Mayor John Ashbaugh, and Mayor Jan Marx City Staff Present: Katie Lichtig, City Manager, Christine Dietrick, City Attorney, Michael Codron, Assistant City Manager, and Elaina Cano, City Clerk, were present at Roll Call. Other staff members presented reports or responded to questions as indicated in the minutes. ANNOUNCEMENT OF CLOSED SESSION TOPICS City Attomey Dietrick announced the following Closed Session topics. None were forthcoming and the meeting adjourned to the Closed Session. CLOSED SESSION REPORT City Attorney Dietrick reported on the Closed Session at the commencement of the 7:00 p.m. Regular Meeting. The Closed Session adioumed at 7:00 p.m. 7:00 P.M. — REGULAR MEETING — COUNCIL CHAMBER Mayor Marx called the regular meeting to order at 7:00 p.m. All Council Members were present. CLOSED SESSION REPORT City Attorney Dietrick reported that Council met in Closed Session to discuss 1) Labor Negotiations. No reportable action was taken. 2) Anticipated Litigation regarding to correspondences sent to the City for the International Association of Firefighters Local 3523. No reportable action was taken. 3) Anticipated Litigation regarding City of Brisbane; Cities of Alameda, Irvine, Newport Beach, Roseville, San Ramon, and Santa Fe Springs; City of South San Francisco .vs. The California State Board of Equalization and Does 1 -500. Action: Council voted 4:1, Carpenter opposed, to direct the City's intervention in the pending lawsuit through its tax representative HDL. PRESENTATIONS Patricia Gomez, Director of Homeless Services Oversight. Council, gave a presentation on the San Luis Obispo Countywide 10 Year Action Plan to End Homelessness and responded to Council questions. PUBLIC COMMENT David Brodie, San Luis Obispo, spoke about his concern regarding the economy of the downtown. Gary Hixon, Morro Bay, spoke about his shows that are shown on the public access channel. City Council Meeting Tuesday, March 1, 2011 Page 3 Curtis Reinhardt, Central Coast Railroad Festival, spoke about increasing the funding for the Promotional Coordinating Committee and of the upcoming festival. John Grady, San Luis Obispo, spoke of his support of placing binding arbitration and pension reform on a future ballot. Steve Barasch, San Luis Obispo, spoke about his concerns regarding the public comment period. Paul Rys, San Luis Obispo, spoke of his support of placing binding arbitration and pension reform on a future ballot and suggested a review of the compensation and benefits for City management. Ron Malak, San Luis Obispo, spoke about his concerns regarding the police department staffing. Annie Malak, San Luis Obispo, spoke about her concerns regarding the benefits and compensation posted on the recruitment flyer for the Finance and Information Technology Director position. Stacey Hunt, Los Osos, spoke about the importance of the Grants -In -Aid program. Bettina Swiager, San Luis Obispo, spoke about the importance of the Grants -In -Aid program. City Manager Lichtig explained the process of the recruitment for the Director of Finance and Information Technology. CONSENTAGENDA C1. MINUTES. ACTION: Moved by Ashbaugh /Carter to waive oral reading and approve as presented; motion carried 5:0. C2. 3 AMENDING THE ZI ACTION: Moved by Ashbaugh /Carter to adopt Ordinance No. 1558 (2011 Series) which amends the zoning designation of the site from Manufacturing (M) to High - Density Residential (R -4) for the property located at 313 South Street; motion carried 5:0. 1 City Council Meeting Tuesday, March 1, 2011 PUBLIC HEARING Page 4 1. CONSIDERATION OF 2011 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDING RECOMMENDATIONS. Community Development Director Mandeville introduced this item, following which Housing Programs Manager Corey presented the agenda report and responded to questions. Mayor Marx opened the public hearing. Roy Reed, Alliance for Pharmaceutical Access (APA), spoke about the importance of the CDBG program. Laura Mohaier, Alliance for Pharmaceutical Access (APA), Executive Director, spoke about the goals of APA. Dee Torres. Director of Homeless Services CAPSLO — Maxine Lewis Memorial Shelter, spoke in support of staff's recommendation. Will Powers, San Luis Obispo, spoke about his concerns regarding the possibility of the reduction of the CDBG funding. Mayor Marx closed the public hearing. ACTION: Moved by Ashbaugh /Carpenter to: 1. As recommended by the Human Relations Commission (HRC), adopt Resolution No. 10246 (2011 Series) to approve funding recommendations for $647,517 of CDBG funds for the 2011 Program Year for projects proposed by CAPSLO, City of San Luis Obispo and Habitat for Humanity. 2. Reallocate $6,205 of unexpended 2006 and 2007 CDBG funds from completed projects for the City of San Luis Obispo ADA Corrections City Facilities, Prado Day Center Improvements and Anderson Hotel Fire Sprinkler System Upgrade to the City of San Luis Obispo Property Acquisition for Affordable Housing (313 South); motion carried 5:0. BUSINESS ITEMS 2. AFFORDABLE HOUSING FUND AWARDS. FOR HABITAT FOR HUMANITY AND ROEM CORPORATION. Housing Programs Manager Corey presented the agenda report and responded to questions. 1 1 1 City Council.Meeting Tuesday, March 1, 2011 Public .Comments There were no public comments. —end of public comments== Page 5 ACTION: Moved by Ashbaugh /Carter to adopt Resolution No. 10247 (2011 Series) approving Affordable Housing Fund awards for Habitat for Humanity (3212 Rockview) and ROEM Corporation (313 South); motion carried 5 :0. Council recessed at 8:42 p.m. and reconvened at 8:55 p.m. with all members present. 