HEARING ROOM, CITY HALL PRESENT: Councilmen Graham, Norris, Petterson and Mayor Schwartz ABSENT: Councilman Gurnee City Staff PRESENT: J.H. Fitzpatrick, City Clerk; R.D. Miller, City Administrative Officer; Rob Strong, Director of Community Development; Terry Sanville, Planning Associate; Glen Matteson, Planning Assistant ------------------------------------------------------------------------- 1. City Council continued their study of the General Plan Update recommended for adoption by the Planning Commission. The discussion this date consisted of various densities in the various land use categories. 12:45 p.m. Councilman Norris left the meeting. The Council also discussed with the Planning Staff economics involved in developing land to different densities as delineated by the Planning Staff. 2. On motion of Councilman Graham, seconded by Mayor Schwartz, the following appointments to the Citizens Advisory Committee as recommended by the Council Sub - Committee be approved: 1) Art Jack, 2) Timothy Kerston; and 3) Charles Andres. Motion carried, Councilmen Gurnee and Norris absent. 3. On motion of Councilman Graham, seconded by Councilman Petterson, Robert Wray was appointed to the Promotional Coordinating Committee upon recommendation of the Council Sub - Committee. Motion carried, Councilman Gurnee and Norris absent. 4. On motion of Councilman Graham, seconded by Councilman Petterson, Ruth Wirshup and Lee Balatti were reappointed to full terms to the City Housing Authority. Motion carried, Councilmen Gurnee and Norris absent. 5. On motion of Councilman Graham, seconded by Councilman Petterson, the meeting adjourned at 2:15 p.m. to 7:30 p.m., Tuesday, October 12, 1976. Fitzpatrick, was asked to place on the October 26, 1976 agenda for Council discussion the make -up of the Area Planning Council. 2. The City Council considered the Floor Control and Drainage Master Plan for San Luis Obispo Creek Watershed prepared by Consultant George S. Nolte & Associates. (continued from the October 5, 1976 meeting) Paul Landell, Jr., representing the engineering division, stated that on August 26, 1976 the Zone 9 Advisory Committee met to review the Master Drainage Plan which had recently been completed by George S. Nolte & Associates of San Jose. The Advisory Committee felt there was more information in this report than could be handled at a general meeting. It was the staff of Wallace Burt, Clinton Milne,of the County of San Luis Obispo, and Paul E. Landell, Jr., of the City of San Luis Obispo, were authorized to meet for the purpose of condensing the comments onto one copy of the report. A part of the motion was that the edited Plan be sent to the Council as soon as possible for their approval and subsequently to the Board of Supervisors for their approval. Only then would the Plan be sent back to the Consultants for final drafting. The desired action would be for the City Council to approve and refer the Master Drainage Plan for San Luis Creek Basin to the Board of Supervisors for their concurrence. Paul Landell then read an eight page Executive Summary of the proposed Master Plan as prepared by the City and County Staff for the Council's consideration. Harold Miossi, property owner north of the City limits, reviewed for the Council's information, the history of floods in the San Luis Creek Basin, and attempts by local governments to alleviate damages caused by the floods. He commented that in his opinion, the very expensive report by the consul- tant Nolte stated that the people of San Luis Creek Basin should learn to live with occasional floods and flood damage or move. He reviewed with the Council for their information, information he had presented to the Zone 9 Board dealing with geology, earth faults, etc. without receiving any response from the Zone 9 Advisory Board, the City /County Staff, or the Consultant Nolte. F u 1 L J City Council Minutes October 12, 1976 Page 3 His final opinion was that the Zone 9 /Nolte Report does not offer a planned solution or a plan for flood proofing or flood control. Robert Bettencourt hoped some plan would be developed to remove people from flood prone areas. James Maino, Jr., South San Luis Creek area, did not feel that the Zone 9/ ' Nolte Report presents any solution to flood protection in the San Luis Creek Basin. He felt the Consultant Nolte tried to satisfy the Council's objec- tions and not a real professional attempt to solve the flood problem was done. The City Council discussed with the Zone 9 staff, Landell, the effects of the various alternatives presented by Zone 9 and their Consultant, Nolte. Councilman Gurnee felt that the Consultant's preliminary report should be returned to the Zone 9 Advisory Board and ask them for more attention to be given to developing land use regulations in the flood planes, and that model regulations be developed for future development in the 100 year flood zone, 2) that more study should be given to flood proofing the downtown structures that are exposed to flooding, 3) that the City express to the Zone 9 Advisory Board that no ultimate solution to flood proofing the San Luis Creek Basin can be made, and that solution No. 4 of the Executive Summary would be unlikely and undesirable, and 4) that any channelization should conform to multi -use development. Councilman Norris enthusiastically endorsed the Nolte Master Plan with one modification which was to stress multi -use of flood control facilities. He