City Council adjourned to Executive Session. 2;: City Council reconvened in Regular Session. 3. There-being no further business to come before the Council, the Mayor adjourned the meeting at 4:30 p.m., December 22, 1975 to 3:00 p.m., Monday, December 29, 1975 at City H41, 990 Palm Street, San Luis Obispo. ' CONFERENCE ROOM, CITY HALL Roll Call PRESENT:. Councilmen Gurnee, Norris, Petterson and Mayor Schwartz ABSENT: Councilman Graham City Staff PRESENT: J.H.. Fitzpatrick, City Clerk; A.J. Shaw, City Attorney; Jack Kellerman, Chief Building Inspector; and'Lee M. Schlbbohm, Fire Chief 1. Jack Kellerman, Chief Building Inspector, submitted a report to the City Council on-the condition.of the fire.damaged.structure located.at 993 Monterey Street. He.reviewed the-physical condition of the building structure ..as a result of the December 28, 1975 fire. It was his opinion that the building was a total loss with-no possibility of rehabilitation. Also, he ..felt that those portions of the building left standing are structurally unsound and should be demolished as soon as possible. Although, in his opinion, he felt there was no immediate:.hazard from collapse but the longer it stands the-greater the possibility-of-collapsing increases. Therefore, he concluded that as Chief.Building.Officer for the City and under provisions of Chapter 4 of the Uniform.-Building-Code, Volume IV, Dangerous Buildings, he should commence proceedings to notify the owners of the building to begin demolition within 10 days. ..The City Staff.(J.H. Fitzpatrick, J. Kellerman and.L..Schlobohm).recommended __ .. that.the streets adjacent to the fire damaged building at 993 -999 Monterey Street continue to be barricaded as follows: CITY COUNCIL - MINUTES DECEMBER 29, 1975 PAGE 2 A. Osos-Street.. Prohibit-parking on both sides from Higuera.to Monterey Street with..2 -way traffic allowed on the easterly- portion.and barricades to be continued along the west side blocking the parking area. B. Monterey..Street. The parking lane in front of the.building to be barri- caded. C. Parking.Lot.West.. No..parking_in.:area adjacent.- to.theatre..building but area to west of driveway open to -the public. D. Parking. Lot Rear to continue to..be closed. The City Attorney was requested-to notify -the property owners..and.property owners attornies of the City's action..and..that the property owner to assume liability for. possible future damage to the public and the private property. On motion of Mayor Schwartz,-seconded by Councilman.Gurnee, that the staff recommendation on the fire damaged building be accepted and - approved: 1. Action to- demolish building 2. Temporary building protection 3. City.Attorney to notify property owner and property owners representative . of liability. Passed on the following roll call vote: AYES: Councilmen Gurnee, Norris,..Petterson.and Mayor Schwartz NOES: None ABSENT: .Councilman Gurnee 3:22 p.m. The City Council adjourned to.Executive Session. 4:38 p.m. The City Council.reconvened . in.Regular Session. .
