheel base automobiles and therefore Mr. Cole stated that he in good faith felt the cars being bid met the specifications. Councilman Spring stated that he felt in all fairness to all the dealers who could not bid a 117 inch wheel base automobile, that the City should not accept these cars as they deviate from the specifications. Further he felt that Stanley Motors should supply the cars that were bid and meet the City specifications. Mr. Ople stated that he agreed with Mr. Spring's statement but it would take another Sys to have the proper cars shipped from the factory equipped according to City specifications. On motion of Councilman Spring., seconded by Councilman Gallagher, that the City reject the 11 inch wheel base automobiles and that the dealer supply cars that meet City specifications and extend delivery date by 60.days. Motion carried. 2. 7:30 P.M. the City Council met with the City Planning Commission. 3. The City Planning Commission discussed the recommendation made to the City Council to rezone that area lying between the freeway,: Lemon Street, Santa Rosa. Park and Stenner Creek from R -3, R -4, and C -1 to R-C and R4. Mr. Kenneth Schwartz Chairman of the Planning Commission, briefed for the City Council the considerations given by the Planning Commission regarding this rezoning. He compared the uses that would be allowed in the R-C and R-O Zones as compared to the uses in R -3, R -4_and C -1 zones. Mr. Schwartz then discussed with the Council the philosophy of the Planning ommission in recommending the change from the C -1 zone to R-0 which was developed as a zone to handle the traveling public. He then presented to the City Council a list of suggested uses that could be added to permitted uses in the R-0 zone by amending the ordinance. For example he stated amhulance service, delicatessen, drug stores, florists, gift shops, photography studios and supplies, laundry and dry cleaning agencies, liquor stores, hospital supplies and ice and food vending machines. The City Council and Planning Commission discussed the uses in the R-C zone and this area particularly for a drive in restaurant. 1 I� u 1 City Council Minutes January 10, 1967 Page 2 Some of the Council felt that no drive in restaurant should be allowed in this zone without a use permit so that the Planning Commission could set conditions for this use. Arnold Volny questioned the attempt to liberalize the uses in the R -C zone when these uses might not be acceptable in another area if R -C were.requested. He urged that any uses contemplated for the R -C zone be placed in the ordinance in detail so that no confusion would exist in this zone. Mr. Young, Planning Director, presented for the Council's consideration the provisions of Section 9200.6(B) which states that uses not listed in the zoning district charts which are similar in character to those permitted in a particular district and do not generate more traffic, parking, dust or noise may be permitted by the Planning Director, The Planning Commission told the City Council that they would immediately begin studies on including these additional uses in the R -C zone for Council consideration. The City Council and Planning Commission then discussed the recommendation of the Planning Commission to rezone a portion of block 77 to R -C from R -3 and R -4 for development by the Maino Corporation. Mr. Schwartz explained to the City Council the considerations given by the Planning Commission in recommending this change for a portion of the block as he stated he felt that the Planning Commission's action inferred that the entire block would be zoned to R -C. Councilman Blake questioned the Planning Commission on the lack of requirements in The C -1 zone of allowing drive in establishments without use permits. ' Mr. Schwartz explained that unfortunately in preparing the ordinance for adoption a typographical error was made and that the conditions for restaurants in the R -C zone was left out. He stated this would be recommended again to the City Council with other amendments to this zone. He suggested that if the City Council wished this requirement on this particular rezoning request that they could add the S classification to the zoning which would require the developer to submit plans for his development. Mr. Lloyd Dietrich, 594 Montalban Street, objected to the rezoning of Block 77 to allow commercial development as he states that he and adjoining property owners are already plagued by noise and other nuisances caused by existing commercial development on Santa Rosa Street particularly the service stations and the drive in restaurants and he stated that for himself if this property were rezoned he would be forced to sell his home as he requires a certain amount of peace and quiet to sleep in order to put in a day's work. Mr. Schwartz then briefed for the City Council future areas being considered by the Planning Commission for rezoning study in accordance with the studies developed by the General Plan. 4. The City Council discussed with the Planning Commission the appeal of Harlis Wall from a denial by the Planning Commission of a use permit to use the property at 1415 Beach Street as a warehouse and service area for vending machines. Mr. Schwartz explained that this building had been a non - conforming use from the time of the adoption of the original ordinance and that it had not been in use for over six months. Therefore the Planning Commission under the provisions of the ordinance, he felt, could not legally grant a use permit for a new business in this area or extend a use permit to this property. He also stated that without amending the ordinance he felt that the City Council could not grant a use permit. 3. Request from Martin Polin for permission to place screening fences into the City parkway adjacent to the Jordan's Market in his shopping center. The Planning Director explained that this matter could not be considered by the City Council at this time as a public hearing would have to be held in order to ' allow the fence to be placed in the street side yard "area and then the City Council would have to consider the placing of the fence in the public right of way. There- fore no consideration was given to this request. 4.