agreed with the recommendations on flood insurance, felt that improvements should be put on an incremental basis, and that the Nolte Report makes provisions for long solutions for flood problems in San Luis Creek Basin. In addition he felt the Council should take every step to protect all citizens from floods and flooding. Councilman Petterson felt that the report was not very conclusive, and did not give clear cut solutions to future floods and flooding. He stated that upon review, the report does not say anything that was unknown prior to this large expense of public funds. Councilman Graham felt that as a member of the Zone 9 Advisory Board that Nolte had given them what they had asked for under guidelines suggested by the City Council and the County Board of Supervisors. He felt that they looked at this as an engineering conceptual attempt to control floods. Mayor Schwartz felt that the report is really in the hands of the Board of Supervisors through their appointed Zone 9 Advisory Board over which the City Council has no control. He felt that this plan meets most of the suggestions made by this very Council to the Consultant. He stated that the City Council may implement any part of the recommendation they wish to finance with City funds. On motion of Councilman Norris, seconded by Mayor Schwartz, that the City Council pass on without prejudice the Nolte Report with modifications requesting multi use of any facilities installed or constructed in the flood plane. Motion lost on the following roll call vote: AYES: Councilman Norris and Mayor Schwartz NOES: Councilmen Graham, Gurnee, and Petterson ABSENT: None Councilman Petterson suggested that the City accept the recommendation on Phase I, scale down the engineer's proposal, and that recommendations 2, 3, and 4 be received and filed. City Council Minutes October 12, 1976 Page 4 On motion of Councilman Petterson, seconded by Councilman Graham, that the City Council refer the Master Plan to the Supervisors agreeing that Phase I can be accepted and that low cost . engineering solution with most life saving and property saving advantages and less environmental damages be approved and balance the creek to a 35 year channel throughout the City, and that parts of Phase 2, 3, and 4 of the proposed Master Plant be viewed unlikely as unrealistic and too expensive for the City and County taxpayers at this time. Mayor Schwartz then reviewed the City Council's action on February 9, 1976 making recommendations to Zone 9 advisory Board for the Consultant's guidance for the Zone 9 Master Plan. Councilman Petterson and Councilman Graham withdrew their motion. On motion of Councilman Petterson, seconded by Councilman.Norris, that the City Council accept the Master Plan.and forward it to the County Board of Supervisors for their action. Motion carried on the following roll call vote: AYES: Councilman Petterson, Norris, Graham, Gurnee, and Mayor Schwartz NOES: None ABSENT: None Councilman Petterson suggested that the City proceed with the low cost recommendations with the most life and property saving advantages and the least environmental damage and take parts 2, 3, and 4 as not be economical or feasible at this, and they may never be implemented. 3. The City Council's review.and.study of the General Plan Update, was continued to Wednesday, October 13, 1976,.at 12:10 p.m. 10:00 p.m., Mayor Schwartz called a recess. 10:20 p.m., the meeting reconvened with all Councilmen present. 4. On motion of Councilman Gurnee, seconded by Councilman Norris, the following appointments were made to the Human Relations Commission: 1) James Brady - term expires 1980 2) Brian Keller - term expires 1979 3) Annjennette S. McFarlin - term expires 1978 4) Jeff Jorgensen - term expires 1977 Motion carried. 4a. On motion of Councilman Norris, seconded by Councilman Graham, Resolution No. 3159, (1976 Series), was introduced. A resolution of the Council of the City of San Luis Obispo approving an agreement between the City and Wilbur Smith & Associates for engineering services relative to downtown parking needs and circulation study. Passed and adopted on the following roll call vote: AYES: Councilmen Norris, Graham, Petterson, and Mayor Schwartz NOES: None ABSENT: Councilman Gurnee City Council Minutes October 12, 1976 Page 5 4b. D.F. Romero, Director of Public Services, submitted an emergency request for a budget increase to replace the Wacker Tamper as the old one is completely out and inoperable. The motor needs to be replaced, the frame is bent, and other working parts are not obtainable. The machine is ten years old and really should be replaced. Currently the City is renting a tamper at the rate of $40.00 per day. On motion of Councilman Graham, seconded by Councilman Petterson, the City .Director of Public Services was authorized to secure informal quotes.for the purchase of a new tamper, and the Administrative Officer was to make the necessary budget changes for Council consideration. Motion carried. 4c. On motion of Councilman Petterson, seconded by Councilman Graham, the City Council authorized the Mayor to write a letter to the County Board of Supervisors urging that they keep the new Courts building being proposed_ in downtown San Luis Obispo. Motion carried, all ayes. There being no further business to come before the City Council, Mayor Schwartz adjourned the meeting to 12:10 p.m. Wednesday, October 13, 1976. Fitzpatrick, City Clerk f! 1
