HomeMy WebLinkAbout03/13/2012MINUTES REGULAR MEETING OF THE CITY COUNCIL MARCH 13, 2012 COUNCIL CHAMBER, 990 PALM STREET SAN LUIS OBISPO, CALIFORNIA ROLL CALL: Council Members Present: Council Members John Ashbaugh, Andrew Carter and Kathy Smith, Vice Mayor Dan Carpenter, and Mayor Jan Marx City Staff Present: Katie Lichtig, City Manager, Christine Dietrick, City Attorney, Michael Codron, Assistant City Manager, and Elaina Cano, City Clerk, were present at Roll Call. Other staff members presented reports or responded to questions as indicated in the minutes. APPOINTMENTS 2012 APPOINTMENTS TO CITY ADVISORY BODIES. Mayor Marx presented the report. There were no public comments. Council Member Ashbaugh commended the City Clerk and staff for their work effort during the AB recruitment. ACTION: Moved by Carpenter /Smith as recommended by the Council Subcommittees, make appointments to the City's advisory bodies effective April 1, 2012, and direct the City Clerk to continue to recruit for the unfilled positions. (5:0) PUBLIC COMMENT Gary Fowler, San Luis Obispo, spoke about his concerns with the increase in parking meter fees and the new electronic parking meter machines. Don Hedrick, San Luis Obispo, spoke about his concerns regarding public comment period, homelessness. Eric Meyer, San Luis Obispo, spoke about his concerns regarding a recent house fire on Johnson Avenue and suggested routine inspections on rentals. Mr. Meyer also thanked the firefighters for responding to the emergency. Dr. Will Powers, San Luis Obispo, spoke about his concerns regarding the City hiring consultants. San Luis Obispo citizen, spoke about her concerns regarding drug trafficking and the US Navy. City Council Meeting Tuesday, March 13, 2012 Page 2 BUSINESS ITEMS TASK FORCE SELECTION FOR THE LAND USE AND CIRCULATION ELEMENTS UPDATE. ( Development. Director Derek Johnson and Long Range Planning Division presented the report and responded to Council questions. Public Comments: Steve Delmartini, San Luis Obispo, questioned the selection process of the TF -LUCE applications. Mayor Marx responded to Mr. Delmartini's question and concerns. End of Public Comments: Mayor Marx daunting task. City Clerk Cano distributed to each Council Member a transparency which included an alphabetical list of applicants. Council Members then marked their 12 choices and City Clerk Cano recorded each of the votes. Council discussion ensued during which they discussed increasing the membership of the TF -LUCE. ACTION: Moved by Carter /Ashbaugh to appoint the first 12 applicants, in addition to Planning Commission Eric Meyer, and Mr. Walter Bremer and Mr. Chris Richardson bringing the total TF -LUCE membership to 15; motion carried 5:0. ACTION: Moved by Smith /Carpenter to add two members Mr. Rossi and Mr. Lamb to the TF -LUCE; 4:1, Ashbaugh opposed. Council Member Ashbaugh concurred with the expansion of the task force, stating his opposition was due to concerns related to the size of the commission, he had no other reservations concerning the individuals. ACTION: Moved by Ashbaugh /Smith to: 1) Adopt Resolution No. 10339 to appoint members to a Task Force for the Land Use and Circulation Elements update (TF -LUCE) and approved guidelines to define its terms and responsibilities. (5:0) Council recessed at 8:15 p.m. and reconvened at 8:20 p.m. Vice Mayor Carpenter left the meeting due to a family emergency and did not return to the Council Chambers. 2. AMEND COUNCIL POLICIES AND.PROCEDURES SECTION 1.3.6.6_1. VOTING PROCEDURES AND ADDING .SECTION 5.5 — COUNCIL MAIL HANDLING POLICY. Public Comments: Don Hedrick, San Luis Obispo, spoke about his concerns regarding transparency and accessibility of documents on the internet. Jody Frey, San Luis Obispo, spoke in support of staff's recommendation. Steve Barasch, San Luis Obispo, spoke about his concerns regarding the Mail Handling Policy. Kevin Rice, San Luis Obispo, spoke in support of the roll call (voice) vote and of his concerns regarding the Mail Handling Policy. Leslie Halls, San Luis Obisppo, spoke about her concerns regarding the Mail Handling Policy. - - -end of public comments— Council discussion ensued during which they discussed concerns with the Mail Handling Policy and the roll call (voice) vote. By consensus, Council agreed to temporarily perform the roll call (voice) vote until staff returns with the update to the Council Policies and Procedures manual. ACTION: Moved by Marx/Ashbaugh to table the discussion to a date certain to the third meeting in April 17 h (3:1, Smith opposed /Carpenter absent) ACTION: Moved by Ashbaugh/ Marx to add Section 5.5 — Council Mail Handling Policy to the Council's Policies and Procedures as presented; (Motion failed 2:2, Cater /Smith opposed). ACTION: Moved by Ashbaugh to add Section 5.5 — Council Mail Handling Policy as modified; motion failed for a lack of a second. ACTION: Moved by Carter that any personal and confidential correspondence sent or received by City staff shall remain unopened. It will be the individual Council Member's responsibility to open, read and provide the original to the City Attorney to maintain, pursuant to the City's Record's Retention Policy; motion failed for lack of a second. ACTION: Moved by Carter /Ashbaugh to table the discussion to a date certain, May 8, 2012 (4:0, Carpenter absent). PUBLIC HEARINGS 1 City Council Meeting Page 4 Tuesday, March 13, 2012 3. CONDUIT FINANCING REQUEST FROM VITUS DEVELOPMENT LLC AND THE CALIFORNIA MUNICIPAL FINANCING AUTHORITY FOR ACQUISITION AND REHABILITATION OF A 120 -UNIT MULTIFAMILY HOUSING RESIDENTIAL FACILITY AT 1550 MADONNA ROAD. Director of Finance & Technology Bourbeau presented the report and responded to Council questions. Ben Barker, CMFA and David Beacham, President - Vitus Group, spoke in support of staff's recommendation. Mayor Marx opened the public hearing. Will Powers, .San Luis Obispo, spoke in support of the project and his concerned with the Chevron Corporation. Don Hedrick, San Luis Obispo, spoke about his concerns regarding the project. Susanne Swaggerty, San Luis Obispo, spoke of her concerns regarding the noticing of the project but in support of the developers. Vanessa Armstrong, San Luis Obispo, spoke of her concerns regarding the noticing of the project but in support of the developers. Mayor Marx closed the public hearing. ACTION: Moved by Carter /Ashbaugh to: 1) Conduct a public hearing under the Tax and Equity Fiscal Responsibility Act (TEFRA) of 1986 and Section 147(f) of the Internal Revenue Code. 2) Adopt Resolution No.10340(2012 Series) allowing the California Municipal Finance Authority (CMFA), on behalf of Vitus Development LLC, to issue tax exempt bonds to assist in financing the rehabilitation of a 120 -unit multifamily housing residential facility. (4:0, Carpenter absent) COUNCIL LIAISON REPORTS AND COMMUNICATIONS Council Member Carter referred to a memo submitted to Council prior to the meeting and on file with the original agenda packet. Council Member Ashbaugh reported on his attendance at the County Regional Water Board meeting. Council Member Smith reported on her attendance at Rob Bryn's memorial and Cal Poly NISEI commemoration event. Mayor Marx reported on her attendance at the SLORTA meeting, dedication and ribbon cutting at the Marsh Street Commons, funeral of Rob Bryn, Film Festival, and NISEI commemoration event.
