Brown, Myron Graham, T. Keith Gurnee, Kenneth E. Schwartz City Staff Present: J. H. Fitzpatrick, City Clerk; W. Flory, Parks and Recreation Director; R. D. Miller, Administrative Officer; E. L. Rodgers, Police Chief; D. F. Romero, City Engineer; A. J. Shaw, City Attorney; R. D. Young, Planning Director. 1. The City Clerk reported the following bids were received for Residential Street Tree Planting, Tract 405, Ferrini Heights No. 6, on Friday, Frebruary 11, 1972 at 10:30 A. M.: Karleskint -Crum, Inc. $2,679.33 San Luis Obispo Troutner Brothers $2,863.70 San Luis Nursery San Luis Obispo ' Heatherwood Landscape $3,008.30 Santa Maria Dennis Landscape Co. $3,500.00 San Luis Obispo On motion of Councilman Blake, seconded by Councilman Graham, the low bid of Karleskint -Crum was accepted. Motion carried. 2. The City Council considered the request of E. L. Rodgers for a second driveway at 3105 Calle Jazmin in order to facilitate the parking of a travel trailer in the back yard. D. F. Romero, City Engineer, stated he had no objections to'the requested driveway variance but that only the City Council could approve it. On motion of Councilman Graham, seconded by Mayor.Schwartz, the variance was approved. Motion carried. 4. The City Council considered the Human Relation Commission's report on T.G.I.F.'s. ' Harry Woolpert, Chairman of the Human Relations Commission, presented the recommendation of the T.G.I.F. sub - committee as amended by the Human Relations Commission. He felt that the recommendations were an acceptable solution to the T.G.I.F. problem and the Commission asked the Council's approval of this solution rather than Ordinance No. 537. The Human Relations Commission asked that the T.G.I.F. sub - committee be continued for a six month period in order to review actions under these recommen- dations. The recommendations were: City Council Minutes February 14, 1972 Page 2 1. That the City Council not finally adopt Ordinance No. 537 as it was regulatory in f6r6rh ti'ut prohibitory in :effect: 2. That the City Council adopt the recommendation to allow T.G.'s with self- regulation by the sponsors to operate under the general guidelines of the T. G. Governing and Sanctioning Board. Mr. Woolpert continued reviewing for the Council's information the fact that the sub - committee had met in six public sessions at which opinions and suggestions from both the young people who sponsor T. G.'s and also other people who were interested in the problem, and as a result of these sessions, the sub- committee's guidelines for regulation were submitted. A. J. Shaw, City Attorney, submitted the..following comment's for Council information regarding the recommendations of the Human Relations Commission: 1. If Council "endorses" the by -laws, or If Council permits an official City representative to serve on the Board. It is quite possible that the City could be exposed to extensive liability for injury to persons or property. 2. Furthermore, as a "sponsor" and "observer" the City might compromise its ability to enforce existing laws for the protection of the neighborhood. 3. Therefore, if the Council desires to continue or discard the proposed ordinance and give a citizens group another opportunity to try self - regulation, I would recommend the following steps: 1. Recognition of the proposed plan for self regulation. 2. Notification that the City will not participate in the plan, but that the City is hopeful the plan will work. 3. Directive to all City employees and representatives that their participation in TG's or on the Governing Board is in private capacity and not as an agent of the City. 4. Notification that the City intends to vigorously enforce any and all existing laws for the protection of the peace and property of City.residents. Mayor Schwartz explained that the purpose of this meeting was to receive the recommendations from the Human Relations Commission and to discuss them with the members of the Human Relations Commission. The Council was also interested in the reasoning for arriving at these recommendations. The Council discussed with Mr. Woolpert, Mrs. Wirship and Rev. Tjaden, some of the background in the Human Relations Commission arriving at the recommendations for a. trial of self - regulation and also discussed the reasons why this matter was being discussed at all. One of the points discussed was the lack of a recommendation even mentioning the control of sale or use.of.alcoholic beverages at T.G. parties. H. Woolpert concluded the discussion stating that this proposal was a temporary one and that the T. G. sub - committee would continue in.office for six months for a more comprehensive recommendation to the Council on the results of the T. G.'s.during the interim period. On motion of Councilman Graham, seconded by Mayor Schwartz, that the City Council hold a public hearing on the final adoption of ORDINANCE NO. 537 on Tuesday, February 22, 1972. Motion carried.. The City Council continued discussion of the following study items from prior study sessions: (6) General Plan: The City Council discussed the benefits of again holding a one -day seminar for all boards and commissions and staff of the City to discuss the Simon Eisner general plan alternatives and the General Plan being prepared by the City. After discussion, it was the consensus that the staff be authorized to proceed in planning the seminar. (9) R. D. Young, Planning Director, reported to the City Council on the code enforcement program since its beginning in the fall of 1971. He reported that over 280 special investigations and inspections had been conducted and- that.approximately 99 violations were found to exist. The majority of the violations have been abated, with the remaining in the process of being resolved. He indicated that the number of complaints and violations appear to be diminishing. He also stated that Mr. Nicklas the Housing Inspector, has been handling approximately 20 dwellings per month on a half time basis. (10) Mayor Schwartz reviewed for the City Council the proposal of Christiansen Enterprises of Santa Maria to inaugurate an intercity bus system throughout San Luis Obispo County. The proposal had been tentatively approved by representatives of all the cities and the County, pending a formal presentation and proposal for consideration of the granting of franchises or agreements by each city and the County to Christiansen Enterprises. He stated that Christiansen Enterprises did not expect to apply for any support or subsidy from the City or County governments, but hoped to operate as a private company. They should be presenting their proposals within the next thirty to sixty days. ' The Mayor also reported on a meeting held Friday, February 11 with a representative of the United States Department of Transportation and Cal Poly officials regarding the application by the City for Capital/ Grant Funds :to•prepare a feasibility study -for- a transportation`. system grant for the City: The Department of.Transportation rep- resentative stated that the grant had been or was being approved and that the City should receive official word within a few days. (15) Mayor Schwartz reported that in the matter of reworking the Municipal Code that he had asked the Citizen's Advisory Committee to review the various fees in the code so that they could be taken out and placed in resolution form for easier updating than by changing the individual ordinances. He stated he also asked that the Citizen's Advisory Committee look at the fees and see if they wish to make any recommendations for changes to the City Council. (16) Mayor Schwartz asked the City Council if they felt it was worth the effort to ask the State Highway Commission to reroute that portion of State Highway 227 that now runs from Broad Street to Higuera /Marsh, there and to Highway 101 to a new route: Broad Street via Santa Barbara Avenue, Railroad Avenue and Santa Rosa Street to Highway 1. The City Council discussed the benefits of such a rerouting and what effect it would have on other local City traffic. After discussion, th= City Engineer was authorized to make preliminary contact with the Division of Highways to see if this plan was feasible for further discussion with the Highway Commission.. 5. Communication from,the Downtown Association requesting permission to use Mission Plaza for a baby farm animal display during Easter vaca- tion from March 27 to April 1. The Mustang 4 -H Club would be in charge of the display and the Downtown Association would furnish the full insurance coverage. City Council Minutes February 14, 1972 Page 4 On motion of Councilman Graham, seconded by Councilman Brown, the re- quest was approved and the City Clerk was instructed to notify them of the Council's approval. Motion carried. 6. The City Council adjourned to executive session. On motion of Councilman Blake, seconded by Councilman Brown, the meeting was adjourned. Motion carried.
