City Hall Pledge Roll Call Present: Emmons Blake, Myron Graham, Arthur F. Spring, Kenneth E. Schwartz Absent: Donald Q. Miller City Staff Present: J. H. Fitzpatrick, City Clerk; H. Johnson, City Attorney; R. D. Miller, Administrative Officer; D. F. Romero, City Engineer; E. Rodgers, Police Chief; L. Schlobohm, Fire Chief. 16. Communication from J. H. and L. L. Nichols, co- owners of the San Luis Obispo Yellow Cab Company, requesting a meter rate change was continued. The City Clerk was instructed to request the Nichols' to appear at the next Council meeting to discuss their proposal. 19. Communication from the State of California Department of Public Works, notifying the City Council that under the State TOPICS Program the City of San Luis Obispo has been granted $40,497.00 as its share of the State of California's 1969 -70 fiscal year allocation of funds. D. F. Romero, City Engineer, explained how the funds will be used and stated that his staff is preparing the necessary applications for use of these funds. The communication was ordered received and filed and the City staff was instructed to proceed with their plans for use of these funds. 20. Mayor Schwartz explained to the City Council that the County Mayors' organi- zation has been working for several months on a uniform dog control ordinance for uniform enforcement throughout-the County and its cities. He stated that one of the problems was that each city and the County have different dog license fees, different redemption fees, etc., which makes it very difficult for Woods Animal Shelter to enforce the various ordinances. He continued that at the last Mayors' Meeting, held in Paso Robles, it was his impression that the Mayors of all the cities and representatives of the County urged the adoption of a uniform dog control ordinance. R. D. Miller, Administrative Officer, explained in detail the provisions of the proposed uniform dog control ordinance. Morro Bay and the County were the only agencies not having a leash law, and the County Administrative Officer was working on a draft ordinance which -will include the County but with some modifications. It was proposed Also that fees for redemption of impounded dogs be raised to a uniform $5.00 for the first occurrence and $10.00 for each subsequent pickup ' during any one year. It was further suggested that the minimum period a dog should be held should be three days. All agencies would charge_$3:00 to -license male and spayed dogs and $4.00 for females. Board fees would.be $1.00 per day and the charge for a duplicate license would be $1.00. City Council Minutes February 4, 1970 Page 2 24. The City Clerk reported on the following bids received for the Los Osos Road and Madonna Road Resurfacing Project, City Plan No. 16 -70. Engineer's Estimate Sully- Miller Company A. J. Diani W. G. Romero, City Engineer, recommended.that the low bid of Sully- Miller Con- tracting Company be accepted. On motion of Councilman Graham, seconded by Councilman Blake, the contract was awarded to Sully- Miller Contracting Company. Motion carried.. 25. The City Clerk reported on the bids received for replacement of various pieces of automotive and contractor's equipment. (See Exhibit "A ") . R. D. Miller, Administrative Officer, presented for the Council's information his analysis of the bids received. He stated he had disregarded the bid of Padre Chevrolet as no bid bond or check was included in the bid which was required in the Notice to Bidders. He recommended that the City Council accept. the offer from Callahan Dodge to purchase all the used City trucks even though they did not bid on the new trucks. He continued that the Police Department would like to increase its fleet of cars from 10 to 11 by retaining unit 423 for use by the Detective Division. Mr. Miller stated that this was not considered at budget time and it would add another $500 to-item #2. He also stated that based upon past experience, Mr. Romero would make a strong plea for the City Council to purchase the Caterpillar grader which is $3,091.00 higher than the Wabco grader, as Mr. Romero felt the Caterpillar would give much better service and would have a greater trade -in value. R. D. Miller stated that in his analysis he recommended that the second low bid of Machinery Distribution Company for the Wabco grader be accepted as he was given to understand that both the Caterpillar and the Wabco met the City's specifications. Therefore he asked that the City Council consider these recommendations. 1. Eliminate the bid of Padre Chevrolet as no bid bond was attached. 2. Keep Police unit #23 3. Accept the offer from Callahan Dodge for purchase of the used City trucks. 4. Accept the bid on the Wabco grader as it is the lowest qualified.bid. C 1 E. Rodgers, Police Chief, explained to the Council the need for keeping the extra sedan for use by the Detective Division in their investigations. He stated that I many times detectives must wait for an unmarked car to be brought in before they can continue their investigation. D. F. Romero, City Engineer, recommended that the bid be awarded to Wallace Machinery Company for the Caterpillar machine on the basis that this machine has proven by past experience and records to give less maintenance expense, less down -time, and a higher trade -in value and that the availability of parts and service from Wallace Machinery was superior to that of Wabco. Mr. Romero stated that by his analysis, it was clear that the Caterpillar machine would give the least cost over the service life and therefore was the best bid. City Council Minutes February 4, 1970 Page 3 H. Johnson,-City Attorney, stated that under the provisions of the City Charter, the lowest qualified bidder must be awarded the bid if it meets with the specifica- tions advertised by the City. He stated that in this case, he can see no justi- fication for taking the higher priced equipment. R. D. Miller suggested that perhaps the City should reject all the grader bids, accumulate more funds and call for bids at a later date. The City Council agreed with the recommendations of the Administrative Officer that the bid of Padre Chevrolet be rejected; that Police Unit 1123 be retained; that the City accept the offer of Callahan Dodge for purchase of the used trucks, and also that R. D. Miller, Administrative Officer and J. H. Fitzpatrick, City Clerk be asked to review the need for bid bonds on this type of equipment purchase. On motion of Councilman Blake, seconded by Councilman Spring, that.the City accept the low bid for each item and that all bids be rejected on item 4113, motor grader. Motion carried. A. Communication from Mrs. Evelyn Goulart, City Library, requesting a leave of absence without pay in order to undergo surgery, was approved on motion of Councilman Blake seconded by Councilman Graham. On motion of Councilman Spring, seconded by Councilman Blake, the meeting adjourned at 1:45 P.M.