3. 2010 -11 _MID -YEAR. BUDGET.REVIEW. City Manager Lichtig introduced this item following which Interim Director of finance & Information Technology Bradley, and Finance Manager Malicoat presented the agenda report and responded to questions. Public Comments Steve Barasch, San Luis Obispo, spoke about his concerns regarding the City's expenses. —end of public comments— Council discussion ensued during which they spoke of their concerns regarding the future pension costs, future funds for CIP's, and the enterprise funds. ACTION: Council reviewed and discussed the City's financial condition and status of City goals at the mid -point of fiscal year 2010 -11. 4. BUDGET COMMUNICATIONS PLAN. City Manager Lichtiq introduced this item, following which Assistant City Manager Codron presented the agenda report and responded to questions. Public Comments Steve Delmartini, San Luis Obispo, spoke about his concerns regarding the use of Measure Y funds. ---end of public comments— Council Member Smith spoke of the importance of having a Public Information Officer and an overall comprehensive plan. Ms. Smith spoke in opposition to adding additional PIO responsibilities to 8 current staff member. City Council Meeting Page 6 Tuesday, March 1, 2011 Council Member Carpenter spoke in opposition to staffs recommendation because of the City's current fiscal situation. Council Member Carter spoke in support of having a Public Information Officer to ensure transparency. Mr. Carter spoke of his concerns regarding in -house training and suggested that the City should research future ways to communicate to the community, such as a reverse 911 system. Vice Mayor Ashbaugh stated that although he would be supportive of staffs recommendation, he preferred to use the resources that the City currently has. Mayor_ Marx suggested Council consider appointing an adhoc Council subcommittee to assist staff with developing a PIO job description and how that position would be financed within the Administration Department. Ms. Marx spoke of the importance of an interim plan which could lead to a permanent position. ACTION: Moved by Ashbaugh to endorse the proposed Budget Communications Plan, which includes guidelines and recommendations to improve the flow of information between the City, the public, and the media; motion failed due to a lack of a second. ACTION: Moved by Marx/Carter to appoint Council Members Carter and Smith as an ad hoc Council subcommittee to work with staff on the development of a communication outreach program and return to Council on April 15th with a recommendation; motion carried 3:2 (Ashbaugh and Carpenter opposed). 5. STUDY SESSION Community Development Director Mandeville introduced this item, following which Deputy Director Long Range Planning Munn presented the agenda report and responded to questions. Public Comments Steve Delmartini, San Luis Obispo, spoke of his concerns regarding the communication plan. Paul Rys, San Luis Obispo, suggested that staff email notices and that property owners ensure that their tenants are aware that they reside in a historic district. - - -end of public comments - -- 1 1 City Council. Meeting Tuesday, March 1, 2011 Page 7 Council Member.Carpenter spoke of his concerns regarding the expanded communication outreach and the alternative uses of resources. Council Member Carter suggested a more focused adhoc effort when there is a specific issue that needs to be communicated instead of a general newsletter. ACTION: Moved by Ashbaugh to direct staff to solicit a proposal from the San Luis Obispo Historical Center or other nonprofit organization to create a newsletter based on the distribution list of historic property owners and historic commercial property tenants. motion; failed due to a lack of a second. ACTION: Moved by Smith /Ashbaugh to direct staff to conduct a one -year pilot program to generate two issues of a newsletter to mail to owners and tenants of all properties on.. . the City's list of historic resources and all properties within historic districts. Staff is to report back to Council at the end of the pilot program. (3:2, Carpenter /Carter opposed). . COUNCIL LIAISON REPORTS Council Member Carpenter reported on his attendance at the Economic Vitality Corporation and the Cultural Heritage `Committee meetings. Council Member Carter reported on his attendance at the Nacimiento Water Commission and Collaboration Committee meetings. Vice Mayor Ashbaugh reported on his attendance at the CAPSLO, Student Community Liaison Committee, and the Tree Committee meetings. Mayor Marx reported on her.attendance at the Student Community Liaison Committee and the City Selection Committee meetings. COMMUNICATIONS Council directed staff to return to Council with a revision to the Historic Preservation Guidelines to clarify language concerning replacement of historic building materials. Vice Mayor Ashbauqh stated that he attended the dedication of the bicycle path at.the Madonna Inn. Council Member Smith stated that she attended the Planning Commission meeting. Mayor Marx stated that she addressed the County Bar Association, SLO Association of Realtors and Good Morning SLO regarding the Council budget goals. Ms. Marx also announced that she serves on a steering committee regarding the 100 year celebration for women having the right to vote. In addition, she spoke of her concerns regarding the downtown bars opening early on St. Patrick's Day.
