Miller, Administrative Officer, reported to the.City Council that in accordance with the contract for.the baseball.stadium facilities it had been necessary to install a four -inch water meter at the job site before the combustible construction began. Informal bids had been solicited with a bid from.R. Baker of $4,800. In order for.this contract.to be let, the City budget.must be increased at this time. Therefore, he recommended that Account No. 60- 12- 5761 -605 be increased by $5,500. On motion of.Councilman Norris, seconded by Councilman Graham.the following. resolution was introduced: RESOLUTION NO. 2800 (1975 Series), a resolution increasing the 1974 -75 budget. Passed and adopted on the following roll call vote: AYES: Councilmen Graham, Gurnee, Norris, Petterson and Mayor Schwartz NOES: None ABSENT: None 3. R. D. Miller, Administrative Officer, stated that his assistant, David Williamson, had submitted to him a draft of the various job descriptions for the new Community Development and Public-Services Departments, but due to. the extremely heavy load in the Administrative Office, he asked Council permission to continue this to a later date. The City'Council'approved the request. 4. The City Council-at this time discussed-the proposal adopted by the 1 City Council retaining a.consultant'.to.prepare.the Laguna Lake and surrounding. area master plan for a.cost of.$50,000. Councilman Gurnee asked that the City Council consider rejecting and not entering in the contract with the.consultant to do.this work at this time as he felt that there were many.more pressing things needed.to.be done and completed by the City; for.example, the General Plan studies that have been.under progress for over.a year and a half, and the lack of regulatory provisions and.ordinances to complement the new General Plan. He felt the_City_had more..important.duties, such as to study the overall role'of consultants within the City, and he felt the Council should make a study of administrative management within the City before initiating further master planning efforts. He also felt that this particular project should be a joint effort between the City and the County. Councilman Gurnee asked for a rejection'of:•the consultant contract for the following reasons: 1)� The.-General-Plan was taking too long to complete. Another major planning - .study would.overload..the planning department and upset the General Plan's timetable for completion. 2) City inability or refusal to implement past plans including the General Plan could indicate that this.new.plan.would.meet the same meaningless fate as previous ones. Until a track record of City accomplishment of past plans-was established, more studies would be a waste of time, energy and money. 3) Such a. planning.effort should require close.cooperation between the City,)County,.and other agencies for it.to have.any:chance of ' being implemented. Until City- County relations.are mended, planning outside the City by the City would meet with the same -fate as the Eisner General Plan which the County refused.to adopt. The City could plan forever outside the City, but they could exercise no control of development without cooperation of the County. City Council Minutes May 23, 1975 Page 3 4) The City has had considerable difficulty with past consultants. Until determining what went wrong.with past consultants and contracts, the City should not jump into another expensive consultant venture. ' 5) The regional nature of the plan, involving detailed studies over large areas outside the City Limits, merited financial assistance from the County and perhaps other agencies. 6) Existing plans, including the County Open Space Plan, the City Open Space Plan , City General Plan, State plans for areas of Statewide critical concern, would hold unneeded development in check - if enforced. There was nothing that another "plan" would do to stop development on San Luis Peak, unless these or existing plans were implemented and strictly enforced. Therefore, the City should concentrate its efforts on completing the General Plan, zoning, subdivision, and grading ordinances, E.I.R. guidelines, making zoning consistent with the General Plan and seeking County agreement to enforce them in the urban fringe, before engaging in abstract studies that would not, in themselves, influence development. He concluded that the timing was.poor, and that he would press for completion of higher priorities in planning and then reconsider the issue of this study. Councilman Norris stated that he was pleased with the City Council's reconsideration of this issue as he had consistently opposed the expenditure of further tax funds for the study of Laguna Lake and the mountains. He ' was opposed to regional planning by .the City. He felt the City should implement the plans they had already and not go into other areas. He stated he-generally agreed with the great amount of money for this particular consultant.. He felt that if the City Council wished to spend money on the Los Osos Valley, he would agree to spend money to man and build a fire station to protect the citizens who live in that area. Councilman Petterson stated that he agreed with both Councilman Gurnee's and Councilman Norris' comments in general but wanted to add that in contacting County planning officials, they had never been consulted by the City on this planning study as envisioned with the new consultant for $50,000. He felt that before the City entered into this type of contract, they should at least get cooperation from the agency in whose area and responsibility the land lay. He then reviewed for the City Council the studies that had been completed to date by both the County and the State agencies which would protect the mountains and peaks of the area. Councilman Graham stated that it was hard for him to believe that the County was not aware of studies being considered by the City of San Luis Obispo. He felt that the City should be constantly updating prior studies for development of specific plans of the City. For example, he felt Laguna Lake area must be updated in order to keep on top of the development. He felt that the City staff was competent and.the Council should support their requests for funds for use of these consultants. He felt that the ' plans should be allowed to proceed and the funds should be expended. Mayor Schwartz stated he could not understand the argument presented by Councilman Gurnee. He stated he felt just the opposite, the proposal and study was needed in order to complete the planning process started by various City Councils and Planning Commissions since 1961 when the adopted General Plan showed the development of Laguna Lake and the adjacent peaks as part of the study area. He continued that in General Plan considerations, no City Council Minutes May 23, 1975 Page 4 member of the public had ever objected to the inclusion of these develop- ments in the General Plan. He then reviewed in detail the Hector Plan for development of Laguna Lake and its staged development. He continued that he saw the new plan as an update of existing plans for the City. He then read various sections of the adopted open space plan of the City with reference to the need for the Laguna Lake study which was being proposed by the consultants. He continued that the City had adopted an open space plan and that the proposed study was part of that plan. He felt that this was just an implementation of the adopted plan. Further, he reminded the Council that development of the Laguna Lake and adjacent land had been carried in the Capital Improvement Program for capital funding for many years. Therefore, he did not feel that Councilman Gurnee's arguments were valid. This was and had been an ongoing planning process and its final acquisition and development would add to the quality of life of the citizens and visitors to the City of San Luis Obispo. He strongly urged that the members of the City Council be very careful in reconsidering and rejecting the consultant's proposal for the Laguna Lake and adjacent land study at this time. Councilman Gurnee agreed that his objection was only on timing of the consultant's study, not on the study itself. He felt that the General Plan should first be completed before adding new elements. He also urged that the Council adopt the new regulatory ordinances in order to get the City's General Plan and State - required elements and local regulatory ordinances under control, which should have been adopted a long time ago. He would be most happy to go into advanced planning such as Laguna Lake study now under consideration when these had been accomplished. Councilman Petterson asked if the Mayor did not feel that the County and State plan for this area had some validity and should the City not consider these proposals? Mayor Schwartz stated that while he recognized State and County plans, he felt his responsibility was to the City of San Luis Obispo and that the City should proceed with its own studies. It was his feeling that many people viewed the peaks as a very sensitive element in protecting the City's natural environment. Councilman Petterson felt that the County of San lead agency in developing plans and strategies fo the area. He felt that there were many questions undertaking this particular study. Mayor Schwartz opened the meeting to the public. Luis Obispo should be the r protecting the Morros in to be answered before Peter Phillips, Design Review Board, stated that the DRB could not make a recommendation as they had not been involved in any of the studies. Homer Odom agreed that most of the land being considered for the study was mostly outside the City and he felt that this should be done by the County. He also felt that before the City Council started to plan County land, they should first try to get cooperation from the County government and develop the plan jointly. He concluded that the relationships.between the City and County governments were bad now and this proposal would not make it any better. He urged the City Council to reconsider their decision at this time and get the City plans within the City under control before they develop plans for the County. Mayor Schwartz declared the public meeting closed.
